    The following topic in lesson 39 is about Judgment
    1.)What is Judgment?
    It is the adjudication by the court that the accused is guilty or not guilty of the offense charged by the offense charged and the imposition on him of the proper penalty and civil liability, if any. It must be written in the official language. Personally and directly prepared by the judge and signed by him and shall contain clearly and distinctly a statement of the facts and the law upon which it is based.
    2.)What are the Contents of the Judgment?
    If the judgement is of conviction, it shall state
    1 the legal qualifications of the offense constituted by the acts committed by the accused and aggravating or mitigating circumstances which attended its commission.
    2. The participation of the accused in the offense, whether as principal, accomplice, or accessory after the fact.
    3. The penalty imposed upon the accused and;
    4. The civil liability or damage caused by his wrongful act of omission to be recovered from the accused by the offended party, if there is any, unless the enforcement of the civil liability by a separate civil action has been reserved of waived.
    What are the contents of the judgement?
    In case the judgement is of acquittal, it shall state whether the evidence of the prosecution absolutely failed to prove the guilt of the accused or merely failed to prove his guilt beyond reasonable doubt. In either case, the judgement shall determine if the act or omission from which the civil liability might arise did not exist.
    3.) When does Judgment become Final?
    1. After the lapse of the period for perfecting an appeal
    2. When the sentence has been partially or totally satisfied or served
    3. When the accused has waived in writing his right to appeal
    4. Has applied for probation.

    Good day Atty. I would like to thank you for your very clear and concise discussion for us to learn and easily comprehend every knowledge you imparted to us. In this lecture I learned about the fourth procedure which is the judgement or the adjudication by the court that the accused is guilty or not guilty of the offense charged and the imposition on him of the proper penalty and civil liability, if any. It must be written in the official language, that is personally and directly prepared by the judge and signed by him and shall contain clearly and distinctly a statement of the facts and the law upon which it is based. The 2 decision of court are based on merits( trial between prosecution and defense) (1 conviction=guilty or 2acquital=the accused is innocent). The contents of the court decision, if the judgement is conviction(guilty) it shall state the legal qualification of the offense and the aggravating or mitigating circumstances because it is connected on the participation of the accused in the offense whether as principal,accomplice or accessory; after that fact it will reflect to the penalty imposed upon the accused. If the judgement is aquital it shall state whether the evidence absolutely failed to prove the guilt of the accused. In either case the judgement shall determine if the acts from which the civil liability might arises do not exist.4 things that judgement become final; after the lapse of the period(appeal only last 15days)(calendar days including weekends and holidays); when the sentence has been partially served; waived; accused applied for probation.I have learned so much from you and I look forward to learning more.     1. What is Judgment?
    - It is an adjudication by the court that the accused is guilty or not guilty of the offense charged and the imposition on him of the proper penalty and civil liability, if any.     -There is two decision of courts based on merits
    *conviction - means guilty
    *acquittal - the accused is innocent

    -In either case, the judgment shall determine if the act or omission from which the civil liability might arise did not exist.
    When does judgment become final?
    1. After the lapse of the period for perfecting an appeal. ( 15 days)
    2. When the sentence has been partially or totally satisfied or served.
    3. When accused has waived in writing his right to appeal.
    4. Has applied for PROBATION.
    - means judgment become final, the party of the accused admits their loss.

Furthermore, I found out what are the contents of the judgment when it is conviction such as the legal qualification of the offense by the acts committed by the accused, the participation of the accused whether as principal, accomplice, or accessory.     1. What is Judgment?
    ✓ It is an ADJUDICATION by the court that the accused is guilty or not guilty of the offense charged and the imposition on him of the proper penalty and civil liability, if any. It must be written in the official language, personally and directly prepared by the judge and signed by him and shall be certain clearly and distinctly a statement of the facts and the law upon which it is based.
    📌 There is two decision of courts based on merits
    • conviction - means guilty
    • acquittal - the accused is innocent
    2. What are the contents of the judgment?
    • The court have two types of judgement, the CONVICTION or GUILTY and ACQUITTAL or NOT GUILTY.
    ✓ If the judgment is of CONVICTION, it shall state;
    (1) The legal qualifications of the offense constituted by the acts committed by the accused and the aggravating or mitigating circumstances which attended its commission.
    2. The participation of the accused in the offense, whether as principal, compliance, or accessory after the fact;
    3. The penalty imposed the accused; and
    4. The civil liability or damages caused by his wrongful act or omission to be recovered from the accused by the offended party , if there is any unless the enforcement of the civil liability by a separate civil actions has been reserved or waived
    (2) In case the judgment is of ACQUITTAL, it shall state whether the evidence of the prosecution absolutely failed to prove the guilt of the accused or merely failed to prove his guilt beyond reasonable doubts.
    📌In either case, the judgment shall determine if the act or omission from which the civil liability might arise did not exist.
    ✓ When does judgment become final?
    1. After the lapse of the period for perfecting an appeal. ( 15 days)
    2. When the sentence has been partially or totally satisfied or served.
    3. When accused has waived in writing his right to appeal.
    4. Has applied for PROBATION.
    - means judgment become final, the party of the accused admits their loss.

    Greetings Atty. Bajita. Today I learned what is judgement and the contents of judgement. Judgement is the ADJUDICATION by the court that the accused is guilty or not guilty of the offense charged and the imposition on him of the proper penalty and civil liability, if any. It must be WRITTEN IN THE OFFICIAL LANGAUGE , personally and directly prepared by the judge and signed by him and shall contain clearly and distinctly a STATEMENT OF THE FACTS AND THE LAW UPON WHICH IT IS BASED. The official court language is ENGLISH. There is two (2) types of judgement based on merit; (1) CONVICTION, and ACQUITTAL. My favorite part is when the judgement is become final, it is if the defending accepted and applied for the probation. I learned a lot sir. Thank you and God bless.

    Good day Justice Buddy! I've gained another useful knowledge about the Court pillar. And this another knowledge is Judgment in the court proceedings. Judgment is the decision by the court if the accused is guilty or not guilty of offense charged. And based on merits, there are 2 decision and those two are the conviction and acquittal. A judgment must be written in the official language which is english or tagalog. And it contains the statements of facts and law which it is based. I've also learned in this video is the contents of judgment whether if it a conviction or acquittal. In A conviction judgment, it shall state the legal qualification of the offense and it shall also state the aggravating and mitigating circumstances. And it shall also state the participation of the accused if he/she is a principal, accomplice and accessory because it is the identification of the offender for its own penalty and lastly it shall state the civil liability or damages. And for the judgment of acquittal it shall state the evidence of the prosecution failed to prove guilt of the accused. In either of the case guilty or not guilty it shall determine if the omission from which the civil liability might arise did not exist. And I have also learned when is the judgment is final. It is final if it lapse the period for perfecting a appeal, it is final if the sentece has partially or totaly served, and it is final if when the accused has waived in writing his right to appeal. And lastly, it is final if the accused applied for probation.

    Good day Atty. I learned after the arguement in Court the next is Judgement. Judgment is the adjudication, it must be written in the official language it usually using english language, statement of the facts and the law upon which it is based. This isnthe time also when the accused is guilty or not guilty. The contents of the judgement are the legal qualification of the offense, the participation of the accused in the offense, the penalty imposed upon the accused, The civil liabilty or damages, if the judgement is acquittal it shall state the evidence of the prosecution absolutely failed to prove the guilt. The judgement shall determine if the act or ommision from which civil liabilty. The judgment become final after the lapse of the period or after 15 days (calendar days), when the sentence has been partially or totally satifies to served, when the accused has waived in wrting his right to appeal and when the accused applied for probation.
