      Personally, I tihink she should probably file criminal and civil harassment charges against the tattoo "artist" in question and subpoena the other artists that shared her information. And probably file a complaint with Better Business Bureau. IMO

They have to prove that the defendant made false and defamatory claims that resulted in personal injury and/or injury to the business in this case.

    For what it's worth, this lawsuit isn't going to *magically* clear up Lindsay's name and reputation. Her name pops up when you google "tattoo gate tattoo artist" and the best thing she can do is apologize and admit to her mistakes, because there's nothing else she can do at this point. Same with Russ, who should definitely be getting more heat than he has been.

    I'd be shocked if the letter came from a real law firm. Lots of people use online services to generate cease and desists and there's no case here. It has to be provably false to be defamation and the accusations against Lindsey are provably true. Scammers in the multi level marketing space use these threatening letters too and it's just a scare tactic, and a childish one at that.

      Anyone can send a cease and desist letter. You don't need an attorney to do it. They are just warnings that you plan to take legal action and the main purpose of them is to avoid the cost of a lawsuit for both sides. It also helps in court to show the judge that you attempted to be reasonable and give the other person a chance to stop doing something that they might not have understood was violating your rights. You also don't technically even have to send one before filing a lawsuit.
      I agree that most people use them as scare tactics without planning to follow through, but as long as they don't falsely claim that it's being sent by an attorney or law firm there's technically nothing wrong with doing it unfortunately

      @@michaell8269 It doesn't have to be a paper letter. It just has to be in writing so emails are entirely legitimate ways of sending them. There's no such thing as a fake cease and desist since they aren't actually legal documents. Anyone can send one to anyone whether they have a case or not

    Wait... an EMAIL?! That's not legit. Nope. I would definitely recommend she look up the law firm and call them, because no lawyer is going to sent an email cease & desist, they would put it on letterhead with certified mail and the person it is addressed to needing to sign so they could prove delivery.

      You don't even need a lawyer friend to create a cease and desist letter. There are plenty of free templates online where you just fill in the blanks with your name, their name, put in a fake address for the law firm, and then just write whatever reason you'd like for the letter

      What’s more is that, depending on the state, actually filing the suit may get Lindsay hit with an anti-SLAPP action. That legislation is meant to protect people’s first amendment rights to participate in public discussion by punishing those who file frivolous lawsuits to silence them, after all.

      ⁠​⁠@@BurningFreesiasas far as i know defamation is extremely hard to prove, as lindsay would have to prove that not only the things ri said are not true, but that ri knew that it wasn't true. so ri doesn't need to prove that what she said is true, lindsay need to prove what ri said isn't and that ri knew that. that's why defamation, even in cases where there is a real defamation, is incredibly hard to succesfully sue for. (sry for mistakes, english isn't my first language)

      Oh I guarantee this is throwing a huge wrench in the entire industry. I imagine a lot of new customers are going to be scrutinizing their payment policies and not paying a dime until they've seen the entire contract in writing. Why anyone is doing verbal agreements when it comes to artwork I don't know. Everything should be in writing before you spend a dime. Never give away your money! And without a contract in writing that's what you're doing. Giving away your money.

    This is something that a lot of predators, who generally have power over their victims, use to silence those who speak out against them. We've seen it a fair bit in the last few years in the kink community, with mixed results. Also, it's disgusting and an abuse of the legal system

      My abusive ex did a similar thing, trying also to get my cat from me cause she had the documents for him and forged her name on it as the owner (which was so obvious, different handwriting AND different pen color lol). I looked at the name of the lawyer and it was a scammy 24/24hr online thing. And they did that by sending me a normal email, and in my country’s law if you don’t respond and by so acknowledge of reading it, it doesn’t even have legal value. Don’t know about how it works in America tough. I’m glad I spoke with an actual respectable lawyer who helped me navigate through the first months of leaving while she was stalking me.
      I hope that this girl get the help she needs. That tattoo artist should just rot in hell at this point for me.

      Depends on the country. In mine you can have it mailed by the postal service (a lot of lawyers will also send an email, too tho) but there are countries in which lawyers can send stuff like this via email IIRC.

    A general rule I was taught when I started in a profession where people sometimes get angry enough to threaten lawsuits: Once a lawyer is mentioned, all interpersonal conversations between you and the person making threats end. Inform them of such. A simple response of "Please forward your legal representative's information to me so that I may pass it along to my lawyers. They will be in contact," without preamble or further explanation can do wonders. For someone who is trying to get a rise or money out of you with an empty threat, it calls their bluff. (Most people don't want to, or can't afford to, spend the money on a lawyer. The person threatening you is hoping that you fall into the latter category and will just give them what they want without testing to see if they are of the former category.) For someone who is serious about getting the law involved, the less you speak to them without a lawyer present, the less chance there is of misspeaking and helping their/hurting your case. And, if the person is serious about getting a lawyer, you can wait until you receive that person's/firm's contact information before spending the money to engage your own. A "cease and desist" has no legal authority in-and-of itself.

    A lawyer sent an email threatening a lawsuit? I know that this is taking place in Canada but that sounds sketchy. I lived in Canada and I know a few lawyers in the province that this takes place in. They usually have an officer or a courier send the lawsuit which is written on paper and signed for, not send an email which could potentially go to the wrong person or not be seen. I have a feeling a friend of Lindsey's set up a server, created a "law firm" with a sketchy website (People's pettiness have no bounds), and sent an email to scare Ri. I would suggest that she gets a lawyer and send an email to that firm saying "here's my legal representation, all further communications are to go through them." I BET that there will be no lawsuit.

      A cease and desist isn't a lawsuit. It's a warning that you plan to file a lawsuit if the person doesn't stop what they're doing. There doesn't have to be any lawyers involved yet at this point because they aren't actually legal documents. Most people do get lawyers to help them write them just to make sure they'll actually have a case and because it gives more weight to the threat, but they don't have to. If it has been sent through a law firm that isn't legitimate then it is very much illegal though

    I think the very public sucess of the Depp trial and the E Jean Carrol trial have made people forget that its really hard to prove defamation because the defense is always that it could have reasonably happened they way they said. All she has to do in this case is show the videos of people sharing her ID and show her payments to Lindsey (3 payments made at the times she said) heck im sure there is a police report backing up what she said as well

      Good point... I think the difficulty of proving defamation varies greatly by country, and you're probably right about it being very difficult in Canada... Crazy thing is, I recently heard that under Japanese law you can legally sue even when what the person is saying is true!

      Depp made it viable for people to try and keep their victims quiet by suing for defamation. Never forget Depp was found to be a wifebeater in the UK. Where it is actually harder to defend against these claims.Look at how Manson and Pitt are now using the same tactic against Evan Rachel Wood and Angelina Jolie.

      I'm thinking it might be because Courtney is more recent and has had so much active support. She also has more public records and have shown that Lindsay essentially plagiarized someone else's work to use for Courtney's sketch that is being charged for. So Lindsay doesn't want to risk touching her.

    She's probably hurting for clients, so she's gotta milk someone for money. It'll probably get thrown out if it ever does go to court because the agreement, as Ri said, was verbal. So, there's no way of proving or disproving what was agreed upon. It's probably just a scare tactic, like a cease and desist.

    It’s called the barbra Streisand effect. She complained that pictures of her mansion were online, and for them to be immediately removed from the internet, which of course had the opposite effect. Now she has a whole phenomenon named after her because of it 😅

      and to add, Streisand sued the photographer, who had put the pictures on the internet for scientific reasons with six views (two views were from her lawyers). As he was documenting the California Coast not just her home. When she filed the lawsuit it went to 400,000 views. She lost the suit and had to pay his legal fees. So the tattoo artist may want to take that as an omen for the future.

    what I find insane is, what is that tattoo artist expecting will happen? she already has one of the worst reputations possible and instead of laying low and letting things rest, she's making a legal mess. again, what does she think will happen? she's literally crashing and burning herself all over again in the court of public opinion. no one likes seeing legal threats, she'll be completely blacklisted in the head of clients forever

    They are just trying to scare her, first because she didn't mention any name, second she has proof that the tattoo artist leaked her personal information. She just need a laywer to respond to it, but not as an email, sent a registered letter.

    Lawyers don't send emails unless it is between their client. I'm guessing the artist made a fake email address. I'd check out the authenticity of her attorney which can be found on the local bar association website.

    She’s in Canada too, and over here, we can’t really just sue anybody and anything like in the US. I don’t think this would fly in a court here, unless maybe we have stricter defamation laws like in the UK.

    In my country if the cops are called they only do it to detain someone, break a fight or something similar, but they never show up and force someone to pay for something, even if the other person has the absolute right to be paid, because that's what the judges are for, so it's really really weird for me to hear that, does that really happen often in the U.S?

      This happened in Canada, and I would assume she paid because Lindsay would likely take legal action, which is a long, expensive, and difficult process, and could end up on your record. My guess is that it was probably just easier to pay, and be done with it all.

    I’m fully confident that this is an intimidation tactic. It’s unclear whether she actually had a lawyer or not, but I doubt she has any plan to actually take this to court. I’ve seen it time and time again, once there is a little push back or serious threat of legal action, she’ll fold

    Hi Lauren! I hope that you're doing well my darling. Every person who has gotten scammed should be filing a lawsuit against Lindsey. Let that tattoo studio get shut down, and make sure that Lindsey never practices tattooing again. My heart breaks for the victims and Ri has my full support. Thank you so much for making some of the best content on TH-cam, and for covering stories (like tattoo gate). I live in New York but, your information helps me find red flags on shady tattoo artists (like Lindsey) in my state. I wish that I would have done my research, and known about these types of tattoo artists before I got my first tattoo (a red heart on my right wrist). The tattoo that I have is tiny and the artist charged my ex (at the time) 60 dollars for the tattoo. I hope that you're having an awesome day. I love you always and forever😘😘😘😘💖💖💖💖

    I really hope this brings to light some of the horrible behavior of certain people in the industry.
    Back when I apprenticed back around 2009 and onward , my mentor warned me about people like this. He told me that I had to act tough or I would get taken advantage of, and he was right.
    While I went back to school I had my expensive liner stolen while I worked at a bogo shop. A lot more happened there that completely turned me off from pursuing tattooing as a career.
    I remember one time I was working on some original flash for an upcoming Friday the 13th Halloween special discount event we were having, and the person who would go on to steal my liner said, and I sh*t you not, “man, I wish I could draw.”
    ….. what the hell did you think tattooing was, just some tracing?!?!
    I digress…I hate to say it but Lindsey’s behavior is NOT surprising in the least. It certainly isn’t the majority, but there is a larger group of people than I’m comfortable with admitting who are swindlers, scammers, cheaters, stealers (I had my custom art stolen with no credit given by the very same shop’s owner)….
    I hope that in todays climate, this behavior is no longer brushed off. I want these people to finally experience some major consequences.

    It sounds like this is just a cease and desist letter. Generally those can be ignored as they are just a scare tactic.
    If (and it’s a big if) Lindsay does escalate things legally, she doesn’t have a leg to stand on in court.

    She (Lindsey) is trying to weaponize the legal system. Lindsey is also going to cost Ri so much money, I hope she can fight this without having a large financial loss.
    Now would be a great time to start a counter/lawsuit against Lindsey with multiple of her scammed customers.

    Fun fact (apologies if it's already been stated here) but in Canada, you need to be able to demonstrate monetary damages to successfully get a favorable judgement in a libel/slander case. The judges are going to send her away telling her to bring back proof of loss of income/business which she can't produce or tie specifically to Ri

    The fact that somebody charged $4,000 for a VERY minimal , Color-Less, Non-Dimensional Tiny Shoulder Cap stretching across MAAAAAYYYYBEE … 5 total inches ..?? -WHEN- My Ex/ First Baby’s Father - paid $8,000 for an ENTIRE “Suit” down his Shoulders-Back-Butt-Thighs-TO THE KNEE; in a Full color Japanese influenced (Old School Warrior-ish) AWARD WINNING Piece of Art.
    Not to mention my MOST costly tattoo - which Landed me in SEVERAL tattoo publications - roses from Top of my Hip - down the side of my thigh , ending at my Knee… Fully Colored and Shaded GORGEOUSLY, SOOOOO much Ink packed into it, - FOR $1,200!!!!!
    Literally. I know certain tattoo artists ARE WORTH the high price. (For example, you ARENT even getting into the Seat of Niko or Roman - before you’ve kissed $3,000 goodbye - AT LEAST - but I mean…. Their work SHOWS in the quality. The tattoos are ACTUALLY NOTICEABLY DISTINCT, and INCREDIBLE!!!!
    This piece on here is just So INCREDIBLY TYPICAL. No shame to RiRiality…. I’ve got plenty of “Cute” “Not Super Unusual” kinda Tattoos myself, but like…. I mean…. They were all done for rates of like …. $400 and lower. Like…. Yaknow …?!

    The woman being sued should check the name of the lawyer, the firm, and the address, then if found contact them with the found info (not what was in the email) and check if they're real and truly working for Lindsay. Many people have used fake services to create fraudulent letters from lawyers. It's illegal to do so (pretend to be a lawyer), so that'd add to her countersuit case. Ri didn't say anything that wasn't true, so I doubt Lindsey even has grounds for a defamation suit. It's not illegal to share your story about someone on your personal accounts, Ri's intent was clearly to back up Courtney's story and help people from falling for the same. If her intent was to defame Lindsey, surely Ri wouldn't have waited to share her story until others came out, she would have "defamed" her right after her bad experience. I'd argue that Lindsey was defaming Ri by sharing her personal info and LYING that she didn't pay, with the intent of causing her trouble. Hopefully the suit is dropped (if it's even real, can't trust a shady person), but if not, Ri should countersue as it seems she's the one with an actual case!

    I don't know about Canadian law but I know here in the US a letter is sent through the mail (usually certified) and you have the opportunity to contact your own attorney to discuss. Emails seem fishy to me. She should contact an attorney regardless and yes, i agree, a countersuit should be filed since her private and personal information, including her home address, was posted online. Without her permission. Anybody could have gone to her home and broken in or kidnapped her kids or whatever. That is scary af and Rhi should have sued her months ago.

    I may be wrong but my history with courts and the legal system (divorce and custody stuff) is that in order for a case to begin she (Ri) would have to be served and sign for the documents. It can’t just be a letter in the mail or email etc. or did I miss that part of the story? I truly think Ri should countersue and maybe even have Courtney there to sue her also.

    I don't know how it works in Canada, but in the US it is really hard to prove defamation. Also if you are running a business and providing a service you are going to have bad reviews and opinions about your services.

    A few things: first, check with the attorney who contacted you. Did she actually pay them to send that, or is she stealing their name? Happens often. Also, look into the attorney. Are they known for being "all talk", mostly a cheap office whose work is mostly empty threats intended to intimidate people into silence (á là Blair "Illuminaughtii" with, er, the American one, ex-friend & editor, had a dog, spacing his name). Also, it's not defamation if what they did is _fact,_ ofc! Also, if isn't basically what people expect of the person, their reputation. As in, she's already known as a duplicitous scammer and this is how she's been with many, many people. Second, the tattooer has been abusive and defamatory herself, and the doxxing is mental.
    Also, on the first TTok clip, the victim cites the cop telling her "the law says you have to pay her whatever she says", but don't rely on their knowledge of the law! Especially in that situation, where she spoke with the cop & he said she has to pay. She doesn't, cos contracts are a thing, and you cannot just "[post hoc] charge whatever [amount] you want". You need to speak to a lawyer! If you have a few thousand to pay for sunk-cost, then you can afford a [often free] consult with an attorney who specialises in this sort of thing, which is primarily a civil matter, not a legal one. And if it is re criminal offence, you have a right to a defence attorney if you can't afford it, and if you don't qualify, there are options like sans interest payment plans.
    And always remember that the police are not your friend and they don't care about you or your situation. And even by law they're not obligated to help you if they "feel threatened or unsafe" and often just don't want to and so they don't. Never trust a copper.

      I am wondering if that really was a cop. She said he called her and told her she had to pay whatever the artist decided to charge. I know in the states, if there was such a dispute, the cop would just tell you to take it to small claims court. There’s no way he’d call someone’s customer and tell them they had to pay. Just doesn’t ring true to me

    I’m not a tattoo enthusiast and I know very little about the process and the industry. However, I think this tattoo is absolutely beautiful. Like someone else pointed out it looks like something out of an old storybook. The art style is unique compared to what tattoos commonly look like. People are being quite harsh it’s a beautiful work of art and she seems very happy.

    I have had friends who have gotten tattoos. They had consultations and quoted a price. Got it in writing. And that was the price. I hope this educates people that when you work with independent contractors. You need to negotiate a fee upfront get it in writing and there is no wiggle room. Whether it's a flat fee. Or if they structure it by the hour. So you make an informed choice if you choose them as an artist. That it can get very expensive, very fast. It's a shame hearing if there are artists (allegedly) violating the trust between artist and client stringing them along and up charging at every turn. Personally, I have no problem with artists charging for a consultation or design time. As time is money, and if they are in high demand they don't want to waste time on someone that might ghost them. And not get the tattoo. Losing income. After taking time to design a tattoo But I would want it in writing what their fees are for it before I put down a deposit and what that covers.

    Consulting/sketch fees for a tattoo should not exceed more than 10% of the estimated tattoo total cost. Lawsuit? That's like sueing someone for saying you stink after you fart, she is seriously deluded. Her lawers should change the defamation suit to the 'you smelt it, you dealt' suit.

    us law is so crazy. in austria, if someone charges unreasonable prices for a service (e.g. from someone in a vulnerable position), that's something you can go to court with.
    also, why was there no written contract? how is that sort of scam even possible under the law??

    I don't know Canadian law, but in the US there is no way a lawyer would actually take this case against Ri. That is so baffling! The fact that this "artist" is only going after Ri when Courtney's video about the fox sparked Ri to come forward shows right there that this lawsuit is absolutely bonkers! And you know this is just her way of continuing to scam, because she's trying to scare Ri into paying her even MORE money! Like you said, there's no way Ri can scrub the internet, but that's the point! Because she can't do that the letter states Ri would have to pay compensation instead, so it's just one big new scam for Lindsay to try out!

    As someone currently studying law for my certification exam in Ontario, I am extremely curious to see what the end result of all this is!!! The clients in my opinion have been wronged and I can see this being an incredibly interesting civil case in Ontario... I hope things work out well for both of the clients. Especially with the sharing of personal private information..... Holy hell.

    I’d verify the “letter” came from a real lawyer before I did anything else. This woman is they type who sends fake cease and desist letters “from her law firm” and uses random attorney names found online to name as her attorney. I had it happen to a legal aid client of mine years ago, where the “opposing counsel” didn’t have a clue what the case was and wasn’t representing a party in it. At that point I reported the wannabe plaintiff to the state for engaging in the unauthorized practice of law. That’s a crime in all 50 US states. For clarity, I’ve been an attorney for 26 years so I’ve seen this nonsense a lot where people pretend to be lawyers in emails and letters (where the named counsel don’t even exist as licensed attorneys).

    In Canada we have the better business bureau, if you look up Lindsay on it you see she’s had complaints against her. The ones that are public are similar to both women’s stories & Lindsay’s counter arguments are picking apart the language of the complaints & saying that obviously these people don’t know what they’re talking about.

    I really wish people understood the law more. That phone call where both parties (who were of legal age and sound mind) constitutes a verbal contract (because one party made an offer, the second party either agreed right away or negotiated until both parties came to an agreement). The fact, and I don't write fact offhandedly, the FACT that they sent her $850 which is magically half of $1700 and not $1900, backs up the defendants claim, not the tattoo artist's. Getting all the complaints from the police against her to show her pattern of behavior as evidence that you are telling the truth backs up the defendant's claim and not the tattoo artist's. Everyone else's TikToks with receipts, talking about their own experiences with that particular person, backs up the defendant's claim and not the artist's. I don't understand why people insist on insane lies and truly believe they can beat them!!! I REALLLLLLLYYYYYYYYYYY hope she decides to countersue and finally put her in her place!
