Kind of, I agree with you but the only reason the officer was in this situation was because of his job, it’s not your job to uphold the law and use force when necessary. How you do even become a police officer without being a constitutionalist? You have to swear an oath to uphold the constitution to be commissioned as a police officer. Saying the oath helps ensure the officers commit to protecting and defending constitutional rights... making them constitutionalists.

I came back from our county's open range. A deputy shows up at the front security door of our house. Bagging away on the door, demanding that he be allowed to enter our home. The deputy was Not allow to enter our home! The deputy jumped over the fence of our home's front yard, in order to get to the front security door of our home. Full audio and video surveillance is recording everything this county deputy has done, and or is doing. I go out front, within our home's secured area of our front porch. My 1911 is still in my shoulder holster, and, I am still well within my actual home's locked and secured perimeter of our dwelling. The deputy goes off the rails, and takes his firearm out of his holster, and then the deputy orders me to get down on the ground. I did Not get on the ground. The deputy in question, had been removed from our property by two State Troopers, on their way to work. The deputy lost his *qualified immunity*, along with his *POST Certification*, and he was fired after the County Sheriff's Office completed their internal investigation.
Imagine using your gun to scare citizens who do things you don't like and still somehow making it to retirement. Sounds like this police station has been corrupt for years.

Though on paper, in the laws, all people are to be held equally under the law. In practice, we are not at all held equally under any law. In practice, we have a multi tiered legal system. Laws mean nothing if even one person isn't held by them. The Executive and Judicial branches of the government have been wielding power they shouldn't possess for far too long. Absolutely, that was insane. This cop clearly thought he can do that shit, threaten with lethal force for no reason just because he is teh authority. Here in Finland if a cop even unholsters his weapon, its considered firearm use and its automatically investigated by the prosecutor's office (this is standard protocol in all firearm usages by police, in 99% of the cases its dismissed as justified)
There are several reason: Police unions with too much power, the police investigating themselves when citizens complain, too many bootlickers who believe the police can do no wrong and you must have done something to deserve it, qualified immunity preventing lawsuits, the prosecutors, judges and police forming personal bonds through working in close proximity. I could go on, but those are the highlights.
@@nonyadamnbusiness9887 I am fairly certain that brandishing a firearm when you would not be allowed to shoot it is illegal in all states. It might be wrapped up in another statute, like assault or menacing, in some states. If it is a situation where deadly force is justified, then brandishing is also justified.

No doubt about that. If there was a fairly wealthy citizen that donated enough bodycams to supply the police twice over, and they would still refuse to utilize them, would be more than enough to convince a jury that the police were acting more as control freaks than police.
There are still places where bodycams don’t exist. I know Kentucky for example has fought them hard, also some of the most corrupt units (narc, vice) around the country still run amok without them.
I understand the concept of it. What if there is a genuine mistake? The problem is that it has become a shield to protect corruption and illegal conduct. It needs to be removed.

Technically, where I live, if a police officer has no reasonable suspicion to detain you, and the cop demands that you do something, and you refuse, then they draw their gun... you ARE legally in the right to pull your own gun and defend yourself. There isn't a court here that would uphold it. They would charge you with murder for shooting the cop who pulled a gun, but technically, the law provides that you have a right to protect yourself from a police officer who has no authority over you. This is direct evidence of a two tiered justice system. It's sh!t and it needs to go. That cop should be charged with the crime of brandishing a weapon.

He's probably been intimidating citizens his entire law enforcement career and he's finally called on his crap so he retires. That his department didn't see any problem with his behavior is an indication of their abusive behavior from the top down. That police are almost always allowed to resign or retire, maintain their certification and/or pension, and go to the next precinct or county and go right back to work or collecting a paycheck or pension without any accountability is a huge part of why this outrageous behavior by police has gotten so out of hand.

By drawing and wielding the weapon, escalating the situation by antagonising and advancing on the cameraman, and showing no signs of deescalation, I think it's safe to say that cameraman is effectively 'at gunpoint'.

I'll agree and add that it doesn't even matter if it is registered or not. If someone hasn't broken the law, officers don't get to just stop them and see if they have weapons. Especially if they are on private property.

A lot of people overlook the part of Terry v Ohio where the judge points out that the subject must have the opportunity to dispel the "reasonable suspicion" BEFORE their rights are breached, which they cannot do if the officer does not actually articulate it to them.

Why is it that firearms/2nd amendment issues/laws are not resolved? Because the US Supreme Court has ducked this issue for almost as long as this country has existed. The first direct case was "Miller" in 1939. Heller was 2007, McDonald was 2010, Bruen was 2022. As you can see, SCOTUS has been playing catch up for the last 17 years. Still, the lower appellate courts have been IGNORING SCOTUS decisions. When will this stop?

As a cop in a medium sized (100,000 population) city, this cop is nuts. It isn't illegal to have your hands in your pocket and every single police officer should be a Constitutionalist when acting under their badge of office. I wish licensing boards would do more when an officer makes it clear they don't respect the Constitution.

My question when a "good guy" cop chimes in is - how many of your fellow officers have you watched do illegal things to innocent citizens and done nothing? Do you intervene? Do you go to a higher up and report the behaviour? I've never had a cop answer this question, unless they are no longer a cop. If you're not helping the problem, you're a part of the problem, regardless of if you think you're "a good one".

Kind of, I agree with you but the only reason the officer was in this situation was because of his job, it’s not your job to uphold the law and use force when necessary. Since this man was in the wrong while doing his job, they took that privilege away as part of an agreement. We don’t have the same duties so any crime committed isn’t something we can run away from with retirement, although it’s still shit that officers are never upheld to same standards that citizens are.

I came back from our county's open range. A deputy shows up at the front security door of our house. Bagging away on the door, demanding that he be allowed to enter our home. The deputy was Not allow to enter our home! The deputy jumped over the fence of our home's front yard, in order to get to the front security door of our home. Full audio and video surveillance is recording everything this county deputy has done, and or is doing. I go out front, within our home's secured area of our front porch.
My 1911 is still in my shoulder holster, and, I am still well within my actual home's locked and secured perimeter of our dwelling. The deputy goes off the rails, and takes his firearm out of his holster, and then the deputy orders me to get down on the ground. I did Not get on the ground. The deputy in question, had been removed from our property by two State Troopers, on their way to work. The deputy lost his *qualified immunity*, along with his *POST Certification*, and he was fired after the County Sheriff's Office completed their internal investigation.

Here in Finland if a cop even unholsters his weapon, its considered firearm use and its automatically investigated by the prosecutor's office (this is standard protocol in all firearm usages by police, in 99% of the cases its dismissed as justified)

Brandishing a firearm is illegal in most states. If you or I did this, we would be arrested immediately. Why do we let cops commit crimes?
There are several reason: Police unions with too much power, the police investigating themselves when citizens complain, too many bootlickers who believe the police can do no wrong and you must have done something to deserve it, qualified immunity preventing lawsuits, the prosecutors, judges and police forming personal bonds through working in close proximity. Technically, where I live, if a police officer has no reasonable suspicion to detain you, and the cop demands that you do something, and you refuse, then they draw their gun... you ARE legally in the right to pull your own gun and defend yourself.
There isn't a court here that would uphold it. They would charge you with murder for shooting the cop who pulled a gun, but technically, the law provides that you have a right to protect yourself from a police officer who has no authority over you.

He's probably been intimidating citizens his entire law enforcement career and he's finally called on his crap so he retires. That his department didn't see any problem with his behavior is an indication of their abusive behavior from the top down. That police are almost always allowed to resign or retire, maintain their certification and/or pension, and go to the next precinct or county and go right back to work or collecting a paycheck or pension without any accountability is a huge part of why this outrageous behavior by police has gotten so out of hand.

A lot of people overlook the part of Terry v Ohio where the judge points out that the subject must have the opportunity to dispel the "reasonable suspicion" BEFORE their rights are breached, which they cannot do if the officer does not actually articulate it to them.

let's say you get jury duty. they say you need to be accessible for 3 days. they might not need the jury all 3 days, but you need to be available. maybe they don't require you at all, and the 3 days pass. you needed to be accessible, even though you weren't necessarily accessed. they need their suspicion to be articulable, but don't necessarily need to articulate it.

Because the US Supreme Court has ducked this issue for almost as long as this country has existed.
The first direct case was "Miller" in 1939. Heller was 2007, McDonald was 2010, Bruen was 2022.
As you can see, SCOTUS has been playing catch up for the last 17 years. Still, the lower appellate courts have been IGNORING SCOTUS decisions. When will this stop?

I've never had a cop answer this question, unless they are no longer a cop. If you're not helping the problem, you're a part of the problem, regardless of if you think you're "a good one".
