      Seriously! My promise not to sue would be that the sheriff were to in writing declare that the nephew is completely unfit to be an officer and to NEVER be allowed to have a badge ever again. Some people shouldn’t have authority and nephew is a prime example.

    • @M_M_ODonnell
      @M_M_ODonnell ปีที่แล้ว +19

      Can't sue the sheriff or the nephew, just the department, at which point they can use as much public money as they want to draw out the lawsuit. Individual law enforcement officers are the exception to the "ignorance of the law is no excuse" rule -- to sue one or press charges, you have to prove not only that their actions were illegal, but that they *knew* their actions were illegal, *and* that they knew their actions weren't standard procedure for either law enforcement generally or their department. In practice (i.e. if you don't want a parade of other officers testifying to things they had no way of witnessing) you also can't bring a lawsuit or charges until after the local police union has decided not to protect the individual(s) in question.

  • @NopeNaw
    @NopeNaw ปีที่แล้ว +98

    The fact that Nephew Cop was still allowed on the force at all after that is probably the most frustrating thing about that story. OP should have insisted that either he was fired with prejudice, or OP sues. Not being sue happy doesn't mean not being prepared to go there if necessary. Maybe not the best thing to piss off the sheriff in a small town where everybody knows everybody, and the sheriff presumably has supporters, friends, and family members. However unfair that may sound, OP probably made the right decision there. Because now he has a sheriff, and one cop, who both owe him. That may pay off in the future.

      Yeah, you can't get things like that back from the police unless the department likes you. Now, in this particular case the sheriff actually seems to have a positive opinion of OP, but in general (and according to the courts) police departments are entitled to seize and liquidate property based on any officer's suspicion, and a lawsuit against a police or sheriff's department is a grand declaration that the plaintiff would like to never have police protection for anything ever again and would, in fact, like to be monitored and harassed constantly for at least a few years.

When we left she pulled me over, gleefully saying "I can smell alcohol" and making me take a breathalyizer. Sucks to be her. Zero blood alcohol reading. If I'd done anything remotely illegal, even crossed a mid line on the road, she would have booked me. No idea to this day what her issue was. Years and years ago, my son and a friend were hanging out in the neighborhood -there was a church and large parking lot two doors down- riding skateboards and being loud, as teen boys tend to do. Quick note: my son has very dark, almost black, hair, and very deep brown eyes ( just like his father’s - gotta love those dark Irish bad boys!) and he tanned very easily, since he spent a lot of time outside skateboarding or just hanging out with friends. He was also nearing 6’ and getting wispy facial hair at the end of 6th grade. His friend had lighter hair and eyes, but was in fact Mexican. I guess they were too loud and doing too much horseplay (they loved the “hurts donut” prank, and similar other pranks) so a neighbor complained and called the cops. They all appear on my doorstep with the neighbor screaming about encouraging “their kind” in the neighborhood (even though it was majority Hispanics/white mixed families) pointing out my son, saying he’s always there and he’s probably robbing us blind and teaching my son - pointing out friend - to smoke that devil’s weed. The other 2 friends looked scared. The girl gets all red in the face having an attitude with me over it. The whole time I’m just sitting there dumbfounded. She eventually sat in the seat next to me crossed her arms and kept giving me dirty looks and made snarky comments. The rest of the year she would race to be in front of me and run to the table. My family had a friend when I was in high school. He was a black pastor from Nigeria, with a masters of divinity. My dad was a college professor, and met the friend on campus. The friend was studying for an MBA specializing in economic development, intending to return to his community after graduation, and help start local businesses.
    The area was very rich, being on the Philadelphis 'Main Line'. Despite the rich almost entirely white area, the college had a large contingent of international graduate students, mostly all people of color, all working toward that MBA, and quite a lot of undergraduate people of color. The students all frequented the tiny town center, which was in walking distance of the campus. They especially visited a couple churches (religous school), the pizza parlor with a couple arcade games and the tiny, old fashioned, two screen movie theater. Non-white students were therefore a common sight in town.
    The family friend was in his fifties, or maybe early sixties. He was rather distinguished, looking a bit of a Morgan Freeman type. He always wore a suit jacket and tie. I knew him as Dad's friend that would visit to discuss theology and a wide range of other academic topics. When he visited he would always make an excellent pot of Nigerian tea.
    One day he arrive to talk to my father. He was rather upset. He had just visited a bank branch in the tiny town, intending to open up a U.S. based bank account. Apparently, while he stood in a que, waiting for service, the police were called. He suspects they were called the moment he stepped into the bank. This was, he said, his first real time feeling outright racism. He was a university and seminary graduate. He was a respected church leader in his community. He was a good husband and father. He always was imbecile in his grooming and semi-formal academic attire. Despite all of this, his black skin immediately panicked the bank workers.
    The police didn't treat him horrible and there were no charges, but he was heavily embarrassed. It broke my heart to think of this educated, kind family friend pulled out of line by uniformed police, while all the white people watched. It still makes my stomach hurt thinking about it, but it goes on every day. If his poster child for formality and kindness was treated this way, then how much blacks be treated who just was to be comfortable running errands, on their days off? This stuff really makes me sick to my stomach.

    Just because they are family, doesn't mean you don't have a right to sue. Sue anyone that screws you over

    Looking at this from the outside, it always amazes me (though if I was living in the country I'd probably use the term "scares" instead) how easy it is for people to become a police officer in the US. Like seriously!

    I’ve lost count of how many times I’ve heard the Monte Carlo and the husband not selling his vehicle to his ex story but all the same they are fun to listen to

    Story 4: It's stories like this that make me worried if I ever come across a Karen and I'd have punched him as consultation for what I'd have to go through if I didn't want to sue him.

    cop in story 4 thought it was like america where he'd be getting a compensation.

    That last story really makes me mad. I can't help but think of the add on damages: 1) They gave his keyring, which probably had house keys on it, to a thief. Now he's got to change the locks and maybe even hire a locksmith to get into his home in the first place. 2) Reputational harm. A wrongful arrest is still an arrest and still has to be disclosed in certain situations. If they aren't purging that from the record, better lawyer up and make them. 3) Physical and psychological harm. The guy got kicked hard in the balls, treated roughly by the policeman, and thrown into a cell without medical care, all while being verbally abused. I'd be getting checked out by the hospital and expecting to be compensated for any medical care necessary. If the police weren't willing to compensate for all those damages, I'd be lawyering up and demanding fair compensation for the harm they did through their policeman's gross negligence.

      The kick in the balls happened before the cop showed up, so that couldn't be blamed on him

    That last story I would of sued the nephew rent a cop and made sure he was fired so bad he wouldn't even be able to get hire as security to a Chuck E Cheese. Also even though the sheriff was a cool guy I would of told him "do you want me to sue you as well on top of suing your nephew?" As soon as he said "don't sue his nephew".

    Story 3 - exactly. When someone is clearly that stupid, there's no point even trying to explain things rationally, go straight to escalation: call security/staff/police/whoever it takes to get that person off your case.
