    One question on 864 and 864a; the questions that have the most recent (3 years) total income. This should have the joint income (sponsor + household member income), is it not?

      Questions 24a-c ask for total income as written on the total income line on federal tax returns. I believe it’s line 9

    Hi Kseniya, thank you for your videos, they are really helpful. I filled out a Form I864A for my parents' claim and this document was not accepted. I have reviewed the document several times and I can't find what the problem is. This is the message that the NVC sends me: Not Submitted Under Household Member's Name - We are unable to accept these documents as uploaded. Please add YOANDRA as a Household Member under MARIO. All documents for YOANDRA should be submitted under their own name.

    Hi, I love your videos and its helping me through this process of applying for Adjustment of Status through marriage based greencard.
    My wife’s last year income isn’t enough to sponsor me so we got her Dad to be the joint sponsor. My lawyer wants my mother-in-law to fill up the i864A. Does it make sense for my mother-in-law to fill up the I864A when me and my wife live together and not with her parents.

      yes it's a normal practice for a lot of lawyers. especially if they file taxes jointly. your MIL is your FIL's household member, not yours.

    You’re real life experience is great. I am filing 1-130+A, my wife and I were virtually married. 9 Oct 2021. I traveled to her home Feb 24th 2022 so the marriage has been consummated. Which is required under what they call a proxy marriage.
    Do you have experience with this? After paying quite a sum of money to a real recognized visa assistance company they were informed by USCIS that they were no longer allowed to process virtual marriages I don’t know if they did something wrong I assume they did anyhow my money is supposed to be refunded according to their text to me. You can imagine what this news was to My wife and I who have worked with them over 15 months felt like. I really like doing it myself. My daughter-in-law and immigrant from the Philippines suggested we do it ourselves she can help me and I want him to follow everything that you have and I’ve been watching your program and I feel more comfortable with your information. That’s why I sent you a little something this morning I’m not trying to buy your support of what I’m trying to do I’m just trying to say I really appreciate it let me know if you have some body that you’ve had to assist in this thank you, have a great day.

I do have a question for my specific case, my husband (petitioner) is filing for AOS for me (principal immigrant), he doesn’t make enough income so his mother is going to help. She doesn’t live with us but she includes my husband as a dependent in her taxes. Should she fill out form I864 as a joint sponsor or 864A as household member?

    Hi - thanks so much for your videos! I'm a USC is sponsoring their spouse and we both live with my parent and sister - I was wanting to know if the household size needs to be all four of us or just 3? I will need to use my parent's income as a household member and my parent has my sister on their tax return as a dependent.

    If you are completing Form I-864A, which is used to supplement an Affidavit of Support (Form I-864), and you have filed your tax returns in different ways (3rd most recent jointly and 2nd and 1st most recent separately), what should you do?

    Hi Kseniya, thanks so much for all the videos you have been sharing. I filled out the form I864A. I got this message from NVC last week, I don't understand it. I need your help. This is the message I found in my inbox. " Please add Mr X as a household member under Mr Y. all documents for Mr X should be submitted under their own name."

      It means you have to create a household member on your CEAC portal and upload those documents there.

    hi!I filled out the I-864A for my husband as the other sponsor but i got a message saying that my documents is invalid because it wasnt submitted under household members.I'm not sure how was it because I believed i wrote my husband's name in part 1 so how did it went wrong.which part has the correction?Please help me and thank you for this video.

      Here I got the same message. I filled up the I 864 with household info & added the household member on the sponsor’s I 864 page 4 part 6 person 1 section. I still got the same message asking to that person as a household member under the sponsor. Very confused. Please help

    Hey Kseniya, so my wife is sponsoring me and she does not have enough annual income. I am currently on my F1- stem opt and work here in USA. Can i add my income in order to fullfill requirement? Also according to the video i dont need to fill out i864A right? As i am little confused as it says you need to be US citizen and you cannot sponsor yourself things like that on USCIS website.

    Hi Ksenia, thank you very much for your video. I got confused about my situation. I am an intended immigrant a wifw of usa citizen. Me, my husband and his parents live in the same residence. My husband do not have enough income to sponsor me so his parents agreed to co-sponsor me. The house is the property of his parents. Noone is a dependent or have dependents. Our expenses are separate. So we are 2 households under the same roof .Is it possible to combine me, my husband as a sponsor and parents as house hold members,and fill l 864 for husband, and 2 i864a for his parents, or make one of the parents as a joint sponsor and fill I864 for my husband, second I864 for one of his parents and and fill i864a for a second parent as a house hold member? The parents file taxes jointly, meanwhile my husband file separately irrelevant they all live at the same residence.Many thanks for your opinion

NVC asked me to add my spouse (intending immigrant) as a HHM and asking file I-864A under her name. But in this vide you mentioned that (part 2, 1a) if my spouse is intending immigrant then we do not need file that form. What need to do then, filing or not and if not what form or supporting letter we need to send or respond for them I-864A request. Thank you. Best regards, Elchin

      You don’t have to count them if one of the following conditions is met:
      Your sisters are US citizens, they have earned 40 quarters of SSA coverage, or they’re not longer permanent residents.

    Thank you for your nice and informative explanation. I have a question about the police certification. My immigrant document is qualified on October 18, 2022. When I checked my ceac account it says the police certificate missing. I submitted the police certificate in march 2021. I don't know why they are asking again. My question is the line for interviews is too long in my county /Ethiopia/. May I wait until the interview letter send? Or to send the new police certification again. Because the police certificate expired each year. If they are not scheduled the interview again I have to submit the police certification a third time. I need your advice, please.

    I am the primary petitioner to my spouse. (i have filled the i-864)
    However we need a joint sponsor. (who has already filled the i-864)
    And this joint sponsor has a spouse who will also be combining income
    You said that if the joint sponsor has a spouse who will also be using their income than that spouse has to fill out the I-864A correct?

    So, my joint sponsor has (who is my aunt) has to fill out I-864A in addition to I-864?
    For context: My husband, U.S. citizen is the primary petitioner but does not make enough income. My aunt lives in another state but is my joint sponsor.

Iam however still uncertain as to the real diference between the i864 and the 1864a. filing for my spouce for a while now and recently was told by nvc that my income isnt enough to petition for my spouce so i need have a joint sponsor fill out i864 but based on the mention of form A in your videoI am wondering if i864a must also be completedby joint sponsor despoite the request of 1864b specifically metioned to be completed. in shoerter term: when do i need to get the form 1864a if any at all? awaiting speeedy clarity. time is of the essence

I would like to know that if my peritioner files her tax through married filing jointly(with her husband)but only her income meets the requirements(her income is enough to sponsor us), does her husband need to fill out i-864a because of tax jointly? If yes, does he need to provide his tax documents and financial evidences?

      @@KseniyaInternational Thank you so much! I watched the video about married filing jointly. As fas as I understand, if we file taxes jointly, we have two options
      1. use combine income(petitioner and her spouse) or
      2. individual income(only petitioner) when the petitioner income is enough.
      So, if we choose option 1, we will need i864a.
      If we choose option 2, we won't need any i864a. Right?
      For option 2, we will have to calculate only petitioner's income from total income in taxes transcript. Right?
      Please correct me if I am wrong. I would like you to confirm my understanding cuz we are gonna upload i864 and not sure to file i864a or not. Thanks in advance.

      @@allisonlynn43 you’re almost right. For the total taxes information in Q 24a-c you still have to write joint income as listed on tax returns. Must include W2

Since the immigrant (my wife) is only related by marriage and we have yet to live with them, would they be a joint sponsor or a household member?

    Hi! We have applied for a Green card for my parents through my sister. She currently (2023) doesn't have any income so, I (her brother) became a joint sponsor, but at the same time, she is filing a tax return as married file joint, so, I guess, by default she is using her husband's income as well. Long story short, I became a joint sponsor and her husband became a household member so we have submitted both I864 and I864a. However, nvc has accepted everything and just rejected the I864a without any explanation. My question is, can a case has two different type of sponsors? Like what my sister did? a Joint sposer and a household member? Thanks for the help

    I have a question. How to add a household member if the primary sponsor and the household member have the same name and last name? It will not let me add the household member, it says that a problem occured as i can not add 'the same person'. But it is not the same person! In this case, can I add the household member's documents under the primary sponsor's documents in the 'additional documents' section, explaining the situation?

    Thank you. I am a Household member and employed in the United States with 40 social security credits. I am intending immigrant and also parent of the sponsor/petitioner, living in the same residence as the petitioner. petitioner is a student and unemployed. What form should I or petitioner fill out for affidavit of support, I-864/I-864A/I-864W? Also what form should I or petitioner fill out for my spouse (homemaker and unemployed) who is also parent of the petitioner and intending immigrant.

    Hello Kseniya, Thank you so much for all of the videos and information it’s helped me a lot. But I have a question I’m totally confused about. I’m currently a full-time student with no income but I have to file affidavit support for my spouse. my question is can I add my dad's income as a household member and file I 864A? Also, my uncle will help me with a joint sponsor so he needs to file for I-864 right? Another thing is do I need to add all my household members ( mom and brother) they don't have income and they are dependent on my dad. It might be great if you can explain it to me.       Hello, household members are used to supplement petitioner’s income while joint sponsors are used to completely replace petitioner’s income. If petitioner uses a joint sponsor, then petitioner’s income becomes completely irrelevant and it makes no sense to add household members in that case. Petitioner still must fill out I-864 regardless.

If I may I’d like to ask one more thing, would it still be okay if I add household member income in I-864? It’s not an issue, right? even though i have a joint sponsor.       @@shefar1171 hello, it makes no sense to include an additional form from the household member for review of their income will not be considered (because it would be combined with the petitioner).

    In section 4 numbers 2a thru c, is that income of spouse of sponsor or total household income which includes both sponsor and spouse household income?

    So the signature in part 5 wouldn't be Jane Doe the spouse but John Doe the Co-Sponsor right ?

    Hi Keseniya! I'm still pretty confused as to whether I must file the I-864A or not. My husband is petitioning for me (the intending immigrant) to get my green card. Unfortunately, he does not exceed the poverty guidelines by a hair, so I'd like to use my income to satisfy the financial requirement. So, must I submit a I-864A along with his I-864? For context, we recently filed our taxes jointly, I'm legally working in the US (I'm a DACA recipient), and he's petitioning for me only (I have no dependents). Please help!

    My question is I have sponsored my sister and her family this year 2022 is f15 yrs I got a message starting refill the I-864 from and submitted 2018 tax return transcript. Do I use 2021 tax return info on the form?

    I am a US citizen, sponsoring my wife (living abroad) but I do not have enough income. My friend will be helping us.
    Q1) I am filling I-864, correct?
    Q2) He is filling I-864 and I-864A, correct?
    Q3) I and my friend are joint sponsors, correct? My friend is married and files taxes jointly with his wife. Does his wife need to fill anything?

    What if the sponsor is not a household member, he is a friend of the petitioner? Do we keep the same form I-864 a? But how do we answer the questions about the relationship, and where do we include, he's information if the I -864 a is only about the household members?

One thing I'm still confused about is in my situation my wife and I will live with our sponsor but are currently living outside of the U.S. since our finanical sponsor will technically become a household member but currently is not, does the sponsor complete I-864 or I-864A?

    My brother-in-law is an American citizen and applying for my sister.( married for 20 years and living outside of the US). He is retired and I have to be my sister's sponsor. Do I have to fill out I846 or I-847A? I live in the US and they live outside of the US and we do not live together. Please advise.     I filed for my parents. Their paperwork is at NVC. I am aware that I need to do two separate DS-260 and two separate I-864.
    For my 2021 tax return I fall below and did not make enough 2022 and 2023 is above the poverty line.
    I live with my boyfriend and I am aware that I need to do an additional affidavit of support. Will my boyfriend be considered part of my household and do I need to fill out the form I-864A for him or do I include him on my I-864? Please help?

    Hi it’s me again, I’m a US citizen and my mom is applying for her green card through me. My question is do I need to be her sponsor? Or per exemple a friend of her can be her sponsor?
    I do not have a full time job( I only have a job for 6 month a year) but my husband has a full time job. Can the both of us be her sponsor?

      You still must fill out I-864 even if you are using a co-sponsor

    However, right now upon watching this video, I was just confused. our situation is..
    what if the household member TAX FILLING is under a "MARRIED FILLING JOINTLY" STATUS,
    we are filling my mother-in-law as a household member, her w2's is $29,000
    but the Adjusted Gross Income is $46,000 ... because their tax filling is combined with her father as well. They are JOINT TAX FILLING
    so how should we file our RFE RESPONSE?.
    I really need your help

      This is what I’ve seen in some fb groups: They may submit their AOS as a joint sponsor and have the spouse sign I-864A as now their household member.

      Now we received an RFE stating
      The Petitioner income doesn’t meet the 125% poverty guidelines
      Now, we want to use my mother-in-law as the Household Member.
      But here’s our Problem.
      My In-laws tax are under Married Filling Tax. My Mother-in-law & Father-in-law taxes are combined.
      Now we don’t know how we will complete our Response. I really hope you could help us what to do. 😔

My husband (principal immigrant) does not meet the minimum income requirements to support me (spouse beneficiary) and his mom who’s living in the same address will be the household member who will combine their income. Does his mom also needs to fill out a separate I-864? or just the I-864A? Thank you so much I hope I will get a response soon.

    I can't seem to find the answerr to this question...Do I have to put my 15 month old son & 4 year old daughter on the I-864 form if they already have a US Passport, US Birth certificate, US social security cards and collect SSI because of my age, 69. I do put them on my taxes only as my dependents but not there income, not allowed.

      You have to count them in the household size

      I understand that but do I have to include there income when it can't be claim on taxes? It's used for them and puts the total household income where it should be as far as requirements
