Hi Kseniya, It's great to see someone like yourself sharing your experience and helping others in the immigration process! I have a comment. At 8:16 you were mentioning the total income from 1040 should be entered into form I-864 part 6 line 2.a but the I-864 specifically says "my total income (adjusted gross income on form ...)" which is a few lines below total income on the tax form. So if the sponsor just has one job as an employee, their total income may be the same as their adjusted gross income. But if the sponsor is self employed such as a contractor, then they may have some adjustments and that results in a lower adjusted gross income than their total income, FYI. If they enroll in retirement plans with their self-employment income, the gross and total could differ significantly. My guess is that USCIS is looking at the total income that the sponsor can use for day-to-day expenses so whatever is adjusted down such as money they put in their retirement plan that they can't take out for day-to-day expenses can't be included.
Hello, it doesn’t matter self employed or retired, they only care about total income. They specify AGI only if using form 1040-EZ which no longer exists.

I've been going back and forth in my head on which i-864 form to use for my specific case. I watched many videos but couldn't decide. My wife is petitioning on behalf of her mother but is a homemaker. So she doesn't work. My income provides our livelihood and we are married and file taxes jointly. So if I'm understanding correct, my wife needs to file a i-864 form as the petitioner and I need to file a i-864a form. Thank you for your help.
Hopefully you figured it out. But from what I know, you'll need to open the pdf in a adobe pdf reader and not in a browser, otherwise the household size won't be counted correctly

What about tax exempt incomes? They are not getting reflected to the IRS forms. Tax exempts are like, IHSS providers in CA who are living with their recipient in the same house. Or, if you work with the United Nations.
@KseniyaInternational That is true, my wife is a tax exempt IHSS provider, and it seems her income determined not qualified based on the RFE we just received today. However, we had submitted her 12 months paystubs, bank accounts, and the IRS 2014/07 regulation which confirms her income being exempt all together in the package at the time of application.

Hi Kseniya! I have a question, I got an email from NVC saying that I need to add my husband as a Household member of Me, as a correction on his I-864a how do I do that? I’m the sponsor and I’m counting my husbands income fully since I’m not working, I’m applying for both of my parents green cards. They also asked me to fill out individual I-864a forms for each of my parents (we first only filled one for both) which I can now fix that cause I watched your video on how to fill the I-864a correctly. That’s what we did. Also me and my husband fill taxes together so I uploaded the exact same document under both of our names for i864 and i864a

The total income line does NOT include income such as the tax-free part of social security pension. In many cases this is the entire amount and can be the majority of income so that without this amount the income will be insufficient. Does this amount get counted so that I don't have to include all my assets?

Hello, I am petitioning for my mother. I and my husband are US citizens, and I have been a housewife for the past three years. My husband and I file taxes jointly. I am filing I-864 and my husband is filling I-864A so that I can use his income. My question is, for the I-864 in Part 6, #24a- 24c (re: My total income as reported on my Federal Income Tax returns for the most recent three years), can I include the total income on our tax returns though technically it is only my husband who earned this? Asking this because from what I understand, since we file jointly, the total income on the tax return is also considered my total income even if I did not work because we filed jointly, hence I can write it on Part 6, #24a-c. Hello Kseniya, this question is in regards. to what you said about filling form I-864a, you said that what we put in the tax returns for previous years must match what the sponsor puts on his 3 most recent years tax returns, but we just got married and it is the first time we are filling together so we only have one joint tax return and I have my own separate income from past years. as i am filling the form I-864a should I put our joint income from the most recent year and just put my own income for the past years even if it does not match what his form (I-864) says?

Hi I have very important question. We actually filed jointly a Tax with my husband year 2023. Which I used to work also which I had my w2 and small income. Hey Kensiya, firstly thank you for your videos, they have been very helpful. How many forms do I need to apply as a Canadian citizen who just got married to a U.S. citizen ? As far as I know now ( 130/131/1485 & the work visa) do I need to apply for the i864 as well ? And most importantly is it true that I have to wait 6 months from the day I entered the u.s. in order to file these forms ? I heard it is recommended to wait otherwise it will look suspicious for some reason

Hi Kseniya: USCIS has sent out RFQ to resend I-864 along with I-864A as I clicked line 23 while filing. Can I resubmit by excluding spouse(without I-864A) as my income is 125% above poverty line? Also, can I make changes to remove assets(Part 7) to avoid confusion? If I submit I-864A along with I-864, I think I need to put both combined taxes that were filled with IRS on line 24a. 24b. & 24c. He is my sponsor and the only sponsor, and I am the intending immigrant, our household size is 2. We are not going to use my income at all, so we just put "N/A" for questions 8 through 19 in part 6. Hi Kseniya! I have a question, I got an email from NVC saying that I need to add my husband as a Household member of Me, as a correction on his I-864a how do I do that? I’m the sponsor and I’m counting my husbands income fully since I’m not working, I’m applying for both of my parents green cards. They also asked me to fill out individual I-864a forms for each of my parents (we first only filled one for both) which I can now fix that cause I watched your video on how to fill the I-864a correctly.
But I don’t know exactly what “add your husband as your household family member” means because we already said that he was my spouse and a household member counted on my family size.

That’s what we did. Also me and my husband fill taxes together so I uploaded the exact same document under both of our names for i864 and i864a

1-Are they referring to the total income in my tax return for the year of 2023 or my expected income for this year (2024)?

If you filed jointly with your spouse even if you made 0 income it’s still considered as filed taxes.

The total income line does NOT include income such as the tax-free part of social security pension. In many cases this is the entire amount and can be the majority of income so that without this amount the income will be insufficient. Does this amount get counted so that I don't have to include all my assets?

I am filing I-864 and my husband is filling I-864A so that I can use his income. My question is, for the I-864 in Part 6, #24a- 24c (re: My total income as reported on my Federal Income Tax returns for the most recent three years), can I include the total income on our tax returns though technically it is only my husband who earned this? Asking this because from what I understand, since we file jointly, the total income on the tax return is also considered my total income even if I did not work because we filed jointly, hence I can write it on Part 6, #24a-c. Hello Kseniya, this question is in regards. to what you said about filling form I-864a, you said that what we put in the tax returns for previous years must match what the sponsor puts on his 3 most recent years tax returns, but we just got married and it is the first time we are filling together so we only have one joint tax return and I have my own separate income from past years. as i am filling the form I-864a should I put our joint income from the most recent year and just put my own income for the past years even if it does not match what his form (I-864) says?

You don’t have to include your income in the form but in the tax return section you must write it exactly as listed on taxes even if joint

I claim one and he claims one on taxes. So for household size would I just put myself, one child, and the immigrant? Total 3.
I make the required income for support.

The primary sponsor/joint sponsor must complete I-864. If you’re a joint sponsor for someone’s green card case, you answer 1d. Your spouse only signs I-864A

And most importantly is it true that I have to wait 6 months from the day I entered the u.s. in order to file these forms ?
I heard it is recommended to wait otherwise it will look suspicious for some reason

Can I resubmit by excluding spouse(without I-864A) as my income is 125% above poverty line? Also, can I make changes to remove assets(Part 7) to avoid confusion?
