I agree. If you project this setup 20 years from now freehold land will be boundary to a town or city. But this is a UDA idea. Govts of the future may actually reverse all this if it proves to be counter productive. The govt must admit they have been wasteful on spending, and it has finally caught up with them, and they are running frantically like headless chickens looking for sources of revenue to plug the gap.

I am not a lawyer, but you cannot introduce new requirements mid-way. If the land was acquired as freehold, It remains as that. Law is not applied retrospectively

Nah, you can. Policies change, principles change, democracies cannot afford to be static. The fact here is that they aren’t changing the ownership of the land as is prescribed by law, but adding a charge on the maintenance and services enjoyed by land owners. If the current system is maintained, then the burden fully lays on the rest of the public to maintain the comfort of individuals, especially those who own lots of property.

This country really has a huge problem, living above our means, so now all over sudden you have to find new ways to come up with new tax regimes, instead of managing the current budgets. There is an assumption that these services are funded by landrates and not road levy, kanjo business permit fees etc. It seems like double, triple, quadriple taxation

People buy land by deliberately deciding between freehold and leasehold. It is an unfair ambush to sneak in a law that suddenly forces them to go bottom-up and pay a rent to Government when the land is private and does not belong to the government! However, all is not lost. Affordable Housing is a noble effort as is growth and development. The public is not poisoned, the approach is. The problem maybe that Mhesh and those around her always have a political chip on her shoulder on an 'us vs them' basis without listening to the citizenry on critical matters

This law needs to be looked at in tandem with the change in law now allowing foreigners to own land in Kenya. As well as the one permitting GoK compulsory acquisition of land.
Watch an American documentary titled "The Grab", recently reviewed on Anampour & Co. 50-60% of the arable land left in the world for agriculture is in Africa. And big money - including Wall Street money - is being dedicated to buying farmland in Africa for food for export.
The agriculture sector is what Corporate America wants to control. Thus by using the IMF as a battering ram on the one hand; & pliant compromised African "leaders" on the other.
It also part of the move by US Corporate interests to get GoK to, ban Kenyan farmers from keeping &/or exchanging their own organic seeds, get GoK to approve patented GMO owned by them, and sell one of the few profitable parastatals, Kenya Seed, which houses Kenya's seed bank. Then, also ban the use & transport of organic manure.
This way, if a Kenyan farmer wants to plant seeds, he must buy them from a US Corporate every season because GMOs don't regenerate seeds. Likewise if he wants to replenish his soils, he has to buy synthetic fertiliser made by private companies (the biggest ones Western owned) to have hope of a decent harvest. Corporate America wants to own & control Kenyan food supply: farm to plate. Its an inch-by-inch campaign
The switch from freehold to leasehold which this dishonest CS claims is "just" for Karen & Muthaiga when she says "urban areas" is a bald-faced lie. Typical of this sellout KK regime. As another poster pointed out, if they pass this, what's to stop them upgrading town after town to city status. Its the domino effect: once one falls, all the rest follow. Meanwhile, who is waiting on the wings to offer GoK $$ to buy land that poor Kenyan peasant farmers can't pay leasehold fees for? Wealthy foreign interests targeting African land.

There is a fundamental flaw in this dicsussion.
You pay land rates for the ammenities received on your land from government.
Land rent is paid in lieu of ownership as a charge to the owner of the land.
Why pay a levy equivalent to land rent for land you already own ?
Don't touch peoples land. They worked hard to pay for it. They enjoy services from the City because of income taxes, road levy's fuel levys and other special taxes. Don't touch peoples primary residences period.

If you want a law affecting huge tracts of land don't lie to us, just make an amendment saying if you own 5 acres or more in the city and it is not your primary residence then this amendment is for you. Please folks reject this land act, you will be paying land rates and land tax on same land. Here in USA any time you're unable to pay taxes for several years the County Government takes the properties. It's a bad law Government can refuse to extend the 99years lease to your family. In future families will be harrassed and there lands taken over with unfair Governors

What extra services is she referring to, the services she's talking about i.e. sewerage, electricity are paid separately to the water companies and KPLC respectively. Can she explain which services the county government and the national government offer to property owners. How does she justify imposing land rent on freehold property yet these properties are still liable to land rates payment and these amounts are also factored into these "services".

Despite having a free hold titles...be been paying land rates in ruiru backdated for appr 10years...the explanation/ rational ruiru urban centre has been expanded to include areas that were free hold but upon zoning they were captured..

In Kilifi County our farming lands outside Municipality areas are charged land rates. I came to know when I wanted to sell that my 6 acres owed nearly ksh 300,000 rates.

First time I've listened to Alice from start to finish. And I must say that I understand her argument. Freehold land within city areas should pay a levy. It makes total sense as amenities in these areas are far much better than in leasehold areas that are already paying. As to if the funds are appropriated in the manner intended, the govt hasn't demonstrated prudency and so this runs the risk of being all flowery talk

I completely agree with the Levy on Freehold land that enjoys government services, especially those that are for private use or use that doesn’t substantially benefit the nation in general. However, why should this only apply to urban land, under the assumption of government services, while the same government is also meant to service rural land?
Secondly, where to we set the cap for areas defined as urban land? Is this a well defined criteria in Kenyan law or policies or will it be arbitrarily defined?
Freehold lands enjoying urban services should be charged a service fee, not converted to leasehold! This wild taxation will destroy the country!

Land rates are levies imposed on all parcels of land and payable to the county governments. Land rent is levy imposed on leasehold parcels of land payable to Ministry of Lands. Urban areas are all areas falling within municipality. Currently we have 107 gazetted municipalities. Kiambu county alone has 12 municipalities
There is no Freehold land in Muthaiga or Karen
But freehold attracts rates, and that is taxation. Is another tax not double taxation? Why not tax one amount and share? And then there is a capital gains tax of 15% of the sale value passed to the buyer. It makes land in Kenya very expensive and inhibitive in development.

What services is national gvt offering to an urban resident that rent will be used for over and above what the city receives rates for? Which amenities?

It would have made sense to first come up with a set of parameters that would be used to introduce these new charges to owners of freehold land. For example, a minimum set of services that the government would first provide - paved roads, water, sewage and waste disposal, served by properly equipped security agencies, public hospital and other government support services etc. What is not being said is that the owners of these properties have most likely also been privately funding these infrastructural and social-services provision for themselves without government support. You can only introduce new taxes where you provide proper services as government. The revision of these laws is a lopsided initiative.

All city land owners pay rates to the the county in Nairobi, that is what caters for services, land rent(the levy according to the CS) is a different animal.

Dagoretti , uthiru and kangemi are Freehold lands in Nairobi if you don't have money you lose your property
She's quoting areas that are well developed but other Nairobi areas like Dagorretti have lands inherited from forefathers and they donot receive any development or services from Nairobi County and they pay land taxes which keeps going up. Land in these areas is already very expensive.

Clearly targets have been set to fill the main coffer and fund pockets. Those are basic "benefits" that have been there. County drains your pocket and seldom provides the said benefits. Why then are there application/joining fees if I'm paying rates? I pay 200k plus every year but don't have street lights, security, road maintenance etc.

I did not hear discussion about the powers taken away from NLC and given to the CS and Counties. A good start towards public participation but nowhere near exhaustive.
