    If that becomes a criminal offence, a woman can accuse her spouse anytime. This will eventually result in fewer marriages or even marriage- phobia and increase number of red streets. People who bat for this should evaluate its consequences very well beforehand.

    If having sex (even if wife doesn't want sex) is considered rape then why marriage??? If the same thing happened to husband (wife forcing a husband to have sex) .

      Bro first they make POCSO gender neutral. lakhs of innocent minor boys in prison just because they were in romantic relationship with girls.
      if both were minors, only the boy is punished. even if he the victim.
      in tamilnaadu, 12 year victim boy booked under POCSO by women force and put him in jail, 17 years old girl got pregnant.
      he is the victim and instaed of arresting the 17 year old criminal they arrested innocent 12 year old child. this is cruel.
      POCSO meant to protect chidren. but here its punishing the victim child. becasue girl is deafult victim even if she is the criminal.

    How can a man prove himself innocent , if a wife filed a false case of marital r**e against him ?
    I am pretty sure the written agreement will not stand in court, what if the women mentioned a date when they were not indulged in the act . How can the man prove it? The problem with these type of laws is that the burden of evidence is put upon the accused party.
    People who are with this law please tell me how a man should protect himself from the misuse of this law ?
    Should he indulge in physical relation with his wife in such a way that others could see and ensure that there are witnesses who will support him. If so then then dignity of women is already lost 😑😑😑.
    People are so eager to bring this law but doesn't have any answer on how innocents should protect themselves.

    1-Bring no fault divorce can be avail by both parties
    2-Easy the process of divorce ( 3 month limit)
    No financial loss and imposed financial burden on men.
    3-Any case filed on can be completed within 3 months so that if that man is culprit then he should get punishment and if he is not culprit then he should not be harrased by year long process of court.
    4- legalise marriage prenup.
    Terms and conditions should be decided before marriage.
    Then bring any law, no problem 😊.
    Women can't have 🍰 cake and eat it too.(This rule is for everyone)

    Martial r@pe is criminalised already. Let me explain. The Domestic violence act which is section 85 and 86 in BNS ( previously known as 498A ) covers sexual violence against spouse. Martial R@pe is sexual violence. If a woman is r@ped by her spouse she can still file a case against her spouse.

      Section 85 of the BNS:
      "85. Husband or relative of husband of a woman subjecting her to cruelty. - Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine."
      Explanation:
      For the purposes of this section, "cruelty" means - (a) Any willful conduct which is of such a nature as is likely to cause grave injury or danger to life, limb, or health (whether mental or physical) of the woman; or (b) Harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.

      Apart from injury (of which grape does not always result in visible injury), the only other prosecutable offense mentioned is 'unlawful demand for any property or valuable security'.
      So given that one of the ways that Marital rape laws protect women by the prosecution proving that penetration took place (this includes other signs of sexual abuse) without the victims consent or without the defendants reasinable belief that there was consent, where in BNS sections 85 and 86 is this mentioned as prosecutable offense?
