Supreme Court rules cities can penalize the homeless for sleeping outdoors

- The Supreme Court ruled on Friday that cities can penalize the homeless for sleeping outdoors by upholding a law banning homeless encampments.
The 6-3 decision stemmed from the case of Grants Pass v. G. Johnson, after the Oregon town began fining people nearly $300 for sleeping outside. If not paid, that fine would increase to $537.60, and multiple citations could expose the individual to criminal trespass charges-which could lead to a heftier fine and jail time.
"The enforcement of generally applicable laws regulating camping on public property does not constitute 'cruel and unusual punishment' prohibited by the Eighth Amendment," the Supreme Court said in its decision.

They already made this a felony in Tennessee a couple of years ago, punishable by up to 5 years in prison. Also, if you're a felon, you cannot go to a homeless shelter here. What a system.
Tennessee thrives on prison labor, ie, slavery per the 13th Amendment.

So someone who lost everything, no where to go, just send them to prison for 5 years and forget about them.. truly disgusting.
I mean yea, but some people dont want to help themselves either, so even if they fix that, it wont fix the over all issue.
So now it cost the public even more putting homeless a prison cells and meals. GOP just don't understand they caused this situation by outsourcing jobs, raising taxes, cutting medical benefits. Also strange Trump is convicted 34 felonies and would see a day 8n prison. He embezzled and swindled enough money to feed most of the homeless. welcome to america, where it's illegal to be homeless
You’d be surprised to learn in most civilized countries you cannot sleep on park bench. The US is an exception.
True. And also legal for the same lawmakers that make laws againt homeless who accept mega-millions in gifts and vacations from the same billionaires that got trillions in tax breaks and incentives then cut jobs or outsourced jobs. Never has the division of rich and poor been of wide.
This is the country that stands against oppression in the whole world and leave their people behind... something is terribly wrong... Something has to change
Yeah, stop voting blue no matter who and things will change in the cities.

If a city can afford to incarcerate a homeless person and feed, clothe, and house him, then why can't a city just fund a way to help a homeless person. Does the city's justice system have a bigger budget than the city's parks and recreation department?
How about making housing affordable.
we dont need affordable housing-- we need more luxury housing and low income housing conversions to parks and luxury shopping! low income housing is such an eye sore! keep that stuff in New Jersey!

I live in Grants Pass & it's a hot mess. Obviously they don't know how awesome it is to be homeless in CA
I was homeless and on the street for a couple weeks many years ago. The most surprising aspect of that experience was that there was no place where it was okay for me to simply be.
I think there have been laws against vagrants skeeping in public parks for well over half a century--in fact, pretty much against anyone sleeping in public parks. Those didn't target the homeless. They targeted anyone. I can't see a big difference legally.
But the good Christian members of the court voted to fine the homeless…nice.
Empathy is a fundamental ability for social interaction and moral reasoning. Some psychological disorders that may involve a lack of empathy include:
Psychopathy
A personality disorder characterized by a lack of empathy and remorse, shallow affect, glibness, manipulation, and callousness. A study published in Frontiers in Human Neuroscience found that when people with psychopathy imagine others in pain, the brain areas necessary for feeling empathy don't become active.
Narcissistic personality disorder (NPD)
Characterized by self-absorption, grandiosity, exploitation of others, and lack of empathy.
Borderline personality disorder (BPD)
Also known as emotionally unstable personality disorder (EUPD), this disorder is characterized by emotional dysregulation, splitting thinking, and unstable interpersonal relationships.
Autism spectrum disorders (ASD)
A severe developmental disorder that includes social communication deficits. High-functioning autistic individuals, such as those with Asperger's Syndrome, are known for often lacking social skills and being emotionally flat
Homeless people will get arrested on purpose when its freezing outside.
They are going to be spending a lot of money to house all the homeless in jail! If they are fined, they won't be able to pay. So instead of spending All this money on housing them in jail, have a heart and help house them before this happens.
It's not curel and inhumane unless your homeless.
The problem is their law is too broad. Establishing a permanent or semi-permanent encampment, i agree!
Rolling out a blanket and eating lunch? NO! That should be fine.
Even taking a nap after lunch? NO! That should also be fine.
What is the purpose of the public park? It's not only to grow grass so some city employee can have a job cutting it!
I hear a lot about people who want them taken care of. I wonder if they've all taken in people to help them or they want "someone else" to do it from their moral high ground.
Who’s going to pay for the incarceration and healthcare city’s won’t pay welfare but ? Another failure to understand why . The war on drugs is lost now fix this 😮😢😱

I know this certainly sounds like unfortunate news. Sounds like they were ruling on a specific narrow argument. Also, this really means that there's a big opportunity here, to innovate in ultra-short-term dwelling design. The people need it real bad right now.
On another perspective, I would have rather seen them fine the homeless person up to a max annual amount, without the criminal trespass label.
I think there are answers to homelessness but this isnt it!
Good these people need to get themselves off the ground and go to work and better themselves. The street is not meant to live in it better your society by doing something with your lives and improving the quality of your lives. Go out there and work. Don't let anybody tell you that you can't wear that there's no work out there. There is if you look, you will find if you knock it will be opened.
My solution is:
No one shall own more than 2 abodes and net worth of said abodes shall not exceed $??? Based on location and normal local wages.
A one-time wealth tax to fund affordable housing. Any non-profit providing housing for staff (mega churches, etc) must have limits and must use % of funds to provide housing.
My theory is that the problem could be fixed. It is not humane for people not to be allowed to sit or sleep or to be safe because they have no housing. I have met people who are homeless because insurance companies took their premiums and did not pay their medical bills. A person who lived in a tent because he could not pay rent and child support. Big tech gave housing bonuses to interns and landlords evicted tenants to get higher rents. Landlords got higher rents from Air bnb. Rx pain meds turned into addictions and drug profiteering families are still rich. Have concerts like Farm Aid for housing aid. How many houses, bedrooms, yachts does one person or family need?
Thank you for the opportunity to vent and to offer some suggestions.

Homeless is a scam and that needs to end
This entire case had to be brought because of the 9th circuit court of appeals had a ruling that was completely moronic. They ruled that homeless people had the right to sleep and live wherever they wanted. They could camp out on your tree lawn and take a dump on your driveway and you couldn't do anything about it. They ruled completely on the best interests of the homeless people without any consideration to the wants or needs of the municipalities of the citizens thereof. The Grant's Pass case basically said that no, they can't sleep just anywhere. It should be up to the municipality to come up with what is in the best interest of the people in their zone.
I mean the answer is build more affordable homes, follow by programs that help give a person a hand up (not a hand out), follow by splitting the people that can help themselves vs the people that can't or unwilling to. The people that cant help themselves are going to be hardest/the ones that will cost us more than then unwilling or the people that need a hand up as they will require care that will cost people long term - and normally, they are the ones that are the hardest to help. The willing will more than likely get back on their feet. The unwilling though are the ones that could, but are stuck doing drugs, dont want help, or rather be on their own. Next to the unable to help themselves, are the ones that I have no idea what you do with other than try and put them out of your cities and towns. Back in the day, they wouldnt have any real choices, but today, they can live pretty much anywhere is the problem.
It's the hegalian dialectic
If I were about to be homeless and I knew I had to sleep on the streets in a big city, I think I’d prefer to just take a one way ticket to the wilderness, build a shack there with my own hands, and then live off the land! some of the homeless just want to be doing drugs and their dealer is in the city.
Let see how much supplies you would need and major skills before your shelter is even built, do you have the skills needed to gather food?,, How many homeless could do that?
