Hello @KseniyaInternational one who has a qualifying tax transcript (above poverty guidelines) for year 2022 but for year 2021 and 2020 they didn’t make enough are they able to sponsor their family without needing a joint sponsor ?
I went to an immigration attorney when I was confused about the affidavit of support and they said they couldn't even give me advice and recommended that I start the whole process over with them. In our case, the third most recent year does not meet that cause my husband started working on September of that same year.
From the form, you only are required to give them one year of taxes. Typically this is the most recent year. I submitted mine for 2021 because 2020 was Covid.

We just received an RFE my husband only submitted W2 and they have requested IRS transcripts. We are now submitting that plus pay stubs and letter for employer. THE STRESS 😩
Same here!! We submitted the paystubs, and W2 for the first turn. And they asked for COMPLETE IRS tax return, which we believe it's form 1040. Did you resubmit it already? We filed i-864ez the first time and they said we're not qualified to use i-864ez which is totally confusing because we believe we are.
@@almeralicehe6169 yes they want the complete IRS transcript so we submitted the last 3 years which was optional. They received our transcripts April 22nd and so far we have not heard anything back so praying that’s a good sign. Our update said documents received and processing will commence again. Hi Kseniya, I just received an RFE for i864, and it was because " we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support is qualified". We believe that the reason could be one of two, as my wife's (the petitioner's) salary was definitely above the 125% guideline: 1. USCIS received the case in Jan 2023. We only reported tax transcripts for 2021, as she still needs to file 2022 taxes (they just opened the tax season 3 days ago). 2. I checked the documents page of my USCIS account and noticed that they did not scan any of the IRS transcripts I sent. Could it be that the officer viewed only the scanned documents and not what was sent and made a decision accordingly?

Last 2021 he got his job started last june and end up his tax of 21,768 for 2021. Can i re submit his 2021 i-864 even with a little difference for the minimum income of 21,775 . So my husband is my sponsor and he is self- employed he makes more than the guidelines but he just have the last year tax return which made me think that I should put also a household joint sponsor because we are currently living in his parent's house, I got the RFE to be honest I don't know why got it, his dad files taxes with his mom but I didn't put anything about her, I put all his W2 for the past 3 years. With my husband I put the taxes and all the bank statements from his personal and his LLC account and IRS letter certifying that he had the money plus and accountants letter to say that basically he is making enough. I'm so confused about that RFE and now I'm not sure what to do.

Hey I submitted my green card package and got my biometric within a week and everything seem to be good then today I got a RFE for joint sponsor with my name listed upon checking form I-864 I realize I made a error by putting my name where my wife name should it’s Page 3 Part 4 Sponsor information ( Full Name ) so they probably read the form Think1 am a sponsor now am not sure what to do. I just got the RFE and I am quite confused in what to do next . My husband who is my sponsor is in disability status right now for a work accident but he is currently recibing payments at to the poverty guideline .He isn't working so He hasn't file any taxes for the las 3 years . However, we just got an RFE request for tax return for “the most recent year”. Do you think that’s because we only submitted tax return for 2021, not 2020 and 2019? Our income for both 2020 and 2019 didn’t hit the poverty guidelines, but it’s way above the guidelines by 2 times in 2021. No you must have missed something else. Recheck everything that they ask for in the RFE letter and send it all again. Is the sponsor self employed? Did you use the total income line on tax returns? Did you send W2?

@@chingchingma1252 I would just resubmit a regular I-864 form with the evidence again. Double check that all the boxes are checked correctly in part 6. And that the household size is calculated correctly

Photos are just one piece of bonafide marriage evidence. If you’ve included plenty of other evidence, you’ll probably be fine. You can bring them to the interview.

Hello! Is my income as the principal immigrant and household member as "weighty" as a potential joint sponsor's who is a US citizen? Technically, I understand it is, but I wonder if anyone knows if, in reality, it has the same weight for my application or if we should try to get a US citizen joint sponsor. Another question, if my income is as valid and we file together, totaling $40k, we would be very much over the $25k requirement for a 2-person household. Hi Kseniya! I’ve heard people saying that IF we add W2 and/or 1040 IN ADDITION TO THE IRS TRANSCRIPTS we can get an RFE because it’s too much. Is that true? Is it safe to send exclusively the 3 last IRS transcripts? The affidavit instructions say “Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless”. What if you changed your name but did change your name on your SSN card yet, and your W-2s and pay stubs still have your old name on them? I have the name change document , will uploading that solve the problem?
Hi , we have the problem because my spouse is self employed he does makes enough income but in his tax return it is a negative income. So the first time we didn't include any assets because we thought its not necessary now we got he RFE and we have enough assets to cover the income, but we don't know if we just load up the assets or do we have to submit the form i864 again with the tax returns ? if somebody could respond this
We got an RFE for I-485 asking us to resubmit the form. The RFE said pages were "missing." Wondering if we can resubmit this form online using the RFE response button--or if we have to mail it in again. Note, I-485 requires passport photos. We can submit digitally but wondering if that is ok to do. Would prefer not to have to print and mail hundres of pages of documents again if possible. Welcome any guidance!
@@ri8686 We got conditional approval this week. We chose to respond to the RFE via USPS mail rather than online because we had way too many documents than what was allowed to be uploaded online in response to an RFE (a maximum of five). One thing. We used Adobe Acrobat Reader to fill out all the original forms, but when I actually printed them I just opened and printed with Chrome. By opening and printing in Chrome, for some reason with our printer it cut off both the bar code and form version information that normally occurs at the bottom of each page of all the forms we printed and mailed (or scanned and uploaded). We got RFEs to redo all the forms but with no explanation as to why. It appears that it was simply because--when using Chrome and my printer--it cut off that info at the bottom of each page of the form. So use Adobe Acrobat reader to fill out the forms and to print them--and double check the bottom of the forms to see version numbers and the bar codes. Make Adobe your default PDF software option. Accidentally using Chrome caused us huge stress and headaches. Hope this helps someone out there.

I received an RFE on I-864 even though my husband’s income/petioner is way above the guidelines that’s why we were surprised that the RFE mentioned that it is not enough and we need a joint sponsor. is the RFE more like a template and automatically asks for a joint sponsor? As i watched your videos i think our error was in filing the form because of the glitches in the number of household and the current income figure.. in this case we intend to correct the form and add some more evidence like the bank statement and the employee certificate of my husband.. in this case as requested on the RFE, do we really need to provide a joint sponsor or we just need to correct my husband’s filing of the form? Thanks in advance for your response.
My letter said the same so we were super confused. I believe it’s a template letter, the first part is all about sponsor - which we also did not need. If you look further down the 2nd page it says exactly what they are requesting from you. Ours was (my husband full name) then requesting official IRS Transcripts. Hope this helps!

@@elmsjourney yes so this time we submitted the transcripts for 3 years, letter from employer, last 3 pay stubs and resubmitted the W2s. They did not ask for all these things but I rather send more than they ask. I did my biometrics yesterday. This is what my current case status is as of today “As of May 4, 2022, we are actively reviewing your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number …………. Our records show nothing is outstanding at this time.” This we are fine now. All the best to you! Feel free to ask if you need further advice!

Great videos and thanks for providing them. Just to be clear, I can use the intending immigrant's income for purposes of federal pov guildelines on i-864 if she is my spouse, I am the sponsor and we filed our taxes jointly?
You can, however the instructions say: "Can the Intending Immigrant Help Me Meet the Income Requirements? If certain conditions are met, an intending immigrant’s income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or she obtains lawful permanent resident status. If the intending immigrant is another relative, there are two requirements: 1. The income must be continuing from the same source after he or she obtains lawful permanent resident status; and 2. The intending immigrant must currently live with you in your residence. Evidence must be provided to support both requirements, however, an intending immigrant whose income is being used to meet the income requirement does not need to complete Form I-864A, Contract Between Sponsor and Household Member, unless the intending immigrant has a spouse and/or children immigrating with him or her. In this instance, the contract relates to support for the spouse and/or children."

Can i re submit his 2021 i-864 even with a little difference for the minimum income of 21,775 .

No it is more advisable to file it all at once… I130, i485, i765, I864, i131 .. and also medical and supporting evidence

So my husband is my sponsor and he is self- employed he makes more than the guidelines but he just have the last year tax return which made me think that I should put also a household joint sponsor because we are currently living in his parent's house, I got the RFE to be honest I don't know why got it, his dad files taxes with his mom but I didn't put anything about her, I put all his W2 for the past 3 years. With my husband I put the taxes and all the bank statements from his personal and his LLC account and IRS letter certifying that he had the money plus and accountants letter to say that basically he is making enough. You have to follow the instructions they gave you in the RFE letter. If they do not request joint sponsor's info, then you don't have to send it again

The I-864 is only needed for intending immigrants. Anyone who is a citizen does not need an affidavit of support.

I just got the RFE and I am quite confused in what to do next . My husband who is my sponsor is in disability status right now for a work accident but he is currently recibing payments at to the poverty guideline .He isn't working so He hasn't file any taxes for the las 3 years . I summit paystubs, a letter for the company that gives him the money and a letter for the lawyer who manage his case notifying that my husband gets that amount monthly. Hi Kseniya, we have submitted my husband’s 2021 tax return, 2021 tax transcript, paystubs for the most recent six months, some evidence of monthly and annual revenue. However, we just got an RFE request for tax return for “the most recent year”. Do you think that’s because we only submitted tax return for 2021, not 2020 and 2019? Our income for both 2020 and 2019 didn’t hit the poverty guidelines, but it’s way above the guidelines by 2 times in 2021. Should we resubmit everything for 2021 or is it better to submit all three years? Thank you again for everything you made on this channel! No you must have missed something else. Recheck everything that they ask for in the RFE letter and send it all again.

Did you use the total income line on tax returns?

□Completed and signed form I-864EZ
□ Copy of petitioner’s most recent (2021) tax returns, tax transcript and W2s
□ Copy of petitioner’s paystubs from the most recent 6 months
□ Document from petitioner’s employer stating current pay rate and annual salary
□ Copy of petitioner’s proof of status (birth certificate)

@@chingchingma1252 I would just resubmit a regular I-864 form with the evidence again. Double check that all the boxes are checked correctly in part 6. And that the household size is calculated correctly

Photos are just one piece of bonafide marriage evidence. If you’ve included plenty of other evidence, you’ll probably be fine. You can bring them to the interview.

Hello! Is my income as the principal immigrant and household member as "weighty" as a potential joint sponsor's who is a US citizen? Technically, I understand it is, but I wonder if anyone knows if, in reality, it has the same weight for my application or if we should try to get a US citizen joint sponsor.
Another question, if my income is as valid and we file together, totaling $40k, we would be very much over the $25k requirement for a 2-person household. Would it hurt my application if we included, also, our liquid assets? Would it make any difference?

Hi Kseniya! I’ve heard people saying that IF we add W2 and/or 1040 IN ADDITION TO THE IRS TRANSCRIPTS we can get an RFE because it’s too much. Is that true? Is it safe to send exclusively the 3 last IRS transcripts?
The affidavit instructions say “Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless”.

Never heard of that. USCIS never states that is the reason for RFEs. Incomplete information and insufficient income are the most frequent reasons.

So the first time we didn't include any assets because we thought its not necessary now we got he RFE and we have enough assets to cover the income, but we don't know if we just load up the assets or do we have to submit the form i864 again with the tax returns ? if somebody could respond this

Hi Kseniya, how does one submit workers comp income on the i864 since they aren't reported on tax returns.
Workers compensation can be used as income, but you need to provide documentary proof of it.

We got an RFE for I-485 asking us to resubmit the form. The RFE said pages were "missing." Wondering if we can resubmit this form online using the RFE response button--or if we have to mail it in again. Note, I-485 requires passport photos. We can submit digitally but wondering if that is ok to do. Would prefer not to have to print and mail hundres of pages of documents again if possible. Welcome any guidance!

@@ri8686 We got conditional approval this week. We chose to respond to the RFE via USPS mail rather than online because we had way too many documents than what was allowed to be uploaded online in response to an RFE (a maximum of five).
One thing. We used Adobe Acrobat Reader to fill out all the original forms, but when I actually printed them I just opened and printed with Chrome. By opening and printing in Chrome, for some reason with our printer it cut off both the bar code and form version information that normally occurs at the bottom of each page of all the forms we printed and mailed (or scanned and uploaded). We got RFEs to redo all the forms but with no explanation as to why. It appears that it was simply because--when using Chrome and my printer--it cut off that info at the bottom of each page of the form. So use Adobe Acrobat reader to fill out the forms and to print them--and double check the bottom of the forms to see version numbers and the bar codes. Make Adobe your default PDF software option. Accidentally using Chrome caused us huge stress and headaches. Hope this helps someone out there.

I received an RFE on I-864 even though my husband’s income/petioner is way above the guidelines that’s why we were surprised that the RFE mentioned that it is not enough and we need a joint sponsor. is the RFE more like a template and automatically asks for a joint sponsor? As i watched your videos i think our error was in filing the form because of the glitches in the number of household and the current income figure.. in this case we intend to correct the form and add some more evidence like the bank statement and the employee certificate of my husband.. in this case as requested on the RFE, do we really need to provide a joint sponsor or we just need to correct my husband’s filing of the form? Thanks in advance for your response.
My letter said the same so we were super confused. I believe it’s a template letter, the first part is all about sponsor - which we also did not need. If you look further down the 2nd page it says exactly what they are requesting from you. Ours was (my husband full name) then requesting official IRS Transcripts.

@@elmsjourney yes so this time we submitted the transcripts for 3 years, letter from employer, last 3 pay stubs and resubmitted the W2s. They did not ask for all these things but I rather send more than they ask. I did my biometrics yesterday.
This is what my current case status is as of today
“As of May 4, 2022, we are actively reviewing your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number …………. Our records show nothing is outstanding at this time.”

You can, however the instructions say: "Can the Intending Immigrant Help Me Meet the Income Requirements? If certain conditions are met, an intending immigrant’s income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or
she obtains lawful permanent resident status. If the intending immigrant is another relative, there are two requirements:
1. The income must be continuing from the same source after he or she obtains lawful permanent resident status; and
2. The intending immigrant must currently live with you in your residence.
Evidence must be provided to support both requirements, however, an intending immigrant whose income is being used to meet the income requirement does not need to complete Form I-864A, Contract Between Sponsor and Household Member, unless the intending immigrant has a spouse and/or children immigrating with him or her. In this instance, the
contract relates to support for the spouse and/or children."
