A couple of my favourites: NewER Super Mario Bros Wii, a "total conversion" mod that imo is even BETTER than the base game it's designed on. Also, while it isn't technically a "fan game" I love the "DX" patch for Super Mario Land 2 for the game boy, which basically turns the r*m into a Game Boy Color remake AND it adds Luigi as a playable character who has different physics than Mario!

Even if fair use wins in court, fangames are still kind of guilty of _trademark_ infringement for using the name. -Bloodborne- Nightmare Kart, for instance.
Sega might be inconsistent with the quality of their games, but their attitude towards fan creativity commands more respect from me than Nintendo's had since the GameCube days

For a project to be oficial takes more than just drop it on the on internet, you can see it whit alex kid, streets of rage 4 where they aproached sega first, if you dont you get you game taken down, like streets of rage 2 remix. Also mario strikers and samus returns are the result of western fans that pitched their ideas to nintendo first

Nintendo sometimes acts like if a car maker said: "No aftermarkets! No parts! No races! No selling modified versions! No hot-rodding! No performance mods!" ... which is why it's so _frustrating_ that companies like Tesla and Ferrari actually _do_ that.
@@IamCoalfoot it is their choice as a company to do with their business as they please within legal boundaries and it is your choice as a consumer to continue giving them more money. Nintendo is not doing anything wrong, what they are doing is not illegal, anyone has the right to protect their own IP and COPYRIGHT from being infringed.

Hell look at one of the most successful official _Sonic_ products in the last decade, _Sonic Mania._ Sega basically saw what the fans were doing, hired them, said "Have at it, and we can all profit."
Yup, this one 100%. SEGA does it right! It's beyond mind boggling that Nintendo doesn't see what an amazing opportunity it would be to recruit the folks that make fan games for their titles. @@redstone0234 Christian Whitehead was doing everything to get noticed by SEGA for releasing that Sonic CD port, while using what he had learned with his fangames since 2005, and making it official. Later that they decided to lend him the work to do the Sonic 1 and 2 port of the Retro Engine and after that they allowed him and his team to Mania. It took a decade of work and perseverance from the him and his team to make Sonic Mania a reality.

Kinda reminds me of Hollywood with Megaupload. The only reason their low quality work at the time was even known was because people watched it for free. Megaupload was their Lifesupport, and they sued and took it down thinking it stole their customers. The reality is, you want people to engage with your creation. You want people to play any mario game, to play any pokemon game. You want people to engage with your material and then spread how good it is. Even if you are not selling it, you want your customers in arms reach when your next game is ready. You don't want people to disengage from your franchise for years on end, because they are not coming back. Nintendo is taking a huge reputation cost in order to turn around and shoot themself in the foot. It is quite common that giant companies, when they feel like they are too big to fail, no longer care if an action is good or bad for them because it doesn't matter to them anymore.
That's a great point, @TheTSense - word of mouth (and spreading good material) is a powerful way for companies to get exposure! It also cuts both ways, negative press burns bridges really quickly ... it's a shame that Nintendo has gotten to the size that they don't seem to mind all that much. Fair point. However I feel Nintendo will require more years and total economy collapses before they're finally at critical mass. Mostly because of the problem that people are just too stupid. We already have a lot of kids or basement dwellers who are the exact same meme format as the "leave the multimillion dollar company alone" guy. People these days just have *_no sense_* in spending their money, especially with the economy happening rn.

@@NotYourFriend-YT Yea, QA on Pokemon SV literally went "you can't release this in this state" and yet The Pokemon Company still replied with "we'll release it in this state" because they wanted it out within the fiscal year, completely ignoring how the actual games fell apart at the seams as soon as you get out of menus.
And then they didn’t return for Superstars, and guess how that turned out. It’s not like there’s other sonic fan game devs Sega could use to replace Whitehead.
Nintendo has been like this ever since they won that case against King Kong. They saw how "easy" it was to hijack IP, and they'll be damned if anybody is going to do that to them. The people who performed this coup are still working for Nintendo, and they are poop-their-pants scared that they'll lose [insert character here] the same way if they don't rabidly defend their trademarks. Also, they are not misunderstanding U.S. copyright law - they follow Japanese copyright law which is far more draconian; they simply don't care how things are done in America. With that being said, they could be less douchy. I am not a lawyer. Be nice.

Nintendo's legal division just needs to take a chill pill while their tech bros develop a slightly more powerful console next gen. Their PR will skyrocket again. @@supersayainasriel6745 No, the situation was that it was ruled that King Kong was Public Domain, which means it belongs to the world and not any one person or company. Outside of the shady practice of lobbying to increase how long an IP can stay out of Public Domain, anything older than 20 years is supposed to count as such too. It's the basis for where I consider emulation to start counting as actual piracy (Wii and older is good, Wii U only gets added once the Switch 2 becomes a thing).

This is not really news to me anymore. Infamously, Nintendo had been after most of Kaze's Super Mario 64 ROM hacks and filing a DMCA on them. Fortunately, some of his most popular Mario 64 ROM hacks are still available to download and play, like Super Luigi 64 and Super Mario 64 Land.

I genuinely don't know what it'll take to wake Nintendo up and realize they should be celebrating that incredible creativity. @@ultimate8125 We should all be glad that SEGA is pretty cool with Sonic ROM hacks and fangames. Hell, Sonic Mania actually WAS a Sonic fangame originally until SEGA noticed it, asked the developer if he could sell it as an actual game and he agreed to do so under SEGA's licence.
Nintendo is nobody's friend, because they have backstabbed a bunch of their supporters, whether it is fans or other companies trying to do business with them, because I still remember the case with the Donkey Kong programmer, where Nintendo illegally copied his source code to mass produce Donkey Kong cabinets around the world, and they had threatened the guy and even told him that he had no chance at winning, but because the guy was able to prove that the source code in all those cabinets that were not made by him had his source code, the judge moved in his favor and he won the case which is one of the cases that Nintendo has lost in a courtroom, and there were others such as the game genie one and etc, but because Nintendo does not want people to look into their past, they have covered most of these cases and even info regarding them which is why not many folks know about them, and they even tricked companies like Sharp into giving them specs on what a good portable device screen should have been, because they pulled that kind of crap when they were making the GameBoy, but even though they had used Sharp's resources and time, they then went with another manufacturer basically backstabbing Sharp, and they basically tried to do the same thing with Sony when they wanted to use their CD technology, as they were working with them to make the Nintendo Playstation, but because Sony would have gotten publishing rights since they were going to use their CD technology, Nintendo pulled out of the deal in the worst way possible, by basically announcing in that years electronics consumer show that they were going to partner up with Philips instead, because their plan was to basically publicly humiliate Sony, so that they wouldn't be able to resort to some kind of retaliation , but Sony just moved on to announce the Playstation as their own console, and as such Nintendo basically created their own worst enemy because of their crappy business practices, and its crazy how such a company has managed to last thing long, because with how evil and anti everything Nintendo is, they should have gotten bankrupt a long time ago and they don't deserve what they currently have, I highly encourage people to look up their history, because this is a company that has even stole funding from schools and stuff, by suing them just because they had Nintendo decorations or merch decorating the schools, since the students had been big fans of theirs, instead of Nintendo just doing a cease and desist or something, but that's just how Nintendo operates...
@@woshee_real Yeah, its just nuts, thats one of the best comparisons you can make though, because Disney is just as bad as Nintendo if not worse, and I would have liked to talk more such as how there are even rumors that Nintendo was the cause for Argonaut games becoming ruined, because those developers had been creating pretty good games for Nintendo and stuff, they were the ones who made Star Fox and even had Star Fox 2 pretty much almost finished, but Nintendo didn't let them do what they wanted, and supposedly when they pushed out the idea for a Yoshi 3D game, they had a working prototype, and showcased it to Nintendo but they acted like they were not impressed, and the rumor is that they used that prototype as inspiration for Super Mario 64, and then Argonaut games in frustration made Croc in order to keep using the assets that they had already made, again though this one is unconfirmed, but I'm sure that there has to be some truth to all the rumors around, and the only way to truly know is for someone really good with investigative journalism to tackle most of these rumors, and that is why I normally mention facts like the one with the Donkey Kong programmer.

What it comes down to for Nintendo, more than anything else, is _control._ They want players to play their games _Nintendo's_ way, and not anyone else's. This goes from playing fan games not made by Nintendo, down to playing official Nintendo games on official hardware _different;y._ Some of Nintendo's community managers were threatened to be fired over the mere _suggestion_ of doing a Nuzlocke run on video. This goes back decades too. Even to _absurd_ levels. Like, the reason they withheld themselves from using full properly orchestral music for so long, was all because playtesters would perform actions in time with the music. Oh no the horror! That's how absolutely insane Nintendo is. You _WILL_ play and think about their games _THEIR_ way and not any other. Including when they start screwing you over or delivering subpar products.
Yup, this is a great summary @GreatFox42 - control has always been at the heart of how Nintendo views their intellectual property. I had a bit in the episode at one point referencing how Nintendo SUED BLOCKBUSTER (the movie rental company) ... but it didn't make it into the final cut. i think people often tend to forget too that for every fangame that gets taken down theres dozens of new ones being uploaded everyday, not to mention the reason WHY they get taken down is because big news sites like kotaku alert the masses *INCLUDING NINTENDO* about their existence.

I thought the problem wasn't sales, I thought it was something about brand image. Nintendo wants to have ALL the control over their brand image and IP - and to that end, they will prevent anyone saying things about it that isn't their ads. It's why they don't like let's plays either. I think that's still stupid, of course

Except there is bad about it. It baffles me how many of you here argue it falls under "fair use" -it doesn't, literally just google "does fair use allow fangames", it will tell you that fangames are an unauthorized use of copyrighted material. Copyright literally means "right to copy" -you as a fangame creator DON't hold their copyright and therefore don't have the right to copy or redistribute copyrighted content claiming it's "fair use". Fair use is for purposes of commentary, criticism, teaching, news reporting etc, it doesn't allow you to steal someone's assets and put together a game of your own out of those stolen assets and redistribute those stolen assets along with the game, regardless if you make money off of it or not, it is illegal. The only time I agree with you is with nintendo's game letsplay footages on youtube getting taken down as THOSE CAN (not always) fall under fair use, tho they would likely fall flat in court in many cases as they're not very transformative and technically can be taken down legally, just many companies choose not to do it because it can be good pr. Educate yourself and stop saying that stealing and redistributing stuff that isn't yours is fair use.

At some point, the copyright offices REALLY need to be overhauled. Not only should copyright offices be actively seeking out and punishing companies that send false DMCAs, but fan projects need to be put under fair use, as, if you aren’t charging money for them, it is essentially the same thing as a kid making up stories with their toys. If it is a parody or analysis, then it shouldn’t matter if it’s making money (technically speaking, that part is already SUPPOSED to be the case), but if it doesn’t fall under one of those categories, as long as it isn’t making money, it shouldn’t be struck, and the government should be actively stopping companies from doing this instead of waiting for somebody both brave enough to face the company and rich enough to afford good lawyers to take them to court. Also, I’m not sure if this is already the case or not, but if it isn’t, then the copyright laws should apply to the country the person BEING SENT the cease-and-desist is from, NOT the country the company is from.
I completely agree, and I appreciate you speaking up about this @gechoman44iwantahippo -- companies that wield copyright law as a weapon to intimidate creators or stifle communities really should be taken to task by the media. It's frustrating! For me personally, I just hope that Nintendo can learn to reflect on these interactions they've had; there's so much genuine passion and creativity in these communities, and it's a shame that they often see them as a legal "enemy" as opposed to what they are: some of their most passion fans. @@gechoman44iwantahippo I'm fairly certain that you don't fully comprehend how international IP laws actually work. Neither do I so I'm not suited to talk as if I do, but enough to know that it seems to encourage aggressive action and is rather outdated. US laws and how they're set on precedence also some part in it. That's why some lawyers would argue that the law itself is the main problem in all this, but I'm no expert. Really, best to consult an actual professional on exactly how IP laws work, rather than simply trust in the layman's very basic understanding of it.
@@luxinfinite1394that and considering Nintendo works with the Japanese interpretation of the laws, going up against the Japanese justice system is pretty much a lost fight in advance. So in the end its nearly impossible to change the current status quo because those who could change it stand to gain from it
I think nintendo wants people to HAVE to buy a nintendo consle if you wanna play Mario. That's why they hate it when you pirate 30 year old games or play a fangame, it allows you to have a Mario experience without buying their console.
yeah this. theyre a good software company and a sub par hardware company. they had been at the forefront for hardware development for a long time.... but since the ambitious wii they seem to be less interested in innovating now
From a business perspective…I kinda get it? Nintendo works with low power consoles that get by on brand recognition. Being hyper protective of that brand is vitally important to them.
Which is funny considering you can't even BUY Super Mario Bros. 3 from them. You can only purchase a temporary subscription to access the game from a server, and as soon as they drop NSO support for the switch, guess what happens, you lose access to that game, and by extension, your save data.
Personally, my theory on emulation, fan games, and now games being not even owned by people or having to be activated is simple! If you play an old game, or a free game, you are not giving them money or playing their newest product. How would you dare not to give them your money.

Apparently, SEGA treated Christian Whitehead and the other devs of Sonic Mania like shit (in payroll). They only got paid from game sales when they hit arbitrary numbers. They didn’t get any money from game sales themselves.
Nice to finally know the reason why Christian and his team had such a bad fallout with SEGA. I knew they had a fallout but not why, only that SEGA was being… well, SEGA. So, while I appreciate SEGA's generous attitude towards fans and their content creation… SEGA isn't really better than Nintendo, they're just bad in different areas. SEGA treats their employees like any standard American corporation - which doesn't excuse anything but makes it easier to swallow when you inevitably get burnt due to how normal/common it is - whereas Nintendo is straight-up draconian control freaks towards their CONSUMERS, which leaves a very sour impression when you try to interact and work with them as a content creator… which is by far and large a much more unique experience that tends to single Nintendo out. Xbox is very protective of its IPs as well and will SOMETIMES send out cease and desist orders to fan game creators for CERTAIN IPs but is by no means as unreasonable with their consumers as Nintendo is. You don't see Xbox or Sony go after modders or people making emulators of their old hardware - like the Xenia and RPCS3 emulators - whereas Nintendo does (they've been in conflict with the Dolphin emulator for years trying to shut it down as an example), and Nintendo will peck at EVERY fan for ANY of their IPs. People dislike Sony and Xbox for their business practices and treatment of their employees but again, it's easier to swallow because they're not unique in this. Nintendo is very unique in how they strike down on content creators, whether its mods, fan games or emulators. Hence, SEGA gets more slack despite its horrid business practices because it's not unique on that front. It is, however, very unique in how VERY GENEROUS they are towards their consumers and fans. So long as you don't profit from their IP, you can go nuts with your content creation. (Not even Xbox is that generous; they'll still send a warning to fans if certain extreme things like creepy pasta get widespread.) SEGA doesn't even mind if content creators ask for donations to help them better sustain themselves and focus more on the fan creations they're making. Because it's not considered profit so much as charity to help out a project both the creator and fans alike are passionate about. The fan game itself won't be charged for, so it's not profit. Very generous indeed. Small things like that are the reasons why a franchise like Sonic is still going strong and still considered a cash cow to SEGA despite its wild inconsistency in quality. If SEGA started striking down fans like Nintendo does, they'd lose a lot of profit and loyalty from fans overnight, and basically kill their IPs.
I've been sick of the "SEGA, HIRE THIS MAN!!!" drivel that's been going on for years. SEGA doesn't hire any random modder in their parent's basement to work for them, it takes proper education and experience with game development like any other studio. And if you are actually this man which SEGA hires, don't expect good working conditions, handsome pay, or to be secured for future projects.
If people are playing fan games and not buying official ones, the fan games haven't done any damage. Either the player has no money and to play the official games would constitute piracy - OR the official games are so bad that they aren't worth buying, in which case the company has damaged their own reputation.
That's a good point @ErdrickHero, I also believe that fan games and Nintendo's official ones could possibly coexist without damaging one-another. More than anything else, it'd be nice to see Nintendo embrace those communities (and their creations), but it's probably going to take a long time. We can hope! Hiya, ex Project M dev here, thanks for the coverage. It's been a pretty dark day for our community when we got shut down, and I'm proud to say that unlike Nintendo, I love our players dearly. I remember doing the interviews for the mod, and we actually did our best to stay in their good graces. We promoted a hackless method to access our mod, spoke positively about Nintendo publicly, and even stated that Nintendo had our blessing to use any content we come up with. We basically did everything right. And this wasn't even enough. Damn, you guys were really fighting an uphill battle. The games industry as a whole (but especially the big players) collectively despises emulation and modding, and Smash Bros being a collaborative effort means the whole industry (even those uninvolved in Smash) would've been breathing down Nintendo's neck to end you. And best of all for these guys, Nintendo would absorb the entirety of the bad press around it likely due to their third party agreements. The industry, and Smash, being what it is meant that you were always going to burn under their ire. I'd just ask to try to see it from Nintendo's side who needs to maintain third party trust in them despite allowing Project M to last so long. And yes, they could've ended Project M way sooner. And again, these third parties that Nintendo courts for Smash Bros, they all hate emulation and modding and it REALLY doesn't look good for Nintendo to do nothing about it, and so for Smash to continue as it is, to maintain third party trust in them, means they'd have to put an end to Project M eventually. In short, Nintendo HAS to be extra, extra skittish about Smash Bros as it is always more than just Nintendo that Smash Bros represents, it often represents gaming in its entirety.
@luxinfinite1394 Sega in fact gave us their blessing to use Sonic and Knuckles. They have even commented on how much they loved our Jet Set Radio costume for Sonic, and expressed sadness at Project M's closure. Konami has not spoken on the matter, and my sources at NOA have confirmed that this was Nintendo, and Nintendo only. I do not wish to see Nintendo's side, as they are clearly in the wrong and they do not have a legitimate case. Mods have been allowed by companies like Valve and Sega without any issues prior. Nintendo acted in bad faith, tried to control us, and the pressure argument falls apart when it was proven that they were subtly trying to get TOs to cast us aside and do their dirty work for them before they started going nuclear. They spent years making false promised and lying to the smash community that if they forsakened our game, they would be getting official support, which never even happened. They tried to get away with it scott free. Mods can easily exist. We call this an open license agreement.
You know what the funny part about terraria is? Today it outselled the original super mario bros and re-logic did a blog about the achievement Like They didn't talk about the 50 million, they talked about the 58 million (super mario sold 57,6 million) like i didnt know they are developer's of super mario bros x and now makes sense why they did it this Really fucking funny

No company will do that because it doesn't affect them. They only stand to benefit from the false hits as it gets them a little more and they can just say 'well, it was a mistake on the bot's part' if worst comes to worse. Their hand has to be forced. Hard. Do it to one company, the rest will be forced to follow suit to avoid going down with them.

Sonic Mania was made by people who started by making ROM hacks and music remixes of Sonic games. SEGA won't officially acknowledge fan games, but as long as nobody tries to sell them, they leave fan projects alone. Nintendo absolutely does not need to behave this way.

This is why DMCA'd games need to just leak. Never understood why fan projects just buckle. These corporations can't do anything about it once it's loose.
That's an insane take, if the games see any distribution then the corporation that DMCA'd them can interpret that as disobeying the DMCA notice and file a lawsuit. Games can't "just leak" as any form of leaking is an intentional action, which gives grounds for it to be taken to court.
@@kieranboulton3953 Things get leaked all the time, stolen. They might have shared the game multiple times during production for testing. Its not like fan games aren't often open source projects produced by many people. No one person can be condemned for a build floating about. If long before the dmca was issued a person had the game sitting on a drive and it got lost on the bus, and that game appears online how is it the makers fault? I've never seen this issue get pushed in court. There is no precedent for someone being hung up like this for something that is out of their hands. Once Software is online it can't be expected to be contained. This is why these projects should be public in the first place.

@@Vespyr_ That's an entirely different situation, you said that you didn't understand why they just buckle when they are DMCA'd, my answer explained why. Of course, any subsequent release from outside of the team would not result in the team facing consequences. Instead whoever was responsible for distributing them would face their own DMCA notice. This is exactly what happened with Yuzu after it was shut down, when a load of reuploads started popping up straight away they were swiftly met with DMCA notices, but the Yuzu team faced no further action.

SEGA, VALVe has issued DMCAs in the past but it's super few of them, really specific, hell Portal 64 was not taken down by VALVe technically, they asked the dev to not use Nintendos N64 code, he ended up declining, and took it down himself. TF2 Source 2 was already dead in the water due to S&Box not being a stable engine (garry keeps changing the entire thing).

Either hide, or sublet your code to so many people that any form of DMCA does NOTHING to stop your project from vanishing. This is what we did with Mario Royale, so many independently developed branches at this point, that we'll never lose the game, hell, I made sure to back up a copy of the game!
nintendo has every right to object to you literally distributing any sort of copyrighted assets of theirs for free, it is illegal and is considered a copyright infringement as you are copying-and-redistributing THEIR content without the COPYRIGHT-HOLDER's permission, it is ILLEGAL to do so. Please do your research on what "copyright infringement" is, what rights does the end consumer have and what terms and conditions apply to the end consumer who is using the product. You are bound by those legal terms and conditions and yet NOBODY READS THEM AND YET PEOPLE CLICK "ACCEPT" WITHOUT QUESTION, I RECOMMEND YOU DO.

@@BiTreeFrog except the law is designed to make you care via punishments for breaking it, and I believe the punishments are there for exactly such attitudes. The copyright law isn't there to piss people off, it's there to protect intellectual proprty from theft and unauthorized use and redistribution, it literally applies to anyone whoever made anything original.
The official answer why nintendo hates fangames that I heard a few years back was that there were people who couldn't tell the difference between the fangames and offical releases and would supposedly contact Nintendo's official helplines when their game busted and nintendo A)didn't have a soultion having never created the game in first place, and B)couldn't handle their helplines being flooded with so many new people. This is why so many fangames have "not an offical product: and should not be treated or sold as such" at the beginning of their game, to try to prevent this problem from allegedly occurring.
This is only happening so far in the West. Idk why this reason was so hated that doing fan games would be a good thing. Plus, Nintendo mostly makes good games lately than any other game company in Japan.

Nintendo tends to consider PR when picking fan-projects to take down. A part of me suspects this is why they have not done anything to the Satellaview fan scene (Notable for BS Zelda projects and translations of recent Satellaview ROM dumps); namely, any attempt to take that scene down via legal action will lead to increased awareness and demand for a legacy platform they haven't touched in over 20 years, that they very likely are not willing to placate. I kinda hinged my TH-cam Channel on that bet, and, somehow, in spite of me sometimes doing high-risk things, I never got any legal threats from Nintendo.

@@NotYourFriend-YT "Cyber Citizen Shockman Zero" is available in English now! You may enjoy that one if you want to play a beat-em-up with some Mega Man-esque platforming and visual aesthetic. A while back, Square's infamous "Radical Dreamers", the predecessor to Chrono Cross, was included in Cross's HD Remaster "Chrono Cross: The Radical Dreamers Edition". I think it'd be a good idea to support these releases to show further interest! "Cooly Skunk", the early version of "Punky Skunk" that broadcast as a Satellaview demo only to never see a proper Super Famicom cart release, may well be next in line if the fundraising does well. As for what's been recovered recently by ROM dumpers, the Satellaview version of Super Bombliss is probably the biggest bombshell in regards to amount of ROM content. There were also releases for BS Fuurai no Shiren and Takara-hai Osumo Eisei Bashou, as well as several demos, including one for SFC Madou Monogatari with a few prerelease graphics and a version of Panic Bomber W that doesn't use the SA-1 expansion chip. Hopefully some of that may interest you! There's still more coming, too!

@@LordTyph Wow, Teleeli's Ancient Stone Tablets fan translation videos go way back by now. Do they even predate the MSU1 dub? Can't recall... It's unfortunate that the fandub voice acting in that seems to have generally not been accepted. Either way, quite a bit has happened.There's be attempts and strives in making the games more closely resemble how they broadcast.

While we're on the subject, fans of Nintendo 64 games should be aware that *every N64 game can be decompiled, and the tools to do so are free and open source.* Anyone who's willing to learn can port any N64 game to PC and play with upscaled graphics, decompressed music, maybe create some bug fixes or make mods. As I recall, my personal tier list when I played was, in order: - Magus (I was an edgy teen.) - Lucca (best girl) - Robo (best girl's robo bro) - Ayla & Chrono (Liked 'em, but not much) - Marle & Frog (actually disliked them) Chrono Trigger was one of the few games that I regularly switched up my team. I actually made use of everyone. Magus, Ayla, Robo - *Elite* demolition squad. Magus, Chrono, Ayla - Balanced team. Chrono, Lucca, Marle - Classic dream team. Magus, Chrono, Frog - Legendary misfits. Magus, Lucca, Robo - The introverts. Magus, Lucca, Marle - Dream team variant. Looking back as an adult I feel differently about some things I didn't respect and think I've got less bias. So the revised list would probably be: - Frog & Magus (Actual legends) - Lucca & Chrono (Ride or die besties) - Ayla & Robo (Happenstance family) - Marle (I can't recall why I dislike her, but her giggling sprite still evokes fury within me.)
@@trajectoryunown Totally agree--Magus is such a great character, and I *love* that the game gives you the choice as to how to resolve the Frog / Magus conflict. Likewise, the Chrono / Magus / Frog line-up is BEASTLY! I love it so much. Darn it ... you've got me wanting to re-play Chrono Trigger now. (I'm in the middle of an FFIX replay, so it'll have to be after that ..)
And you know who caused all the stock market crashes on Monday? It was Japan. What happens is that Japan has the cheapest loans in the world and many people found out that they charged very little interest on loans, and people used it to buy or invest in the stock market, and Japan saw that they were giving money instead of the loan being returned with interest, they increased the interest and made no changes and that is why the stock market fell.
The real irony is how Nintendo's aggressive attitude towards fan games hurts their own reputation, sales, and fanbase. They are actively declaring they do not want to have fans. It also leads people to question the quality of their modern games when, without all the DMCA, they might have been happy to overlook the lapse in quality.

Nintendo logic (probably) If fans are playing fan games they aren't playing our newest game If fans put out fan games for free people aren't buying our new game If fan games get more popular then our original game it makes us look bad and they worry people will whine why wasn't this in the original game Fan games that upgrade the original might set a new standard for the next game we put out or be unfairly compared to it Fanames/mods that are higher rated them the original game make us look bad and ruin the rating that game has and are not to be encouraged WHAT if my chronically online child found it! Etc Every story has at least 2 sides

Funnily enough I have seen a video exactly about that It was basically Mario wonder vs Mario world ROM hacks Do I agree with the guy?no, alot of points was just, ROM hack y, did this better, and ROM hack x, did this better, and físics on wonder are not Mario world enough (even tho he mostly plays Mario world so of course the other 2D is not gonna feel like world) Is not creative enough, wonders seeds are respective (yes but no, you play the stage twice sometimes just to see what doesn't change and be new level even it is just a bigger enemy) and a lot of bosses are respective (even tho a lot of ROM hacks of Mario world are still use vanilla bosses in a different situation only) But the fact that a guy did this video, to dunk on wonder, praise ROM hacks that are nowhere near eachother aside from using Mario world says alot
No wonder is not perfect HOW WE STILL HAVE NO COOL BOSSES LIKE THE FIRST NEW MARIO BROS FROM NINTENDO DS? And some of the stuff of Mario wonder seems...sus to say the least (looking at you bubble flower) But try compare a one game vs probably 2 decades of improvements of ROM hacking feels unfair even if it is 2D Mario By all means continue to do ROM hacks or play wonder or maker But I feel is pretty clear there shouldn't be a discussion about comparing the 2
@@NotYourFriend-YT It's going to be a while because there's a cultural difference in play. Honestly, I think that, despite some of their scummy moves, they're probably the lesser of the evils currently in play. At the very least, they're not as interested in moralizing, demonizing their customers, forcing political stuff into their games, ect. I'd suffer with it so long as that remained the minimum, though I'd obviously hope for a change for hte better.
I know how you feel @magmamaster1801; I grew up really enjoying Nintendo games myself, and have *amazing* memories of playing them with my friends and family. I hope they can reflect as a company and learn how to embrace a lot of these communities. There's a lot of passion and creativity there! As a child in Eastern Europe I didn't have access to Nintendo games and I was the only kid who even knew what it was, spent my time playing fangames as we didn't have access to Nintendo consoles.
Nintendo as a company sucks. The only people worth a damn at Nintendo are the actual development teams, everyone else there are some of the worst businessmen and women to ever exist.
The industry as a whole sucks, Nintendo is just another standard. Valve, Sega, Konami, Capcom, Microsoft and EA, the big players all follows the same guidelines basically. And no, Valve and Sega are no different, actually dive into the messy logistics and it's easy to see how it's all cold, calculated business. You can find plenty of deeper diving videos here on TH-cam. It's easy to see it as "only Nintendo sucks" when the video only talks about Nintendo. Branch out and you'll see the same crap everywhere.
TH-cam has really kicked it into high gear with recommending small creators. Like half the videos I see I look at the sub count and it’s in the hundreds

Except most of the fans just wanna ride that train of success nintendo has by stealing their assets and designs and slapping their name onto it. I think anyone who is a creator (I can tell most of you never created something of your own given how you can't imagine yourself in nintendo's situation) -I think anyone would be pissed if they saw someone else using their work without permission and slapping their own name onto it and saying "this is my fangame" while it's put together of ripped original assets and designs that aren't theirs. It's downright unfair, go make your own platformer and don't give him blue and red overalls while naming him mario and giving him the exact same look as the original mario design, see how successful you can get when you have to make the works yourself instead of stealing nintendo's content.
@@Bond01_ that’s dramatically oversimplifying the situation. I’m an artist, it’s literally my job to create things. It’s completely acceptable to make art of a character you don’t have the rights to, it’s protected under fair use laws. While a lot of fan game creators and modders don’t use their own assets, which is not protected under fair use, a game is more than just graphical assets. When Sega saw the work of dedicated fans, instead of trying to destroy their careers, they hired them. That’s how we got Sonic Mania, one of the most beloved modern Sonic games. Sega has learned that fans carry the heart of their franchise, so they hired fans to help create Sonic Frontiers. If Nintendo took a leaf from their book and chose to hire these talented creators, even in a single small project, to work under their roof then we could have some incredible games. Pokemon tries to snuff out their fans as much as they can, imagine if they hired them to create their side projects instead of ILCA, who make the worst version of Diamond and Pearl. If Nintendo hired fans then they’d have their ears directly at the source of the people who purchase their games. But no, Nintendo only sees fans as obstacles to their money, much like you apparently.
@@tylerwebb2495 Except those fans don't have much to offer to nintendo, that is exactly why they compensate for their own shortcomings by using nintendo's concepts, designs and downright assets because they contribute very little by themselves most of the time and trust me -nintendo doesn't need an average-to-mediocre level of quality worker, especially if he hasn't gone out of his way to try to apply for the job directly instead of infringing on copyright by distributing stuff that isn't fully his. You are right that it is acceptable to make art of a character you don't have rights to but that is exactly a case of fair use, the fangames we are talking about do not fall into the same category as they are not merely using a portion of the work in a transformative way but downright copying the entire game in many cases or producing an end product that is absolutely drowned in copyright-infringement and is then distributed as a game. Don't you see a problem with that? Hell, even if it was lets say -only music, wouldn't that be incredibly unfair for someone to be allowed to just yoink some music and use it in some work that isn't even fully theirs infringing on more and more copyrights, its a total disrespect to the law of "if you don't have permission then DON'T DO IT, ASK FIRST", nobody is stopping people from asking nintendo if they can use their stuff, except they probably know nintendo would just say "no" but anyway. Nintendo has every right to do with their IPs and their EXCLUSIVE COPY-RIGHTs as they please, if they don't want to give you permission to do what is ILLEGAL WITHOUT A PERMISSION then you are simply not allowed to, end of story.
@@Bond01_ we’re not talking about every average creator to be worked with, that was never the case. Not every kid who makes stuff on Mario maker has a lot to provide. But I’ve played countless fan games across multiple franchises that have just as much original content, including assets, as the games they’re modding. When a fan chooses to use assets from say Mario or Pokemon, they do it because they love that franchise, not because they want to rip off something that isn’t there’s for some sick pleasure. It’s not out of laziness, it’s out of passion. Instead of harnessing their creative power they’d rather end it. In the end it’s closed minded and destructive. If every tech company just wanted to jail hackers they’d have very vulnerable systems. Instead they hire hackers to test their systems, using their talents for their benefit instead of attacking them. Some will be destructive no matter what, sure, but that’s just life. Nintendo doesn’t make allies for themselves, they only make enemies. You have every right to kill creativity because it hurts your feelings, power to you. So does Nintendo. But there are better options that Nintendo and you refuse to see
It also reminds me of when persona 5 was released and even the gameplay being uploaded caused DMCA takedowns. Honestly, DMCA is just the catch all of “trademark” whilst ignoring “transformative work”.

Speaking of Sega, they did DMCA the fans that were working to translate Fate/CCC to english, people though that sega would actually bring the game to EU and US, but they never did, so we never got the translated version.

Project M was especially quirky in the fact that if you wanted to play it You'd have to buy the smash bros game. Meaning if you wanted to play the fan project. You'd have to send Nintendo your money first.
I said this to a friend... As good as Nintendo is at making high quality fun games, SEGA is at dealing with their fans. The reverse is also true. As bad as SEGA is at creating good high quality games, Nintendo is at dealing with their fans.
Thank you. Finally someone is saying that needs to be addressed. That is a true fact. People that played Nintendo games needs to get over this because compared to Sega, Capcom, and other game companies in Japan, they’re literally the biggest game company so far and they’re strict with their characters which they don’t want to be used publicly. Even the player base in Japan will not like it either.
"If something is put on the internet, it will never go away" Is a moto that companies need to understand and accept. They’ve erased a fan game on Roblox that I play called pwip, you could play as pikmin and creatures, pwip was taken down multiple times but always put back up until eventually it was taken down for good

I found out something weird about Japanese copyright law... there is ZERO allowance for fair use in Japanese copyright law. So as far as they're concerned, nothing is fair use.

I think the reason companies take down fan games so often is because this fan made content is almost always better than what is officially offered by such companies, and could just prevent users to spend money on their products for the fact that they could get a better one for free, thus making these companies lose tons of potential money gains.

My all-time favorite game is actually a fangame: Sonic Robo Blast 2. Sega has been so incredible to their fans over the years because they KNOW that the thousands of fangames, romhacks, mods, animations, music remixes, etc do nothing but HELP the franchise succeed. Whenever the official sonic games lacked in quality, the fans would step up and make things that they wanted to see. Sega saw that and didn't JUST actively choose to let all of it continue, they also HIRED some of the most prevalent creators in the community to work on the series officially. Tyson Hesse, Tee Lopes, Christian Whitehead, Simon Thomley, Ian Flynn, all of these people were major figures in the sonic community. ALL of them have worked on the official games in one way or another. (hell, Sonic Mania, Sonic 1 HD, CD HD 2 HD, 3 HD and Superstars literally would not exist without them.) No company is your friend, but some are better than others, and Sega is among the best in terms of how they treat their community. It breaks my heart to see the passion and love people have for nintendo's franchises and the hard work they put in just be completely disregarded by the company.
This is in no way me trying to defend Nintendo, it's just something that might offer a... explanation to their behavior. I have a feeling this originates out of paranoia of losing control. Because that almost happened to them with Sony, when they were originally working on the Playstation together. I recommend watching the video "Nintendo was right to backstab Sony over the PlayStation". Again, not a defence. Just a possible explanation as to why they're so overly hostile.

Hilariously whenever Nintendo strikes down something that fan game still remains on the internet forever, btw I've sent you something on your community post as well Keep in mind, I still despise their DMCA legal team and weird business decisions, but the problem is when you blame the company as a whole, You're dragging in its developers and employees considering the fact they have nothing to do with the DMCA decisions. Another thing is some of those developers/ voice actors do go to Comic-Con conventions and see fans as well.

It is high time that they put their stringency aside and view those games for themselves for they truly are. Art and darn good masterpieces at that as well! If I was the current CEO of Nintendo, I order my men to find the person who made that fan game, bring him/her here and tell them that I want them to turn that fan project into a game, and that I will heavily promote it. Thus not only strengthening the brand, but also the company closer to its fan base. And occasionally, we might the same thing SEGA had done with Sonic Mania, albeit with better pay and resources to make the best game that project can be! What do you think of this idea, eh? Is it not great!?
Because their entire identity requires complete control over their IP in turn making it impossible for people to say "We can fix it." or "It could be better." They have even targeted children with MTX heavy games yet are family friendly? Nintendo's true identity would cause a massive fallout especially if fans could do better with ease and consistently. For example, think of what would happen to a more spiteful Sega if fans do almost everything better for free. It would be the death of Sega, or in Nintendo's case likely their own death if not massive loss.
I ain't a developer, but from what I can see these fan developed games aren't a great resume builder. Sega Sammy likes to cheap out wherever they can, whereas Nintendo I'm guessing simply hires experienced professionals or outsources to experienced studios. Also, sending job offers to fan developers is likely frowned upon by the gaming industry as a whole, especially with its universal disdain towards pirating software and hacking. Plus the main teams working on the main Nintendo games tend to all be located in Japan. In the same building, speaking the same language.
Seriously, Nintendo games have been getting stale, giving the fans the reins gives 2 things: 1. Easy ideas for future Nintendo products 2. Games that can fill out content droughts
This reminds of a story from 2 years ago. SEGA issued a DMCA copyright to a Sonic game on Roblox. However, they did so because the creator of the game was a creep, and Roblox moderation didn't do anything about it. At most, he was banned for 3 days, but Roblox did nothing. So, seeing that a PeD0 was being tied to the Sonic name and Roblox's refusal to punish him for his deeds, SEGA stepped in and gave him a DMCA as a last resort of sorts to hopefully get him banned off Roblox. Tbh, a W move by SEGA.

24:55 From what I've heard TH-cam actually changed it so if you get a bunch of DMCA claims from one source it counts as one strike. Probably to tone down abuse of the system. It's still abject lip service of course but at least one claimant can not threaten your channel. (I mean they technically could and people abusing the system to harass people would use this method but I'm not going to mention how, don't want to give anyone ideas)
Nintendo hasn’t sent a DMCA for it yet, but look into Star Fox: Event Horizon. A single person has been working on it for ten years and it has multiple of the original voice actors in it.

NewER Super Mario Bros Wii, a "total conversion" mod that imo is even BETTER than the base game it's designed on.
Also, while it isn't technically a "fan game" I love the "DX" patch for Super Mario Land 2 for the game boy, which basically turns the r*m into a Game Boy Color remake AND it adds Luigi as a playable character who has different physics than Mario!

@@redstone0234 Christian Whitehead was doing everything to get noticed by SEGA for releasing that Sonic CD port, while using what he had learned with his fangames since 2005, and making it official. Later that they decided to lend him the work to do the Sonic 1 and 2 port of the Retro Engine and after that they allowed him and his team to Mania. It took a decade of work and perseverance from the him and his team to make Sonic Mania a reality.
Sega and Garfield gets to have fan-made games but NOT Nintendo.

Kinda reminds me of Hollywood with Megaupload. The only reason their low quality work at the time was even known was because people watched it for free. Megaupload was their Lifesupport, and they sued and took it down thinking it stole their customers.
The reality is, you want people to engage with your creation. You want people to play any mario game, to play any pokemon game. You want people to engage with your material and then spread how good it is. Even if you are not selling it, you want your customers in arms reach when your next game is ready. You don't want people to disengage from your franchise for years on end, because they are not coming back.
Nintendo is taking a huge reputation cost in order to turn around and shoot themself in the foot.
It is quite common that giant companies, when they feel like they are too big to fail, no longer care if an action is good or bad for them because it doesn't matter to them anymore.
That's a great point, @TheTSense - word of mouth (and spreading good material) is a powerful way for companies to get exposure!
It also cuts both ways, negative press burns bridges really quickly ... it's a shame that Nintendo has gotten to the size that they don't seem to mind all that much.

Nintendo has been like this ever since they won that case against King Kong. They saw how "easy" it was to hijack IP, and they'll be damned if anybody is going to do that to them. Also, they are not misunderstanding U.S. copyright law - they follow Japanese copyright law which is far more draconian; they simply don't care how things are done in America. @@supersayainasriel6745 No, the situation was that it was ruled that King Kong was Public Domain, which means it belongs to the world and not any one person or company.
Outside of the shady practice of lobbying to increase how long an IP can stay out of Public Domain, anything older than 20 years is supposed to count as such too. It's the basis for where I consider emulation to start counting as actual piracy (Wii and older is good, Wii U only gets added once the Switch 2 becomes a thing).

This is not really news to me anymore. Infamously, Nintendo had been after most of Kaze's Super Mario 64 ROM hacks and filing a DMCA on them. Fortunately, some of his most popular Mario 64 ROM hacks are still available to download and play, like Super Luigi 64 and Super Mario 64 Land.

We should all be glad that SEGA is pretty cool with Sonic ROM hacks and fangames. Hell, Sonic Mania actually WAS a Sonic fangame originally until SEGA noticed it, asked the developer if he could sell it as an actual game and he agreed to do so under SEGA's licence.
Nintendo is nobody's friend, because they have backstabbed a bunch of their supporters, whether it is fans or other companies trying to do business with them, because I still remember the case with the Donkey Kong programmer, where Nintendo illegally copied his source code to mass produce Donkey Kong cabinets around the world, and they had threatened the guy and even told him that he had no chance at winning, but because the guy was able to prove that the source code in all those cabinets that were not made by him had his source code, the judge moved in his favor and he won the case which is one of the cases that Nintendo has lost in a courtroom, and there were others such as the game genie one and etc, but because Nintendo does not want people to look into their past, they have covered most of these cases and even info regarding them which is why not many folks know about them, and they even tricked companies like Sharp into giving them specs on what a good portable device screen should have been, because they pulled that kind of crap when they were making the GameBoy, but even though they had used Sharp's resources and time, they then went with another manufacturer basically backstabbing Sharp, and they basically tried to do the same thing with Sony when they wanted to use their CD technology, as they were working with them to make the Nintendo Playstation, but because Sony would have gotten publishing rights since they were going to use their CD technology, Nintendo pulled out of the deal in the worst way possible, by basically announcing in that years electronics consumer show that they were going to partner up with Philips instead, because their plan was to basically publicly humiliate Sony, so that they wouldn't be able to resort to some kind of retaliation , but Sony just moved on to announce the Playstation as their own console, and as such Nintendo basically created their own worst enemy because of their crappy business practices, and its crazy how such a company has managed to last thing long, because with how evil and anti everything Nintendo is, they should have gotten bankrupt a long time ago and they don't deserve what they currently have, I highly encourage people to look up their history, because this is a company that has even stole funding from schools and stuff, by suing them just because they had Nintendo decorations or merch decorating the schools, since the students had been big fans of theirs, instead of Nintendo just doing a cease and desist or something, but that's just how Nintendo operates...
So basically the Disney of video games? Except their output at minimum is mediocre and at max is critically acclaimed.
@@woshee_real Yeah, its just nuts, thats one of the best comparisons you can make though, because Disney is just as bad as Nintendo if not worse, and I would have liked to talk more such as how there are even rumors that Nintendo was the cause for Argonaut games becoming ruined, because those developers had been creating pretty good games for Nintendo and stuff, they were the ones who made Star Fox and even had Star Fox 2 pretty much almost finished, but Nintendo didn't let them do what they wanted, and supposedly when they pushed out the idea for a Yoshi 3D game, they had a working prototype, and showcased it to Nintendo but they acted like they were not impressed, and the rumor is that they used that prototype as inspiration for Super Mario 64, and then Argonaut games in frustration made Croc in order to keep using the assets that they had already made, again though this one is unconfirmed, but I'm sure that there has to be some truth to all the rumors around, and the only way to truly know is for someone really good with investigative journalism to tackle most of these rumors, and that is why I normally mention facts like the one with the Donkey Kong programmer.

This goes back decades too. Even to _absurd_ levels. Like, the reason they withheld themselves from using full properly orchestral music for so long, was all because playtesters would perform actions in time with the music. Oh no the horror!
That's how absolutely insane Nintendo is. You _WILL_ play and think about their games _THEIR_ way and not any other. Including when they start screwing you over or delivering subpar products.

i think people often tend to forget too that for every fangame that gets taken down theres dozens of new ones being uploaded everyday, not to mention the reason WHY they get taken down is because big news sites like kotaku alert the masses *INCLUDING NINTENDO* about their existence.

Except there is bad about it. It baffles me how many of you here argue it falls under "fair use" -it doesn't, literally just google "does fair use allow fangames", it will tell you that fangames are an unauthorized use of copyrighted material. Copyright literally means "right to copy" -you as a fangame creator DON't hold their copyright and therefore don't have the right to copy or redistribute copyrighted content claiming it's "fair use". Fair use is for purposes of commentary, criticism, teaching, news reporting etc, it doesn't allow you to steal someone's assets and put together a game of your own out of those stolen assets and redistribute those stolen assets along with the game, regardless if you make money off of it or not, it is illegal. The only time I agree with you is with nintendo's game letsplay footages on youtube getting taken down as THOSE CAN (not always) fall under fair use, tho they would likely fall flat in court in many cases as they're not very transformative and technically can be taken down legally, just many companies choose not to do it because it can be good pr. Educate yourself and stop saying that stealing and redistributing stuff that isn't yours is fair use.

This isn’t a talk about whether a fan game falls under fair use or if it’s legal or not to use assets from someone else game. Before you start rambling on about that kind of stuff, please read what the original commenter is talking about first. It isn’t that hard
At some point, the copyright offices REALLY need to be overhauled. Not only should copyright offices be actively seeking out and punishing companies that send false DMCAs, but fan projects need to be put under fair use, as, if you aren’t charging money for them, it is essentially the same thing as a kid making up stories with their toys. If it is a parody or analysis, then it shouldn’t matter if it’s making money (technically speaking, that part is already SUPPOSED to be the case), but if it doesn’t fall under one of those categories, as long as it isn’t making money, it shouldn’t be struck, and the government should be actively stopping companies from doing this instead of waiting for somebody both brave enough to face the company and rich enough to afford good lawyers to take them to court.
Also, I’m not sure if this is already the case or not, but if it isn’t, then the copyright laws should apply to the country the person BEING SENT the cease-and-desist is from, NOT the country the company is from.
I completely agree, and I appreciate you speaking up about this @gechoman44iwantahippo -- companies that wield copyright law as a weapon to intimidate creators or stifle communities really should be taken to task by the media. It's frustrating!
For me personally, I just hope that Nintendo can learn to reflect on these interactions they've had; there's so much genuine passion and creativity in these communities, and it's a shame that they often see them as a legal "enemy" as opposed to what they are: some of their most passion fans.

Neither do I so I'm not suited to talk as if I do, but enough to know that it seems to encourage aggressive action and is rather outdated. US laws and how they're set on precedence also some part in it. That's why some lawyers would argue that the law itself is the main problem in all this, but I'm no expert. Really, best to consult an actual professional on exactly how IP laws work, rather than simply trust in the layman's very basic understanding of it.

From a business perspective…I kinda get it? Nintendo works with low power consoles that get by on brand recognition. Being hyper protective of that brand is vitally important to them.

Which is funny considering you can't even BUY Super Mario Bros. 3 from them. You can only purchase a temporary subscription to access the game from a server, and as soon as they drop NSO support for the switch, guess what happens, you lose access to that game, and by extension, your save data.
Personally, my theory on emulation, fan games, and now games being not even owned by people or having to be activated is simple! If you play an old game, or a free game, you are not giving them money or playing their newest product. How would you dare not to give them your money.
If you make a Nintendo fan game:
Release the game and it's source code quietly and anonymously. The internet will handle the rest.

Apparently, SEGA treated Christian Whitehead and the other devs of Sonic Mania like shit (in payroll). They only got paid from game sales when they hit arbitrary numbers. They didn’t get any money from game sales themselves.

Nice to finally know the reason why Christian and his team had such a bad fallout with SEGA. I knew they had a fallout but not why, only that SEGA was being… well, SEGA.
So, while I appreciate SEGA's generous attitude towards fans and their content creation… SEGA isn't really better than Nintendo, they're just bad in different areas.
SEGA treats their employees like any standard American corporation - which doesn't excuse anything but makes it easier to swallow when you inevitably get burnt due to how normal/common it is - whereas Nintendo is straight-up draconian control freaks towards their CONSUMERS, which leaves a very sour impression when you try to interact and work with them as a content creator… which is by far and large a much more unique experience that tends to single Nintendo out.
Xbox is very protective of its IPs as well and will SOMETIMES send out cease and desist orders to fan game creators for CERTAIN IPs but is by no means as unreasonable with their consumers as Nintendo is. You don't see Xbox or Sony go after modders or people making emulators of their old hardware - like the Xenia and RPCS3 emulators - whereas Nintendo does (they've been in conflict with the Dolphin emulator for years trying to shut it down as an example), and Nintendo will peck at EVERY fan for ANY of their IPs.
People dislike Sony and Xbox for their business practices and treatment of their employees but again, it's easier to swallow because they're not unique in this. Nintendo is very unique in how they strike down on content creators, whether its mods, fan games or emulators.
Hence, SEGA gets more slack despite its horrid business practices because it's not unique on that front. It is, however, very unique in how VERY GENEROUS they are towards their consumers and fans. So long as you don't profit from their IP, you can go nuts with your content creation. (Not even Xbox is that generous; they'll still send a warning to fans if certain extreme things like creepy pasta get widespread.)
SEGA doesn't even mind if content creators ask for donations to help them better sustain themselves and focus more on the fan creations they're making. Because it's not considered profit so much as charity to help out a project both the creator and fans alike are passionate about. The fan game itself won't be charged for, so it's not profit.
Very generous indeed.
Small things like that are the reasons why a franchise like Sonic is still going strong and still considered a cash cow to SEGA despite its wild inconsistency in quality. If SEGA started striking down fans like Nintendo does, they'd lose a lot of profit and loyalty from fans overnight, and basically kill their IPs.
I've been sick of the "SEGA, HIRE THIS MAN!!!" drivel that's been going on for years. SEGA doesn't hire any random modder in their parent's basement to work for them, it takes proper education and experience with game development like any other studio.
And if you are actually this man which SEGA hires, don't expect good working conditions, handsome pay, or to be secured for future projects.
If people are playing fan games and not buying official ones, the fan games haven't done any damage. Either the player has no money and to play the official games would constitute piracy - OR the official games are so bad that they aren't worth buying, in which case the company has damaged their own reputation.
That's a good point @ErdrickHero, I also believe that fan games and Nintendo's official ones could possibly coexist without damaging one-another.
More than anything else, it'd be nice to see Nintendo embrace those communities (and their creations), but it's probably going to take a long time. We can hope!

Hiya, ex Project M dev here, thanks for the coverage. It's been a pretty dark day for our community when we got shut down, and I'm proud to say that unlike Nintendo, I love our players dearly.
I remember doing the interviews for the mod, and we actually did our best to stay in their good graces. We promoted a hackless method to access our mod, spoke positively about Nintendo publicly, and even stated that Nintendo had our blessing to use any content we come up with. We basically did everything right. And this wasn't even enough.

Damn, you guys were really fighting an uphill battle. The games industry as a whole (but especially the big players) collectively despises emulation and modding, and Smash Bros being a collaborative effort means the whole industry (even those uninvolved in Smash) would've been breathing down Nintendo's neck to end you. And best of all for these guys, Nintendo would absorb the entirety of the bad press around it likely due to their third party agreements. The industry, and Smash, being what it is meant that you were always going to burn under their ire.
I'd just ask to try to see it from Nintendo's side who needs to maintain third party trust in them despite allowing Project M to last so long. And yes, they could've ended Project M way sooner. And again, these third parties that Nintendo courts for Smash Bros, they all hate emulation and modding and it REALLY doesn't look good for Nintendo to do nothing about it, and so for Smash to continue as it is, to maintain third party trust in them, means they'd have to put an end to Project M eventually.
In short, Nintendo HAS to be extra, extra skittish about Smash Bros as it is always more than just Nintendo that Smash Bros represents, it often represents gaming in its entirety.
And keep in mind, one can absolutely stand up to the rest of the industry... But they're not gonna lend you their characters if you do, will they?
@luxinfinite1394 Sega in fact gave us their blessing to use Sonic and Knuckles. They have even commented on how much they loved our Jet Set Radio costume for Sonic, and expressed sadness at Project M's closure.
Konami has not spoken on the matter, and my sources at NOA have confirmed that this was Nintendo, and Nintendo only.
I do not wish to see Nintendo's side, as they are clearly in the wrong and they do not have a legitimate case. Mods have been allowed by companies like Valve and Sega without any issues prior.
Nintendo acted in bad faith, tried to control us, and the pressure argument falls apart when it was proven that they were subtly trying to get TOs to cast us aside and do their dirty work for them before they started going nuclear. They spent years making false promised and lying to the smash community that if they forsakened our game, they would be getting official support, which never even happened. They tried to get away with it scott free.
Mods can easily exist. We call this an open license agreement.

No company will do that because it doesn't affect them. They only stand to benefit from the false hits as it gets them a little more and they can just say 'well, it was a mistake on the bot's part' if worst comes to worse.

Sonic Mania was made by people who started by making ROM hacks and music remixes of Sonic games. SEGA won't officially acknowledge fan games, but as long as nobody tries to sell them, they leave fan projects alone. Nintendo absolutely does not need to behave this way.

This is why DMCA'd games need to just leak. Never understood why fan projects just buckle. These corporations can't do anything about it once it's loose.
That's an insane take, if the games see any distribution then the corporation that DMCA'd them can interpret that as disobeying the DMCA notice and file a lawsuit. Games can't "just leak" as any form of leaking is an intentional action, which gives grounds for it to be taken to court.
@@kieranboulton3953 Things get leaked all the time, stolen. They might have shared the game multiple times during production for testing. Its not like fan games aren't often open source projects produced by many people. No one person can be condemned for a build floating about. If long before the dmca was issued a person had the game sitting on a drive and it got lost on the bus, and that game appears online how is it the makers fault? I've never seen this issue get pushed in court. There is no precedent for someone being hung up like this for something that is out of their hands. Once Software is online it can't be expected to be contained. This is why these projects should be public in the first place.

Of course, any subsequent release from outside of the team would not result in the team facing consequences. Instead whoever was responsible for distributing them would face their own DMCA notice. This is exactly what happened with Yuzu after it was shut down, when a load of reuploads started popping up straight away they were swiftly met with DMCA notices, but the Yuzu team faced no further action.

SEGA, VALVe has issued DMCAs in the past but it's super few of them, really specific, hell Portal 64 was not taken down by VALVe technically, they asked the dev to not use Nintendos N64 code, he ended up declining, and took it down himself. TF2 Source 2 was already dead in the water due to S&Box not being a stable engine (garry keeps changing the entire thing).
They should reconsider becoming a lawsuit firm instead with their track records

Either hide, or sublet your code to so many people that any form of DMCA does NOTHING to stop your project from vanishing. This is what we did with Mario Royale, so many independently developed branches at this point, that we'll never lose the game, hell, I made sure to back up a copy of the game!
nintendo has every right to object to you literally distributing any sort of copyrighted assets of theirs for free, it is illegal and is considered a copyright infringement as you are copying-and-redistributing THEIR content without the COPYRIGHT-HOLDER's permission, it is ILLEGAL to do so. Please do your research on what "copyright infringement" is, what rights does the end consumer have and what terms and conditions apply to the end consumer who is using the product.

@@BiTreeFrog except the law is designed to make you care via punishments for breaking it, and I believe the punishments are there for exactly such attitudes. The copyright law isn't there to piss people off, it's there to protect intellectual proprty from theft and unauthorized use and redistribution, it literally applies to anyone whoever made anything original.
The official answer why nintendo hates fangames that I heard a few years back was that there were people who couldn't tell the difference between the fangames and offical releases and would supposedly contact Nintendo's official helplines when their game busted and nintendo A)didn't have a soultion having never created the game in first place, and B)couldn't handle their helplines being flooded with so many new people.
This is why so many fangames have "not an offical product: and should not be treated or sold as such" at the beginning of their game, to try to prevent this problem from allegedly occurring.
This is only happening so far in the West. Idk why this reason was so hated that doing fan games would be a good thing. Plus, Nintendo mostly makes good games lately than any other game company in Japan.

Nintendo tends to consider PR when picking fan-projects to take down.
A part of me suspects this is why they have not done anything to the Satellaview fan scene (Notable for BS Zelda projects and translations of recent Satellaview ROM dumps); namely, any attempt to take that scene down via legal action will lead to increased awareness and demand for a legacy platform they haven't touched in over 20 years, that they very likely are not willing to placate.
I kinda hinged my TH-cam Channel on that bet, and, somehow, in spite of me sometimes doing high-risk things, I never got any legal threats from Nintendo.

@@NotYourFriend-YT "Cyber Citizen Shockman Zero" is available in English now! You may enjoy that one if you want to play a beat-em-up with some Mega Man-esque platforming and visual aesthetic. A while back, Square's infamous "Radical Dreamers", the predecessor to Chrono Cross, was included in Cross's HD Remaster "Chrono Cross: The Radical Dreamers Edition". I think it'd be a good idea to support these releases to show further interest! "Cooly Skunk", the early version of "Punky Skunk" that broadcast as a Satellaview demo only to never see a proper Super Famicom cart release, may well be next in line if the fundraising does well.
As for what's been recovered recently by ROM dumpers, the Satellaview version of Super Bombliss is probably the biggest bombshell in regards to amount of ROM content. There were also releases for BS Fuurai no Shiren and Takara-hai Osumo Eisei Bashou, as well as several demos, including one for SFC Madou Monogatari with a few prerelease graphics and a version of Panic Bomber W that doesn't use the SA-1 expansion chip.

While we're on the subject, fans of Nintendo 64 games should be aware that *every N64 game can be decompiled, and the tools to do so are free and open source.* Anyone who's willing to learn can port any N64 game to PC and play with upscaled graphics, decompressed music, maybe create some bug fixes or make mods. Skies the limit. The code is your oyster.
Other N64 titles currently being worked on include Mario Kart 64, Super Mario 64, Banjo Kazooie, Goldeneye 007, Perfect Dark, and Majora's Mask.

As I recall, my personal tier list when I played was, in order:
- Magus (I was an edgy teen.)
- Lucca (best girl)
- Robo (best girl's robo bro)
- Ayla & Chrono (Liked 'em, but not much)
- Marle & Frog (actually disliked them)
Chrono Trigger was one of the few games that I regularly switched up my team. I actually made use of everyone.

Darn it ... you've got me wanting to re-play Chrono Trigger now. (I'm in the middle of an FFIX replay, so it'll have to be after that ..)
And you know who caused all the stock market crashes on Monday? It was Japan. What happens is that Japan has the cheapest loans in the world and many people found out that they charged very little interest on loans, and people used it to buy or invest in the stock market, and Japan saw that they were giving money instead of the loan being returned with interest, they increased the interest and made no changes and that is why the stock market fell.
The real irony is how Nintendo's aggressive attitude towards fan games hurts their own reputation, sales, and fanbase. They are actively declaring they do not want to have fans. It also leads people to question the quality of their modern games when, without all the DMCA, they might have been happy to overlook the lapse in quality.

If fans are playing fan games they aren't playing our newest game
If fans put out fan games for free people aren't buying our new game
If fan games get more popular then our original game it makes us look bad and they worry people will whine why wasn't this in the original game
Fan games that upgrade the original might set a new standard for the next game we put out or be unfairly compared to it
Fanames/mods that are higher rated them the original game make us look bad and ruin the rating that game has and are not to be encouraged WHAT if my chronically online child found it!

It was basically Mario wonder vs Mario world ROM hacks
Do I agree with the guy?no, alot of points was just, ROM hack y, did this better, and ROM hack x, did this better, and físics on wonder are not Mario world enough (even tho he mostly plays Mario world so of course the other 2D is not gonna feel like world)
Is not creative enough, wonders seeds are respective (yes but no, you play the stage twice sometimes just to see what doesn't change and be new level even it is just a bigger enemy) and a lot of bosses are respective (even tho a lot of ROM hacks of Mario world are still use vanilla bosses in a different situation only)
But the fact that a guy did this video, to dunk on wonder, praise ROM hacks that are nowhere near eachother aside from using Mario world says alot

Honestly, I think that, despite some of their scummy moves, they're probably the lesser of the evils currently in play. At the very least, they're not as interested in moralizing, demonizing their customers, forcing political stuff into their games, ect. I'd suffer with it so long as that remained the minimum, though I'd obviously hope for a change for hte better.
I am a long time Nintendo fan and I have grown to genuinely hate them as a company with a burning passion.
I know how you feel @magmamaster1801; I grew up really enjoying Nintendo games myself, and have *amazing* memories of playing them with my friends and family.
I hope they can reflect as a company and learn how to embrace a lot of these communities. There's a lot of passion and creativity there!

And no, Valve and Sega are no different, actually dive into the messy logistics and it's easy to see how it's all cold, calculated business. Except most of the fans just wanna ride that train of success nintendo has by stealing their assets and designs and slapping their name onto it. I think anyone who is a creator (I can tell most of you never created something of your own given how you can't imagine yourself in nintendo's situation) -I think anyone would be pissed if they saw someone else using their work without permission and slapping their own name onto it and saying "this is my fangame" while it's put together of ripped original assets and designs that aren't theirs. It's downright unfair, go make your own platformer and don't give him blue and red overalls while naming him mario and giving him the exact same look as the original mario design, see how successful you can get when you have to make the works yourself instead of stealing nintendo's content.

It’s completely acceptable to make art of a character you don’t have the rights to, it’s protected under fair use laws. While a lot of fan game creators and modders don’t use their own assets, which is not protected under fair use, a game is more than just graphical assets. When Sega saw the work of dedicated fans, instead of trying to destroy their careers, they hired them. That’s how we got Sonic Mania, one of the most beloved modern Sonic games. Sega has learned that fans carry the heart of their franchise, so they hired fans to help create Sonic Frontiers. If Nintendo took a leaf from their book and chose to hire these talented creators, even in a single small project, to work under their roof then we could have some incredible games. Pokemon tries to snuff out their fans as much as they can, imagine if they hired them to create their side projects instead of ILCA, who make the worst version of Diamond and Pearl. If Nintendo hired fans then they’d have their ears directly at the source of the people who purchase their games. But no, Nintendo only sees fans as obstacles to their money, much like you apparently.
@@tylerwebb2495 Except those fans don't have much to offer to nintendo, that is exactly why they compensate for their own shortcomings by using nintendo's concepts, designs and downright assets because they contribute very little by themselves most of the time and trust me -nintendo doesn't need an average-to-mediocre level of quality worker, especially if he hasn't gone out of his way to try to apply for the job directly instead of infringing on copyright by distributing stuff that isn't fully his. You are right that it is acceptable to make art of a character you don't have rights to but that is exactly a case of fair use, the fangames we are talking about do not fall into the same category as they are not merely using a portion of the work in a transformative way but downright copying the entire game in many cases or producing an end product that is absolutely drowned in copyright-infringement and is then distributed as a game. Don't you see a problem with that? Hell, even if it was lets say -only music, wouldn't that be incredibly unfair for someone to be allowed to just yoink some music and use it in some work that isn't even fully theirs infringing on more and more copyrights, its a total disrespect to the law of "if you don't have permission then DON'T DO IT, ASK FIRST", nobody is stopping people from asking nintendo if they can use their stuff, except they probably know nintendo would just say "no" but anyway.
Nintendo has every right to do with their IPs and their EXCLUSIVE COPY-RIGHTs as they please, if they don't want to give you permission to do what is ILLEGAL WITHOUT A PERMISSION then you are simply not allowed to, end of story.
@@Bond01_ we’re not talking about every average creator to be worked with, that was never the case. Not every kid who makes stuff on Mario maker has a lot to provide. But I’ve played countless fan games across multiple franchises that have just as much original content, including assets, as the games they’re modding. When a fan chooses to use assets from say Mario or Pokemon, they do it because they love that franchise, not because they want to rip off something that isn’t there’s for some sick pleasure. It’s not out of laziness, it’s out of passion. Instead of harnessing their creative power they’d rather end it. In the end it’s closed minded and destructive. If every tech company just wanted to jail hackers they’d have very vulnerable systems. Instead they hire hackers to test their systems, using their talents for their benefit instead of attacking them. Some will be destructive no matter what, sure, but that’s just life. Nintendo doesn’t make allies for themselves, they only make enemies.
You have every right to kill creativity because it hurts your feelings, power to you. So does Nintendo. But there are better options that Nintendo and you refuse to see
It also reminds me of when persona 5 was released and even the gameplay being uploaded caused DMCA takedowns. Honestly, DMCA is just the catch all of “trademark” whilst ignoring “transformative work”.

Speaking of Sega, they did DMCA the fans that were working to translate Fate/CCC to english, people though that sega would actually bring the game to EU and US, but they never did, so we never got the translated version.

Project M was especially quirky in the fact that if you wanted to play it You'd have to buy the smash bros game. Meaning if you wanted to play the fan project. You'd have to send Nintendo your money first.
My guess is Nintendo just has PTSD from the Donkey Kong incident, so they want to keep a stranglehold on their IP to make sure it never happens again.
And now their IP is suffocating to death.

As good as Nintendo is at making high quality fun games, SEGA is at dealing with their fans. The reverse is also true. As bad as SEGA is at creating good high quality games, Nintendo is at dealing with their fans.

People that played Nintendo games needs to get over this because compared to Sega, Capcom, and other game companies in Japan, they’re literally the biggest game company so far and they’re strict with their characters which they don’t want to be used publicly. Even the player base in Japan will not like it either.

I found out something weird about Japanese copyright law... there is ZERO allowance for fair use in Japanese copyright law. So as far as they're concerned, nothing is fair use.

I think the reason companies take down fan games so often is because this fan made content is almost always better than what is officially offered by such companies, and could just prevent users to spend money on their products for the fact that they could get a better one for free, thus making these companies lose tons of potential money gains.

My all-time favorite game is actually a fangame: Sonic Robo Blast 2. Sega has been so incredible to their fans over the years because they KNOW that the thousands of fangames, romhacks, mods, animations, music remixes, etc do nothing but HELP the franchise succeed. Whenever the official sonic games lacked in quality, the fans would step up and make things that they wanted to see.
Sega saw that and didn't JUST actively choose to let all of it continue, they also HIRED some of the most prevalent creators in the community to work on the series officially. Tyson Hesse, Tee Lopes, Christian Whitehead, Simon Thomley, Ian Flynn, all of these people were major figures in the sonic community. ALL of them have worked on the official games in one way or another. (hell, Sonic Mania, Sonic 1 HD, CD HD 2 HD, 3 HD and Superstars literally would not exist without them.)
No company is your friend, but some are better than others, and Sega is among the best in terms of how they treat their community.
It breaks my heart to see the passion and love people have for nintendo's franchises and the hard work they put in just be completely disregarded by the company.
This is in no way me trying to defend Nintendo, it's just something that might offer a... explanation to their behavior. I have a feeling this originates out of paranoia of losing control. Because that almost happened to them with Sony, when they were originally working on the Playstation together. I recommend watching the video "Nintendo was right to backstab Sony over the PlayStation".
Again, not a defence. Just a possible explanation as to why they're so overly hostile.

Hilariously whenever Nintendo strikes down something that fan game still remains on the internet forever, btw I've sent you something on your community post as well
Keep in mind, I still despise their DMCA legal team and weird business decisions, but the problem is when you blame the company as a whole, You're dragging in its developers and employees considering the fact they have nothing to do with the DMCA decisions.
Another thing is some of those developers/ voice actors do go to Comic-Con conventions and see fans as well.

What these guys are doing is actually promoting Nintendo’s brand in their own way. I don’t think they are damaging anything from what I can tell.
I completely agree @davidolukotun2870 - these fan games are *celebrating* those brands and characters, and it's a shame that Nintendo doesn't see it that way.

@@NotYourFriend-YT That’s the thing, you see. Nintendo is just too out of touch in this day and age. It is high time that they put their stringency aside and view those games for themselves for they truly are. Art and darn good masterpieces at that as well! If I was the current CEO of Nintendo, I order my men to find the person who made that fan game, bring him/her here and tell them that I want them to turn that fan project into a game, and that I will heavily promote it. Thus not only strengthening the brand, but also the company closer to its fan base. And occasionally, we might the same thing SEGA had done with Sonic Mania, albeit with better pay and resources to make the best game that project can be! What do you think of this idea, eh? Is it not great!?
Why wont they team with the developers to make EVEN BETTER mario or pokemon games instead of DMCA'ing their games..?
Not like they don't have 11 billion in cash to burn. USD equivalent, not yen.
Because their entire identity requires complete control over their IP in turn making it impossible for people to say "We can fix it." or "It could be better."
They have even targeted children with MTX heavy games yet are family friendly?
Nintendo's true identity would cause a massive fallout especially if fans could do better with ease and consistently. For example, think of what would happen to a more spiteful Sega if fans do almost everything better for free. It would be the death of Sega, or in Nintendo's case likely their own death if not massive loss.
@@cosmicskydragon333 if these fans can make better games than Nintendo, then they don't need the the Nintendo IPs to do it.
I ain't a developer, but from what I can see these fan developed games aren't a great resume builder. Sega Sammy likes to cheap out wherever they can, whereas Nintendo I'm guessing simply hires experienced professionals or outsources to experienced studios. Also, sending job offers to fan developers is likely frowned upon by the gaming industry as a whole, especially with its universal disdain towards pirating software and hacking.
Plus the main teams working on the main Nintendo games tend to all be located in Japan. In the same building, speaking the same language.
Seriously, Nintendo games have been getting stale, giving the fans the reins gives 2 things:
1. Easy ideas for future Nintendo products
2. Games that can fill out content droughts
This reminds of a story from 2 years ago. SEGA issued a DMCA copyright to a Sonic game on Roblox. However, they did so because the creator of the game was a creep, and Roblox moderation didn't do anything about it. At most, he was banned for 3 days, but Roblox did nothing. So, seeing that a PeD0 was being tied to the Sonic name and Roblox's refusal to punish him for his deeds, SEGA stepped in and gave him a DMCA as a last resort of sorts to hopefully get him banned off Roblox.
Tbh, a W move by SEGA.

24:55 From what I've heard TH-cam actually changed it so if you get a bunch of DMCA claims from one source it counts as one strike. Probably to tone down abuse of the system. It's still abject lip service of course but at least one claimant can not threaten your channel. (I mean they technically could and people abusing the system to harass people would use this method but I'm not going to mention how, don't want to give anyone ideas)

Nintendo hasn’t sent a DMCA for it yet, but look into Star Fox: Event Horizon. A single person has been working on it for ten years and it has multiple of the original voice actors in it.
