      I was gifted a cheap dashcam years ago. Make sure to get a 2-lens setup that can face both forward and toward the driver.
      Besides the occasional suction-cup failure, I never thought much about it until recently. Got pulled over while picking my brother up one evening. Cops were obviously making up a story to why they stopped me at a house, saying security at the closed salon store across the street called them and reported my car, despite the (state) police having pulled up seconds after me- no time for the observe/report/respond events they claimed. They kept trying to convince me they could search my car. "Don't talk to cops" is good for not incriminating yourself, but not great at making them stop.
      Probably 30 minutes into the hassle, I remembered the cam tucked behind my rearview and started giving it glances to check that it was capturing. Current cop at the window walked away and they huddled for a minute, then came back with a different attitude and told me to go.

      Yes that would've ended it, and that's fine. The points of this video though are:
      1) that in this situation on that property, the cop had no right to cite him, which means his authority is the same as your average person walking by and saying "this isn't a parking spot, could you please move your car?", which, a reasonable person may do. But
      2) It's not illegal to be an asshole, or to be short with somebody, or to be silent with somebody. If someone is an asshole in general, they don't need to bow to a cop and pretend they're not an asshole. We shouldn't live in fear of being arrested or worse when being "grumpy" when interacting with a cop. It's not illegal to be an asshole.
      Granted, I would've been the nice guy and this would've been a 2 minute stop, but we need to change the way we all view cops and the extent of their power and actual purpose.

Even if he had politely asked the driver to move on he would have been overstepping his authority. While on duty the officer represents the police force for which he is a part of. The presence of his uniform would unfairly influence a citizen to change his actions via intimidation/ power of an individual.

Plus he was way out of line being on private property, now if the property Owner wanted to pursue him he could but it would be a waste of time since there’s no signs or markings saying no parking. You know damn well if there’s an accident in a private parking lot and you call the police they refuse to do anything, they will create no paper trail, and they’ll leave it up to you and the other person to sort out because they don’t have jurisdiction for one, and two they don’t want to go through the paperwork and potential court hearings...

      The only grounds the cop had to question this person's mental state was a 'prolonged period of anger and irritability'. But that's hardly surprising, and it's what you tend to get, if a cop spends a long time angering and irritating someone. I would give him a Z rather than an F, kick him out of the police force and start civil proceedings. It's frightening to think people like this are employed as police officers and let loose on the public.

      It's gotten - literally - to the point where simply NOt TALKING is seen by cops as a hostile act. So, if you talk, you will pay for it with arrest or beatings, and if you are silent, the same will happen.
      We are supposed to give them everything they want - total obedience, without any questions, let them push us around, violate our privacy, or 4th amendment rights, 1st amendment rights, allow ourselves to be physically abused, humiliated, never try to document any interactions, and - on top of all of that, to smile and chat with as though we were their wind-up dolls and punching bags - to cheerfully smile and satisfy them by stroking their egos, as though we were their property: I think the term is "cheerful submission."
      A society where this is EXPECTED of its citizens is called a "Fascist State" - and rightfully so.
      We must act as though we ENJOY (and expect) being bullied and abused, for fear of being bullied and abused worse, or killed.
      THIS HAS TO STOP! MY GOD! How can they be surprised when someone cracks and starts killing cops?
      There are too many of them, too many of them are corrupt, cowards, and bullies, and they are FAR TOO MILITARIZED. When they are throwing Phosphorous Grenades into baby's cribs in the WRONG HOUSE, shooting the very people who called them for help, killing children,
      (I know, the "good" get punished with the "bad" - but if the "good" would refuse to support, excuse, or stand up for the "bad," we would know which was which, and this is one way they protect each other).
      A dog that is always beaten and abused by one person will eventually snap, and attack him. Free citizens deserve to be treated at least as well as dogs.

      Cops are trained in high conflict situations as well as in routine tasks. It is literally their job. They are expected to be able to deal with people professionally in ALL situations. Being a jerk, regardless of the demeanor of the person he is dealing with, shows a complete inability to fulfil the requirements of the job. If he was a checkout operator and behaved that way to a customer, he would have been fired on the spot.
      Not knowing that he has no jurisdiction to issue a fine in a private car park is just incompetence. His best course of action if he realised his mistake during the stop, would have been to say, "Thank you, sir", hand back the documents, and wish the gentleman a good day.

A lot of the things happened in this video I've experienced myself but in a crazier and more unfair way and thinking back about my situation just filled me with anger and frustration that I never followed with a complaint against the officers, then again, I'm from Mexico, and if people in USA are demotivated to go through complaints against officers, imagine how you normally feel in a country as corrupted as mine.
    So frustrating!!
    But at the same time it is kinda making me want to pursue a career (even though I've already finished my mechanical engineering career and I also teach English) in the law field. It just makes me excited to think about that.
    Hopefully I follow through with that and I can go back here and express (of course you already have it) my gratitude for making such amazing content that motivates people to understand better their Country's laws to be able to defend yourself and others of all the injustice going around us.

    • @lawnboy81SMS
      @lawnboy81SMS 3 ปีที่แล้ว +8

      Definitely important for many reasons, even just for car crashes. But especially for discrepancies in tickets or police encounters. I support good police and cooperate with all law enforcement when encountering them, but now drive with a dash cam that records speed and GPS coordinates after being issued a speeding ticket and losing the case when I went to court and showed the GPS tracking app on my phone that showed my top speed at the time. Judge looked at my screenshot from the app that showed speed time and location but disregarded it when he asked about if I had my speedometer calibrated before or after the traffic stop and when I said no he said guilty judgment for the plaintiff. DE owes the court whatever my fine for the ticket was. (State trooper said I was going 60 in a 45. My GPS said 47 and my cars heads up display said 48). So that one sucked but I didn’t have money to pay an attorney to overlook a simple $200 traffic ticket when it costs more than that to even obtain one Unfortunately. I thought I had a good case but had never been to court before to know how it really works. Basically you answer questions and don’t get to explain things hardly, at least in my personal experience for that one case. It’s a pain especially when two more different judges might give completely different rulings on the exact same case with the exact same evidence provided etc.

    • @alexpalapa7603
      @alexpalapa7603 3 ปีที่แล้ว +3

      @@lawnboy81SMS Yeah I completely understand what you mean about not being able to explain yourself in court and you can only answer the questions the judge asks you. You have to request permission to make a quick statement immediately after they ask you the first question. Just say " Your honor may I please make a brief statement after I answer this question?", and that will create the dialogue your looking for. Just a theory. They have so many cases everyday, it's become an automated script to them.

    The worry is the next guy that cop gets encounters all of the frustration from this encounter, and isn't as savvy as Mr. Proctor.
    I'm not in America, but when I was young and worked out a lot, I had a very similar incidence with a cop that was around my age, and was insisting that there was some indication on my dash that I was only on the sidelights of my car (main headlights weren't on). At first he said they weren't working, and when I tried the dial, I hadn't put it all the way on (honest mistake), which I apologised for. Instead of saying "ok, make sure you check that in future" and letting me go, he insisted that there was some light on my dash that would indicate it, and told me he was going to "have (my) licence" for driving without due care and attention. When I calmly said "ok, here are my details" he also added obstructing a police officer to the ticket. I attended court, explained myself and ultimately walked out with no consequences, but it cost me a day off work to go to court, and my name was in the local paper for being up before the magistrate for obstructing a cop -- not good. I wish I'd had video, but it was pre-camera phones that could capture long HQ videos.
