Have You Got Permission To Film On Private Land? (Prison Drone Footage Included)

  • Today we take a look around HM Prison Gartree, Gallow Field Rd, Leicestershire LE16 7RP. (HMP GARTREE)
    We read a little history on the prison and the fact it was the only prison to have a helicopter breakout in the UK.
    We then walk around the perimeter and make comment on the odd things we notice.
    Prison staff tell us we cannot be on the land and that we cannot film.
    Then we take the Drone up for a rare live shot into prison grounds.
    2 Police Vehicles arrive very shortly after take off.
    Enjoy!

      The story going round was that in case of escape the prison would phone the police and the call phrase was “Rogue Elephant” and then the local air force base would be involved to capture the escapees. Of course the police had no clue what Rogue Elephant they were referring to!

      Actually some post boxes are possibly still on private land and should be removed. New installations from about 10 years plus ago will always be on the the public highway but I’m very sure some have slipped the net and are still on private property. I know this before you ask as I was responsible for the Royal Mail street furniture and agreed where they were to be located in the Essex area.

      I may have come for an argument!
      There is good reason why AB is considered 'The Daddy''...
      None manage to approach the mystique, and very few Mr AB's wide range of remarkable attributes. I think he would be able to happily continue to make popular and entertaining content if auditing itself ended tomorrow. He has real talent as a performer. I know all this is a bit subjective, but still there are aspects that can be weighed and tallied. For arguments sake. He will improve, I can criticise some aspects. I'm not sure I like it when he makes sexist comments to women PCs..
      I watch DJ Audits and consider him one of the very finest . I have nothing but appreciation for DJ, except I just adore AB and would hope we all do. Its like comparing a popular high profile television actor with Laurence Olivier. One stands alone.

      They were most likely 'following procedure' ... so, from that perspective there was a perceived need to follow through, especially as the drone flying was mentioned to the Prison Officers. Having put those new signs up about drones and probably a lack of knowledge about the details of what's permissible, I am not particularly surprised that the Police were called.

      @forthfarean 2 ปีที่แล้ว +1

      @@georgebarnes8163 It does not have to be the owner ,anyone who has the owners authority to remove the implied access for that person or group of people. Quite right,the police are not in the execution of their duty to insist on trespass laws being obeyed, except,as you say,in a criminal trespass. But the owner or his agent can instruct you to leave. If after a reasonable time you do not leave he can use whatever force is necessary in the circumstances to remove you . Any resistance will be a battery,which is an offence under law .
      What should happen is that the owner or agent asks police to attend to prevent a breach of the peace while he ejects you. The police themselves cannot initiate force to eject you,it is not a part of their duty. But once the owner or agent starts to eject you , any resistance is a BOP then the police can arrest you. The police might consider your actions in refusing to leave conduct likely to occasion a BOP, if they do they can arrest.
      The purpose of the arrest is to prevent BOP. Once they have removed you from the vicinity and the danger of BOP is past the police must release you. They might decide to issue a summons to a magistrate’s court to show the magistrates good reason why you should not be bound over in a sum of money to keep the peace. BOP is an offence at common law and actually anyone can arrest for it but it is better to have a Constable standing by.

    i love drone footage, so much easier then to have a heli or plane to fly over to get a nice overview of a place, i have a 30 year old picture of my town, and a newer one, so one can see how much the town have chanced over the years :)

    When you notice they have the body warn camera on and they don't tell you a question that stumps them is "do you have permission from the chief constable to perform covert surveillance" but don't confront them about it straight away leave it awhile before asking.

    • @Youremywifenkwdave
      @Youremywifenkwdave 2 ปีที่แล้ว +2

      They can't use it as evidence if you've not been informed. They can't present it as an article in court.

    • @Mean-bj8wp
      @Mean-bj8wp 2 ปีที่แล้ว +2

      @@Youremywifenkwdave i know that. I was just saying that they don't seem to grasp what is being asked when asking about covert surveillance you tend to get a blank expression as they're trying to work it out.

    • @MW_1981
      @MW_1981 ปีที่แล้ว

      I'm afraid you are both wrong in your comments about not being able to use body worn footage as evidence if you haven't been notified. This is totally inaccurate.
      I'll give you an example. Police receive a call that someone in the street is threatening people with a gun. Firearms unit are deployed and activate their BWV cameras as standard procedure. They arrive at the scene and see the person waving a gun around. They are shouting at him to drop the gun but instead, he points it directly at a member of public and is then shot by officers. The entire incident has been recorded on their cameras but at no point did they advise that he was being recorded. This has no relevance at all and the footage is perfect evidence of what happened. If you seriously think this evidence is no good then you are very naive.

    • @Mean-bj8wp
      @Mean-bj8wp ปีที่แล้ว

      @@MW_1981 that's an extreme situation. But the police required to notify you that you are being filmed not only is it their policy its the law so any person being filmed can request a copy.

    So you flew a drone for 4 minutes and the police arrived, there is no way that they came to investigate the drone and its pilot in that amount of time, begs the question what was the real reason they came for and what lies were told to warrant a response?

    • @DMC888
      @DMC888 2 ปีที่แล้ว +1

      I’d expect that they’d already called the police once when he was walking around the perimeter. They were probably told no laws were broken. When the drone went up they’d have called again and said it was over the prison to get the response they wanted.
