    Good afternoon Atty. thank you for the new knowledge that you teach us today. You explained and elaborated Rule 114 which is Bail. Under Rule 114 Section 1 Bail is defined, it stated that Bail is the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified.     Good day Atty. another very well explained discussion! With regard to Rule 114
    1. What is bail?
    -It is defined as the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions herein after specified.
    2. What are the forms of bail?
    We have Four Forms of Bail which are :
    1) Property bond- An undertaking constituted as a lien on the real property given as security for the amount of the bail. Personal property is prohibited or not allowed.
    2) Cash deposit- A cash held as a guarantee of payment. When you bail someone out of jail the easiest option is to post the full amount in cash.
    3)Corporate surety-A surety is a loan you receive to post bail. In the case of surety bond the contractor is a bail bondsman. The bail bondsman meets with you and agrees to post bail for you. The bail bondsman then contacts the surety company they work with to borrow the cash to post your bail.
    4)Recognizance-a mode of securing the release of any person in custody or detention for the commission of an offense who is unable to post bail due to abject poverty. Light crime or light offenses for those who have a good reputation. Also known as "guarantor".

    RULE 114: BAIL/PIYANSA
    1. WHAT IS BAIL?
    According to Rule 114, Section 1. BAIL DEFINED. - Bail is the SECURITY GIVEN FOR THE RELEASE OF A PERSON IN CUSTODY OF THE LAW, furnished by him or a bondsman, TO GUARANTEE HIS APPEARANCE BEFORE ANY COURT AS REQUIRED under the conditions hereinafter specified.
    Bail is the security provided in exchange for the release of a person who is in the custody of the law. It guarantees the court that he or she will appear as provided under the conditions stipulated by the court.
    2. WHAT ARE THE FORMS OF BAIL?
    The following are the FORMS OF BAIL:
     PROPERTY BOND - A property bond is an undertaking constituted as a lien on the REAL PROPERTY (immovable property) given as security for the amount of the bail. (Section 11)
    Hindi maaari ang PERSONAL PROPERTY.
     CASH DEPOSIT - The money deposited by the accused or any person acting on his behalf, with the nearest collector of internal revenue, or provincial, city, or municipal treasurer. Considered as bail, it may be applied to the payment of any fees and costs, and the excess, if any, shall be returned to the accused or to whoever made the deposit. (Section 14)
     CORPORATE SURETY - One issued by a corporation licensed to provide bail subscribed jointly by the accused and an officer duly authorized by its board of directors. (Section 10)
    Tao o ahensya na magpopondo sa piyansa, ito ay parang insurance company, sa tunay na buhay ang tawag sa corporate surety ay “piyansador.”
     RECOGNIZANCE - An obligation of record entered into usually by the responsible members of the community before some court or magistrate duly authorized to take it, with the condition to do some particular act, the most usual act being to assure the appearance of the accused of trial.
    Ito yung maaaring iapply sa maliliit na krimen, light crimes or offenses, na kung saan yung tao na may integridad, reputasyon, at good moral character will guarantees na magpapakita siya sa hukuman kapag kailangan ang kaniyang presensiya, kahit na hindi siya magbayad ng piyansa. Ang tawag dito ay “GUARANTOR” like barangay captain and other authorities.

Thank you for explaining and teaching about the rule 114 in section 1 of rule 14 some idea are meaningble and usable for the future learning some idea are also idea that gives me more idea Recognizance that stands for PCCR. A property bond is all about the property that is immovable or also known as real property. While cash deposit is the money on hand, and Corporate Surety is also known as the "piyansador" that will take charge of your bail but you still need to pay him with an interest amount.

    Goodafternoon Atty. In this video I learned about a bail is a matter of right, Under Sec 1. Rule 114 Bail is the security given for the release of a person in custody of the law, furnished by him or a bondsman, guarantee his apprearance before any courft as required under the condiotions hereinafter specified. Under 114 there is 4 Forms of Bail - 1) Propery Bond; where your property is used as bail, not your personal properties like cellphones, gadgets; 2) Cash Deposit - were you can use cash for bail; 3) Corporate Surety (Pyansador); 4) Recognizance - Applies mostly to the light crimes/light offenses of a person that has a good integrity, reputation, good character guarantee to any person accused allowed to see his/her presence in the court even if you don't want to pay for bailment, for example Brgy. Captain.

According to Section 1 of Rule 114, it is the security given for the release of a person in custody of the law, to be furnished by him or a bondsman that will guarantee his appearance before any court as required. And if the person didn't appear before the court, his/her bail will be forfeited and warrant of arrest will be issued.
    the forms of bail are:
    1. Property bond - It refers to real property that is considered as immovable.
    2. Cash deposit
    3. Corporate surety - It states that a certain company will pay for your bail but in exchange, it will have an interest.

    2. What are the forms of bail?
    • 4 forms of bail under Rule 114 of Revised Rules of Criminal Procedure (P-C-C-R)
    1. Property bond - It is an undertaking constituted as lien on the real property given as security for the amount of the bail.
    2. Corporate surety - It is any domestic or foreign corporation, licensed as a surety in accordance with law and currently authorized to act as such, may provide bail by a bond subscribed jointly by the accused and an officer of the corporation duly authorized by its board of directors.
    3. Cash deposit - The accused or any person acting in his behalf may deposit in cash with the nearest collector or internal revenue or provincial, city, or municipal treasurer the amount of bail fixed by the court, or recommended by the prosecutor who investigated or filed the case. Upon submission of a proper certificate of deposit and a written undertaking showing compliance with the requirements of section 2 of this Rule, the accused shall be discharged from custody. The money deposited shall be considered as bail and applied to the payment of fine and costs while the excess, if any, shall be returned to the accused or to whoever made the deposit.
    4. Recognizance - Whenever allowed by law or these Rules, the court may release a person in custody to his own recognizance or that of a responsible person.

    Recognizance - usually apply in light offenses. There are other people who will pay for the bail.

    I learned about the topic of bail and learned that any individual arrested can utilize bail to have his or her case dismissed, but my understanding is that not all crimes are eligible for bail. The discussion falls under Sec 1 of Rule 114 Bail is the security given for the release of a person in custody of law to guarantee his appearance before any court as required. It also stated here the 4 forms of bail. •Property bond or only real properties or immovable properties are allowed • Cash deposit or bail through cash •Corporate surety or someone will pay your bail but with interest •Recognizance it is applicable in light offenses.

    - According to Section 1 of Rule 114 of the Revised Rules of Criminal Procedure Bail defined as the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified.

    4 forms of bail under rule 114 of Revised Rules of Criminal Procedure.
    1. Corporate surety - Any domestic or foreign corporation, licensed as a surety in accordance with law and currently authorized to act as such, may provide bail by a bond subscribed jointly by the accused and an officer of the corporation duly authorized by its board of directors.
    2. Property bond - property bond is an undertaking constituted as lien on the real property given as security for the amount of the bail.
    3. Cash deposit - The accused or any person acting in his behalf may deposit in cash with the nearest collector or internal revenue or provincial, city, or municipal treasurer the amount of bail fixed by the court, or recommended by the prosecutor who investigated or filed the case. Upon submission of a proper certificate of deposit and a written undertaking showing compliance with the requirements of section 2 of this Rule, the accused shall be discharged from custody. The money deposited shall be considered as bail and applied to the payment of fine and costs while the excess, if any, shall be returned to the accused or to whoever made the deposit.
    4. Recognizance - Whenever allowed by law or these Rules, the court may release a person in custody to his own recognizance or that of a responsible person

Bail is the given for the release of an accused in the custody of the law to make sure that the person sill show up in the hearing and to guarantee his appearance. Bail has 4 forms such Property bond, Cash deposit, Corporate Surety, and Recognizance that stands for PCCR. A property bond is all about the property that is immovable or also known as real property. While cash deposit is the money on hand, and Corporate Surety is also known as the "piyansador" that will take charge of your bail but you still need to pay him with an interest amount.     RULE 114: BAIL/PIYANSA
    1. WHAT IS BAIL?
    According to Rule 114, Section 1. Bail Defined. - Bail is the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guard his appearance before any court as required under the conditions hereinafter specified.
    Bail is the security provided in exchange for the release of a person who is in the custody of the law. It guarantees the court that he or she will appear as provided under the conditions stipulated by the court.
    2. WHAT ARE THE FORMS OF BAIL?
    The following are the forms of bail: PCCR
    (a) PROPERTY BOND - A property bond is an undertaking constituted as a lien on the real property (immovable property) given as security for the amount of the bail. (Section 11)
    Personal property is not included.
    (b) CASH DEPOSIT - The money deposited by the accused or any person acting on his behalf, with the nearest collector of internal revenue, or provincial, city, or municipal treasurer. Considered as bail, it may be applied to the payment of any fees and costs, and the excess, if any, shall be returned to the accused or to whoever made the deposit. (Section 14)
    (c) CORPORATE SURETY - One issued by a corporation licensed to provide bail subscribed jointly by the accused and an officer duly authorized by its board of directors. (Section 10)
    (d) RECOGNIZANCE - An obligation of record entered into usually by the responsible members of the community before some court or magistrate duly authorized to take it, with the condition to do some particular act, the most usual act being to assure the appearance of the accused of trial.

    Good afternoon Atty! Thank you for another fruitful video. In this video I have learned about bail and forms. BAIL under section 1 rule 114 it is the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his apperance before any court as required under the conditions here in after specified.
    The bail has four (4) forms and this are the following:
    1) Property bond- An undertaking constituted as a lien on the real property given as security for the amount of the bail. Personal property is prohibited or not allowed
    2) Cash deposit- A cash held as a guarantee of payment. When you bail someone out of jail the easiest option is to post the full amount in cash
    3)Corporate surety-A surety is a loan you receive to post bail. In the case of surety bond the contractor is a bail bondsman. The bail bondsman meets with you and agrees to post bail for you. The bail bondsman then contacts the surety company they work with to borrow the cash to post your bail.
    4)Recognizance-a mode of securing the release of any person in custody or detention for the commission of an offense who is unable to post bail due to abject poverty. Light crime or light offenses for those who have a good reputation. Also known as "guarantor".

    Good day Atty., Thank you for another insightful video today. It was a comprehensive and informative video of yours constituting some provisions about bail and its form. It was discussed in the lecture the definition of bail in accordance with our law, which was bail is the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified. Moreover, it was emphasized by Attorney that under in the said provision, bail itself is a security given to a person under the custody of the law to guarantee that he/she will also comply in the court even after his/her release. On the other hand, it was also mentioned and discussed in the lecture that bail has four forms, which are property bond, cash deposit, corporate surety, and recognizance. First is property bond, wherein you are allowed to use your property instead of money for your bail. However, it must be real property and not personal property like cellphone, bags, shoes, etc. Next is a cash deposit, wherein you tend to use the money for bail and to be released. It was followed by a corporate surety, wherein there are other agencies or corporations that will fund your bail. And lastly, recognizance, wherein it applies in a small kind of offenses or crime which there are an authority that will guarantee that you will comply in court if there is and in this form of bail you don't need to use money.     1. What is Bail?
    * Under Section 1 of Rule 114 of the Revised Rules of Court, bail is defined as the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified.
    * Bail is designed to guarantee your appearance in court. Unless charged with a capital offense or an offense punishable by life imprisonment, and the proof of guilt is evident or the presumption is great, every person charged with a crime or violation of municipal or county ordinances shall be entitled to pretrial release on reasonable conditions.
    2. What are the forms of bail?
    * Property Bond - it is a bond that posts the value of tangible property, such as real estate, in order to obtain a pre-trial release from jail. In some cases, the value of the property may need to be twice as high as the bail amount in order for a property bond to be accepted. A property bond is not allowed in every state. It may be obtained from a bail agent. Depending on the law of the particular state, a court-appointed appraiser may need to asses the value of the property being used to post the bond.
    * Cash Deposit - under section 14 of Rule 114, The accused or any person acting in his behalf may deposit in cash with the nearest collector of internal revenue or provincial, city, or municipal treasurer the amount of bail fixed by the court, or recommended by the prosecutor who investigated or filed the case.     Part 1: Bail and its Forms
    What is Bail?
    - Under Section 1 of the Rule 114, Bail is defined as the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified.
    The following are the four (4) Forms of Bail otherwise known as the PCCR:
    Property Bond - In this form, you are allowed to bail by just using your property. But it doesn't mean that it allows any personal property. Because the only property that allows by the law is a real property or immovable property like House and Lot.
    Cash Deposit - It says that the accused or any person acting in his behalf may deposit in cash with the amount of bail fixed by the court, or recommended by the prosecutor who investigated or filed the case.
    Corporate Surety - In this form, there is another representative or agency that will serve as your post bail--an insurance company that will handle your bail but with interest that you will repay to the surety in the next following day or once you temporarily get out of jail.
    Recognizance - It is applied in the light crime or light offenses for those who has a good reputation or character. It is also known as a guarantor who will be presented in the court once his presence is needed even if the accused wouldn't pay for his bail.

    Good day Atty. Today I’ve learned regarding Rule 114 which is about Bail. Under Section 1 of Rule 114, Bail defined as the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions hereinafter specified.
    I’ve also learned under Rule 114 the four forms of Bail which are Property Bond, Cash deposit, Corporate surety, and Recognizance. Property bond is a legal document that establishes a claim on real property as deposit for the amount of bail. Cash deposit is using cash money for bail. Corporate surety is a corporation or company that act as your surety that provides bail. Lastly, Recognizance applies to light crimes or light offenses where person with integrity, reputation and good character will guarantee that the accused will appear in court when required to do so without the requirement of a posting bail.

    May ibang tao o ahensiya ang magpopondo sa piyansa mo. Paramg insurance company, sila magbabayad ng piyansa ngunit may percentage na kasama kapag binayaran mo. "PIYANSADOR"
    Recognizance
    Nag-aapply sa mga mabababang klase ng krimen. Ang taong may dignidad ay haharap sa hukuman kahit na hindi magbayad ng piyansa. "GARANTOR", may ibang mag-gagarantiya.

    I've learned that under rule 114 bail is the security of a person who is under custody of the law. Bail also is a security of the law that this person shall appear to the hearing or trial. Bail has 4 forms such as property bond, cash deposit, corporate surety, and recognizance that stands for PCCR.

    4 forms of bail under rule 114 of Revised Rules of Criminal Procedure.
    1. Corporate surety - Any domestic or foreign corporation, licensed as a surety in accordance with law and currently authorized to act as such, may provide bail by a bond subscribed jointly by the accused and an officer of the corporation duly authorized by its board of directors.
    2. Property bond - property bond is an undertaking constituted as lien on the real property given as security for the amount of the bail.
    3. Cash deposit - The accused or any person acting in his behalf may deposit in cash with the nearest collector or internal revenue or provincial, city, or municipal treasurer the amount of bail fixed by the court, or recommended by the prosecutor who investigated or filed the case. Upon submission of a proper certificate of deposit and a written undertaking showing compliance with the requirements of section 2 of this Rule, the accused shall be discharged from custody. The money deposited shall be considered as bail and applied to the payment of fine and costs while the excess, if any, shall be returned to the accused or to whoever made the deposit.
    4. Recognizance - Whenever allowed by law or these Rules, the court may release a person in custody to his own recognizance or that of a responsible person

    Isang magandang araw sa pinaka magaling na taga paghatid ng kaalaman sa lahat ng mag-aaral Justice Buddy!! Ito yung isa sa pinaka kailangan ko malaman sapagkat atty kahapon po ay naging talakayan lang namin ng aking kaibigan ang piyansa. Now i'm aware about the forms of Bail. Kapag sinabing Property Bond maari mong gawing pampiyansa ang bahay at lupa mo kapag Cash deposit as in cash mismo. Corporate surety ito naman yung mga companies na maari mag support sayo o pauntangin ka with interest and Recognizance ito naman yung pangmalakasan kapag marami kang kilala na matataas na tao like captain sagot na nila ang bail mo. ako'y lubos na namangha sa bago kong nalaman. And thank you so much Atty sobrang daling tandaan dahil sa paggamit mo ng mga marks like PCCR.

    Good day Atty.
    BAIL under section 1 rule 114 is the security given for the release of a person in custody of the law, furnished by him or a bondsman, to guarantee his appearance before any court as required under the conditions herein after specified.
    The bail has four (4) forms and this is the following:
    1) Property bond- An undertaking constituted as a lien on the real property given as security for the amount of the bail. Personal property is prohibited or not allowed
    2) Cash deposit- A cash held as a guarantee of payment. When you bail someone out of jail the easiest option is to post the full amount in cash
    3)Corporate surety-A surety is a loan you receive to post bail. In the case of surety bond the contractor is a bail bondsman. The bail bondsman meets with you and agrees to post bail for you. The bail bondsman then contacts the surety company they work with to borrow the cash to post your bail.
    4)Recognizance-a mode of securing the release of any person in custody or detention for the commission of an offense who is unable to post bail due to abject poverty. Light crime or light offenses for those who have a good reputation. Also known as "guarantor".
