The way you feel about FF9 is the way I feel about the OG western Fire Emblem for the GBA. I would do just about anything to make sure that game stays available and accessible, it's just a huge part of my childhood!
There's just one thing I don't understand, was coursebot levels deleted? Because my favorite levels usually are mine and if the servers went down I wouldn't really be harmed. Because at least ig user levels are reserved
Love the videos, i agree with u 100 percent. Bro I have been saying this since the switch came out, instead of virtual console we have bunch of crappy indie scam games on eshop and then Nintendo online service, wii u we still haven't got zelda wind waker and twilight princess and they could easily port those games and make a killing on switch, now 3ds is a huge disappointment, zelda ocarina of time and major majoras mask, fire emblem echoes, fates, awakening, pokemon sun and moon, zelda a link between worlds, I can go on and on with some truly crazy good games that we should be able to play on switch via virtual console, it's literally insane nintendo won't re sell these amazing games, luckily I bought a new 3ds xl and modded it so I have all the games I could ever want and retro games however I'd gladly rebuy all those games on switch if Nintendo would allow us to buy and play them, the 3ds and DS saved Nintendo from going bankrupt due to poor wii u sales and almost all the wii u games got switch ports besides zelda which is insane, but none of the 3ds and ds, which literally have some of the best Nintendo games ever made and saved nintendos company, its the craziest dumbest thing ever a 12 year old could run the company better. I really don't get Nintendo, do they not wanna make money and save these great games and make them playable on modern consoles? Ppl hate on xbox but they actually listen to gamers and have an incredible reverse compatability feature on xbox where u can play almost any xbox game ever made on the latest xbox and when u buy digital that games stays on your account why Nintendo doesn't do this is beyond stupid as well but even then at least sell the games but we can't even do that smh
Fortunately they have DMCA exemptions which do protect them. The problem though is that they can expire and if the library of congress dose not renew their exemption then well... lets just say the Internet archive would not exist anymore.
@@ProjectionProjects2.7182 What about an edge case where a given ip isn't protected by the archive but isn't owned by the creator, legally means it's freeware right, yet noone with the money to own 'the rights' will let that happen. It's frankly stupid legal design, then again can't say I'm surprised they're burying legacy and grandfather protocols so they can continue to exploit the recurring price tags.
Actually they can't sue the Internet Archive because the copyright laws only works if you sell copies of the main product but since there is no copied products being sold Nintendo can't do anything. Just like renting games where games are being borrowed for a few day fee.
Not to mention that, Nintendo also took down the scans for 1996 Super Mario 64 strategy guide in the Internet Archive, too. It was uploaded in 2022. It's why Nintendo isn't your friend.

If I had my way, all online capable games with user-generated content that's uploaded to servers would be illegal to shut down without first providing a complete and fully functional offline export/backup function
My suggestion would be that there should be a company to hire individuals dedicated to preserving EVERYTHING internationally and nationally, undercover of course, to archive, preserve, and confiscate whatever we can get our hands on, regardless of copyright or piracy.
would be a good extension for Ross Scott's Stop Killing Games initiative, he had similar arguments, but it's such a hard fight to even have the "bare minimum" provisions passed
Nintendo: "We need to protect and preserve our property by destroying all attempts to preserve our property, also we want to be able to sell you the same thing again and again in the future; we currently don't have any plans of doing so but we want to have the option." And that's not even getting into the aggressive control measures that do nothing but inconvenience legitimate users like how they encrypt save data so that it only functions on one specific console or the myriad of more sinister speculations for why they don't allow you to own/play games from their past.

It's all for Profit. If it were legal, Nintendo would put a kill-switch in their games and consoles, forcing you into buying the newest systems and the newest games with no guarantee that you can ever play your old games again. They see their own library of older games as an active threat to their profit margins. Hell, a big reason for this hostility is Romhacking and Console Modding, which they have successfully criminalized in Japan. It's in the interest of their profits to make these things 100% illegal in the West as well, simply because they are places where Nintendo *doesn't* have control over the consumer. They want a "Disney Vault" of sorts, where they have complete control over what games are playable and for how long. And as soon as a game isn't profitable anymore, they would very much like to be able to lock that game back in the vault, where *nobody* has access to it anymore. You get to REMEMBER the old games, not PLAY them, at least until they decide you're allowed to. Full Price, by the way, because there's no reason not to charge that much when they can un-release games.
That's a great comparison, @BlitzkriegOmega - I hadn't even thought about this from the perspective of the "Disney Vault" and how they rotate media in and out on a cycle to maximize profits. It's a shame that it hurts consumers / makes getting these things more difficult! Thank you very much for sharing your insights, I appreciate you as always!

The problem is, more and more companies are viewing it as: you are not BUYING anything. You are paying a rental fee for their product as long as they feel like allowing you to have it, and they can pull the rug out from under you at any time.

The sad thing is, Nintendo views their old catalog the same way they view illegal copies of their games: they represent lost sales for their new, expensive games. In their ideal world, every copy of every game released before the Switch would be deleted, and the only way to play Nintendo games is on the Switch.
Wich is why I don't buy anything from them anymore and I try to tell other people about Nintendo's scummy practices but they are just to stubborn to listen saying oh its thair ip or oh emulation is illegal that kind of thing
It says something that they’re so paranoid about their older titles possibly threatening sales of contemporary games….even Nintendo themselves realize they’ve lost something over the years.
@@therealjaystone2344 Seriously, even though now it is barely (I mean like 1 pixel away from not) worth the money, I honestly would rather just find a copy online than pay to emulate a game on a console I personally detest using.
Sony did a similar thing to the LittleBigPlanet servers but unlike Nintendo with super Mario maker, Sony just pulled the plug on the servers without warning to the community. We would have lost over 10 million community levels if the community didn't back them up
I hadn't heard about that @mallowcream; that's awful, and I hope the community was able to preserve as much of their creations and history as possible. Thank you for bringing attention to this issue, I appreciate you!
Media preservation comes from respect and love. Nintendo is part of our culture, after all. But Nintendo sees it as an attack and makes every effort to eradicate it. They provide no alternatives, no communication, no understanding; they just seek and destroy. As much as I love Nintendo, I have no regrets accessing them through alternative means.
As long as this ire is aimed specifically at the executives then it’s understandable. But if you’re aiming this at the developers then you’re going after the wrong group.
this just makes me think about sega's recent post about preserving sonic generations mods. Sure you may argue that their decision to delist the og generations was wrong, but to me, the fact that they even acknowledge their fanbase, they acknowledge the effort and talents that go into making community made content for their IP, and they encourage their fans to be creative and go wild with sonic just really makes them feel more down to earth and *human* if you ask me
I completely agree @His_Coconut_Gun - it's always good to see companies at least *acknowledging* these types of fan games and communities. I hope Nintendo is able to learn a thing or two from them! Thank you for sharing your knowledge and for checking out the video. You're the best!
You can still get the original sonic generations in different bundles with different sonic. It sucks that you have to buy more games to get the original, but at least it's an option for big fans
Dang, I loved Nintendo Power as a kid. I had no idea that Nintendo tried to remove it completely from the internet. What a bizarre way to treat a much beloved part of their history.
Nintendo Power Magazine is a certified gaming TREASURE! I hope it remains available for all to enjoy and peruse for many years. Thank you for being a friend, TB!
Copyright used to expire after 14 years. The idea was to give creators a temporary monopoly long enough to be compensated for their labor, but short enough for the works to fall into the public domain while they're still relevant enough to add value to society. We should go back to that, or maybe even shorten it to 10 years because the world moves so much faster now. Then old media could be easily preserved and used freely, both to enjoy it as-is and to spur all sorts of innovations.
Completely agree @ToyKeeper, it's a shame that so many fans and creators feel "locked out" from being able to celebrate these characters and series, without fear of getting a C&D, takedown, strike, etc... Thank you for sharing your knowledge, and likewise, I like your suggestion!

Coincidentally Nintendo announced they are opening a museum a day later from this video. Note: While a nice step and I think it is something Nintendo's Employees have put heart into it, does not invalidate this video with Nintendo still making it harder and harder to access their own history.

Still hurts to this day for me that Wii U and Gamecube were apparently failures second only to the Virtual Boy, when they are my two favorite consoles ever...
Much as I hate Ubisoft, I hate it even more how completely out of context that statement is being taken by every single idiot who quotes it. The full statement was "For a Netflix-like game streaming service to be profitable, gamers need to get used to not owning their games." - and that statement is 100% true. For Netflix to be profitable, customers have to be comfortable not owning movies.
@@Atlessa It doesn't make a difference on what was said or who stated it, because as long as they have the ability to remove any game you paid full price for from their service for any reason while not providing a refund, then the idea of subscription-based gaming is not worth defending for any reason in my eyes. So as far as I'm concerned, there's nothing out-of-context. At least with Netflix, you have the better deal of paying once a month to gain access to EVERYTHING in their lineup.
Many, especially companies, often forget about the Library of Alexandria. Of how it burned, and so much history was left to ash. What has been done by them and so many other companies is essentially just repeating history... or rather burning history in this constant cycle. I pray that one day, the cycle will be broken.

0:55 the time when nintendo deleted the code for super mario bros & had to illegally download an "illegal" rom they no longer "legally owned" to sell back in the virtual console for profit.🧐
If that's not karma, I don't know what is. I wonder if Nintendo could technically get sued for piracy bc of that. Probably not, but it would be REALLY funny.
Shit happens sometimes. I've heard Sega won't ever remake Shining Force 3 beause they also deleted its code. I'd personally be okay if Sega downloaded a rom for it though.
Yeah, Nintendo is always going after fan games, but the frustrating bit is that they don't stop the games while they are in development, they only go after the creator of these games after they have released their games and made them playable. I still remember one of my favorite fan games of all times was Super Mario Crossover, which was created on a website called explodingrabbits or something like that, and the thing that made that game great was that you could play as all sorts of other NES characters in the levels of the first Super Mario Bros, where my favorite character being Ryu Hayabusa from Ninja Gaiden, as you could just totally destroy the levels and wreck Bowser in all the -4 levels, and that game was very neat because not only did it have other characters from other NES games, but you could also use graphics from other systems, such as having sprites from GameBoy or even SNES versions of the Mario games, and it eventually even added sprites from like the Contra series and all the other games where the other characters came from, making it feel like the Mario levels had a different feel to them with those other sprites, but unfortunately Nintendo went after that guy and he had to stop development of his game, as he had been planning in adding in the Lost levels and a couple of other things to the games, but he was stopped from doing so. Fun fact about the development of Super Mario Crossover though, according to the creator in a few TH-cam videos as he was working on the game and such, the guy actually developed the game while he was homeless, as it was his only way of basically distracting himself throughout his whole depression and stuff, and through the encouragement of people in the ROMHACK community and stuff, is how he managed to bring the game into a state he was satisfied with so he could upload it online, and he also managed to get his life somewhat together in order to stop being homeless, but I don't know what happened to that person after Nintendo went after him. Its why I get frustrated with Nintendo, because they go after everybody claiming they are only protecting their IPs, but they just cause a lot of damage in their attempts to do that, which is why I can't blame the people that turn from being fans of Nintendo, into being their biggest haters because even I have gotten tired of Nintendo's BS, I just wish that they learned from Capcom or SEGA, who are more chill about fan creations and stuff, and actually encourage people to do better, such as how Capcom published on their official websites the fan game Mega Man X Street Fighter, or how SEGA actually hired Christian Whitehead the creator of a lot of Sonic fan games, so that he could work on Sonic Mania and stuff, which is arguably one of the best Sonic games made in the last decade.
"the frustrating bit is that they don't stop the games while they are in development, they only go after the creator of these games after they have released their games and made them playable" But is it really frustrating, or is it a blessing? Because this means that the game gets finished and is available to the public.
@@Atlessa It can be seen as a blessing but its also a curse, because once its online its like a hydra where if you cut off the source, then a lot more places will upload the games, but the creators can no longer get involved with their creations, or else Nintendo will sue them for every penny they have, and you also run the risk of getting a virus or malware if the other sources where the games get uploaded, gets their files modified for that.
Why they go after fan games when they release? Because that is the point, where it becomes questionable leagaly. You can make your own fangame for yourself, but as soon as you try to distribute it, you have reached the point, where you infringe on Nintendos copyright. Same goes for mods and roms.
I've recently watched a video that explained why is nintendo is so protective, it's linked to the creation of donkey kong : After the success of the first DK game, Universal attacked nintendo for copyright infringement for king kong, arguing that the plot was too similar. At the time, nintendo wasn't the giant they are now so if universal won nintendo would had probably not survivevide, they were saved because of copyright problems with the king kong movie script, basicly there was some disputes inside of universel on who owned the script, because of that the copyright wasn't renewed and had entered public domain. Nintendo won the case and learn a lesson, a terrifying lesson for a company: "no matter how big a company (you)is and how small the opponent is, one mistake can cost you everything". And so nintendo act in fear of that lesson, they flex there legal muscles so much because they're terrorized at the idea that a fan game, or fan anything for that matter, could be used as a never thought before legal loophole who would make them loose their rights to their IPs.
I may not be a lawyer, but I'm fairly certain that Nintendo has zero authority to block someone from publishing a book about their experience translating a game even if the act of translating the game wasn't legal.
Not being able to play MM1 levels anymore would be like if Sega somehow made it utterly impossible for me to play classic Sonic, feel bad for the kids that grew up with games that disappear.
100% agree Bean-I hope Nintendo realizes what they're doing to these communities and reflects on how they can do better 🙏 Thank you for checking out the video!
9:53 I'd argue it's apples and oranges IN FAVOR OF your argument. "If I can want to save that, imagine how many people would want to save this, how many tried."
Ngl, I tend to want to see a law that prevents a company from removing illegal roms from websites if they haven’t been selling the game for over 5 to 10 years. Companies can take it down again if they are selling the game again in a convenient fashion. But they can’t just constantly add games right before the deadline and immediately take them off without getting fined.
@@LG555 Sure. Even then, I still want them to actually sell the game. While NSO applies to my made up law, I would just rather companies go back to just selling their games than doing a subscription service. Besides, there are still a lot of games not on NSO anyways. And they are really slow with adding new titles.
Corporations are profit-driven enterprises. Frankly, I don't think they should be *_allowed_* to have a say in preservation. If it exists, it should be held onto. The decision to preserve it or not should not be the decision of a company that is beholden to soulless investors.
I *completely* agree @autofox1744 - I also think it's worth considering updating copyright laws since they were written so long ago and technology has changed so drastically. It's probably not a popular opinion, but worth talking about!
@@NotYourFriend-YT Hardly unpopular! I'd say we're well past due for an update; the DMCA was a band-aid, and is profoundly anti-consumer and in many ways anti-creator.

It's especially weird to me because Japanese culture is very much about unity and sticking together, yet Nintendo represents none of that in the way they treat their fanbase. Nintendo wouldn't exist without its fan, yet time and time again the company as a whole shows how little they care about their consumers and the history of their own games.
I think it’s less about unity and more about not “rocking the boat” with dissenting opinions, or ever questioning senior leaders…this is even more apparent in the Japanese corporate world, but your point is valid.

They delete history so they can sell you the same old games at full price, which they *know* you'll buy. Because you need to believe they're new games, otherwise, you're just stuck with nothing instead
And fun fact, a lot of the DNA of those places show up in those re-releases! So, they are doubly profiting off of the fans, through their wallets and the hard work preserving their games. NGL all of the ROM sites should come together and do a big strike against Nintendo
One thing I hate about this topic is that it feels like sony is trying to get rid of disc games as the PS5 slim has no disc support unless you want to buy the disc drive separately
That's a good point Pyro, thank you for spotlighting it! When I get around to talk about other companies (and Sony) I'll definitely do research on it. I appreciate you checking out the video, you're the best!
NGL, so long as they offer an external disc drive, I am fine with it, it makes the console more affordable, especially since new physical media has become pointless. Do you want to buy a game then wait several hours to install the disc and updates, or just get the digital and immediately download everything in 1 go?
@@JamesTDGsure digital games are easy to download but so much can go wrong in the future unlike physical games which you can take care off for years to come like what if a part of the console breaks and is unfixable boom all the digital games are lost but the disc games can just work on another working version of the same system
@@JamesTDG Pyro is right. You can either store a CD to preserve it, or better yet, scan it, and save it on a cloud. It'd be either really hard or even outright impossible to do that with digitally purchased games. Remember, that cool new game won't be new forever, and it exists so it's already part of history. If someone is able to help preserve history, they should.
I'd love to point out as well, with Nintendo Power: Despite being considered almost required for a lot of old NES game guides, Nintendo Power was exclusive to the USA. Anyone outside the US never even got the chance to read it officially in the first place, because it never shipped internationally. So seeing Nintendo continue to shut things down even as someone who has no legal choice at all is...definitely a mood.

Honestly, if they were as worried about backlash with Mario Maker as they were with Pokemon Bank, I'm sure they would have implemented a way to back these up.
I reckon SEGA is also planning something. They removed Sonic Adventure, Adventure 2 and Heroes from Vimms Lair, not Shadow the Hedgehog or Sonic Riders, so this makes me think that maybe, they're planning something as per Sonic Origins with these three. If so I can kinda understand their doing so, but Nintendo and others like Square Enix just did it because they can. (Square Enix forgot they haven't released anything except Final Fantasy VII, Final Fantasy VII or Final Fantasy VII in the last half decade so removing the other 1 - 6 and 8 - 12 seems odd.
2TB? They couldn't be bothered to come up with a way to preserve 2TB of files? I have two hard drives that size in my desktop plus a 1TB SSD. That easily could've been made available to be archived. But they would rather have it no longer exist than be unable to have exclusive possession of it. This is why I hate this whole "Gaming as a live service" model altogether. We can't let our most precious cultural works be in such a tight grip by corporations that just horde it and do nothing with it like Smaug sleeping on his stupid pile of gold. There needs to be a reasonable ability to hold and protect intellectual property, but too many things can be copyrighted too easily for too long and it's too easy to claim infringement.

4:55 "Players were given an incredible amount of control over how the mechanics worked"? Uhm, that's a stretch. What players were given were a bunch of modifiers like super size, wings, being put into blocks, blasters and pipes, but I'd argue that was not much "control over how the mechanics worked", just "control given how the mechanics worked". It was all fine-tuned as expected of our fine-tuned Nintendo. Nevertheless, the package was something more unique than just a Mario level editor. Every interaction had some light-headed voices, with a pitch matching the melody. And the objects themselves behaved in a goofy way. I'm speaking about that shake-to-modify verbs.
Sorry for the delay APM the Agent, and thank you for calling that out! 👏 I definitely didn't intend to imply that it was as deep as LunarMagic or anything like that, but I was personally surprised by the level of control players had in MM1 (I was expecting the bare minimum, tbh) Thank you for sharing your insights and checking out the video, I really appreciate you!
I wish there was some cheap two screened device with lower as touch screen so all we lot had An Device still well-suited to DS-esque titles and maybe even Wii U style maybe some? Imagine that. Imagine we still had a dual-screen system and it wasn't even tied to Nintendo.
I am one of the few fans with original hardware. Every year it gets harder and harder to find retro games in playable condition. ESPECIALLY GameCube titles. The discs are literally starting to rot! Others are becoming brittle and cracking. *ROM back-ups are the only way to ensure preservation of these games.* And the worst part is, GameCube games are tricky to dump at home without specialized hardware. I can't easily buy a retro-player that connects to my PC like for GB/GBC/GBA or NES/SNES/N64 cartridges. Fans literally don't have a way to create legal (under US Law) backups of the software we physically own. I just obtained a copy of Earthbound for my SNES. The condition it was in, was boderline horrific. I worked my ass off to deep-clean and restore it. It was the most disgusting cartridge I have ever dared to try and save. Its one of the only games I would ever go through what I did to save it. Because I know how much this game matters to so many people. Nintendo's actions are indicative of Japan's extreme copyright laws and the fact the company STILL can't operate amicably in the global market. I love their games and systems. But until there is a serious culture-shift at Nintendo, I will never cut them slack. They need to be called out on their bad behavior. Thank you for continuing to shine a light on these problems.
That's *incredible* Cruznick - thank you for sharing your experiences! I am so happy that you were able to acquire (and restore!) a copy of EarthBound ... I can't imagine how faded it was when you got it. Old-school games need all the help and protection we can give them! Likewise, I can't tell you how much I appreciate your kind words. The goal of this series has always been to bring visibility to these issues, and I'm beyond grateful for folks like yourself sharing your knowledge and insights as gamers, collectors, and fans. ❤️
I just wanna say that these videos are very well made and interesting, i was very surprised to find out how small your channel actually is considering the quality of it being through the roof. Keep up the good work, you are making amazing videos!
I've said it before, I'll say it here too. The video game industry is blatantly anti-consumer. A lot of the time, the problem is that by being pro-consumer, the studio could make $$$$$ and $$$$$$$$ later, but they would rather make $$$$$$ at the moment even if it meant they lost money over time from it. Ironically a lot of the time they will turn down that money if they got to screw over consumers. The death of older videogames seems to be very much by design. "Don't think, just consume product, and get excited for next product". You see if you are playing an older game, you aren't playing a newer game and if you aren't playing a newer game you likely didn't buy said newer game (because you saw no need). That means any older game can become a threat for a newer game. As time goes on, older games make companies less and less as prices drop. If a person buys used, the company makes no money from that sale. The chances of a person buying used goes up as time goes by since less and less new copies are available. If it was impossible to DL a rom, then Nintendo would probably not sweat so much. They know that they could easily make a killing by either only selling new games or if they resold older games they could sell at a high price and still be cheaper than the used market. Unfortunately for Nintendo, Roms are a thing, and they are incredibly easy to get. Some companies seem to get it for the most part. Sega puts all of their older games on pretty much any platform you can think of. On PC, the classic games they sell for their Genesis and Master System software emulator actually come with standard roms in a folder titled "uncompressed roms". Sega also has Steam Workshop support for that to give users the ability to upload and download romhacks. The romhacks are also downloaded as roms. Both the standard and romhack roms can be played using any other compatible emulator. There is an unfortunate side effect of the romhack feature and that is that some people abuse it to post or download Sega games they didn't buy (or can no longer buy in the case of the Sonic games). I assume Sega knows but either doesn't care or think it is worth the hassle of dealing with. Valve also comes across as an exception since they allow fans to put their own mods on Steam for anybody to use. Other than the Workshop, there are mods that have their own store pages that are free to download if you own the game the mod is for.. And then there are fan games that are also on Steam such as Black Mesa. Valve generally celebrates fan efforts. Some of Valve's games started as mods and they've hired modders too. There are a couple of exceptions. Most notable is they sent a cease and desist to the man who was making Portal 64. However, they only seemed to have done so because he was using proprietary Nintendo libraries to make it and Valve did not want to be brought into a lawsuit with Nintendo or burn any bridges. SImilarly, they disallowed Dolphin on Steam for a similar reason (ironically, Retroarch is on Steam and that can emulate a bunch of Nintendo emulators). Despite my initial paragraph, I don't think Nintendo outright hates their consumers. I do however think they care more about control than most developers. They care even more about it than money at times. There have been countless examples showing that not treating consumers badly can still get you a lot of money, but it of course means there will be some control given up. To be fair, Nintendo cares deeply about how it is perceived. You or I may not think anything of a mod that gives Mario a Shotgun, but Nintendo might recoil in horror. On the other hand, if they cared so much about their image, one would think they might not be so anti-consumer at times, and also...you would think they would clean up their eshop. While everything on there has an M rating or below, there is a perception that they allow softcore p*rn. Sadly there is some truth to it. There are games on there that have little to no gameplay and only exist to show you lewd artwork (oftetimes AI-generated artwork). They technically never reach an AO rating but they aren't games like Witcher which often show more but have an actual game surrounding the lewd. It's weird to me that a company that will shut down anything they perceive as harming their public image, allows their store to be overrun with this stuff. It's like they want to be seen as an open platform, but don't want to commit all the way like Steam does. And they also don't give the user any real way to filter it out like Steam either. Steam by default hides it and it knows there is a difference between something like Huniepop and something like The Witcher 3 or Grand Theft Auto. The Eshop shows it all, and even setting up parental controls still shows the thumbnail and title and of course if you block it out you block out Witcher or Doom. I wonder how different it would have been if instead of all of the shovelware (especially the thirsty shovelware), you went on there and there were all Nintendo's old games as well as any new game. Imagine logging on and seeing they have Wind Waker on sale for 5 bucks. Maybe Ocarina of Time is on sale for 1 dollar. Maybe they have a bundle of all of the older Zelda games for a few dollars. Nah that would never happen. We all know Nintendo would try to sell them for like 60 bucks each if they could. That's what they did with Donkey Kong Returns. A full 60 dollar price for a Wii game. They know Dolphin exists. It can play most Wii and Gamecube games flawlessly on even some toaster hardware. Playable in 4K too. They packaged a wii game in 2024 and said it was worth 60 dollars. No wonder they are so against any preservation. Again, companies like Nintendo know that if people normalize the act of downloading a rom and playing it on any hardware, it becomes way harder for them to sell the most basic ports one can imagine for ridiculous prices. If you're playing an older Zelda game then you might not buy the new Zelda game when it comes out. If you're playing an old Pokemon game, you might not buy the newest Pokemon Games. Nintendo also engages in the same practice that Activision does with CoD games. The idea is that if every game is the same priice, the consumer is incentivized to buy the newest entry. Most publishers will reduce the price of older games when new ones come out in order to get new customers into the series. Not so for Nintendo. That'll be 60 bucks for that port of a 15 year old game please. If you're lucky they might cut off a few dollars. It may seem backwards, but if money was the goal, sales and cheaper prices have been consistently shown to be good for the developer, the publisher, and the consumer. Steam got so big largely because of it's use of sales. Many devs learned that when their games went on sale they actually made more money since more people were buying. And it isn't just short term either. People buying your games now lead to them buying your games later as well. It benefits everybody, but doesn't allow full control and Nintendo wants that more than the money. They would rather spite consumers than give up that little bit of control. They may not outright hate them, but they do not like or trust them either.
Thank you for sharing your knowledge and insights @AlbedoAtoned, and likewise, my apologies for the delay! I really like your point about the use of sales. Like you point out, the experience of sales on the Switch could be *SO* different, and it would be amazing to see something analogous to Steam. (I know some people feel that Steam sales as of late haven't been as strong, but I've been lucky to find some good discounts). Likewise, I think your point about Nintendo trying to exert "control" is spot-on. Not just in their pricing models, but in their lack of mod support, fan content, thrashing competitive scenes, etc. Control is a *huge* part of their intent behind many of the decisions we see today, at least, that's how I interpret their actions. If I may ask: are you mostly gaming on PC these days? (I'm on a Steam Deck myself, and it has become my favorite console as of late.) ❤️
@@NotYourFriend-YT Yeah I play a lot on a Steam Deck and I also have a desktop I play a lot on as well. I've been a PC gamer for about 12 years or so, though I have technically used computers before that for a good majority of my life.
I do feel control is absolutely a huge part of it, that and a degree of the need to have their image to the general masses and public be as clean as possible. They are an incredibly old Japanese company who, though they have changed hands over the years, has been around at least during the 1890's, and similar to many Asian countries, appearances and adherence to old customs and ways is everything. Had Nintendo been born in a newer age, they may have been a bit different in their practices, not as strictly adherent to it, but they're OLD and originated from an age before that lessening up really took effect.
Not sure why Mario Maker 1's servers going down is highlighted here as it's not a unique case for Nintendo, any and all games with an online server will face the same fate sooner or later. I do, though, often wonder what studios could really even do to keep servers for this kind of game up for as long as possible.
“The unapproved use of Nintendo’s intellectual property can weaken our ability to protect or preserve it, or to possibly use it for other projects.” So what you mean is, YOU want to preserve your games yourself, not have us do it on your behalf? Then do that instead of striking down game preservation efforts. It’s your older stuff, not your newer stuff, what sales are you losing?? (Answer: None.) I don’t remember all the games that use older sprites, but I’m pretty sure NES-era Mario has been around so long, people can potentially recreate it with their eyes closed. Just because Odyssey and Mario & Sonic 2020 Olympics had Mario sprites doesn’t mean you lose sales compared to a FREE 2D Mario fangame with SNES-styled sprites.
The fact that Nintendo attacks everyrhing that moves on the internet while little by little they force their fans to a subscription model is just terrible, and not enought people are talking about this 😢
100% agree @marcovargas3372! I miss the days where we could download titles individually, now it's sign-up for a monthly fee if you want classic games! 😢
I had to take to the high seas in order to play Sonic Heroes and Shadow The Hedgehog, because they don't have a PC port and I'm not paying thousands of dollars just to buy an old console just to play two games. If they had a PC port, I would have bought it.
@@sedrosken831 Not sure how Sonic Heroes runs on recent hardware, but when I played it, it looked identical to the GameCube version (which was the best of the three), and ran beautifully on a Geforce 7300, which was potato-class from day 1. I think it ran fine on a GTX 960 as well, but I haven't tried anything newer. Nor did I try time attack to see if the controls were as tight as the GCN version. The main problem is that, like Sonic Riders, it was never brought over to online stores like Steam.
Me included! I *love* so many of their games, but I really hate how their leadership has come down on so many of these fan communities. I hope they can grow as a company and be a force for good in this conversation some day!
Gosh darn dude! You’re blowing up like crazy! I told you your content was fire and that you’d get the recognition you deserve. Super happy for you man. Well done my friend.
I will never forget the kind words and support you showed me when I needed it most @CISRtv - I'd love to do a collab sometime and send some love your way! (Just ... be prepared for comments on your video of people saying, "you had PETER from Deadpool on ?!!!") 😂
I’m going to say this years before it happens so people know. Wait 10 or 20 years and they will re-put out these games as new games and basically say this game took us eight years to create. They’re just going to resell the same crap back to us later, when everybody forgets.😂
It's like Nintendo truly does hate their fans, and looks down on everyone. What they're doing is malicious. They never used to be this way. Sure, there has been times when they made decisions that weren't good for consumers, but the passion was still there. I'm guessing when Sotoru Iwata passed away, Nintendo just lost its heart and it's now all about ego and profit. They used to show love to their fans, making their actions easier to swallow. Now there's nothing they do for the fans, just try to fleece them. The last thing I bought from Nintendo was a New 2DS. I sold it less than a month later. I dunno, I just felt icky and disgusted just having it in my possession. I may enjoy a Nintendo property from time to time, but definitely not the new stuff. That disgust always sets in, it just takes a little longer when it comes to older games. But I just can't do it anymore. I went from an avid Nintendo fan to someone who can't stomach the company. That's what they did. Thanks for the hard work, your videos are awesome. Happily a subscriber.
Why did you even buy a 2DS? It was an inferior hardware from the start. Funny how Nintendo treated everybody else like crap except for their employees.
@@therealjaystone2344The price point was very compelling and the amount of 3DS games that actually needed 3D was shockingly low. The 2DS was also markedly more durable than the 3DS. Some people have issues where their eyes can never fully work with the 3D display anyway - namely, I do - and ironically, the device considered one of the best for actually playing 3DS games as it’s the largest and most comfortable in the hands is the 2DS XL.
Over the years I've seen a lot of lost pokemon media and fan made games just vanish into thin air which to me is just a painful loss. I remember going out and getting Red/Blue/Yellow when they came out and having a blast with them and while I still own physical copies of the games I'm saddened that later generations won't really see what a cluster duck and marvel the first games were. Sure there have been tons of remakes of the games but its not at all the same. They could have just ported the older games to the Switch and they did once with the original Silver but never after that. They are not at all concerned at preserving these games and that actually hurts.
100% agree with you, @paneth8466 - there's something really magical about older games that's best experienced, and it's sad that so many gamers today won't be able to play them if they're not protected. I hope Nintendo learns to protect gaming history before it's too late!
Who wanna bet Nintendo will take down the latest fan made Mario game called Super Mario and the Rainbow Stars demo because of worrying over prevention sales for Mario & Luigi Brohtership and Super Mario Wonder?
I didn't know Riley's dad was so concerned about video game preservation. But back to the topic, they really should have made Super Mario Maker 2 be backwards compatible with SMM1.
Your comment gave me a HUGE laugh @Dairunt1 (I haven't seen Inside Out, but I googled the character name and yup ... that looks like me) 😂 😂 Likewise, I completely agree-it would've been nice for MM2 to be able to import the levels from the first game. It's frustrating that they didn't do it!
I'm still angry at nintendo for purging flipnote hatena for the dsi. I had some sonic and shadow animations that got lost and a few hundred followers in it's red and blue dithered shaded glory.
I didn't experience flipnote for myself Pheoniex, but I've seen other commenters talking about how special it was. It's genuinely mind blowing that any company wouldn't take steps to preserve those fans' creations. ❤️
Libraries like Internet Archive have always been on our patron's side. We're the providers of information that want to help you and protect your information.
People get real upset over big companies being called out for unsavory practices. I still like playing Nintendo games but they just don't have the same nostalgia they had back even 15 years ago and definitely not what they were in the early 80's.
Nintendo is so stubborn on their games and communities getting forgotten. Imagine if World War 2 history wasn’t preserved and you had to preserve it yourself under the fear of getting in legal trouble.
@@thegamebusters5413 As if Japan is the only country that glosses pieces of history that makes the country look bad. Also Hello Kitty was originally created to capitalize on rebellious teenagers in the 60's so to claim that she was made to distract from Japan's war crimes is laughable. Out of all the ways to criticize Japan hiding their dark past, that was the best example? You could've have just said "The high school textbooks don't include the Nanjing massacre,", but no let's go with Hello Kitty.
Nintendo would make so much money if they soled their ROMs, and we have proof of this, as anyone who has the Sega Classics on steam, has the ROMs of those games, there are people who buy those games, and use them on different emulators
Honestly, I probably would legitimately pay to AFFORDABLY (because nintendo has a habit of NOT reducing the prices of their games over time) play SMW or Super Mario Kart.
@@JamesTDG that's part of the reason I don't play Nintendo games When ever I get ROMs, I always try to pay to companies, like Rayman 2, got the Dream Cast ROM then bought PC version off GOG
The thing is, if they sell you the rom, they can't keep selling you the same game on different platforms over and over, because you already own the game in its raw form.
@@blazeneko3384 Do they? What games they released on Megadrive? Also, the thing with the Megadrive/Genesis may be because Sega allows it to still be manufactured. I'm argentinian and I tell you, it's even easier to find a Genesis model 3 here than even those Nes rip-off consoles, and from what I've heard, the same happens with the Sega Master System in Brazil. Still, this means you wouldn't try to pay for stuff like, I dunno, Sonic Mega Collection+ for the PS2 and PC, for example. That thing has all the main series Sonic games for the Sega Genesis and Game Gear, as well as some other spin-offs, like Mean Bean Machine, Sonic 3D Blast, Sonic Spinball, and Sonic Drift. If you have the specific rom for the game you want to play, you wouldn't buy that kind of collection, you know what I mean?
Mario maker really did feel really restrictive for me. From the skins locked to the oldest style that I wasn't fond of, to the weird level requirements that made the game literally unwinable. I guess I can appreciate the bridge a bit, but the game felt so off. I don't think that means it deserves to be gone forever though, jeez Nintendo.
Right? My timing is absolutely comedic with this one 😂 Next up I'm talking about the fighting game community, and knowing my luck they'll announce a big official Nintendo-endorsed tournament after the video goes up 🤪 Thank you for checking out the video Magnetized Bread! ❤️
I'm so happy that Automaton Lung is on Steam, it was one of the last games released on the e-shop before it closed I already own it on both Steam and 3DS, but i'm just happy that others can still play it
Oh wow, this game looks *AMAZING*, 4nt!! Thank you for sharing this! I'm the first to admit that I'm a sucker for PS1-style graphics, and these polygons give me such cool oldschool vibes. I'll have to check this one out!! Thank goodness it's available on Steam!!
100% agree with you @BuildingWolf100_WolfDab - I hope they can learn to embrace these games and communities someday, and *protect* them for gaming history! Thank you for checking out the video, I really appreciate you*
Honestly, not just Nintendo, you could say this about a lot of things, anywhere from companies like Nintendo to people like cops and politicians, all of them frequently abuse their power.
34:34 this is so strange because I learned about EarthBound through a flash animation on AlbinoBlacksheep using sprites from it to The Time Warp. This comparison hit me like lightning and my ass had no Franklin badge on
Oh dang, I haven't heard the word "AlbinoBlacksheep" in a LONG time, haha. I remember it being popular back in the day when Ebaum's World was popular 🥳
Thors reaction to Ross from Accursed Farms' game preservation movement must have destroyed you. Thor had some validity in his side of issue, but he went off the deep end by saying pretty bluntly that things like mario maker online only service should exist and should fade away for the sake of the company interests. This is art, and the best art in my opinion is art that has constraints and expected to be interesting out of those constraints. Mario Maker 1 was a microcosm of that kinda art. So sad it's gone.
You're completely right @rogero8443 - you read my mind! ❤️ It's definitely frustrating, but I think the one thing that everyone can agree on (Thor, Ross, and otherwise) is that consumers deserve as many options as possible when it comes to this stuff. It's shameful to me that when Nintendo decided to pull the plug on MM1, they didn't give users anything; no way to export levels, no way to migrate them to MM2-nada. Whether or not Thor agrees with the deletion of player-made content, I think he'd be in favor of players having the opportunity to choose for themselves, but I might be wrong. Thank you for spotlighting this conversation Rogero; I really appreciate you! More people talking about it (even if they disagree) is a good thing!
Personally, the first thing I did when I got Mario Maker 2 was reconstruct what I'd made in the first game. That didn't really preserve the original versions, though, as some slight differences in functionality meant I had to make some modifications. If nothing else, they should have released a patch that would let people download a practically unlimited number of levels to local storage.
I'm glad you were able to rebuild your levels @JediMB! Likewise I agree: it would've been cool for them to allow people to download lots of levels to preserve them. The fact that fans had to make multiple Nintendo accounts to try and save games is awful... 😭 Thank you for checking out the video, I appreciate you for sharing your experiences!
And Nintendo would make so much money if they just put up a Nintendo Archive website that let people buy roms of their old games. They could make them playable in-browser, as executables with the roms embedded, and as standalone roms for advanced users. There are so many people out there who aren't tech savvy or don't want to take the risks of downloading illegally that would gladly pay a couple of bucks for a shot of nostalgia.
Finally, someone acknowledges the fact that they have that much money in reserves instead of pretending like boycotting will do much or that they’ll be gone in the next decade. Also, 100% agree with what you said.

The topic of games preservation is incredibly important, and I’m grateful for the chance to talk about it (and make a few jokes) about the state of the industry and Nintendo’s actions on this front.

Internet Archive: archive.org/donate
Video Game History Foundation: gamehistory.org/donate/
Game Preservation Society: www.gamepres.org/en/support/
They need all the help they can get, and I really believe the best way to nudge the industry in a good direction is to vote with our wallets and talk about these issues publicly.

20:05 Internet Archive needs legal protections far beyond what any suit can ever touch.
👏👏👏 You have my axe, YTU! 👏👏👏

Does that include the Japanese one that was super rare?
If I had my way, all online capable games with user-generated content that's uploaded to servers would be illegal to shut down without first providing a complete and fully functional offline export/backup function
My suggestion would be that there should be a company to hire individuals dedicated to preserving EVERYTHING internationally and nationally, undercover of course, to archive, preserve, and confiscate whatever we can get our hands on, regardless of copyright or piracy.
would be a good extension for Ross Scott's Stop Killing Games initiative, he had similar arguments, but it's such a hard fight to even have the "bare minimum" provisions passed
Nintendo: "We need to protect and preserve our property by destroying all attempts to preserve our property, also we want to be able to sell you the same thing again and again in the future; we currently don't have any plans of doing so but we want to have the option."
And that's not even getting into the aggressive control measures that do nothing but inconvenience legitimate users like how they encrypt save data so that it only functions on one specific console or the myriad of more sinister speculations for why they don't allow you to own/play games from their past.
I wish they would sell some games again. There’s many I would like on my modern consoles.

"the frustrating bit is that they don't stop the games while they are in development, they only go after the creator of these games after they have released their games and made them playable"
But is it really frustrating, or is it a blessing? Because this means that the game gets finished and is available to the public.
@@Atlessa It can be seen as a blessing but its also a curse, because once its online its like a hydra where if you cut off the source, then a lot more places will upload the games, but the creators can no longer get involved with their creations, or else Nintendo will sue them for every penny they have, and you also run the risk of getting a virus or malware if the other sources where the games get uploaded, gets their files modified for that.
they don't ask for permission in the first place and ofc Nintendo are entitled to protect their IP.
Why they go after fan games when they release? Because that is the point, where it becomes questionable leagaly. You can make your own fangame for yourself, but as soon as you try to distribute it, you have reached the point, where you infringe on Nintendos copyright. Same goes for mods and roms.
@@agamersinsanity The entitlement is absurd though
I've recently watched a video that explained why is nintendo is so protective, it's linked to the creation of donkey kong :
After the success of the first DK game, Universal attacked nintendo for copyright infringement for king kong, arguing that the plot was too similar.

Companies can take it down again if they are selling the game again in a convenient fashion. But they can’t just constantly add games right before the deadline and immediately take them off without getting fined.

It's a mistranslation. What they actually said was "we appreciate the money of our fans"
They appreciate their passion in being fanboys
I appreciate them going out of business in the next century.

Nintendo with Mario Maker: "Make em start over."
Media Molecule with LittleBigPlanet: "All the levels you built are playable in LBP2!"
Nintendo has made their stance abundantly clear. They hate you, and the only reason they release a game is to make sure they sucker you out of another $60-$80 to buy another cruise ship, 6 more expensive cars, and heated office chairs that play music.
I hadn't heard that all the LBP1 levels were playable in 2, that's amazing! What an incredible way to preserve (and share) all those moments with new players ❤️

Thank you for the kind words @chunkysenpai7930 -- I always appreciate you tuning in, and for being a friend.
👏 I definitely didn't intend to imply that it was as deep as LunarMagic or anything like that, but I was personally surprised by the level of control players had in MM1 (I was expecting the bare minimum, tbh)

I actually cried when I heard mario maker 1 was being closed down. It was my favorite game. I didn't play games for 3 months because I was so sad.
8:18 Yeah, adding a serverless way to share stuff woulda been nice...
Just making it preservABLE.
I hate that amiibo support and mysterious mushroom was cut from smm2. mario kart would be nice in smm2
Remember kids, it's morally right to pirate nintendo games.
“The unapproved use of Nintendo’s intellectual property can weaken our ability to protect or preserve it, or to possibly use it for other projects.”
So what you mean is, YOU want to preserve your games yourself, not have us do it on your behalf? Then do that instead of striking down game preservation efforts. It’s your older stuff, not your newer stuff, what sales are you losing?? (Answer: None.)
I don’t remember all the games that use older sprites, but I’m pretty sure NES-era Mario has been around so long, people can potentially recreate it with their eyes closed.
There is a PC port of Sonic Heroes, it was released with the rest of the platforms it launched on I believe. So it’s still a buggy mess. lol
Nintendo is truly in a toxic love-hate relationship with its customers.
Me included! I *love* so many of their games, but I really hate how their leadership has come down on so many of these fan communities.
I hope they can grow as a company and be a force for good in this conversation some day!

(Just ... be prepared for comments on your video of people saying, "you had PETER from Deadpool on ?!!!") 😂
I’m going to say this years before it happens so people know.

I see Nintendo as a cave of ogres, violently defending their things from anything and anyone, including (and especially) their most loyal fans.
I’ll never forgive them for not dumping the VB library onto 3DS. It really seemed like a no-brainer.
Who wanna bet Nintendo will take down the latest fan made Mario game called Super Mario and the Rainbow Stars demo because of worrying over prevention sales for Mario & Luigi Brohtership and Super Mario Wonder?
That is a genuine possibility. Lets cross are fingers and hope that dose not happen.
Let's just hope it sails just long enough underneath the radar to let us see a full release
I didn't know Riley's dad was so concerned about video game preservation.
But back to the topic, they really should have made Super Mario Maker 2 be backwards compatible with SMM1.
Your comment gave me a HUGE laugh @Dairunt1 (I haven't seen Inside Out, but I googled the character name and yup ... that looks like me) 😂 😂
Likewise, I completely agree-it would've been nice for MM2 to be able to import the levels from the first game.

Actually doesn't that perfectly describe Japan? They never talk about what they did during WW2. Hello Kitty was created to fucking distract from it
@thegamebusters5413 Why do you think CIA and hollywood are intertwined?
@@thegamebusters5413 As if Japan is the only country that glosses pieces of history that makes the country look bad. Out of all the ways to criticize Japan hiding their dark past, that was the best example? Nintendo would make so much money if they soled their ROMs, and we have proof of this, as anyone who has the Sega Classics on steam, has the ROMs of those games, there are people who buy those games, and use them on different emulators
Honestly, I probably would legitimately pay to AFFORDABLY (because nintendo has a habit of NOT reducing the prices of their games over time) play SMW or Super Mario Kart.
@@JamesTDG that's part of the reason I don't play Nintendo games
When ever I get ROMs, I always try to pay to companies, like Rayman 2, got the Dream Cast ROM then bought PC version off GOG
The thing is, if they sell you the rom, they can't keep selling you the same game on different platforms over and over, because you already own the game in its raw form.
@@Burn_Angel Again Sega proves that's wrong, Sega keeps releasing Megadrive games, and they sell

It's definitely frustrating, but I think the one thing that everyone can agree on (Thor, Ross, and otherwise) is that consumers deserve as many options as possible when it comes to this stuff.
Thank you for checking out the video, I appreciate you for sharing your experiences!
You can trust Nintendo about as far as you can throw them, which considering they’re a massive multibillion dollar company, it isn’t very far
Finally, someone acknowledges the fact that they have that much money in reserves instead of pretending like boycotting will do much or that they’ll be gone in the next decade.
