22:50-23:08 You claim that the lane splitting law is ambiguous, it's not. It expressly states: "...in the same lane including on both divided and undivided highways, streets, roads, or highways". This codifies ALL roadways, including those which have only single lanes of travel in either direction. The vast majority of streets are not multilane, most "roads" as classified under California law have no marked center division for travel direction, and most state highways are dual carriage ways (meaning single lane bidirectional travel). A lane is defined as the space sufficient for a single car to travel. As written, in plain English, a motorcyclist can split the lane (meaning riding abreast another vehicle) in the same lane so long as it is safe to do so. Furthermore, courts take into account the INTENT of the law as passed. In this case, the intent was to allow for motorcyclists to filter through traffic to alleviate congestion, as they're more maneuverable than a typical car and can fit through tighter spaces. This is exactly what the biker in this video was doing, and he was doing so safely. Even if the legislature grants discretion to the officer to determine what is and isn't safe, per se, that doesn't grant an officer the discretion to utterly misrepresent and misinterpret the law as set forth by the California State Legislature and use that misinterpretation and misrepresentation to detain and cite motorcyclists.

The fact that the first guy can’t find an attorney that is willing to take his case against the police says so much about how screwed our “justice” system is.
Justice is only for those with money. To get a civil rights case started, be ready to spend $30k, just to get started and in 3 or 4 years, you may get your day in court with no guarantee of a big payout.

So cops entered a private property, illegally, then want to jam the guy up for being there. But they don’t know who the owner is or who has permission to be there. They threatened to kill the man’s dog in the place he’s staying! Then they look for excuses to arrest him. What a crock.

Thank you for the breakdown of that video. I am the one in the first part. I did not file a suit but did take other actions. The officers down to the capt was dealt with. Extra help with support from others after the video first went out, caused others to get dealt with. Since then, they have treated me with high respect.

Cops unalive dogs so often. If a dog annoys me I can call the cops on the owner. By the 4th time, they are highly likely to have shot the dog by then. It's messed up, but goes to show how little cops care and how willing they are to off dogs, even over dumb shit like noise complaints.

Of course, they have the same legal rights as the rest of us and no more and no less. But I have never put my life on the line to serve my country. I’ve never subjugated my own needs and wants about where I lived, and what I did to that of my profession. I’ve never had to leave my children for extended period of time to serve my country. I do feel veterans should be given special respect, they should be supported differently from the rest of us when they come out of the military. And they absolutely should inform the police that they are veterans when their PTSD could be activated. Just like you are I should tell the police if we have seizures caused by flashing lights so that they can turn off the lights. Just as you and I should tell the police if our child is severely autistic and might react differently on a traffic stop. And he certainly had every right to say “I thought for this country, for these rights, and this is despicable what you are doing”.

How do you break into someone’s place, demand ID, not give him a chance to get the ID, and then threaten him with arrest for not responding fast enough when a cop asks?
Plus he had no requirement to produce a document for ID because he wasn't performing a restricted activity (drinking, driving, fishing, hunting, etc.) - verbally giving his name, birthdate, and address would have met the requirement even if the LEO had reasonable suspicion.

In relation to the 2nd scenario. The mistake belief that a law has broken is enough to support RAS, is a great example of why under educating police is so prolific.
It seems the people in charge of police academy curricula are deliberately leaving out relevant sections of law in order to fool people into thinking they have no rights vs. cops, so cops can continue their highway robbery apace.

I also noticed that a judge can throw the case out ,for what seems like any reason they feel like. Cops behaving criminally has become so commonplace that our "justice system" is full of public servants that refuse to honor their Oaths as well. They don't deserve our tax dollars that pay them.
What I want is for the police to not violate my rights, but since they already have, what I want doesn't matter. Police are going to do what they want to do.
If I go to jail, I will petition the judge for equal treatment under the law and demand you face jail if this stop is found to be unlawful. So you tell me, officer. What stakes are you willing to put up? I know who my District Attorney is, I do my civic duty locally, do you?

In situations like these, you can only conclude, either they don't know the law, which is pretty incompetent for his position, OR, he just didn't care about it, and likely out of habit, just disregarded it because he feels the laws don't apply to him. Neither one of those is a good thing. Who would think so? It continues to amaze me how, more often than not, officers aren't even proficient with or of the laws they're supposed to enforce, and it's like this nation wide. How can there be such widespread ignorance among officers? Furthermore, is there not a single person capable or concerned enough, to put forth the effort out of genuine concern, responsibility and ethical considerations, to notice the consistently negative effects of what continues to be a repetitive issue, and have no desire or not even be curious enough about fixing what is broken? It doesn't take a genius to conclude, that maybe the educational requirements for becoming a "law enforcement" officer, have standards that are too low. Perhaps it'd be a good idea in making the written exams tougher than the physical requirements. At the very least, officers should be given some kind of entry exam prior to being hired, and, any time when moving to another state, to clarify any differing laws from any state they no longer inhabit. At least once a year, they should be tested again on established laws as well as familiarizing officers with any newly passed ones, to make certain they are aware and understand them, and anything applicable to their division or when a promotion is given. I can't imagine the cost that can accumulate from civil rights violations lawsuits against PD's nationwide, for no one to have the sensibility to see, how a lack of knowledge is counter productive and an inevitable liability, as well as a waste of money using funds that could be better spent for improvements. Not to mention, improving citizen/officer interactions, because there would be far less unlawful arrests and abuses of power that can cause unnecessary trauma on mistreated citizens. It seems stupid to me that the only answer they ever seem to come up with, is to throw more money at the problem, by raising taxes instead of raising competence. It's common sense to consider the adage, " money in the hands of sensible people will be handled sensibly, while money in the hands of those without sensibility, will be handled senselessly." It's not complicated, yet in all this time, and with all the unnecessary incidences, there doesn't appear to be any effort toward ensuring officers are thoroughly understanding of their protocols, and with more challenging standards in their licensing curriculum that isn't done on a sliding scale to pass. I haven't experienced this. Maybe it's just different locations. When I became homeless a few years ago, there were people moving mountains to get me under a roof. They gave me the hand up I needed to get back on my feet. Now I volunteer as a peer advocate for other disabled vets in my area. I'm sorry you haven't been treated well. Not to get into politics, but I think the rulers of a state have a lot to do with attitudes of the people working for them. It seems like red states are much less caring about people who need help. They tend to help rich people who don't need any help.
From my experience, the VA works at the local level. The clinic I go to does a great job. Now filing a claim or do anything at a higher level....good luck

That cop seemed perfectly reasonable. I know in my state it's illegal to pass on the right except when the vehicle you're passing is turning left, and you can pass without leaving the traveled portion of the road. Lane splitting is also illegal in my state as well though.

The motorcycle incident is exactly why I stopped riding when I moved to California. My bike is completely stock and I get pulled over with good ol’ Long Beach pd saying my turn signals are too close together but stick out too far. It’s not the risk of riding that’s scary, it’s dealing with cops.

The cop was correct he just didn't use the correct terminology. No one was making a left turn. There wasn't two sufficient lanes for vehicles. It wasn't a one way street. It was not a divided highway.. Number two motorcyclist was wrong. (a) When the vehicle overtaken is making or about to make a left turn. (b) Upon a highway within a business or residence district with unobstructed pavement of sufficient width for two or more lines of moving vehicles in the direction of travel. (c) Upon any highway outside of a business or residence district with unobstructed pavement of sufficient width and clearly marked for two or more lines of moving traffic in the direction of travel. (d) Upon a one-way street. (e) Upon a highway divided into two roadways where traffic is restricted to one direction upon each of such roadways.

This is about motorcycles in CA being permitted to *share* lanes. With no legal determination whether or not they must share to the left or to the right. Literally zero laws establishing such. The statute does not consider sharing a lane the same as two lanes (nice try, tho). The law is silent on how to share the lane. Therefore any attempt to regulate such would be incorrect.

They had no authority to go in there at all, nor to demand anything of Sample, nor to put him in handcuffs, nor force him to come outside, nor force him to grant access to his vehicle to get his ID. Cops in U.K. rarely kill dogs unless they are attacking or have attacked someone and are too dangerous to do anything else with, including too difficult to catch. Yet seems US cops are scared of all dogs and gun crazy.

The lack of teaching of the law to police officers in the US, is the reason I’m glad I live in a country where the training to become a police officer takes between 2.5-3 YEARS, depending on the state. In the state of Bayern, where I live, it takes 2.5 years to become a police officer. The 1-1.5 YEARS is basic study period about laws and regulations, report writing, first aid, general political Zeitgeist, languages (German and Englisch), communication, job ethics and of course physical fitness. From what I can tell from my research, no recruit will actually be on the streets (with at least one senior officer) until the last year of the training process. I got pulled over in Houston one night for some BS lane change (cop was fishing for DWI's) at 145AM, years ago, I was a security guard at Lockheed (off-site NASA) in uniform on my way home from a shift. I argued that he was wrong, he didn't like that one bit and threatened to call Lockheed Martin and tell them I shouldn't be driving their patrol vehicles if they have any (which they didn't at this facility). He gave me a no seatbelt ticket which was also bogus because I took my belt off when we stopped (dumbass move on my part, dont ever do that)
The purpose for a cop to call your employer has nothing to do with the situation that’s happening, being a traffic stop, the cop was wrong and his ego wanted to ruin this guys life, there should be a law on the books that prevent these cops from going outside their scope of policing and calling peoples employers, there’s absolutely no reason for this with the exception on revenge!
I saw people comment that the door was open, but the video only starts when backup shows up, the first cop had opened the door and illegally entered but fallen back when he heard barking.

That second guy and the cop are doing very well. I haven't finished yet (26:22) but I think the cop should make it clear he's concerned for the safety, the biker should point out when the lane narrowed he got back in line for safety reasons, and then they can agree that the law is ambiguous, THEN the cop can offer to ticket him for it anyway to the amount of $0.01, so the biker can go fight it in court and get it codified in case law and clarified.

I seem to remember a case from Indiana like 15-20 years ago that went to a supreme court’.

This codifies ALL roadways, including those which have only single lanes of travel in either direction. The vast majority of streets are not multilane, most "roads" as classified under California law have no marked center division for travel direction, and most state highways are dual carriage ways (meaning single lane bidirectional travel). A lane is defined as the space sufficient for a single car to travel. As written, in plain English, a motorcyclist can split the lane (meaning riding abreast another vehicle) in the same lane so long as it is safe to do so. Furthermore, courts take into account the INTENT of the law as passed. In this case, the intent was to allow for motorcyclists to filter through traffic to alleviate congestion, as they're more maneuverable than a typical car and can fit through tighter spaces. This is exactly what the biker in this video was doing, and he was doing so safely. Even if the legislature grants discretion to the officer to determine what is and isn't safe, per se, that doesn't grant an officer the discretion to utterly misrepresent and misinterpret the law as set forth by the California State Legislature and use that misinterpretation and misrepresentation to detain and cite motorcyclists.

Thank you for the breakdown of that video. I am the one in the first part. I did not file a suit but did take other actions. The officers down to the capt was dealt with. Extra help with support from others after the video first went out, caused others to get dealt with. Since then, they have treated me with high respect.

I do feel veterans should be given special respect, they should be supported differently from the rest of us when they come out of the military. And they absolutely should inform the police that they are veterans when their PTSD could be activated. Just like you are I should tell the police if we have seizures caused by flashing lights so that they can turn off the lights. Just as you and I should tell the police if our child is severely autistic and might react differently on a traffic stop. And he certainly had every right to say “I thought for this country, for these rights, and this is despicable what you are doing”.

I also noticed that a judge can throw the case out ,for what seems like any reason they feel like. Cops behaving criminally has become so commonplace that our "justice system" is full of public servants that refuse to honor their Oaths as well. They don't deserve our tax dollars that pay them.
What I want is for the police to not violate my rights, but since they already have, what I want doesn't matter. Police are going to do what they want to do.

In situations like these, you can only conclude, either they don't know the law, which is pretty incompetent for his position, OR, he just didn't care about it, and likely out of habit, just disregarded it because he feels the laws don't apply to him. Neither one of those is a good thing. Who would think so?
It continues to amaze me how, more often than not, officers aren't even proficient with or of the laws they're supposed to enforce, and it's like this nation wide. How can there be such widespread ignorance among officers? Furthermore, is there not a single person capable or concerned enough, to put forth the effort out of genuine concern, responsibility and ethical considerations, to notice the consistently negative effects of what continues to be a repetitive issue, and have no desire or not even be curious enough about fixing what is broken?
It doesn't take a genius to conclude, that maybe the educational requirements for becoming a "law enforcement" officer, have standards that are too low. Perhaps it'd be a good idea in making the written exams tougher than the physical requirements. At the very least, officers should be given some kind of entry exam prior to being hired, and, any time when moving to another state, to clarify any differing laws from any state they no longer inhabit. At least once a year, they should be tested again on established laws as well as familiarizing officers with any newly passed ones, to make certain they are aware and understand them, and anything applicable to their division or when a promotion is given.
I can't imagine the cost that can accumulate from civil rights violations lawsuits against PD's nationwide, for no one to have the sensibility to see, how a lack of knowledge is counter productive and an inevitable liability, as well as a waste of money using funds that could be better spent for improvements. Not to mention, improving citizen/officer interactions, because there would be far less unlawful arrests and abuses of power that can cause unnecessary trauma on mistreated citizens.
It seems stupid to me that the only answer they ever seem to come up with, is to throw more money at the problem, by raising taxes instead of raising competence. It's common sense to consider the adage, " money in the hands of sensible people will be handled sensibly, while money in the hands of those without sensibility, will be handled senselessly." It's not complicated, yet in all this time, and with all the unnecessary incidences, there doesn't appear to be any effort toward ensuring officers are thoroughly understanding of their protocols, and with more challenging standards in their licensing curriculum that isn't done on a sliding scale to pass.
Sorry about the unintended length of this comment. I didn't realize until I started sharing my thoughts, that I'd get as fired up as I am. I suppose I'm guilty of just being tired of all the corruption in our government related institutions, that have somehow gone from serving the public with ethics and integrity, to the hierarchy of the socialist model, and the usual influence peddling and clique cronyism. Hopefully in the coming years, we can get back to doing what used to work. A time when the best most competent person would be in a position. Not installed or selected by manipulators of power who ignore any possible virtue of honestly serving the public, and instead, use government institutions as a profit source where the more citations and violations that are issued on an unknowledgeable or ignorant public (who would be less likely to know their rights or afford an attorney), the more money they make. It's such a racket, and anyone who's been on the other side of these crooked interactions, knows all too well, about having their lives totally and unjustly disrupted in ways that were entirely a violation of their individual rights. It is, like so many other things these days, beyond dysfunctional, and all these like minded "professionals" and people in government, with their collective lack of responsible action, (how ironic) need to be replaced by people who actually care about excellence and results. Things generally don't improve when those in command, refuse to recognize their failures, putting their personalities ahead of principles because the money they get for doing so, is just too good!
I'm so entirely sick of all the deliberate red tape BS. As a society, we've got to do better than this, and remove the impetus that has intentionally deteriorated our institutions so others can profit behind the scenes, being done at all of our expenses. It's long overdue that the morally bankrupt people in high places, be replaced with people who actually have a conscience. If this should actually take place, the corruption and countless problems we've endured that shouldn't have ever happened in the first place, would completely improve.

I haven't experienced this. Maybe it's just different locations. When I became homeless a few years ago, there were people moving mountains to get me under a roof. They gave me the hand up I needed to get back on my feet. Now I volunteer as a peer advocate for other disabled vets in my area. I'm sorry you haven't been treated well. Not to get into politics, but I think the rulers of a state have a lot to do with attitudes of the people working for them. It seems like red states are much less caring about people who need help. They tend to help rich people who don't need any help.

That cop seemed perfectly reasonable. I know in my state it's illegal to pass on the right except when the vehicle you're passing is turning left, and you can pass without leaving the traveled portion of the road. Lane splitting is also illegal in my state as well though.

The motorcycle incident is exactly why I stopped riding when I moved to California. My bike is completely stock and I get pulled over with good ol’ Long Beach pd saying my turn signals are too close together but stick out too far.

In the second encounter, it demonstrates that ignorance of the law is only an acceptable excuse if you wear a badge.
The cop was correct he just didn't use the correct terminology. No one was making a left turn. There wasn't two sufficient lanes for vehicles. It wasn't a one way street. It was not a divided highway.. Number two motorcyclist was wrong.

(b) Upon a highway within a business or residence district with unobstructed pavement of sufficient width for two or more lines of moving vehicles in the direction of travel.
(c) Upon any highway outside of a business or residence district with unobstructed pavement of sufficient width and clearly marked for two or more lines of moving traffic in the direction of travel.

That’s what I immediately noticed - if it was as “far as he knows it wasn’t the man’s home”, then there was no evidence it wasn’t his home, so the officers were trespassing and violating his rights. Pity the guy didn’t stand up a little more

19:13 German here. The lack of teaching of the law to police officers in the US, is the reason I’m glad I live in a country where the training to become a police officer takes between 2.5-3 YEARS, depending on the state.
In the state of Bayern, where I live, it takes 2.5 years to become a police officer. The 1-1.5 YEARS is basic study period about laws and regulations, report writing, first aid, general political Zeitgeist, languages (German and Englisch), communication, job ethics and of course physical fitness. From what I can tell from my research, no recruit will actually be on the streets (with at least one senior officer) until the last year of the training process.

I got pulled over in Houston one night for some BS lane change (cop was fishing for DWI's) at 145AM, years ago, I was a security guard at Lockheed (off-site NASA) in uniform on my way home from a shift. I argued that he was wrong, he didn't like that one bit and threatened to call Lockheed Martin and tell them I shouldn't be driving their patrol vehicles if they have any (which they didn't at this facility). He gave me a no seatbelt ticket which was also bogus because I took my belt off when we stopped (dumbass move on my part, dont ever do that)

That second guy and the cop are doing very well. I haven't finished yet (26:22) but I think the cop should make it clear he's concerned for the safety, the biker should point out when the lane narrowed he got back in line for safety reasons, and then they can agree that the law is ambiguous, THEN the cop can offer to ticket him for it anyway to the amount of $0.01, so the biker can go fight it in court and get it codified in case law and clarified.
