The fact I've been watching videos like this for MANY years now....and cops STILL can't understand that people DO NOT have to provide ID unless they're being arrested for a CRIME is absurd. Either police departments hire the dumbest people on the planet to be cops....or more likely...these cops KNOW you don't have to identify....but push it anyway because it's their POLICY to identify everyone... bypassing and/or ignoring constitutional rights.

She stated it perfectly: I was asked to leave a public meeting, which I did refuse. They said they called the cops, so i waited to not be seen as a criminal. And upon the cops arriving, I was promptly detained, and then charged for trespassing despite not being allowed to leave
I just wish the lawsuits would steer more towards the personal side but it always ends up "individuals are not held liable" and the city gets sued out the ass causing them to spend worse next year.

Just because you carefully remove a criminal let's say from a crime scene and they twist and ankle or something. Is that your fault? It depends. So qualified immunity at least says look you won't be sued into poverty for not doing anything out of this world ridiculous that we've already labeled as unconstitutional. But damn there is so much film of officers who have zero clue of this case law, zero clue of the bill of rights, etc. I'm a certified public accountant and the sheer amount of continuing education we need is ridiculous.... @@tysonkrehnke2835 To the same extent that we can only fight unlawful charges and/or conduct from a police officer in the courtroom, they should have to do the same. Qualified immunity has nothing to do with protecting cops from things they weren't responsible for. It specifically exists to protect them from things they were responsible for, but the court feels they should be excused from.

This video has done more than millions of dollars by showing just what these people are like, and what they think of 'citizen journalists', or as I call them, the real news. He knows that if the pushback becomes too much, he's likely to end up in trouble when they find out money is unaccounted for.

That’s any woman Brother. Literally any woman in the world thinks they know more than everyone yet when the most basic thing happens in their lives, they have no idea what to do. I guess when you live a privileged female existence, that’s the only existence you know.
It is ultimately the responsibility of the public for who their officials are. Even if an official is unelected, they are chosen ultimately by an elected official and the laws that govern them are created by elected officials. I'm not saying we shouldn't remove qualified immunity in many cases, but I am saying that ultimately the buck has to stop at the citizens who either voted or chose not to vote.

I have seen many videos of supervisors correcting the officers and making them release, back off, or even made them return the illegally arrested person to where they got them. Not all LEO’s are bad or violate the rights of citizens. There are good agencies that will not tolerate their officers acting like tyrants. I worked at a municipality that had very poor management and the City manager lost his job over it. The new city manager cleaned house throughout the PD and it was a vast improvement in a few years. They did violate the rights of one group at a festival which they lost in court and the judge read them the riot act for violating their rights. This was a few years later with another new city manager who was tyrant and was eventually fired for her poor decisions. The good city manager was stolen by a neighbor city who paid he very well to clean up their house. He recognized good people and talent and the woman who followed him, forced out those good managers to replace with so called friends of hers.
@@StashHouse56 They only need RAS to investigate which is less than probably cause. My point is that they always tell someone you are being investigated so hand over that ID but, they rarely ever actually conduct an investigation to find out if they have probably cause to ask for the ID.
In New York, you need to always provide name, address, and explanation of your current behavior/activity if the cop has *any* slight suspicion of possible criminal activity now or in the future. Since you can't read the cop's mind, you always have to provide this information when asked. Your actual physical ID card is not required to provide this information, so a good lawyer could argue the police never asked for the information they were entitled to and instead only asked for their ID cards.
@aaronkoning7255 Every state in the nation requires Reasonable Articulable Suspicion of an actual Crime. You don't just bend over and present ID just because a cop says so.
It is part of the first admendment. Redress of grievances. Female call was wrong on the ID requirement. The trespassing is absurd because when the cop showed up she was leaving. Deputy did not have to give her the statute but she was unfamiliar with it and got it substantially wrong. Youvare being detained you need to leave but you cannot leave. Officer asking if he had evidence of the trespass order. Supervisor stumbled all over himself trying not to say we don't keep meeting minutes per the law. What a bunch of idiots. The DA were correct to let everything expire. Everybody looks right, even the DA.

You can't be asked to leave say no, then wait to try and leave when the cops show up, to try and avoid a trespass. When the cops show up, you are already violating a trespass.

I agree with the logic that policies are not laws but the city argued that the meeting was acting in the execution of governmental duties. She wasn't clear in her response that policies weren't laws which was the reason I understood the grade of B. Had she been clearer to that, it would have been better for her.
I'm more on her side after watching the video, but even if she was mistaken, she should absolutely still get an A because she was so calm and articulate.

The following should be mandatory for becoming a LEO. 1) Mandatory 1 yr constitutional law and civil rights education. 2) Mandatory annual continued civil rights education. 3) Mandatory annual de-escalation training. 4) Prior citizen complaints follow for life. 5) Prior reprimands follow for life. 6) Limited qualified immunity. 7) Mandatory body cameras and mandatory termination and jail time for muting, tampering, or deleting body camera footage. 8) Mandatory full accountability and enforcement for breaching laws. (such as filing a false report and /or lying on a report/court). Send this to your congressman.
Keeping “every” complaint would create an incentive for petty civilians to punish cops for just doing their job because let’s be real, people super petty and will abuse the hell out of it. There are instances where body cams do need muted or turned off for privacy and in sensitive areas. Any exceptions to this rule or does a cop get terminated for trying to take a shit in private?

Too many false complaints about officers harming or being racist, sexist etc. The police have a lot to deal with as it it. I do however feel one thing that should change with immediate effect & it will reduce crime, police killings & civilian casualties. Throughout America a 100% all of nothing law to produce documentation at the roadside, in bars, shops etc heck in the middle of the ocean on a inflatable pink flamingo! I'm a retired chief of police. This is why I studied law and forensic anthropology and have a minor in law enforcement before I went to the police academy. I've forgotten more law than these ignorant officers have ever read. Officers need to follow the law and not people's feelings. Protect and serve means to protect and serve the constitution. Josie - 1. Abolish qualified immunity ASAP, 2. Abolish civil asset forfeiture ASAP, 3. Make it illegal for a cop to mute or turn off a cop body camera, 4. Make it cheap, easy and fast for a citizen to obtain any and all records - not redacted when possible. 5. Make all internal investigations subject to independent civilian oversight. 6. Fast track civil rights lawsuits into months instead of years. 7. Do not let a cop simply “retire” only to move to a different department.

The officers' job isn't to determine whether a person is guilty-that's for the courts to decide. The officers only determine whether there's probable cause to arrest.

Here me out, you know who doctors especially surgeons have to get medical malpractice insurance? What if we applied the same logic to police, EMT, firefighters, and government officials? We can give them all a small raise to cover the increased cost, knowing this cost guarantees the citizens will never have to pay out a multi-million dollar lawsuit again. If a cop for example breaks the law and uses to much force, or does something else heinous enough to warrant a pay out, eventually they won't be able to get insured. Which means they won't be able to work in government. It's the free market perfect solution an I'm annoyed I feel like I'm the first person to think of this.

The lady cop is a godsend. Trespass in a public place. 4th amendment violations. 1st amendment violations by both the town officials and cops. What a gold mine of a settlement coming.
Cop: "Show me ID." Citizen: "Of what crime am I suspected?" Cop: "I'm investigating you, so you must show me ID." Citizen: "You must suspect me of a crime to require ID." Cop: "Refusal to show ID is a crime." So many cops play this circular reasoning game and seem to actually believe it. It's complete BS.
They use the same kind of circular reasoning for searches of a car. Refusing to give them permission to search is considered reasonable suspicion to conduct a search.
A prime example as to why qualified immunity has to be abolished if we are ever going to have a just justice system. Put some cops in jail for this crap and we'll see change

If I was a cop, as soon as I come on to the scene I'm not taking the callers side. I'm simply going to review what happened and decide if any law was broken. I noticed a lot of cops take the side of the caller RIGHT away which isn't right. Its if laws or rights were broken or infringed on.
That's not dumb to be fair. You can be charged with anything no matter if the officer is right or not. Being found guilty or innocent is completely different.

Well apparently it was open for a public meeting and then when the meeting was over they closed the building but they refused to leave. I fell asleep multiple times watching this one lol so I may have missed something 🤣

Even if an official is unelected, they are chosen ultimately by an elected official and the laws that govern them are created by elected officials. They did violate the rights of one group at a festival which they lost in court and the judge read them the riot act for violating their rights. The good city manager was stolen by a neighbor city who paid he very well to clean up their house. He recognized good people and talent and the woman who followed him, forced out those good managers to replace with so called friends of hers.

In New York, you need to always provide name, address, and explanation of your current behavior/activity if the cop has *any* slight suspicion of possible criminal activity now or in the future. Since you can't read the cop's mind, you always have to provide this information when asked.
Your actual physical ID card is not required to provide this information, so a good lawyer could argue the police never asked for the information they were entitled to and instead only asked for their ID cards.

Every state in the nation requires Reasonable Articulable Suspicion of an actual Crime. You don't just bend over and present ID just because a cop says so.
It is part of the first admendment. Redress of grievances. Female call was wrong on the ID requirement. The trespassing is absurd because when the cop showed up she was leaving. Deputy did not have to give her the statute but she was unfamiliar with it and got it substantially wrong. Youvare being detained you need to leave but you cannot leave. Officer asking if he had evidence of the trespass order. Supervisor stumbled all over himself trying not to say we don't keep meeting minutes per the law. What a bunch of idiots. The DA were correct to let everything expire. Everybody looks right, even the DA.

The officers' job isn't to determine whether a person is guilty-that's for the courts to decide. The officers only determine whether there's probable cause to arrest.

What if we applied the same logic to police, EMT, firefighters, and government officials?
We can give them all a small raise to cover the increased cost, knowing this cost guarantees the citizens will never have to pay out a multi-million dollar lawsuit again. If a cop for example breaks the law and uses to much force, or does something else heinous enough to warrant a pay out, eventually they won't be able to get insured. Which means they won't be able to work in government.
It's the free market perfect solution an I'm annoyed I feel like I'm the first person to think of this.

If I was a cop, as soon as I come on to the scene I'm not taking the callers side. I'm simply going to review what happened and decide if any law was broken. I noticed a lot of cops take the side of the caller RIGHT away which isn't right. Its if laws or rights were broken or infringed on.
