The camera being out of his possession and the deleted video needing to be recovered, plus that video containing evidence of the initial incident and the following police interactions (including an illegal arrest), is means, motive, and opportunity. Thorough investigation is the only appropriate response.
In my opinion, if a police officer is caught attempting to delete, conceal, or tamper with evidence in order to cover up their own unlawful actions, then they should face the same legal repercussions as a citizen who's committed that same action.

Careful, that actually might be a benefit to the officer. If you quit, you are generally ineligible for unemployment; however, you may have a case for unemployment if terminated. It’d be a long shot since they would terminate with cause, but I could see any little mistake being used to allow for unemployment benefits. Additionally, being fired with cause is simply not a barrier of entry for another police job, as evidenced by the fact that “problem” cops often end up passed around multiple departments, changing hands once they also have an issue caused by that LEO.

I was on a jury recently and argued exactly as you say, that as no evidence of suspect being informed of arrest was presented, he could not be convicted of resisting arrest.
@@sherryleigh1966 it was an obvious case of police retaliatory overcharging. They charged him with 7 or 8 counts. We found him not guilty on all but two and he was convicted essentially on disturbing the peace. No felony convictions.

Surveillance videos are a bit different than people filming for monatized TH-cam videos. People can actually do privacy claims on TH-cam videos and they will be forced to blurr their face or take down the video.

It is completely expected that a chance encounter with the police may result in some factual misunderstandings surrounding the law by the auditor in question. However, Mr. Roberts was clearly seeking a police encounter and was fundamentally wrong in the law and the rights it would provide in the specific circumstances in which he was seeking the encounter. While the money Mr. Roberts gets from his TH-cam may be a secondary benefit, it still makes him a paid professional auditor and he must therefore meet a higher expectation of conduct just as we expect from the police.
Sheriff departments are highly political organizations owing to the fact that the Sheriff is an elected official. Given this fact they are packed with political hires by the party the Sheriff ran under. The only real 'qualification' for employment is that you vote for that party! As such the quality of the officer they employ has nothing to do with whether the person is qualified or even of moral character.
As a security contractor it’s astounding how many of my clients need to be reminded the legalities of filming in public. It’s always awkward when a client orders you to “stop someone’s filming” and you have to instead sit them down and professionally explain why what they’re doing is completely legal.

Once I explain establishing “a reasonable expectation of privacy” such as installing blinds or even solid perimeter fences that can’t be filmed through they usually understand a little better. Legality of the action of filming has nothing to do with this bullshit. Instead of finding a productive place in life, these people point there cameras in hopes of a negative reaction. Former security here. And yes, that was most definitely annoying. The main property I handled was split by a highway. So, yes, we owned both sides for about 1000-1500 feet from the highway, the highway itself are well as 10 feet to the sides are public/public use easement. And I had some... unique situations. From a guy stopped within the easement passed out drunk (parked vehicle, thankfully), to people lighting off fireworks in the easement, but less than 50 feet from some gas pumps. Luckily, the property manager had full authority from the owners, and she ALWAYS sided with me. As such, any time I made a call, I never had to worry about being overruled by the property manager. So when she asked my thoughts on a guy filming from the easement, I explained the law. And after that, she welcomed him onto the property and said he was allowed "anywhere a paying guest would be allowed, except within their room without their personal consent". She was easily the best manager I've ever had, even if she wasn't my direct manager.

Auditors fulfill the function of a stress test for law enforcement. Stress tests are meant to push the boundaries to find failure points or demonstrate the resiliency of the police department.

Great breakdown on the auditor's behavior. The Sherif definitely deserves a gold star for conducting the investigation and the first two deputies get silver for patience. Firing a member of a public employee union is extremely difficult. In many cases a resignation is best to avoid reinstatement and backpay after an arbitrator decides in the employee's favor.

I put money on the fact that the Sergeant who was fired was the ‘husband’ when the first two workers yelled out “call 911, call your husband”. That would be why he went right up to the auditor trying to escalate things. His behaviour seemed personal to me.

Dude was 100% told to resign and was referred to another department. Nothing comes from these incidents besides the officer having to pack up and move on to the next community to terrorize. The united states courts need to take these incidents much more seriously and treat police officers like this one with the same swift justice they enforce on every other tax paying citizen. That is the ONLY way we get the bad eggs out for good.
And such internal investigations need to be open the the public so everyone can see exactly how the individuals involved reached their conclusions. None of this "no evidence of wrongdoing was found" should be allowed unless the investigation was clearly done properly and a subject of record.

The reason it is, is because police can detain you for suspicion of a crime, and you have to comply with that. If you resist a lawful detention, even if the investigation clears you of other charges, you still committed a crime by resisting.

Policing is a very unforgiving when dealing with shows of force against unarmed citizens.

The sheriff's office should be filing criminal charges against that deputy for any assault and tampering with evidence. Resigning should not alleviate you from the consequences of your actions. But you know they protect their own so he'll probably just move to another law enforcement job.
I can't help but notice that in, most situations like this, when the person tells them "I have it all on camera", the cops almost NEVER actually asked to see the video. You'd think that would be one of the first things they'd want to see.
I got pulled over for running a stop sign by a rookie cop on her first day, and as soon as I pointed to the display in my Tesla and offered to look at the video, that ticket turned into a "warning". 🙂 I knew I had stopped at the stop sign - it was maybe a 2 second stop, but then there's nothing in the law which specifies how long a car has to be motionless.
To be fair, many laws and policing policies are out of date around the ability for nearly everything to record video now days (cameras, cellphones, dashcams, even cars themselves like Tesla). There should be mandatory training on video laws and best practices - to your point of actually viewing the video and lawfully obtaining a copy of it- for all law enforcement and best practice for security guard companies. After viewing the video in this case, the officers should have arrested the assaulting man in this and the scenario would have never been enough of an issue for this video. Simple assault of a citizen.

There's something called the Peter Principle, which is an observation that the tendency in most organizational hierarchies is for every employee to rise in the hierarchy through promotion until they reach a level of respective incompetence. Once hired, each officer rises through the ranks over their career until they reach this point.

Many times, a criminal case has been heard in court and the laws by the prosecution and defense would be available in motions. If a civil suit was filed, it would have the laws/case law noted in the suit.
They let him resign. That is tantamount to approval of his actions. They acknowledge that his behavior makes them look bad, but they proactively chose to do as much as they possibly could to help an officer who assaulted and illegally arrested someone and then deleted evidence to cover up his crime. Allowing a man like that to resign means the people who run that department are themselves like that.
Sgt. Morrison was given the opportunity to resign instead of fired, so he can now go work for another Law Enforcement Agency and continue with his tyrannical behavior.
Deleting footage (destroying evidence) should come with a mandatory 10 year prison sentence and a $20,000 fine when you swear an oath and decide to break it.

He's just out looking for lawsuits instead of women to knock up. I've seen these types of videos before but a lot of the time the cameraman is respectful and more doing it for a learning experience for police that don't know the entirety of the laws they are required to abide by and enforce. This cameraman, however was just a douche trying to break some eggs to find some broken eggs. He isn't for bettering society. He isn't for educating the public or LEO's. He's looking for a nice check from the taxpayers. I don't know how anyone can respect that, but you already know who he is calling if he is ever in an emergency.

@RobJo I agree with you, but there are always going to be bad apples. Whether it's race, religion, or profession, there are always going to be bad ones that give the good ones a bad name. I'm a firm believer in more screening for the police, body cameras, as well as periodic mental fitness evaluations. They deal with a lot of things the majority of society won't ever see. What I think should change though is that instead of the city forking over money for lawsuits on the police that can't maintain their composure like the last cop in the video, the money should come out of their pension or at the bare minimum have a waiver/morality clause in their employment contract that relieves the department from responsibility of the police officers actions if they go off the book or abuse their power, and places the financial burden on the police officer him/herself.
Agreed, he lost most of his credibility by being so confrontational and just plain rude. The first two cops were reasonable, the senior one was a terrible example for his junior officers.

I've lost some respect for Audit the Audit with him giving this dude a B+ and the first officers a C. I think both officers and the videographer could have handled it better and both groups were equally right/wrong about the laws. I believe there should be a database both on the state and national level for any officer who has been fired or resigned in an attempt to avoid being fired. Further, along that same vein, I believe there should be a national database for anyone convicted of child or elder abuse.
Filming in public is just so creepy. No one likes some random camera pointed in their direction and he was doing it to prove a point that he CAN do it. The problem is, not one wants to watch a video of someone taking a video of a building. They WILL watch a video that ends up like this for enjoyment purposes only. You can tell he HOPES that something like this will happen so he can sue and get some money to pay for a better camera.

The fired cop probably went down the road to the next town/county and got on with the PD or Sheriff's office. These guys are rarely held accountable and their criminality is usually swept under the rug.
That is why many police and sheriffs departments have changed many rules on where they live now. In the past you had to live in the city or county where you worked.
Because that makes it easier for the complainant to win a lawsuit against the city. That one Sheriff in Florida is probably the only LEO in the US that acts in a serve and protect manner in the public.

I'm guessing Sgt Morrison is the "husband" in the "go call your husband" statement. The fact that he responded to the scene simply because his wife works there and escalated situation after it was already settled is just more reason for him to be charged.
I haven’t finished the video yet and I’m sure there is a bad cop who does a bad thing but right now the guy doing the initial filming is a huge problem. He’s being combative and it’s like he’s doing this specifically to get a rise out of someone hoping they’ll put hands on so he can call foul. No one should touch another person like that but he was only escalating the situation.

The camera being out of his possession and the deleted video needing to be recovered, plus that video containing evidence of the initial incident and the following police interactions (including an illegal arrest), is means, motive, and opportunity. Thorough investigation is the only appropriate response.
In my opinion, if a police officer is caught attempting to delete, conceal, or tamper with evidence in order to cover up their own unlawful actions, then they should face the same legal repercussions as a citizen who's committed that same action.

Careful, that actually might be a benefit to the officer. If you quit, you are generally ineligible for unemployment; however, you may have a case for unemployment if terminated. It’d be a long shot since they would terminate with cause, but I could see any little mistake being used to allow for unemployment benefits. Additionally, being fired with cause is simply not a barrier of entry for another police job, as evidenced by the fact that “problem” cops often end up passed around multiple departments, changing hands once they also have an issue caused by that LEO.

I was on a jury recently and argued exactly as you say, that as no evidence of suspect being informed of arrest was presented, he could not be convicted of resisting arrest.

However, Mr. Roberts was clearly seeking a police encounter and was fundamentally wrong in the law and the rights it would provide in the specific circumstances in which he was seeking the encounter. While the money Mr. Roberts gets from his TH-cam may be a secondary benefit, it still makes him a paid professional auditor and he must therefore meet a higher expectation of conduct just as we expect from the police.
Sheriff departments are highly political organizations owing to the fact that the Sheriff is an elected official. Given this fact they are packed with political hires by the party the Sheriff ran under. The only real 'qualification' for employment is that you vote for that party! As such the quality of the officer they employ has nothing to do with whether the person is qualified or even of moral character.

As a security contractor it’s astounding how many of my clients need to be reminded the legalities of filming in public. It’s always awkward when a client orders you to “stop someone’s filming” and you have to instead sit them down and professionally explain why what they’re doing is completely legal.
I think a lot of them are doing some dodgy stuff on the side or something, only reason to be so menstrual about being on camera.

Once I explain establishing “a reasonable expectation of privacy” such as installing blinds or even solid perimeter fences that can’t be filmed through they usually understand a little better. Legality of the action of filming has nothing to do with this bullshit. Instead of finding a productive place in life, these people point there cameras in hopes of a negative reaction. So one must ask themselves, why purposely set out to do things that they know will incite panic, annoy people and waste the time of law enforcement. Former security here. And yes, that was most definitely annoying. The main property I handled was split by a highway. So, yes, we owned both sides for about 1000-1500 feet from the highway, the highway itself are well as 10 feet to the sides are public/public use easement. And I had some... unique situations. From a guy stopped within the easement passed out drunk (parked vehicle, thankfully), to people lighting off fireworks in the easement, but less than 50 feet from some gas pumps.
Luckily, the property manager had full authority from the owners, and she ALWAYS sided with me. As such, any time I made a call, I never had to worry about being overruled by the property manager.
So when she asked my thoughts on a guy filming from the easement, I explained the law. And after that, she welcomed him onto the property and said he was allowed "anywhere a paying guest would be allowed, except within their room without their personal consent".
She was easily the best manager I've ever had, even if she wasn't my direct manager.

Believe it or not, that’s actually the point. As a security officer of my own, these auditors act like that on purpose in the name of catching an officer slipping up. Firing a member of a public employee union is extremely difficult. In many cases a resignation is best to avoid reinstatement and backpay after an arbitrator decides in the employee's favor.

Dude was 100% told to resign and was referred to another department. Nothing comes from these incidents besides the officer having to pack up and move on to the next community to terrorize. The united states courts need to take these incidents much more seriously and treat police officers like this one with the same swift justice they enforce on every other tax paying citizen. That is the ONLY way we get the bad eggs out for good.
And such internal investigations need to be open the the public so everyone can see exactly how the individuals involved reached their conclusions. None of this "no evidence of wrongdoing was found" should be allowed unless the investigation was clearly done properly and a subject of record.

The reason it is, is because police can detain you for suspicion of a crime, and you have to comply with that. If you resist a lawful detention, even if the investigation clears you of other charges, you still committed a crime by resisting.

That said too, if you have 20 years of service and make one mistake - the issue was not that you made one mistake, it was that you let it be a public one. Policing is a very unforgiving when dealing with shows of force against unarmed citizens.

The sheriff's office should be filing criminal charges against that deputy for any assault and tampering with evidence. Resigning should not alleviate you from the consequences of your actions. But you know they protect their own so he'll probably just move to another law enforcement job.

I can't help but notice that in, most situations like this, when the person tells them "I have it all on camera", the cops almost NEVER actually asked to see the video. You'd think that would be one of the first things they'd want to see.
I got pulled over for running a stop sign by a rookie cop on her first day, and as soon as I pointed to the display in my Tesla and offered to look at the video, that ticket turned into a "warning". 🙂 I knew I had stopped at the stop sign - it was maybe a 2 second stop, but then there's nothing in the law which specifies how long a car has to be motionless.
To be fair, many laws and policing policies are out of date around the ability for nearly everything to record video now days (cameras, cellphones, dashcams, even cars themselves like Tesla). There should be mandatory training on video laws and best practices - to your point of actually viewing the video and lawfully obtaining a copy of it- for all law enforcement and best practice for security guard companies.
After viewing the video in this case, the officers should have arrested the assaulting man in this and the scenario would have never been enough of an issue for this video. Simple assault of a citizen.

There's something called the Peter Principle, which is an observation that the tendency in most organizational hierarchies is for every employee to rise in the hierarchy through promotion until they reach a level of respective incompetence. Once hired, each officer rises through the ranks over their career until they reach this point.
Yes, this makes perfect logical sense. There are cultural norms in all organizations and what is normal for one is likely normal for the others. You can see the attitude on the ginger cop who first approached him too.

Many times, a criminal case has been heard in court and the laws by the prosecution and defense would be available in motions. If a civil suit was filed, it would have the laws/case law noted in the suit.

@RobJo I agree with you, but there are always going to be bad apples. Whether it's race, religion, or profession, there are always going to be bad ones that give the good ones a bad name. I'm a firm believer in more screening for the police, body cameras, as well as periodic mental fitness evaluations. They deal with a lot of things the majority of society won't ever see. What I think should change though is that instead of the city forking over money for lawsuits on the police that can't maintain their composure like the last cop in the video, the money should come out of their pension or at the bare minimum have a waiver/morality clause in their employment contract that relieves the department from responsibility of the police officers actions if they go off the book or abuse their power, and places the financial burden on the police officer him/herself.

I believe there should be a database both on the state and national level for any officer who has been fired or resigned in an attempt to avoid being fired. Further, along that same vein, I believe there should be a national database for anyone convicted of child or elder abuse.

Filming in public is just so creepy. No one likes some random camera pointed in their direction and he was doing it to prove a point that he CAN do it. The problem is, not one wants to watch a video of someone taking a video of a building. They WILL watch a video that ends up like this for enjoyment purposes only. You can tell he HOPES that something like this will happen so he can sue and get some money to pay for a better camera.

The fired cop probably went down the road to the next town/county and got on with the PD or Sheriff's office. These guys are rarely held accountable and their criminality is usually swept under the rug.

That is why many police and sheriffs departments have changed many rules on where they live now. In the past you had to live in the city or county where you worked.

I agree. But it's designed to be a stress test. Put them through the worst so you feel confident they act reasonably all other times. We should be giving them kudos if they handle the situations well. Sadly we don't often get to see those cases

I think it’s one of those things where you live and you learn. The guy who got arrested is young and hasn’t learned how to behave in situations like this. You gotta grease those wheels, not act like a cocky shit. I'm guessing Sgt Morrison is the "husband" in the "go call your husband" statement. The fact that he responded to the scene simply because his wife works there and escalated situation after it was already settled is just more reason for him to be charged.
