      Ganito po ang problema ko sir, meron din kaming nabiling lupa nabayaran n nmin buhay pa ang seller pero alam nman itong dalwang kaya lang hindi nmin hawak ang mother title nito nasa enginer

    Itatanong ko lang po kung paano ang proseso sa paglipat ng ownership (bahay at lupa) sa buyer kung ganito po ang situation:
    Ang dating may-ari, ayun sa ipinakitang plan or map, ay pumanaw na, subalit buhay pa po ang asawa. Non-title po ito. Nang ipinakita sa akin ang tax declaration ay anak ang nakapangalan. Updated naman po ang tax at separated na rin ang tax dec sa land at improvement.
    Paunang pasasalamat ko po ng malaki! :)

    Hello Atty. Bumili po ako ng lupa sa Coron, Palawan at meron po kaming pinirmahan na Absolute Deed of Sale for the amount of P500K. Inaayos po yung transfer ng title to us ng real estate agent. However, na misplaced yung Titulo at hindi na po namin mahanap.
    How can we apply for a new Title for the property we bought?

      Mag execute ng affidavit of loss ung tao na nakawala ng original na titulo and have it filed in Register of deeds(RD) where the title is issued. Then, through your lawyer, file a Petition in court for the Reconstitution of the lost or damaged title.     Atty may tanong din po aq... Nagbenta po ang papa q ng part ng lupain namin pero 15 yrs na po at yong nakabili sa part sa lupain hindi po nabibigay ng share sa buwis... Maari po ba namin na kunin uli kasi hindi sila sa gumawa ng aksiyon pra ipalipat ang pangalan ng lupa?

      Tulad ng sabi ni atty.wong walang expiration ang pagbenta lalo may Deed of Sale, so di mo pwede kunin. Ang dapat mong gawin ay pumunta sa Registry of Deeds at ipahiwalay na yung naibenta sa Mother Title at pumunta sa City Assessor para ma-update yung parte lang na dapat nyong bayaran na buwis.

      Tanong ko lang po, bumili ako ng part ng lupa, nabayaran ko na lahat ng tax at na iparehistro na sa bir at na isyuhan na ng car, at need na ng mother title para maseparate na sa mother title pero yun pala mother title ay sabi naka sanla , eto tanong, kung iremata ng pinag sanlaan, sakop ba yun nabili kong parte na makukumpiska ng pinagsanlaan kahit naka annotate yun "part " na binili ko sa likod ng mother title?

    Atty., ask lang po pwede po bang magamit ang deed of sale para magfile ng case of unlawful detainer ? kasi po yong lupa po ng mother-in-law ko wala pang land title dahil po hindi pa po nasubdivide yong lupa na binili niya , namatay na po yong may-ari.. magagamit ba namin 'to to file a demand letter po sana to let the squatters vacate their land? thank you po.

      Yes pwedeng magamit ung inyong notarized na deed of absolute sale sa pag file ninyon ng unlawful detainer laban sa occupants ng inyong nabiling lupa. Take note na by operation of law, from the time na nag pirmahan ng deed of absolute sale ang seller at buyer kaakibat sa kabayaran ng lupang binili, ang FULL OWNERSHIP at lawful poseesion nito ay nailipat antemano sa buyer. At bilang bagong may-ari ay karapatan mong ma-enjoy ang full possession ng lupa na inyong nabili.

    Hi Attorney, May remedyo pa po ba kung nakabili ng isang maliit na bahagi ng lote lamang (mula sa malaking lote) tapos walang ginawamg Deed of Sale. Ang tanging hawak ng bumili ay sulat kamay na resibo na tinanggap ng bumili mula sa may ari ng lupa, katunayan na may natanggap ang may ari na kabayaran sa lote na binili. Hindi po notaryado. Pwede po ba balikan daw ang may ari ng lote para mag-issue ng Deed of Sale kahit 8years na naganap ang bilihan nila? Thanks so much :)

      Kung mga buhay pa ang seller at buyer ay mas makakabuti na mag pagawa na lang kayo ng deed of absolute sale at mag pirmahan uli ang seller at buyer sa harapan ng notary public. Take note na dahil portion lang ang inyong nabili, ay mas makakabuti na fully identified ung portion na binili particularly ung sketch plan , area, boundaries, location, ng nasabing property at iba pang detalye. Pinaka the best ay kung nag pasurvey na kayo at nagkaroon kayo ng subdivision and lot plans with approved technical descriptions galing sa LMB-DENR, at ung mga technical descritions ay particularly described sa inyong deed of absolute sale.

      Dapat at pinanood at tinapos ninyo ung video. Nandoon ang kompletong kasagutan ng inyong tanong. For purposes of showing na na-ibenta na na seller ung lupa sa pamamagitan ng deed of absolute sale it may serve the purpose pero dahil hindi notaryado the document is only considered as private document ay hindi ito tatanggapin ng Register of deeds upang ma resistro ang bilihan without proof of due execution, tulad ng pagpapanotaryo nito. Kung hindi notarized upang ma prove ang due execution ng nasabing bilihan ay kailangang dumulog pa sa korte sa pamamagitan ng pag file ng Petition. Maaring mas malaki pa ang gastos sa pag file ng petition kaysa sa pagpapanotaryo nito.

Nasa abroad po ako nakatira as permanent resident.May binibili po akong lupa 600 sqm po yun at nag down na po ako bilang kasiguruhan na ako ang bibili at balak ko po na full payment ko pag uwi ko na. Ngayon nagkaproblema di ako matutuloy sa pag uwi po.     Very informative and it's almost exactly what I want to ask similarly. Thank you attorney. Yet, in my case I may want to ask you if I just want to have the Deed of Sale signed by me (the buyer) and the seller. But since I don't have enough money for now to pay for the Capital Gains tax, doc stamps and transfer taxes, as I agreed with the seller, is it okay for me to postpone the notarization of the Deed of Sale in order, also to postpone my payment of the Cap.Gains and related taxes? But actually, I may be able to come up with the needed money within a couple of months and not in ten or more years as what you mentioned as a scenario in this video. Thanks again, atty!

      @@peppersalt9712 kaka purchased ko lng din po ng lupa. At ang ginawa po ng mama ko ay during exchange of payment, nag sign na din ang seller ng deed of sale. Parang nag exchange lng sila ng product. At lahat yon nangyari sa harap ng attorney with another witness from the general public which is yong kaibigan ko. Transparency is the key. Kapag po involved ang malaking pera, secure nio po din ang sarili nio. Wag po kayo maglabas ni piso na wala kayong makukuhang kapalit. Ang hirap pa nman kitain ng pera. Hope ma settle po yan

      You still need to notarized it your deed of sale. Then, make agreement for the new deed of sale if you are ready to pay the capital gains tax. Circumstances occur wala u hawak na ebedensya na notarized.

      @Gus C, as much as possible do not postpone the notarization of Deed of Sale (DOS), kc ang DOS needed yan para ma-transfer ang Title sa name mo. Pag di mo yan ginawa at binenta sa iba ng seller at yung 2nd buyer naunahan kang maka-kuha ng Title, kawawa ka.
      Pwede, gumawa ka ng Deed of Sale na ang petsa ay ilang buwan ang layo para maka-ipon ka ng pambayad ng Cap Gains Tax at DS tax, pero ang Deed of Sale dapat palaging Notarized para may habol ka. Pero tandaan mo, mas pinapatagal mo na di ka nakakuha ng new title sa name mo, tumataas ang risk mo na mawala ang lupa sa iyo. So ang payo ko, Action, action, action.

    Hello po sir attorney tanong ko lang po kung valid na po ba iyong papel galing sa brgy. hall bale dun po sila nagpirmahan sa pagbili ng lupa. Sa ngayon po kasi hindi pa napagawaan ng deed of sale kasi ang sabi nasa manila pa daw po ang 1 pang kapatid bale magkakapatid po kasi sila ang pumirma sa kasulatan. Ano po ang mapapayo nyo para mapabilis po ang paggawa ng deed of sale pwede po ba na iyong mas matanda na lng sa magkapatid ang makipag negotiate samin bale sya na lng po ang representative nila para magawa na ang deed of sale? At kung ayaw po nila kanino po kame pwede lumapit para magpatulong.

      Good day po atty..ask lang po ako kasi yong lupa ng lola namin na mdyo matagal ng panahon ay may na i donate na portion doon sa close friends nya ang tanong po namin kasi pareho na po silang patay pero wala pong kasulatan na makikita namin na na donate ang lupa or titulo na katunayan na may legal documents sila. Ngaun po namomoblema ang mga ka anak nila kasi gusto nilang gamitin sa nigosyo ang area kaso hindi makaka process ng dokument or business permits sa municipyo sa kadahilanan na walang deed of donation...maari po ba yan maibalik sa mga tunay na mga may ari katulad namin?       hi sir, dependi po yan sa agreement ninyo both parties. It can be either the seller or the buyer. But pwede rin hatiin both parties.

      Ang talagang may shoulder ay ang seller. But sometimes it depends sa agreement nyo kung tumawad u ng super sagad sa price at pumayag ka na sau lahat gastos, no choice ikaw na buyer ang gagastos. But kung walang agreement na ganon, ay si Seller ang mag shoulder po pati capital gains tax.

    kahit po no expiration deed of sale we should act as a buyer w/in 1 to 2 yrs mglaan ng oras at pera pr maging legal. later bk maibenta pa sa iba or nmatay na ung ngbentang tao, innocent ang mga heirs....agree po ako sau atty.ntenks

    Good day po attorney. may binili po ako na lupa. ako po ang nag pa survey at nagbayad ng lupa sa mga magkakapatid na supposedly tagapagmana ng lupa na ito. apat po silang mga tagapagmana na lahat ay tiyuhin at tiyahin ko. nabayaran ko na po sila lahat at may kasulatan kami (sulat kamay lang). in short nagkaintindihan na po kami na ako talaga ang bagong nagmamay ari nito. napatitulohan ko na po ang lupa subalit dahil sa respeto ko sa pamilya ng tatay ko, ipinapangalan ko po ang titulo sa tatay ko. few years ago ay nag issue po ng deed of absolute sale ang tatay ko at nanay ko as seller into my name dahil nga ako naman talaga ang bumili ng lupa na ito at notarized na din po ito subalit dahil ofw po ako ay hindi ko pa po naasikasong ipalipat ang titulo sa name ko. ako din po ang nagbabayad ng real estate tax sa munisipyo ever since. namatay po ang tatay ko last year lang at buhay pa naman ang nanay ko. pwede ko po ba ibenta ang lupa or portion ng lupa kahit po nakapangalan pa ang titulo sa tatay ko granting that i have a deed of absolute sale? salamat po.

    28 years napo ang lupa namin na nabili piro nahirapan kami mag patitulo dhil ayaw ipahiram ang mother title sa amen lahat binayaran na namen mother title nlang kulang para matapos na!!

    My question?how can i resolve inheritance property neighbor encroachment who altered and has title ?where declaration 330 square mts.recorded.now it has only 307 smts.altered by govt.surveyor.recorded at municipality? On 1966.i can not apply title?doesnt match?

    Halimbawa po pinalabas n nabili lupa pero hindi pinagbili ang property ng mga heirs hindi nag k pirmahan s harap ng notary public lawyer gawa gawa lang ng nagpapanggap n buyer tpos hindi n register s register of deeds n me nk bili ng property at malinaw n hindi n bayaran ang capital gain tax at documentary stamp tax pero nag claim n me ari ng property yung nag p panggap n sya ay buyer in good faith, sino po me right bilang me ari ng property

    hello po attorney, gud day po sa inyo, nakabili po kami ng lote 643 sqm.last 2018 sila po ang nasukat pagkatapos nilagyan nila fence,tapos ngayong 2022 nagpakilala ang kapitbahay na siya ang nakapatitulo ng lupa at totoo naman pinakita nami sa geodetic engr. para magawan ng deed of sale ngayon pagsukat may excess na 83 sqm. so instead of 643 sqm. naging 726 sqm. ngayon pabayaran sa amin yong excess na 83sqm. sa dati naming nabilhan na walang titulo, ang sabi naman engr. sa amin huwag nadaw kami magbayad kasi pati rin sa kanila kami narin po ang nagpadukat para may deed of sale din sila kami nagbayad lahat ng gastosin sa pagsurvey sa lahat ng documents, dahil nag excess, ngayon lang nakatanggap kai ng summon na pababayarin daw nila kami sa excess na 83sqm. ng 58,000 k. ano po gagawin namin, sana masagot po ninyo ang tanong namu bago paman kami magharapan sa barangay this coming augost 18 2022 salamat po. and God bless

    isa po akong Barangay Secretary ngayon, at witness noong naibenta ang isang lupa sa aming Barangay LGU noong 2021. Ang Deed of SAle ay hindi naiparehistro at dumating ang panahon na ang original copy ng titulo na naiturned-over sa may-ari ay nawala. Namatay na ang mga may-ari at gustong bawiin ng mga anak nila ang lupa na nadeveloped na sa barangay government. Mayroon nang Housing Units at mga government facilities. Mababawi pa ba nila ito? sa kasalukoyan ay may ginawa sila affidavit of loss na gustong ireconstitute and titulo atang laman ng affidavit ay hindi daw naibenta.
