Hello Kseniya, my mother-in-law (green card holder - petitioner) petition her husband and younger daughter (minor at that time) way back 2016. Her eldest daughter (which is my wife) filed I-864A as a joint sponsor because my mother-in-law income is not enough. Hello, the following page from the NVC talks about domicile requirements: travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos18 You also need to answer questions factually exactly as they are now. If based on the information above you’ve determined that you’re not domiciled in the US, you have to answer that on the form. You do however have to show proof of intent to reestablish domicile (according to the resource).
That was a very good presentation. I have a question though with the affidavit of support, can I sponsor the principal immigrant(my wife's brother), his wife and two children? The reason is because my wife is not working anymore therefore she has no income except from what she is receiving from the social security service.
You can be a household member (I-864A). Your wife will still have to be the principal sponsor and submit I-864. I have another video specifically talking about income, so check that one out as well

Do I have to include both of them in the household? Also I am filing a separate Form 1-864 for each as well so in each they both should be part of the total Household rite? I864EZ is only used if you’re using the sponsors income. Your wife will fill I864 and you will fill I864A. I have another video on reporting income on this form specifically
Awesome information provided clearly. However, I have a different case. I have an approved I-140 NIW EB2 petition. Now I need to submit documents to NVC after their welcome letter. Do I need to submit I-864/A/EZ. There was no affidavit of support fee asked by NVC on the CEAC website. Help will be appreciated.

My immigration NVC document got to the stage of approval, Eveything was approved but on the I-864 form was rejected. It says we were suppose to fill 12pages of paper, but they on have 10pages on there. This is so draining and confusing. And does it matter if the one I found carries a old expiring date? Hi Tania, this is what I found on Nolo.com "Although some sources of money related to unemployment cannot be counted toward income for purposes of Form I-864 (such as food stamps, SSI, Medicaid, and TANF), unemployment benefits are in a different category. They are basically insurance payments, which you are allowed to collect upon based on your employer having paid into a federal/state unemployment system earlier. For that matter, if you are also receiving any retirement benefits, worker’s compensation payments, or other benefits that are similarly considered “taxable income” by the IRS, you can count these toward meeting the 125% of Poverty Guidelines levels required in order to serve as an immigrant’s financial sponsor. (This comes from 71 Federal Register 35731.) How long you will remain eligible for the unemployment benefits is an issue to look into, however. U.S. immigration authorities may consider this in assessing your ability to maintain the necessary income levels over time." I'm very confused with Part 4 of i-864EZ where it states: Add together Item Numbers 1.a-1.e and enter the number here. "This is your HOUSEHOLD SIZE for the purpose of this Form I-864EZ." .. If i add together my number would be 3 because on question 1.e if I have any dependents listed on my most recent Federal income tax, I enter 1 because i have my little sister who is here in the states and i have her as a dependent. If I'm the petitioner who filed the i-130 for my mother and my income is filed jointly with my husband, who makes all of the income for my household. Do I fill out i-864 and complete part 5 "Income you are using from any person who has counted in your household size" or do I fill out i-864a and he signs that form with my form i-864 with 0 income.
I assumed that my income would have met the requirements so I didn't include my husband's income. Now NVC IS SUGGESTING JOINT INCOME BECAUSE I DID NOT REAVH THE MINIMUM INCOME. Can I go ahead and add my husband's income and fill out the I864A? What can I do?

Your household size will have to include everyone living with you and all of the prospective immigrants or any other people you’re sponsoring.

Hello Kseniya, my mother-in-law (green card holder - petitioner) petition her husband and younger daughter (minor at that time) way back 2016. Her eldest daughter (which is my wife) filed I-864A as a joint sponsor because my mother-in-law income is not enough. Now, her husband and daughter has a upcoming interview this coming Dec 6, 2023 and i just found out in the CEAC website that we need to upload a new form I-864EZ before the interview. So what is going to happen to her original I-864 form if she submit the I-864EZ? Please respond, i would highly appreciate it.

Again amazing stuff! For Part 3 question 1. I am the main petitioner and sponsor. I do have enough income to support my brother (intended immigrant) but not his now wife and 4 children. Do I select Yes for P3Q1? I will have only one joint sponsor outside of the household. Do they also have to select Yes on P3Q1? Or can they select No and the select Yes for P3Q2? Thank you

You also need to answer questions factually exactly as they are now. If based on the information above you’ve determined that you’re not domiciled in the US, you have to answer that on the form. You do however have to show proof of intent to reestablish domicile (according to the resource).
That was a very good presentation. I have a question though with the affidavit of support, can I sponsor the principal immigrant(my wife's brother), his wife and two children? The reason is because my wife is not working anymore therefore she has no income except from what she is receiving from the social security service.
You can be a household member (I-864A). Your wife will still have to be the principal sponsor and submit I-864. I have another video specifically talking about income, so check that one out as well

Looks like you have to file I134 while you apply for fiancé visa and I864 later when you are married and your spouse will be applying for green card.
Thanks again for you generous help. I have a question, if you dont mind. Im only a joint sponsor, sponsoring for my friend and she has a son. From my understanding, for part 3 I entered yes then indicated the child under family member. So the total people im sponsoring is two, correct? Or do I also need to check part 3 number 2 as well?

Do I have to include both of them in the household? Also I am filing a separate Form 1-864 for each as well so in each they both should be part of the total Household rite? So should I add each of them in the family member section in Part 3? Also which option to select in Part 3? will it be 1 or. 2 or 3? Will appreciate your input. Thanks

I am a petitioner for my parents. My income is enough to sponsor for them. I myself made over $100k. But I just married 2 months ago. We haven’t filed tax yet, and we will file tax together next month. Tax in 2021 was under my name ONLY. Now I got the NVC letter to summit financial support for my parents. Which form do I need to file ? I-864 or I-864A or I-864EZ ? Does my husband need to sign I-864A even I don’t need his income to sponsor for my parents?

I864EZ is only used if you’re using the sponsors income. Your wife will fill I864 and you will fill I864A. I have another video on reporting income on this form specifically

In each i-864, I am sponsoring only 1 person and there are no derivative applicants. So the household size is 2 in each application. However, I am filing 2 applications at the same time and sponsoring 2 persons. So should the household size be 3? Please note on the application of parent1, I can't include the other parent on item 6 since they aren't LPR yet.

My immigration NVC document got to the stage of approval, Eveything was approved but on the I-864 form was rejected. Hi Tania, this is what I found on Nolo.com "Although some sources of money related to unemployment cannot be counted toward income for purposes of Form I-864 (such as food stamps, SSI, Medicaid, and TANF), unemployment benefits are in a different category. They are basically insurance payments, which you are allowed to collect upon based on your employer having paid into a federal/state unemployment system earlier.
For that matter, if you are also receiving any retirement benefits, worker’s compensation payments, or other benefits that are similarly considered “taxable income” by the IRS, you can count these toward meeting the 125% of Poverty Guidelines levels required in order to serve as an immigrant’s financial sponsor. (This comes from 71 Federal Register 35731.)
How long you will remain eligible for the unemployment benefits is an issue to look into, however. U.S. immigration authorities may consider this in assessing your ability to maintain the necessary income levels over time."

Question - Sponsoring only my wife. I thought about filing the 864ez form. My current income and last year's income meet the poverty guidelines. But before that, I was a student - so no income. 864ez asks for the past 3 years' income. Does all my past 3 years' income need to meet poverty guidelines or just the current?

They only require most recent year’s taxes (2020). Providing taxes from 3 years is optional.

I'm very confused with Part 4 of i-864EZ where it states: Add together Item Numbers 1.a-1.e and enter the number here. "This is your HOUSEHOLD SIZE for the purpose of this Form I-864EZ." .. If i add together my number would be 3 because on question 1.e if I have any dependents listed on my most recent Federal income tax, I enter 1 because i have my little sister who is here in the states and i have her as a dependent.
