  • NOTE - I have checked with @sherlockjones603 if the footage at the end of this video can be used (as it mentions his name) and he has viewed and approved it. 👊
    Today we visit Meadowhall Shopping Centre. It has been the scene for many TH-cam videos regarding filming in public.
    Whilst in the area, we went there to see if the place had improved with signage and security staff professionalism.
    All was good at first until we went to have a look at the Apple Store.
    Security was called and we was asked to leave.
    Some of the party asked for clarification about the reason we have been asked to leave as filming isn't normally a problem.
    In summary, Meadowhall have their own rules, even though they are not on display. If the security tell you to do something, you must do it or be ejected out with reasonable force.
    1 Last thing, anyone can make an arrest for breach of the peace.

    Hope you don't take this the wrong way DJ, but I've seen a couple of your vids where you're with your 'colleagues' and it seems to me that that they do nothing but deliberately create confrontation and antagonise to the detriment of your standing as one of the better Auditors. Best to disassociate yourself from these types before they drag you down.

      @@ltrick3096 Do you not think that the very fact so many people take umbrage to a camera's presence is sufficient proof that it may not be lawful to ban photography but if somebody takes offence that is sufficient reason to stop filming? Wait till you are doing some innocent pastime like photography and are not breaking any law, but you get into trouble for it. Obviously I am nor wishing that upon you, but, it is a distinct possibility in a world where somebody else's feelings trump yours.

There are rules in place a venues to stop it going on the internet. Also there are signs saying camras in operation. So yes a big difference he is just a freak that wants to film and cause problems.       It’ll be a sad day when we restrict what you can do in public.
      When they started doing this a couple of years ago the standard response of every policeman was “papers please!”.
      Now, that’s al stopped.
      You still get people rushing up to the camera, saying filming is illegal. Thankfully, that is on the wane too.
      Some people even believe they have copyright over their face and building.
      A couple more years and that’ll stop too.
      The old chestnut about there might be children is old hat too.
      You CAN film children in public so long as it’s not obscene.
      Sky do it at football matches everyday.

    The only people that had a problem with being videoed here are the security, no one complained and there are no rules posted about no cameras, so this security team are talking absolute crap!!! .

      There is no legal requirement to have signage. Shopping Centres are private property to which the public have an implied right of access, that access being conditional on the compliance with the terms and conditions of the owner/occupier. Security staff are authorised agents of the owner/ occupier and if they say you cannot film or record on the property you must comply, failure will result in your implied right of access being revoked.
      The fact no member of the public complained is irrelevant.

    The police officers there were outstanding in their handling of the situation.....they didn't even raise their voices..... were helpful, gave clear instructions......and were very fair with all concerned!

    Why are they so transfixed with stopping you filming ...I think its because the security are worried that their universal credit claim might not go well.
    I know at least 18 families who refuse to use " shopping centres with security thugs " because they don't feel safe because of their thuggery , im sure shop owners want to bear that in mind

      @@topcat1358 it might be a ''just in case'' thing. for example if a video taken of a bunch of kids running around and it gets reported on some dirty nonce website that was taken in their premesis theyll get it in the neck. also regular members of the public putting complaints in about being filmed. you can garuntee that a small portion of the people in the background dont want to be filmed but wont dare say anything to the gang of lads doing it and would rather complain to management. its safer to just disallow filming alltogether. the risks outweigh the benefits

      @@juliandavies1974 A lot of shopping centre owners have no problems with auditors or those who do covert filming in their shopping centres as the footage often ends up on TH-cam which is accessible worldwide. The problem is with security staff who make up rules that do not exist and/or are little more than thugs in a uniform.

      ​@@juliandavies1974 Unfortunately, when you have security staff who don't know the law - and really don't care what the law says - that is when things go horribly wrong.
      As for conditions of entry, I've just checked Meadowhall's website and they are nowhere to be seen. To be honest, it is difficult to stop people using smartphones to send pictures to others who are not at Meadowhall. A lot of people use smartphones to show what is on sale and to check whoever is on the other end of the phone that is what they want the person who is at Meadowhall to buy for them or enquire about. Most of the major supermarkets do not seem to have any problem with this.
      I suspect the "Conditions of Entry" you refer to have been made up by security staff. This was found going on at another shopping centre owned by British Land. When challenged, the shopping centre manager knew nothing about it and confirmed there was no condition of entry regarding filming.

    35:00 If you come back next time and the sign has been updated to ban cameras, then you have a stronger case against them as it would be acknowledgement that they fucked up. It would also be an indication that they act in a retaliatory way and not because it's a policy that is actually needed.

What you appear to be doing - and it is pretty obvious - is trying to excuse or justify the conduct of the security staff who are ill-disciplined and aggressive. I'm a retired cop, and to be honest, I have no time for aggressive security officers or those who try to act as apologists for them or try to justify their behaviour. As for your attempts to say British Land can, effectively, do as it likes, something tells me you need to learn what the law actually says and how it works in practice.

    All of you should be in a civil claim for compensation from Meadowhall. They haven't learnt from multiple visits. They might learn from a large payout. Since not all of you were physically manhandled like Ryan was, the amounts will be different but since they abused your rights, made up rules on the fly, didn't follow the law or policy, called the police all based on the security manager's hatred of photographers the amounts should be between £500 for a simple unlawful trespass to £5000 for Ryan.

      They do for indictable offences and some others such as Criminal damage and theft offences that are either way offences but even if said offence is summary. Here the detained under the common law breach of the peace which in some circumstances can be done by security if someone is resisting when being physically removed from the land their in charge of. Assault and battery charges can also arise from this.

      In this case they can, as authorised agents of the Centre management, revoke your implied right of access and instruct you to leave. If you refuse you are then trespassing. Trespass is a civil matter and in such cases Security staff (or any other authorised person appointed by the owner/occupier) can then use reasonable force to remove you from the property. if you resist such action you are then committing the criminal offence of aggravated trespass.

    I've just been on their website, ans I can't find one word about filming in the Centre. There are rules, but not one that doesn't allow filming. The Police must get pissed off with security chimps throwing their weight about, then calling 999 when it all goes wrong and the REAL Police have to come and bail them out. They should tell the chimps, "YOU started it; YOU sort it out!".

    I have changed my mind about different kinds of auditor....we need each and every single one of our auditors....they are well within rights to be annoyed by the bad policing And guards and getting angry at being abused and let down by public officials...it is not our auditors that have to change it is the police and all the security guards who don't know what the hell they are doing...these bad officials need to be held personally responsible for abusing public and we need more transparency and accountability 👏👏👏👏👏👏well done and thankyou ❤️ all of our auditors

    I think DJ is always polite and explains well exactly why he is there and gives respect to people he speaks to. Sadly doesn't get it reciprocated. Appears some of the others he is with aren't always the same and quite often get slightly aggressive

    I find it very interesting Meadowhall shopping centre appears to have such an extreme position on public photography whilst previously partnering the police/ state in a secret covert operation of facial recognition. Can anyone advise if the property owner has ever defended the extreme policy in a substantive manner?

    I took pictures of the Christmas decorations for years. Nobody ever said anything. People have become very uncomfortable with activities that previously nobody cared about. I work in retail if people want to take photographs that's ok with me.

      @@happyguy201 You are correct in that the shop units are private areas, but the public areas (known as common areas) are classed as public places whilst the shopping centre is open to the public. The security staff featured have, probably, done untold damage to the public image of Meadowhall Shopping Centre by their actions. The gobby one really does need start looking for another job as the assault and false imprisonment are enough to warrant Dismissal On the Grounds of Gross Misconduct under Employment Law.       @@MrAndrewFarrow It's reasonable force in England/Wales and the minimum required force in Scotland. 100's of bouncers will use it every single night and SIA training includes the use of reasonable force to remove trespassers. I think the difference between bouncers and other SIA is bouncers expect to use reasonable force (every night) while its rare for other security to have to do it. Normally asking people to leave will do the trick

Ask a shop owner what does police do and how long it takes for them to come to his shop emergency like if he was attacked he will say the same thing. My local newsagent got robbed by a knifeman about two months ago and the son
      Was out and his mum was in shop (husband dead) and there
      Was only one female customrer who tried helping but the guy too around £300 in cash and luckily no one was hurt but she is scared and terrified and so is he for his mum when alone in shop. They obviously called police they turned up nearly and hour later and took cctv but nothing happened yet no one arrested. I work at a shop even me if I get attacked at the shop where I work the police will not turn up on time despite them literally located next door to shopping centre they will turn up may the next day they are useless and ridiculous. They will turn up within minutes for politicians mate that's what you should say they will not turn up for us the public whether at our homes or shops.

    There is a line in the code of conduct that Meadowhall publish on their website. Hidden away in the most inaccessible place and not easily found as it's not titled or signposted well. It took me a few minutes to find it as I searched all over the site for it. It says:
    To ensure the health and safety of our visitors the following are strictly prohibited:
    • Smoking on the malls.
    • Cycling, roller blading, micro scooters, segways, hover boards and skating on the malls.
    • Running, climbing or sitting on any escalator, balustrade, barrier, fence or railing.
    • Filming and photography, using tripod equipment.
    So as you didn't use any tripods you were ejected for reasons made up on the fly based purely on the personal opinions of the security.

So not sure what you on about....they we're not permitted. And security did tell where to find this information.       @@laserr10000000 Who goes to the bottom of a web page to look for some legal mumbo jumbo. A professional photographer would do so and would even check with the management without looking for the T&Cs - because thats what they do.
      But a hobby photographer or a tourist/visitor wouldn't because they'd have the belief that photography is not some sort of thing that only terrorists and criminals perform (which is what security think). So a visitor admiring something in the centre, or just taking pictures of something of interest to show to someone else such as a nice product to buy wouldn't check the T&Cs.
      To have any weight a policy needs to be shoved in the faces of people entering, not hidden away at the bottom of a webpage that hardly anyone visits. It can't be enforced willy nilly when security see something as it could be seen as just the opinion of the security based on nothingness.
      T&Cs for shopping centres are pointless since people just carry on doing what they do outside of it, and they don't do what they don't do outside of it. The T&Cs basically repeat legal stuff like no smoking or repeat known social conventions like no skateboarding. Having policies like shoes & shirts must be worn (yes I have read it) is fucking stupid and unenforceable on a hot day.

      Common law power of ejection to use force is available in law aswell.
      If you stopped and thought through your position you'd realise we're all better off from an individual rights point of view that this exists, as it ensures those people that do own property can deal with trespassers... In your hellscape of a world any clown could impose themselves on another's land without consequence.

    As far as I'm aware, shopping centres are run by private companies and as such offer no right of way. And as with any private company, they can choose who they let onto their premises and the rules of conduct for said premises. The simple answer is, don't use horrible, tacky, consumer-bot shopping centres. Cheers.

    If I was in public and a auditer was fliming I would have no problem whatsoever because they are performing a legal activity I would be far more concerned with the amount of surveillance from the CCTV and security cameras constantly watching us all the time I trust the auditers more than operators who just want to intrude and spy on peoples freedom.

    Most shops have a no filming policy even coffee kiosks have the sign. Sometimes it's for copyright reasons. Other times it is for the patron's privacy.

      Not puzzling at all. Such a large and concentrated retail area need to have police there quickly. These shopping malls have more shops etc than a large town. The nearer they are, the faster the response. It’s just a sub station that were on most estates at one time.

    The lady that owns Meadowhall has a husband that bought an iron foundry I worked in. He closed it down after a few years and my pension was ripped off. Never paid us redundancy and had to claim off the government.

    IVE been shown a report in some retail magazine it appared to be several months old , it stated or at least suggested that a growing number of people shop for others using digital means such as "i phone" , face chat facilities , ie the children goes shopping for an elderly parent, who might be infirm or ill, in doing the child goes into the shop then films the article they are interested in for the parent or loved one . According to the article this growing practice represents about 30% of all in store sales ie people buying for others . So by security firms creating rules for no logical reason such as no photography they are affecting those businesses proffitabilty and in many cases causing stores to leave our city centres relocating to out of city locations , so in efferct these security firms are killing our city centres and in doing putting them selves out of a job

    I didn’t know that private security employees had powers of arrest.
    I also thought that they had absolutely no rights to put their hands on you.
    These people looked very unprofessional in their handling of this situation.
    I’m Curious what happened with the police follow up investigation.
    Was this private security man interviewed by the police for over stepping his boundaries.

      I know this video is a year old but just replying here in case it's useful. Members of the public can use reasonable force to remove someone from their property, not delving into whether this would be reasonable force or not, just stating the facts. These security people have the same powers of arrest as regular members of the public, read up on S3 Criminal Law Act.

      There are too many of these auditors about nowadays who have jumped on the bandwagon. That in turn has diluted the quality. A lot of these auditors get more upset and snowflakey than the people they film, who are probably on a shit wage. They’re targeting the wrong people, it’s not the cannon fodder on the shop floor they should go for, but the bosses who are sat on their fat arses raking in the money.

      Those are security cameras for the shopping centre. They are not going to put these footages on internet like these annoying auditors. She and everyone else including auditor as already gave them consent to film when they entered the premises that had s sign on it saying "CCTV" in operation.

      If you're going to base your economy on underpaying migrant labour, you don't get to complain when all the poorly paid jobs are being done by migrants. English employers want foreign workers because people who can be deported are afraid to put up a fight when they have their wages stolen or are otherwise abused.
      Maybe spend more energy hating the cunts who gave your jobs away instead of foreign workers desperate to take any work they can get or the people "on the dole" because English employers don't want workers who might have a way to assert their rights.

    The security guard had a case. Nobody wants 4 cameras being thrown on them. I'm a big fan of AB and he does it all on his own. Much more entertaining.

      I think the point was that they had turned up on their own to film on several occasions prior to this and been treated in exactly the same manner!!! Filming is not a crime don’t let them make it into one!
      If you don’t exercise your rights you will lose them!
