I'd like to think that the Sheriff had a change before the encounter was over. I have found that the current changes we are going through has made me rethink and more firmly understand why I believe what I believe. I think we saw some awakening here.
You should give out your attorney app to some of these guys for free, then during these audits, bam attorney there on the phone. Would be a crazy video .

The property OWNER didn’t have any authority to intervene because the property is public property because it is leased to the government. PUBLIC.

It is disturbing that the lieutenant did not know nor understand that the fourth amendment deals with unlawful search and seizure. The reality it is a part of the training, including annual training. So if he doesn't know, then he should be fired for incompetence.

Dumb cops are the biggest danger to the public.
They're the true heads of the abomination. They're supposed to be our last line of defense. Yet they're all oathbreakers. We don't need them. They've proven it. Our 2a covers everything and more than any Leo has ever done for us. Uvalde is just one of countless examples of how we no longer need their jobs in the public sector.

It takes a lot of experience, resources and connections to be a top shelf auditor. This fellow has very strong potential, so I hope he keeps an open mind and keeps learning from the best. The most skilled auditors, and folks who support them like TCRL (and AtA), are definitely making an important difference in police reform.

I have no respect for him, while these officers might seem ignorant, small towns have a completely different flow to them so while they seem slow, it’s just the way life is there. I have nothing but respect for auditors who go out with no preconceived notions and without trying to entrap the police because the bad officers will do that themselves. Anyone cheering on somebody purposely antagonizing cops is just ignorant. They are not all bad to say they are shows pure ignorance.
This sheriff is the best example for what’s wrong in US Law Enforcement and Society. Doesn’t even know the basics about the constitution or anything like that.

I feel that all peace officers, cops, deputies, etc must have at least a bachelor's degree. Sheriffs, chiefs, captains etc must hold a masters. I don't care if it's in criminal justice , engineering, business, or fine art. We need law enforcement officers to be educated professionals. And they should paid well to reflect their education level. We would still have some bad cops, but the gene pool would be vastly improved.

As someone that comes from a family of law enforcement and military service members, watching these cops proudly display their ignorance is appalling.
What's even more appalling is that otherwise honorable and honest cops will watch or be aware of bad behavior by fellow officers but do nothing or say nothing about it. Blue wall of silence and all, disloyalty is severely punished.

@@joefoster2155 Each state is sovereign under the constitution. That's called federalism, states each have their own sovereignty and share power with the federal government. However, due to the supremacy clause, if a state law conflicts with a federal law or the federal Constitution, the federal law wins. That doesn't mean the states still aren't sovereign - they are.

The federal government was originally designed to deal with issues between States, not to supercede each States laws, regarding how they Govern their own land, and their citizens.
A States constitution can give their citizens MORE rights than the federal Constitution, but can't give them less. That's what the supremacy clause means. The federal Constitution is the baseline.
After the Civil War, the States lost their sovereignty, and Federalism took over.
If a State was sovereign, they would have the right to succession. They don't. They are not sovereign by definition.

That's what you get when they spend more time on the gun range than in the library at the cop academy. They should need to get 95% on The Constitution and The Bill of Rights. I live in Australia and can answer the questions on the 1st, 2nd, 4th and 5th Amendments (I threw the 2nd in there as it's important as well).
Whilst this cop doubtless did lack knowledge of the relevant amendments, that’s not even the issue with his conduct here. The moment the “auditor” started trying to assert control of the situation by quizzing him on the constitution, the lieutenant should have shut him down with a clear statement to the effect that “I’m not going to be debating the law with you and you’re not going to be telling me how my job works”. Just refuse to engage with those people, if you’ve got grounds to detain or arrest them then do so, otherwise ignore them and let them go about their business.

"State law supercedes federal law" is a line I have personally heard from at least 3 law enforcement officers, and more than once in videos like these. I once told a Colorado cop he was violating my 14th, he said "We don't have a 14th amendment" to which I retorted "Well someone should tell them because they've made it up to 25 now"

Absolutely Elizabeth, I'd be willing to bet less than ten percent of the American population can recite the first five amendments , and less than five percent of the population can recite any part of the constitution . When the sovereign Republic allowed public schools to educate our children we lost more than we could even imagine. We are all supposed to be self governing kings and queens but instead our government has the population believing we are a democracy governed by elected leaders. Which is not accurate either, these elected "officials" are merely supposed to be the voice of the people, instead they have turned themselves into "leaders". Most of the population has been enslaved and don't even know, the 13th amendment may as well not exist. But anyway, yes you are correct.

@@only1muppet I’ve looked at police cars. I’ve climbed underneath to get a picture of the serial number off the transmission because I was looking to get the same transmission. Some of the pursuit cars are really interesting stuff.
I was watching a group of kids at a park once and they kept trying to look in a parked cop car lol. It's curiosity, seeing all the tools and doodads, the bits of personality left by the individual mixed with the work equipment.
More interesting cars to look in: party bus, fire engine, lawn care trailer, pipeline truck, and logging truck. I once looked in a presidential motorcade car but the tinting is reeeaaaaally strong and you can't see anything lol
To be fair, that's every police department here in Arkansas. I had several members in my family in the past, and some are now currently LEO's. They are all corrupt and proud of it.

It is amazing to me that ANYONE still thinks that "stop and ID" means "The cops can simply demand ID from anyone they come across." That isn't what it means. It means, IF you are in a state that has a so called "stop and ID law" AND you are being detained under reasonable articulable suspicion of a violation of the law, THEN the cops can demand that you identify yourself. If you are in a state that does NOT have a stop and ID law, you NEVER have to identify yourself, even if you are being detained under RAS (aside from being stopped for a traffic violation... the driver IS required to ID, so long as the stop is legal).

You NEVER EVER have to ID yourself merely because a LEO demands ID, in ANY state, with or without a "stop and ID" law existing. As AtA points out in the video, the SCOTUS has ruled that the police cannot stop you for the hell of it. If a state has/had a law that says/said, "Every person has to ID themselves every time a cop says so" it would be absolutely irrelevant. You do NOT have to, per rulings in Brown v Texas, Hiibel v Nevada, and tangentially, Terry v Ohio and Delaware v Prouse. They have to have AT LEAST reasonable articulable suspicion of a crime in order to detain you.
I hope that clears it up for you, but it is no different than I already said.

What do you expect? It’s Arkansas. The state in which a state trooper performed a PIT maneuver on a pregnant woman rather than let her find a safe spot to pull over.
Fleeing in a vehicle is a felony. You don't get to pick where you stop. Saying the driver was a pregnant woman looking for a safe place to stop is just sensationalism. Clearly the officer didn't know that when he made that decision. All he knew, and all he needed to know, is that he signaled a vehicle to stop, and the driver refused to stop.

I agree with him not knowing that information prior but as for the first part you absolutely have the right to continue driving (at the speed limit) to a secure, well-lit area where you'll be in plain view. Long answer: Statistics/their training would suggest it's very, very likely he has done an innocent person wrong, whether he knew or didn't at the time. How are you so sure that he hasn't done any of those things. I admit, I jumped the gun confronting him (& I'm sorry about that former officer) before getting all the information I could, but his response told me I was correct.
Also, why did you say weed when you were asking that? When I'd never referenced weed, but that's a good point. Just look at the limited information available about the people charged and blood tested for Dui for admitting to smoking weed. While you're at it, look up how little information about how accurate blood testing of Marijuana in the bloodstream is. They've been using that crime to destroy lives for decades under the guise of saving lives. If you truly research those two things, you'd see immediately I am right, it's a possibility I'm not correct about him but they're all trained to do this and other things to people who are poor/middle class/ not criminals, until that first charge of course.
If he's ever arrested anyone for Dui, for simply claiming to partake in smoking cannabis but isn't high at the time of the traffic stop/checkpoint or whatever and the person was not high but still charged, even if they weren't convicted! That is ruining an innocent person's life. Thanks for the great example.
