      To be fair, that supervisor is probably one of the best. He probably shovels shit for a living, and many people hate him for being a cop, when he is most likely one of the intelligent and caring officers we all keep demanding to be policed by.

      Most probably that only happened because he had see the auditor's video/s and immediately knew what was going on. That is the big difference between him and those other two officers. This demonstrates how incomplete and inadequately officially "properly" trained officers

      Mr. Supervisor should have trained his officers a little better BEFORE being placed into such a situation in the wild. It would have saved the city a lot of money. The supervisor is as much at fault here as the officer/perpetrator.

      From the cop's viewpoint, it was a little creepy when that man starts taking pictures of the police parking lot. So yeah I'd say he was waiting for the cops to confront him so he'd have a case. Not every day people are fascinated by a bunch of cop cars in a parking lot. Most people would be getting the hell out of there.

So you must be obliged to allow every stranger that "hey hey"s you to interrupt your activity and have a conversation you don't want to have? Your rights end where mine start and you are not automatically entitled to my time regardless of your profession.
      Additionally, in an encounter with a cop, they are trying to gather any evidence of any violation of any law. Anything you say can and will be used against you. The 5th amendment is mainly there to protect the innocent, not the guilty. Why should or would you want to help the police in their investigation against yourself by possibly making incriminating or suspicious statements? Outside of select situations where there is officer discretion (traffic stops), the only thing you can gain from talking to the police is jail time.

      in some videos the police says its some trained "sign" thing they have that silent or uncooperatetive people are hiding something. Many of these cops that act worse are either rookies, or old angry assholes who have been used to that they are law and no complaints in past have surfaced so they use the power and think that 90s brutality is still ok.

      The information that you as a citizen offer law enforcement has so many unspoken implications, even when it's something as innocent as you telling them where you're coming from (perhaps a crime had just taken place there soon after you left), that there really IS no incentive to answer any of their questions beyond the ones you're legally required to.
      I tell them with every interaction: "Why would I knowingly engage with folks who the supreme court has ruled can lie to me, and who'll openly admit anything I say can and will be used against me in a court of law? Feel free to investigate and earn that paycheck, but I've done nothing illegal so you won't find anything on me, and in the meantime I'll be here using my right to remain silent."

I have seen it where I work, were an officer/officers/Lt, could not articulate a specific crime/violation of the law and still tried to justify an illegal stop. The sad part was the Chief was on board with the stop and even demoted a Sgt. because the Sgt refused to go along with the illegal stop/detention. I wish I could disclose the details and have Audit the Audit do a video of the incident, but I worry it could cost me my job. There is body cam footage to.

      Rosendo Gerrero oh hell to yeah, I agree, this cop was paid while completing a police academy and in most cases is additional to a personally obtained college degree in criminal justice. In other words, he should’ve known better because he was educated in the matter well before that moment.
      So why should tax payer have to pay for this? The officers having to pay would serve as further motivation for officers to stay educated and make only legally necessary contact with the community they serve.

      David T In all fairness, if you were a police officer wouldn’t you want to know why someone was talking photos of the place where you work? I work in an office, but if some one takes a photo (It’s quite a nice building) of it I’m not bothered, as it doesn’t affect me, but don’t you think a police officer would? Especially when every day they deal with people who would wish them to be dead? I’d say it’s less the officers knowing the law and more the law needing updating

    Theres no reason why the supervisor shouldnt get the A+ here. He did everything right, no drama. He got the basic rundown, immediately ordered that the auditor be uncuffed, listened to the auditor and literally invited him in to make a complaint about the matter. It was perfect on the supervisors behalf.

Doing this for money is sad. These settlements are a result of police departments not charging their respective policy's for the people but rather against the people who theg swore to serve.

Auditors largely do this for money, be it lawsuits (not super common anymore but were once very common) or simply viewers/subs/donations on their videos.       You figured it out, huh? Yeah I changed my major to Music Theory and Composition in college but I was minoring in Criminal Justice and majoring in Psychology. See, here's the fun part. Police officers pay Police-Union-dues. The Police Union pays for Union insurance. Union Insurance covers civil settlements for violations of Constitutional Rights and a civil rights lawsuit has to have merit to even go forward. Most dismissed charges and overturned convictions have little if any retroactive effect on Qualified Immunity but if they go forward, yes, officers are shielded from personal liability by paying into those insurance polices via the dues they pay to those mean ol' Police Unions.
      For some cops, they consider their union dues to be the key to the backdoor of some assholes' Constitutional Rights. Say, "I don't consent to speak to you, officer and I'm going to break contact now.       Metal Jack respectfully, there is a bigger picture. These officers work for their chief, who reports to the mayor and councilmembers, and just like the roadways and other infrastructure, those people are elected and accountable for the training of police officers. If police are not trained properly, it is the responsibility, even if not the direct fault, of those elected officials who designate where money goes. That $41,000 should have been spent on training. It wasn’t, and you have to hit these people in their pockets for not appropriating their budget correctly. When the city loses money, people are pissed off and the politicians either fix the problem or they don’t get re-elected. And just as importantly, we have to remember that poor training can result in a loss of life, and no amount of money can rectify that.

Something as basic as culinary, if a salad goes out wrong, it starts with the chefs to properly train our subordinates. If they make a mistake I look bad, I am held to the standard of how effectively I lead it's simple. 1 person can not be everywhere buy it's his job to ensure those under are an extension of his leadership, knowledge and training. If this dude was just a hustler, the cops under him should have known this was a grift. Cops have know the law and they have to know the streets, how else would they survive. If the captain knew this individual or of similar gifts that cost the city money, his subordinates should have known..he gets a C. The team under him is lacking and that's unacceptable. If they are to have access to military level equipment and gear, these people need the highest training. I expect Navy seal level, my safety is on the line, we need to police who cant handle these situations without bias, just based on the laws. Why is our bar so low. I expect my doctors to also hopefully be the best on the planet as well.

An auditor can never know how PD will react but present them with a legal dillemna to see how they react. Depending on how badly they react they SHOULD be sued for damages because their mistakes have real life consequences.

      It’s actually a valid point you make, in the future however in order for us to get the officers to pay out of their own pocket, they just have to be sued in their private capacity instead of the Police force. This would certainly get their attention on a more personal note, however, if that were to happen, there would probably been no policy change and education as it is now. I ‘m not sure if you could sue the department and the individual at the same time or not but that’s something we might want to look in to.

      The police dept, fire dept. Etc.. they all get a budget each year. Certain amount of money to use each year for equipment, training, paying overtime, supplies etc. etc.
      They should take these law suit fees out of that departments annual budget.
      I know it's all still tax papyer money paying these budgets but atleast this way you are directly affecting that department. They don't want to loose budget money, in fact you do everything you can to burn thru that money and make it look as of you need more the next year in Hope's the city manager will give it to you. If these lawsuits come out of their budget they will start training their officers better to not loose any of that money.

      @@Logan_Baron It's not that those people are incorrect but rather they don't understand that those types of arguments are never, ever acknowledged by the lower courts for a variety of reasons so it's pointless to claim the "right to travel" unless you have the resources to appeal the case all the way and even then the higher courts can simply decide they don't want to hear the case.
      Also, I've seen tons of these videos where the auditor can recite the relevant statutes verbatim as did the guy in this video.

    It makes no sense that you can become a law enforcement officer without at least a basic understanding of the laws you are there to enforce. You wouldn't hire someone to be a pilot who didn't understand how to fly a plane.

      I assume your a cop, or a buff.
      Loss of qualified immunity can occur from an officer who deprived a citizen of their rights. They swore to uphold and protect those rights.
      They probably settled out of court for such a low amount, if he had pushed for a full trial the officer could have lost his home and his wife and kids would have left him. The officer should be thanking him.

      You need to factor in the time to thoroughly learn the local laws and ordinances and time conducting the court proceedings. Also I think its more than just about the money. He looks at it as his job to fight for fair treatment from the police.

    This is the best training those cops ever got. Mr O'Connell getting $41k compensation is actually just him collecting his well earned salary from the police department. O'Connell should be given a medal from all citizens, he is literally spending his time making the country safer for everyone.

    I know this one's old but I'm relatively new to watching auditor videos. The quality of them, shall we say, varies WILDLY! :) I love your channel because of how in-depth you go, and I like how you singled out this particular audit as a SPLENDID example for other auditors to follow. Some have followed that advice, but alas some have not.
