- The I-864 form is the Affidavit of Support for the Green Card application. Errors on this form can lead to delays and possibly even rejections in your Green Card case. It is important that once understands the form before submitting it too USCIS. In this video, I discuss the most common errors that USCIS receives in the I-864 Form and how you can correct them

Thank you for the helpful video. I do however have a question. What do they mean by current annual income? My wife owns a business and whatever the adjusted gross amount is what she takes home, do I put the non adjusted income amount, or the amount once expenses are taken out such as employee pay, rent, ect?

Under Part 6 > #7, should the current Individual annual income amount be before taxes are taken out or after from the 1040 tax return form? Do you know which box that we use the amount from the form? Or is this the amount from our paystub that shows our YTD (year to date) income?

My question is when it comes to household sizes and the calculation, would you claim a dependent (eg. dependent on taxes) but DO NOT live with the joint sponsor, would it still count as 4? For example, joint sponsor the husband, his wife, the supported immigrant and one more person, but the last two do not live with them.. would the household be 3 or 4? Thanks:))

Aloha! I jsut have a question. The new rule with the I-485, that you need to fill up I-944 and I-864. How do you do your I-864 if you are the intending immigrant. How do you fill I-864 if you are the intending immigrant, since they require you to submit.

However, I am filling as a joint sponsor for my cousin. Do I enter the same information under part 3? Also, I had sponsored my wife recently and I file married jointly for our income tax each year. Does this mean she becomes a sponsor as well even though she doesn't have any income? Is she required to fill out an i864a or is my sponsorship enough? And under part 5, should I check box 6 if box 3 is already checked?

Hi, good info thank you. Question: WHEN do I file this petition, I’m having a hard time with the timeline. I submitted the petition for my parents in February.. its still says “in process”. It’s been 8 months. Will they send me a notice when I should file the Affidavit of support or should I already do it. I read someone even said it should have been filed along with the petition.. Abhisha, thank you so much for posting such a detailed videos. I appreciate your time and knowledge sharing. I was green card hold when I filed I-130 and I-130a for my spouse. I became US citizen when my petition for I-130 got approved (I was able to let USCIS know about my status change). I-130 approval took more than 2 years due to COVID. First question: I am now double minded whether my 2 kids are approved or not with I-130 petition for my spouse alien relatives (I have 3 years of daughter and 1 year old son) I did provide all the birth certification documentations as supporting document with I-130 petition. My second question is do I have to file I-864 and include my children in one affidavit of support as I was green card holder when I filed the petition or I have to file separate I-864 for both child including spouse (total 3 I-864 forms?) because I am now US citizen. One again thank you for your help and I hope I will get response too.
Hello, Abhisha. When applying for a adjustment of status, the co-sponsor provided only form 1040 for 2018 without supporting documents. I received a request from USCIS for additional evidence. I have a question whether it is necessary to provide supporting documents for 2018 tax return or also a new form 1040 for 2019, which was filed to the IRS after applying for adjustment of status with an updated form I-864? If you are using the intending immigrant as a household member because you are married and file taxes jointly do they also need to file l-864 along with I-864A? If so what box do they select in the first section?

Form I-134 is only for non-immigrant visas. I-864 is for Green Card petitions.

Hi, I had completed the entire form I 864 and submitted it. The response I received yesterday was that there were pages missing and that even if it is blank it should still be submitted which I did. But I went back to check, the form was 10 pages and I submitted 10 pages. Is there anyway you know what may have happened? They didn’t explain anything else but that pages were missing.

1/ I just open my business starting January this year of 2021. How can I calculate my current individual income? Part 6 -7.
Do I need to make the Profit and Loss statement based on the Bank statement to determine the current anticipated income for this year.
2/ If my current individual income does not meet the 125% poverty guidelines. Can I use my current property to meet this income requirement? This property is my primary living and the only one I have.

Thank you very for a nice video, my question , my income for the previous year is 54,152 which is above the poverty line for my family size, this year my income will reduce to 50,125 which is also above the poverty line for my family size, do i still need to add a letter from my employer to support the change?

One last question, under part 5, if the total number (house hold size) is 4 and I'm filling as a joint sponsor with an AGI of $42,500, will that be enough or should I wait to submit 2020 tax return with higher AGI?
So I have got a question in part 3 section I applied for my wife ,2 kids and 3 siblings. wife, 2 kids and 2 siblings case has been approved since im a citizen of USA I have to file separately for wife and kids . Hi, I hope you are well. I have submitted all my forms and documents. However, I received a letter request for initial evidence because USCIS is unable to tell whether my sponsor is qualified. I only submitted one form I-864 with my packet that had our friend information and tax documents, our friend has filed taxes for two years only but she meets the income requirement to sponsor. My wife does not have a full time job as she is interning nor does she meet the income requirement, we are recent graduates (2018). Does my wife also has to file the form I-864 and add our friend as a joint sponsor? This is the only thing, I am struggling with. What steps should I take? If the USCIS Center is processing the paperwork in 10.5 Months (Vermont) You have submitted the 130 Form On June 8, 2022, and you have a case number when will they ask to submit the Affidavit of Support? I got a message from USCIS on July 25, 2022, that they are now processing my paperwork and said they have not asked for any other paperwork so far. Will they ask in 4, 5, or 6 months? Or more? How months in advance will they set the interview date to give the person time to get the Heath Check? 2 months?

The instructions clearly say to put Total Income, Not adjusted gross income unless you are using form 1040EZ.

Hi nvc just rejected our i-864 affidavit of support without clear explanation but they said that the form is expired? I made sure that all was correct and the sponsor i-864a form was accepted but the i-864 is rejected im so confused

Omg! This is such a big help and so complete! I had to ask for my mom who is retired and lives with me as my household sponsor. I didnt know we can combine income and of course add her as a household and I DID NOT know that its only x3 for spouse for the asset. I thought it was x5 for everything.
