EDIT: The grade issued to the officer is a means to highlight the fact that the law may be flawed. As I said in the editorial section of this episode, the officer followed the law as it is written, and that alludes to grander problems within Florida's legislation. The real issue here is the language of the law, not the conduct of the officer (in regards to Florida's fleeing statute).

I would respectfully disagree with your assertion that the law states one must immediately stop. I understand that the case law leans in this direction (at least in fla), but finding a better location has been used (not sure what states) as a successful defense from fleeing charges. The subject also did a pretty good job at communicating that decision.
I have never spoken in your comments section b4 because i primarily come to learn legal interpretation, and i rarely disagree with your assertions. I love this channel, thanks for all your hard work and research.

“ *Those who are capable of tyranny are capable of perjury to sustain it* .”
“... *only those who have the will and the power to shoot down their fellow men, are the real rulers in this, as in all other (so-called) civilized countries; for by no others will civilized men be robbed, or enslaved* .”
― Lysander Spooner, No Treason: The Constitution of No Authority
*"So these villains, who call themselves governments, well understand that their power rests primarily upon stolen money* . *With money they can hire soldiers, and with soldiers extort money* . *And, when their authority is denied, the first use they always make of money, is to hire soldiers to kill or subdue all who refuse them more money* ."
*-The payment of taxes, being compulsory, of course furnishes no evidence that any one voluntarily supports the Constitution* .
*It is true that the theory of our Constitution is, that all taxes are paid voluntarily; that our government is a mutual insurance company, voluntarily entered into by the people with each other; that each man makes a free and purely voluntary contract with all others who are parties to the Constitution, to pay so much money for so much protection, the same as he does with any other insurance company; and that he is just as free not to be protected, and not to pay any tax, as he is to pay a tax, and be protected* .
*But this theory of our government is wholly different from the practical fact* . *The fact is that the government, like a highwayman, says to a man: Your money, or your life* . *And many, if not most, taxes are paid under the compulsion of that threat* ;.
*The government does not, indeed, waylay a man in a lonely place, spring upon him from the road side, and, holding a pistol to his head, proceed to rifle his pockets* . *But the robbery is none the less a robbery on that account; and it is far more dastardly and shameful* .
*The highwayman takes solely upon himself the responsibility, danger, and crime of his own act* . *He does not pretend that he has any rightful claim to your money, or that he intends to use it for your own benefit* . *He does not pretend to be anything but a robber* . *He has not acquired impudence enough to profess to be merely a “protector,” and that he takes men’s money against their will, merely to enable him to “protect” those infatuated travellers, who feel perfectly able to protect themselves, or do not appreciate his peculiar system of protection* . *He is too sensible a man to make such professions as these* . *Furthermore, having taken your money, he leaves you, as you wish him to do* . *He does not persist in following you on the road, against your will; assuming to be your rightful “sovereign,” on account of the “protection” he affords you* . *He does not keep “protecting” you, by commanding you to bow down and serve him; by requiring you to do this, and forbidding you to do that; by robbing you of more money as often as he finds it for his interest or pleasure to do so; and by branding you as a rebel, a traitor, and an enemy to your country, and shooting you down without mercy, if you dispute his authority, or resist his demands* . *He is too much of a gentleman to be guilty of such impostures, and insults, and villanies as these* . *In short, he does not, in addition to robbing you, attempt to make you either his dupe or his slave* .
*The proceedings of those robbers and murderers, who call themselves “the government,” are directly the opposite of these of the single highwayman* .
*In the first place, they do not, like him, make themselves individually known; or, consequently, take upon themselves personally the responsibility of their acts* . *On the contrary, they secretly (by secret ballot) designate some one of their number to commit the robbery in their behalf, while they keep themselves practically concealed* . *They say to the person thus designated:*
*Go to A- B-, and say to him that “the government” has need of money to meet the expenses of protecting him and his property* . *If he presumes to say that he has never contracted with us to protect him, and that he wants none of our protection, say to him that that is our business, and not his; that we choose to protect him, whether he desires us to do so or not; and that we demand pay, too, for protecting him* . *If he dares to inquire who the individuals are, who have thus taken upon themselves the title of “the government,” and who assume to protect him, and demand payment of him, without his having ever made any contract with them, say to him that that, too, is our business, and not his; that we do not choose to make ourselves individually known to him; that we have secretly (by secret ballot) appointed you our agent to give him notice of our demands, and, if he complies with them, to give him, in our name, a receipt that will protect him against any similar demand for the present year* . *If he refuses to comply, seize and sell enough of his property to pay not only our demands, but all your own expenses and trouble beside* .
*If he resists the seizure of his property, call upon the bystanders to help you (doubtless some of them will prove to be members of our band)* . *If, in defending his property, he should kill any of our band who are assisting you, capture him at all hazards; charge him (in one of our courts) with murder, convict him, and hang him* . *If he should call upon his neighbors, or any others who, like him, may be disposed to resist our demands, and they should come in large numbers to his assistance, cry out that they are all rebels and traitors; that “our country” is in danger; call upon the commander of our hired murderers; tell him to quell the rebellion and “save the country,” cost what it may* . *Tell him to kill all who resist, though they should be hundreds of thousands; and thus strike terror into all others similarly disposed* . *See that the work of murder is thoroughly done, that we may have no further trouble of this kind hereafter* . *When these traitors shall have thus been taught our strength and our determination, they will be good loyal citizens for many years, and pay their taxes without a why or a wherefore* .
*It is under such compulsion as this that taxes, so called, are paid* . *And how much proof the payment of taxes affords, that the people consent to support “the government,” it needs no further argument to show* .
      *Lysander Spooner (1870)*

This happened to me in the 90s before bodycams & cell phones. I was pulled over a half mile from my house, we lived in the country at the time. There were no other houses for miles. I decided to keep driving until I got home like i mentioned earlier it was approximately a half mile. I turned on my hazard lights & kept my speed steady. The second I turned into my drive, the officer litterally jumped out of his car before it even came to a complete stop. He preceeded on going ballistic he started cussing me calling me names & and saying the only places woman should be aloud was the kitchen & bedroom. Then, he proceeded searching me made me shake out my bra & hold it out so he could see my breast. I was scared to death, horrified & humiliated. He put me in hand cuffs & leaned into my body for like 5 minutes it fealt like a lifetime. He told me repeatably he was arresting me for fleeing & i was going to love, love, jail. I started crying & he told me to dry my tears or he would give me somthing to cry about. I seriously thought he was going to rape & kill me that day.. While he was searching my car my husband & brother pulled up. My brother saw me crying & ask me what happend. My husband ask the officer what happened & if he had a warrant to search my vehicle he told my husband he was not searching & that he was simply retreaving my registration...! To tie this up...! After my husband arrived & started questioning him he decided to let me go with a warning. He unhanscuffed me & left. The next time I saw him was in court when i decided to sue him. After the city lost the lawsuit the officer eventually resigned from the department. I received a settlement for $69,000 after attorney fees ect...! After my ordeal I decided to return to college. I received my Bachelors degree in criminal justice & 9 years later, I received my Masters degree in Psychology with a minor in criminal Psychology...! I didnt drive for 2 years after this ordeal & even when i did start driving again i was terrified eveytime I saw an officer.. Something like this does something to a person. It scares them & takes away their since of security & trust...! Unfortunately not alot has changed since ny ordeal, we now have better technology, but police misconduct is still a major problem to this very day...!!!

I was pulled over for speeding twice and unbuckled my seatbelt to reach in my glovebox to get my registration and insurance since I knew I’d have to give it to the officer. I got an additional ticket both times for “not wearing a seatbelt” when both times I had it on but the officers claimed I wasn’t wearing it since it wasn’t on when they walked up to my car. Both times I told them I just unbuckled it to get my registration and both said, “That’s what everybody says”. You are charged with finding as many gun and drug violations as you can in a day. You get$10,000 for ever vehicle that you can pull over and find either in. Oh, by the way, you can get shot, just like any other person/cop, when you pull someone over.
So, you attempt to pull over a young black male in an older car, like are common in the hood. The individual refused to stop. He drives in for a little while, and you can't see exactly what he is doing in his vehicle. He finally pulls over in the middle of l nowhere special, but by a big bush, where no one else could really see from the side of the road into his vehicle. He claims that he wanted to stop there, because he was concerned for his safety.... Mind you, he didn't pull over in a crowded area, where people would be a witness to events, thereby ensuring his fair treatment.
Now, in all honesty, are you not going to immediately place that man in handcuffs so that you know that you are safe?
The narrative is bullshit. Yes, cops are going to try to arrest you. Do not help them do so. I do not fair him for his actions, the thing is, I don't fault either if them, for their actions.

Lastly, number rarely matter in a firefight. Element of surprise and firepower as well as planning usually decide the outcome of short term battles.

In my country any kind of police has to pass a physical and intellectual test to be approved for a two year period of education, after that period they have to pass another test, then they may work as junior police officers under senior police officers.
If this is true I have read that some police units in the US train their apprentices only for *6 weeks*! I actually still can not believe it.
Do you think they can be "good" officers after such a short time of training? I think you all must ask for better education for your multiple police forces and that police really, really should care for the ~95% of population that is hard working, honest and paying their taxes. At least that would be a start. It is so astonishing to watch US police treat normal citizens like trash it is unreal. So not the picture of the land of the free... 😪 love the US and have had personal interaction with highway patrol as a tourist, they were very nice and polite. It's pretty clear that since the police or the courts aren't able to determine if a person driving at 25 MPH is " fleeing and eluding" then maybe the wording in the law needs to be changed to show some intent to elude. You know like driving wrecklessly at a high rate of speed, something that a reasonable person would assume meant eluding. As far as pointing a gun at a person pulled over for a seatbelt infraction, let's just say the cop should be real happy that I wasn't his boss. Maybe 6 months latrine duty would make an impression.

The way the officer approached with gun drawn and pointed, ordered him to his knees, cuffed and searched him, partially searched his car, etc. on an alleged seatbelt violation pretext was disgusting and I would knock the officer down a full grade just for that. I don't know the exact survival rate of a black man once a police officer has him in his gun sights, but I can understand anyone having emotional trauma from the experience. He's an "accidental weapon discharge" or "I thought he was reaching for a weapon" trigger finger twitch from death or grave injury.
Instead, the officer could have taken a couple of minutes in his car to run the plates and correlate the owner to a license photo and any arrests or warrants. (This would also confirm that Mr. Black was not actually fleeing by giving him ample opportunity to start up again.) If nothing of concern came up, he could have handled it like issuing a ticket to the mayor while also cautioning Mr. Black on the implications of the ridiculously vague, yet strict FL fleeing law. Instead, this stop appears to be primarily aimed to produce maximum fear and intimidation. Congratulations. It worked. I found multiple sources that say that citizens have the right to wait to pull over for police until they feel comfortable.

      step 1) don't have a seatbelt on
step 2) you see a cop turn their lights on in your mirror
step 3) put your seatbelt on while still driving
step 4) take your seatbelt off when the cop walks up
I'm not saying he did that. We don't know. But that also means you don't know. It's just useless information, basically, whether he had one on at the time of the stop or not. Gotta be a bit more imaginative my man. It would come down to he said/she said, maybe some dashcam footage from the cop driving past initially if it's high enough resolution, or any internal dashcam of the person if there was any.

May we politely suggest the following de-escalation for remedy?
THE TRUST IS COLLAPSED....in other words, your company is no longer granting them any more credit.
If the policeman is not lawfully investigating the crime on behalf of the male/female victim and is entering YOUR company jurisdiction without you summonsing them, then would it not be advisable to be politely placing YOUR public-servants/trustees under your notification that your company is charging $707 per hour/part-there-of for YOUR company time and also $717 for YOUR company performance?....and that any further communicating (verbal) and/ or corresponding (written) with your company, is with them accepting the terms & conditions of the commercial contract IN THE PRIVATE (the cop and their CHIEF and their POLICE UNION is now with PERSONAL liability.... because Notice-to-Agent-is-Notice-to-Principal....and also through JOINDER....and they also lose their qualified immunity)
This way, you are NOT resisting/refusing to obey/comply with their orders/demands/policy /questions, but instead, you are now willing to perform WITH THE CONDITION that payment is with your company immediately, because you have NO CONFIDENCE with them administrating YOUR company trust!
THE PUBLIC TRUST IS COLLAPSED...Why is YOUR company issuing them extra credit! Are YOU not the executor and the beneficiary of YOUR trust?...making them the trustees, whom are with their fiduciary obligation and duty-of-care to be NOT causing you injury nor damage nor loss nor harm.
Is THEIR job YOUR job? Is THEIR company policy YOUR company policy?
not unless and until they are PAYING for your company time & performance
THE CONSTRUCTIVE TRUST IS COLLAPSED...YOUR company is no longer performing free-of-charge!
You may be willing to pursue the matter through the small-claims-court and/or through arbitration which is held in-the-private because PUBLIC court is only for the PUBLIC servant.
YOUR TRUST FUND IS NOW WITH RESTORATION....YOUR company is now making money from every encounter with YOUR public-servants because the days of doing something with your trustees for free are over.
PS-Be the BUSINESS man with the public-servants.......NOT the victim.

That’s going to be a disputed fact in the Section 1983 action. It is possible that he was wearing it the entire time and it it is also possible that he buckled it after he saw the sirens. That it is disputed generally helps the reasonable suspicion for the stop to not qualify for a determination of qualified immunity on that particular cause of action (4th Amendment Detainment). However the fleeing statute kind of raises the possibility of qualified immunity or even simply a dismissal on that cause of action since the officer then had reasonable suspicion for the stop and as the statute and litigation of the statute is described in this video that’s going difficult for the plaintiff to challenge a qualified immunity defense. The search of the vehicle is more problematic. Personally I think they should have ticketed him for fleeing and impounded the car and gotten his documents during the inventory. I think the search is the only thing that will survive summary judgment in the sense that was most likely an unlawful search.
      I apologize if that’s TMI.

I am 2 minutes in and so disgusted by this cop. Pulling him over for a seatbelt infraction and drawing down on him? What the holy hell!

@@baileywilliams5419 Oops, 5 minutes was from the 7:26 discussion of State vs. Kirer. At 0:53 we are indeed told "Mr. Black continued driving for approximately one minute before pulling over." Thanks for the correction!

This man (councilor) has class. You cant buy that. No matter what actions were done to try to humiliate him, the man came out as a class act. Kudos to you.

I had a cop imply I was possibly reaching for a weapon when I TOLD them I was reaching for my ID after they asked me to.
Almost like the entire system is setup to make sure the average person loses.
