      @@popcorn-uz3tn I think it was a great suggestion for him to keep improving the channel. there will be many times he can not get that updated info but he can say that as well. If there is settlements out of court they typically will come with a gag order or a NDA. I think this is a great teaching channel and I am sure it will grow and improve greatly

      The point is he now has to prove that his authority can not be challenged. The other officer said it perfectly near the end when he told the other guy not to let him go and to set an example showing him and the rest of us that we can’t just assert our rights and must bend to their will. It’s all about maintaining power and control over anything they decide to control.

      Remember that cops do make mistakes sometimes, this cop must be new or never had to deal with such a circumstance. And do not fret, the punishment for an officer unlawfully doing something does not go unnoticed. There will be written records that anyone may access that in detail explain what the officer has done and if they commit too many strikes, they're removed from their job. I don't agree that cops are the problem with USA or the world because if they were then you'd have videos of every police encounter.

      @@PsyKick Remember the office vs the student who picking up trash on his apt. ground?.. well, he served 14 years.. so it's not about newness or inexperienced.. the cop even pull-out his service gun against the student for not obliging to his command to sit and provide birthdate.. if that's not a case of ego and arrogance, then I don't know what it is..
      Beside, if any law hasn't been broken is NOT THE MATTER (as the cop in the video stated and the point the OP highlight).. then what rights the officer has then to arrest/detain anyone.. is like saying that police can and has the authority to arrest someone for even breathing just because he like to do so..

      ada-dech I don’t know what the second part is meant to be or where it came from but the first part of your sentence literally explains what I put, referring to when I said new OR never had to deal with such circumstance. I’ve known police who have served 10 years and the worst thing they were in was someone driving a stolen tank through the street and the rest wasn’t anything terrible, so it doesn’t matter how long you’ve served it matters if you’ve been in the situation before.

      I used to live in southern California and had a friend who shared his 2 kids with his wife in Arizona. In the 90 degrees summer heat in California, his kids would be wearing hoodies and sweat pants because it was 115 in Arizona. 60 degrees is cold to a lot of people.

If he fumbled or lied in the retelling on camera, you can't say otherwise in court.

There is a big reason that the right to remain silent NEEDS to be used more. As was pointed out in the video, because the "subject" was talking and swore at the officer, the officer now has him as committing

      @@jesse630 The problem with that is though we don't know how the officer will react. The other problem here is that all he said to the man was that someone called because he is suspicious, which is not a crime. Sure, the demand to know who you are can on its face be a reasonable one, on the other hand, you have no right to know who I am unless you can point to some criminal action I have taken. The Police do not have the right to stop you just because, and unless that we exercise that right it will get eroded. This is an argument about what is right, the police should not be able to just stop you and force you to identify. Then it turns into how many times do you encounter the police. Even if every time you have interacted with them, how long until they see something that is not there? "Well this is the third time we have talked to you, why do you keep running into the Police? Seems suspicious to me."
      I understand the desire to perceive the Police as a force for good, as genuinely helpful. I want to, I really do. But this channel shows us that the Police are very often, wrong. They are not an all good force in our society, they are not all bad either, they are grey. This is why the best way to interact with them is to know your rights, and only give them the bear minimum in order to protect yourself. There is a reason that the Miranda warnings specifically include "Anything you say can and will be used against you." What it fails to mention is that anything you have already said can be used as well.

      Its a big part of the problem. So many jobs require you take test to make sure your still knowledgeable about your job and you have to pass those test. And yet its not required for police to be tested on a regular basis.

      I agree. Considering the gravity of the powers police are afforded in terms of fundamental human rights their training and recruitment screening can only be inadequate.
      To all coloured people and minorities, I am so sorry that you have to suffer these challenges and I am ashamed to be a white person. Race should be and is irrelevant.

Ive been rooting for standardized and mandatory police training handled at the federal level regardless of State, and subsequent State laws can be trained at the local City or County and State level via attorneys who are local and understand the local laws and can pass on the most critical info to police better than a DA would. All of this should be mandatory training from the very top to the bottom. I used to be in auxiliary police myself and Ive seen what types of training go on...and the other downside is lots of cops shell out money from their own pockets for additional training outside of their departments because the departments dont have funding. Thats why I want to see all police/sherrif/whatever training handled in a standardized way at the Federal level, much in the way the military branches are trained (I was Army, and I know this highly standardized training will work). Federal-mandated and standardized police training would obviously include heavy understanding of the Constitution and the laws they are sworn to protect and the inalienable rights that ALL Americans have, along with plenty of training on using non-deadly force options, better verbal commands and communication skills, de-escalation skills, COMPASSION for the public regardless of protected-class status (age/sex/race/religion/etc) and generally how to not be a total loser and not fail at your job...also mental health screenings or counseling quarterly or bi-annually, or yearly to make sure that no one is cracking under pressure or whatever. Policing is a really tough job especislly in high crime areas, and the bad cops need to be weeded-out because it makes the job even more painful and dangerous for every other good cop out there. All of these things and much more are critically important for every single officer to be trained on and aware of. I pray that what Im hoping for happens...at least that every State is forced to take it upon themselves to enforce their own standardized training of every officer or sherriff/deputy in their own lands...but I like Federal better because just like history has shown, one State could choose to standardize on a racist or sexist or otherwise stupid policy that would never fly if the Federal government handled it. Normally I hate big brother and stuff like that, but I know that Basic Training and AIT works in the military for standardized training and every soldier across the US is mostly on the same page if properly trained...therefore if we made a police-specific training program where no county or city or town could cry about not having the funds or time to schedule every officer for all this training, I feel that this would help tremendously. States should still have a say in their own unique training and laws, but its gotta fall under a broader standardized training system that forces training on identifying and avoiding abuse of power and excessive force and knowing the laws, etc.

    The grading scale has certainly changed since this video, I’m going back to from today to see more content since finding this channel and this one definitely stands out for grading the civilian too harshly. Today he would have a an A+ as I believe he should, he was calm, verbalized his rights and didn’t resist when unlawfully arrested. Many put up a struggle to remain out of cuffs and I think he did great to remain this calm and complying when his argument wasn’t understood by the officer.

      I think the narrator got it wrong that he didn't comply. What he was doing was calling their bluff. He asked if he was detained and the cop refused to answer him, so he walked away. He forced the cop to choose if he was detained or not so he could have a lawsuit. Otherwise, the interaction could have been construed as consensual.

      All the officer knows in this situation is someone called in a suspicious. The man in video is acting in a manner that a guilty person would. All he had to do was identify himself, tell his side and go about his day. But no, he had to be a hardass, filming it to show his friends. What if this happened in a dangerous suburb. Someone could've been shot in this situation. Nothing would've happened to him had he just complied. If the officer tried to do something shady, he would've won in court. The officer here was extremely polite and patient here.

      @GentlemenGhidorah What is more likely to happen is that there would be a lot more dangerous escalations when interacting with the police because the police officers in the United States are incredibly touchy about seeing citizens wearing weapons, and like it or not, they will outnumber you in those situations. Heck, you are likely to be shot just for carrying.
      What I do agree with is that the police officers need a lot more training, psych evaluations, and oversight by someone other than the police themselves. It is stupendously dumb that when an officer's conduct is evaluated by the department of police.

      @@Datamike lawfully open-carrying firearms doesn’t increase police shootings. It’s incredibly common where I live (small town where an incredibly high % of people do tend to legally carry guns) and shootings are essentially a non-existent thing. Police officers also don’t have anonymity here because of the small town nature of the area so it’s virtually impossible for them to do fucked up things without being held socially accountable for it. More people expressing their 2nd amendment rights in a legal and responsible fashion almost always equals a more fair and just societal experience. Those looking to infringe on your rights or do you harm, whether they have a badge or not, have to think twice about their actions when they don’t have an inherent leg up on you.

      All interactions should require 100% recording. Cops shouldn't be able to turn cameras off. Pressing the "off" button should make the cop think it's off, flag that part of the video as attempted to shut off, but keep recording.

Being black and wearing a jacket and hat in 60 degree weather while walking in a public space like a sidewalk is not a crime and therefore a police officer cannot detain you and force you to identify yourself even in a Stop and ID state.       Unfortunately this is VERY common. In most police interactions there is a crime or a report of a crime, and thus police can legally detain and question people. But when there is no crime and by default, no investigation of a crime, I think police forget that people can choose to not interact with them and the officer feels like his authority as a LEO is in question and their ego takes over.
      Someone clutching their pearls because they saw a black man on a public sidewalk and calling the police is incredibly racist. LEO's should recognize that fact and once they determine the person is not threatening, belligerent or intoxicated they need to wish him a good day and leave them alone.

      What I don't get though is.. Yeah, this was 99.99% called in via racial profiling. But if a cop was called on me for soliciting in a neighborhood as a white person, I would've cooperated with his questioning. And yes, I've seen neighbors call the cops for solicitors in my neighborhood. As soon as this guy disclosed he wasn't soliciting & it was political, this convo would've been over and cop would've been on his way. This didn't have to be difficult. I understand black dude's frustration but he could've gone the easy way. Innocence and openness will prevail 99.999999999% of the time

    It should be a Class A felony (destruction of evidence) for police to mute or turn off cameras while in the field or durring investigation, or any conversations while in charge of arrestee. Obvious crimes are committed by cops when they take these actions.

    When ever an officer is caught on camera like that. Not knowing, or disobeying the laws. They should be striped of their badge. And sent back to cadet school to learn their laws!! No pay!!! loss of any seniority!! And no vacation time!! Also those body cameras should be turned on at the start of a shift by a registered officer in charge at the station. And shut off only at the end of the shift by a registered officer at the station!! No more covering up plots! Or mistakes!

      Danny Fergusson well that’s not necessarily true. Freedom of information act allows anyone to obtain these types of videos. Now with TH-cam, a whole lot more “average joes” are requesting & posting these body cam videos & interrogations. There does not need to be any intention of court proceedings in order to get this video. But you probably know all this lol

      "Suspicious" must be clearly articulated and demonstrated before an arrest or lawful order can be made. The "CRIMINAL" asked countless times and did not receive a justifiable response that warranted an ID check, an arrest and more importantly, gave this impotent cop any jurisdiction... which can only be obtained if a crime has, is being or about to be committed, without which he's just another bum on the street. If we did this it would result in kidnapping charges. This was profiling, racism, harrassment, threats, assault, false imprisonment and the denial of rights, freedoms and liberties on the "SUSPECT" and a complete violation of the Constitution this muppet took an oath to uphold. .. no matter what order it was in... The cop was the idiot.. the idiot was the cop.

      @@SomeKata there is no "illegally detain". There is "detain while police are figuring out the situation". Its a basic right they have. It would be unsafe if officers were not able to do this. A traffic stop is actually an example of this. Detain doesn't mean arrest.

This person refuses to answer questions about the call, which gives the officer reason to stop him, since he doesn’t know if he has or hasn’t committed a crime yet, and since he’s walking away, it make it look like he has. Lawsuits are some of the worst things that happen in courtrooms, since they don’t determine laws they dint carry the same weight, which can result in some really stupid shit. Such as, I spilled hot coffee on myself, give me money, and I ran away from a police officer and refused to cooperate in his investigation and I deserve money since I got arrested fir that. My point being, lawsuits that go through do not have the same effect as a criminal court case. So this little lawsuit can be unjust and still get this person money.

      i disagree with you both. Those things made him a suspicious person, plus the handbills and they are why Dispatch sent an officer out to investigate. But what got him arrested was exactly what the officer kept saying over + over at the end when the guy asked him "Why are you arresting me?" - he always answered "Because you are not listening to me!!". All I could think was, buddy, just wait until your kids are teenagers, you better learn to get over yourself or they'll be in those not-listening arresting cuffs too!

      @@heidikickhouse- Buddy, the police are not our parents, they are not our authority. They are our servants, they listen to us until duty calls on them to do otherwise. It's clear that their training in this case did not include any legal knowledge of how to detail a person under suspicion, and when to let someone go after it is clear the person had, has, or is not about to commit a crime. I hope everyone sticks up under the police misconduct so we can further understand their corruption and actually make change to better it.

    I've watched a bunch of these videos recently and the common theme across all of them is that all these officer are on huge ego/power trips, and then escalate the situation when law-abiding citizens don't put up with their abuse of authority. The need to be held accountable.

      I agree. I’ve seen so many of these videos where these power tripping cops act like this. They can’t stand it when someone knows more than them. I would love to see them all get held accountable but I don’t think it’ll happen unfortunately. I’m a female (contrary to those who call me ‘sir’ or ‘bro’ on here lol I’m not a hater though because I choose to look like this lol) and I had a male officer throw me against his patrol car and got so close to me while screaming in my ear that I felt his penis against my behind. Someone told him someone had warrants but he automatically zeroed in on me when it wasn’t me! I don’t get this type of bully.

      This is so so true, it TRUELY bothers me that still agencies are hiring these type of police officers…there should be mandatory classes and training to maintain their egos and use common sense but most important learn to NOT GET JADED!!! Start every interaction giving every person the benefit of not judging them based on ur previous interactions and get better at DEESCALATING situations instead of ESCALATING THEM!!!!
