This story is mind blowing and not the tattoo culture I know.

Literally! If it goes to a trial she'll have to provide documents and proof in discovery and it'll become part of the record. But I doubt it'll go to trial. It'll settle if a judge doesn't dismiss it on its face. Defamation is SO hard to prove.
Lindsey can't win a case, there is no defamation. Defamation means to say harmful things that you know are incorrect to knowingly cause harm, that is not what Ri has done. Any harm to Lindsey's reputation is solely her own doing.

That's going to depend on jurisdiction and the exact circumstances. There are places where it's easier to prove defamation than the US. I vaguely recall them fixing it a bit, but at one point recently truth wasn't always an absolute defense to libel or slander claims in the UK, though it is in the US. I have no idea how it works in Canada. Earlier stages were definitely best covered by tattoo artists and enthusiasts, at this point, I'd love to see a lawyer take this on. Ideally a Canadian lawyer who would be more familiar with the relevant laws, but even someone like Legal Eagle would be cool to see. Of course, morally speaking, Lindsay is absolutely 100% in the wrong here. But that doesn't always map to the laws the way it should.

Wow I really am shocked that Lindsey hired a lawyer for this. If she actually goes through with the lawsuit she'll have to sit for depositions and provide information about her business practices that may become public depending on her local laws. I'm glad Ri has a lawyer and support from the internet on this one.
@@silentlyjudgingyou I'm not, for two reasons. 1) a lawyer always gets paid. 2) even a morally sound lawyer will represent clients who ought not to win and make every effort to represent them well, in order to make sure that the outcome is the result of proper and just procedure, so that it cannot be claimed afterwards that shortcuts were taken; the sort of claim that can get convicitions overturned for guilty people.

I am so proud of Ri for standing up for herself...I think what ticks me off about this Tattooer sending a letter to not only Ri but Courtney too is that Courtney never once named names...she never once mentioned the tattoo artists name or tattoo shop...people did their own digging and got that info out there and Im assuming that Ri not only recognizing a fellow Canadian being scammed and how she was scammed was similar to her, but art style as well was the one that called the artist out on her B.S and rightfully so seeing as her Drivers License was wrongfully spread on the interwebs...what a disgrace of a human and Im ashamed that she is a fellow Canadian...I swear we are not all this crazy😅 I truly hope that Ri and Courtney are able to stand their ground against Lindsey and get what they so rightfully deserve (a win and hopefully reimbursement as well as maybe the shop closed for good)!

When tattoo gate was happening, both of these ladies put in alot of work to NOT mention Lindsey Joseph's name or shop. They were deleting comments naming her, and they didn't mention her in their videos. Defamation without naming the person is a lost case immediately right?
not that this is the case for tattoo gate, but if the person is obvious even without naming the individual, you can still sue for defamation. An example would be the Amber Heard/Johnny Depp case; even though Amber never mentioned him by name everyone still knew who she was referring to with the article.
Someone else says in Canada you must refer to the person for it to count as defamation. In the US if you can tell who it is even without being directly referred to you can still sue for defamation. I'm not sure how strict Canada is about their "refer to the person" rule

Lindsey had pretty much got away with everything she has been accused of, keeping all of that money. And now through her own actions she may actually be held to account for it. For this reason, stress for the people she is now attempting to sue aside, I am rather hoping she doesn't back down so she instead effects her own comeuppance.

I know that in the UK, defamation can be easier to prove than the States; I don't know how it is in Canada, but I can't think that this case is going to hold up. I also wonder if Lindsay here realizes that she's opening herself up to discovery (release of text messages, e-mails, et cetera in relation to either/both of these cases) by taking this to court, which could reveal even more of this poor behavior on her part. Just such a strategically terrible decision, never mind the moral implications of her behavior.
Also, as I watch this video, I wonder if that guy who was running the scammy "How to Make Money" tattoo MLM thing pulled his videos related to Tattoogate because of this- did he get a letter, too? Hilarious if so.
On one side, there are multiple people who don't know each other sharing similar stories and willing to show their faces to the public while sharing their experiences. On the other, a person who still seems to not want to actually explain themselves or provide anything in their own defense while threatening legal action against anyone talking about them. It's just so hard to figure out who might be the guilty party. The world may never know.

I guess the fact that all these prices were Canadian went over my head originally, but now I am more aware. I am Canadian and I can compare prices and practices and Lindsey was outrageously wrong. Just the fact that she shared Ri's personal info publically is a huge illegality. I guess Courney is also being served a letter based on her tone. That is just terrible. I feel bad for Ri and Courtney in this situation. I almost had to face a similar situation because my past employer wouldn’t give me my state mandated covid sick pay until I sent a legal letter and she eventually sent it - but then accused me of stealing my own equipment that I paid for (I was a dog groomer) and threatened to send me to debt collections for what I “owed” which unsurprisingly amounted to the majority of my covid check. I half expected to get a claim to suit in the mail from her since my boss is very similar to Lindsey in the way that she just likes to silence people but it was all empty threats because 1. I never stole anything which meant she doesn’t have proof 2. I never bought anything from her 3. I recorded every interraction I had with her including her denying my pay 4. What she sent me was a hand written “receipt” to scare me and 5. She would have had to file a criminal case against me for stealing for any of those claims to be valid via lawsuit or debt collections. I would have had a great case against her had she sued me. It’s been way over the 90 days period to file a criminal claim from initial incident so I think it’s safe to say I’m in the clear, but what I’m trying to get at is people like Lindsey exist and do things just to spite people when they know they’ve done fucked up but can’t admit it because of their fragile egos. I don’t know why people are like this. Legal stuff is scary and stressful and expensive so I hope whatever happens with Ri and Courtney ends up going well for them. So many well wishes and support for them.
I still can't believe a cop told that lady who was being blackmailed and was a victim of fraud that she had to pay the blackmail to that con artist of a tattoo artist. That cop and the tattoo artist should both be sued. That cop was like, "I know this tattoo artist has multiple complaints for fraud and blackmail but you have to pay her whatever she wants, if she says you have to pay her a million dollars then you just got to do it or I'm going to arrest you."
Sending a letter to her may stop this from going further and is in no way a counter suit. It’s more or less a cease and desist. Also, if they did go to court and Ri wins, she can put it in her suit to have Lindsay pay her legal fees. I support Ri, but she’s not getting my money and I don’t think folks need to blindly send money to strangers on the internet. She’s still a stranger, even if you know about this one situation she’s involved in.

I don’t know about the law in Canada but at least in here defamation cases are incredibly complicated and I see no case here. It’s not defamation when it’s your truthful experience. If Lindsay’s lawyer has a brain they will not go forward with the case beyond trying to bully them to silence.

She could have offered to refund any of the money people paid her for work that wasn't done. Second, I was going to mention before seeing the whole video that America is SO litigious, that it's jarring to see someone mention so much about their case (cue second video from Ri clarifying lawyer has said, "Clear this with me before mentioning anything, please." Lol). Anything you say can get your whole case damaged & add more fuel against you in court. So for those who aren't aware, it's usually best to be mum on the topic (cue Courtney's cryptic video). Defamation is super hard to win and usually only applies whenever something is untrue and the truth is twisted to skew the way people see the person in a way that is untrue. This sounds like she is grasping at straws and going for the first thing she heard aka defamation…if anything the lady who scammed her clients could go after the guy whose course she learned these scammer tactics from. Not her clients whom she already did horribly wrong enough.
From reviews it appears that she decides on the spot when the session starts and ends (often making people waiting) while charging for a whole day session nonetheless and that she accepts only cash which makes it even wilder to me!
I would really love it if one of these days, with the sorts of drama we get exposed to on the internet, when the person who is the actual criminal does the whole "send a threatening letter to everyone to scare them into backing down" nonsense, if it would then turn out that the person being threatened is actually a state district attorney or something so they'll just be like "Well these threats won't hold up in court, but if necessary I'll be glad to prove that to you and a judge. :) "

I'm sure that her lawyer is aware but there is a thing in some states called an anti-SLAPP Statute which protects people against civil lawsuits brought as a way of intimitating an entity. SLAPP stands for Strategic Litegation Against Public Participation, basically a case can be dismissed if it's found to violates a states anti-SLAPP Statute. For now though I think all parties would be smart to not post because anything they post online can be used as evidence in the case.

Lindsey had pretty much got away with everything she has been accused of, keeping all of that money. And now through her own actions she may actually be held to account for it. For this reason, stress for the people she is now attempting to sue aside, I am rather hoping she doesn't back down so she instead effects her own comeuppance.
I think the lawsuits are literally just a form of intimidation. There’s no way at that Lindsay would win these cases.

Honestly, there is probably no game plan here. The most Lindsay can do is to ruin their credibility by destroying their reputation. Beyond that, I bet she is furious at them and wants to hurt them any way she can.
We should have seen this coming. Someone who is so morally corrupt to scam their clients to this degree is so self-assured she thinks she can win a case. She cannot see that she is in the wrong here and is trying her best to get revenge.
Nice to see that Ri's Gofundme has already hit its goal; the decision of this artist to just start panic suing people is truly wild. She was already the bad guy here, and now she's going to be a total villain, regardless of how the lawsuit turns out. I know that in the UK, defamation can be easier to prove than the States; I don't know how it is in Canada, but I can't think that this case is going to hold up. I also wonder if Lindsay here realizes that she's opening herself up to discovery (release of text messages, e-mails, et cetera in relation to either/both of these cases) by taking this to court, which could reveal even more of this poor behavior on her part. Just such a strategically terrible decision, never mind the moral implications of her behavior.
Also, as I watch this video, I wonder if that guy who was running the scammy "How to Make Money" tattoo MLM thing pulled his videos related to Tattoogate because of this- did he get a letter, too? Hilarious if so.
On one side, there are multiple people who don't know each other sharing similar stories and willing to show their faces to the public while sharing their experiences.
On the other, a person who still seems to not want to actually explain themselves or provide anything in their own defense while threatening legal action against anyone talking about them.
It's just so hard to figure out who might be the guilty party. The world may never know.

I guess the fact that all these prices were Canadian went over my head originally, but now I am more aware. I am Canadian and I can compare prices and practices and Lindsey was outrageously wrong. Just the fact that she shared Ri's personal info publically is a huge illegality. I guess Courney is also being served a letter based on her tone. I hope she knows that if she needs help the community will back her up too.

That is just terrible. I feel bad for Ri and Courtney in this situation. I almost had to face a similar situation because my past employer wouldn’t give me my state mandated covid sick pay until I sent a legal letter and she eventually sent it - but then accused me of stealing my own equipment that I paid for (I was a dog groomer) and threatened to send me to debt collections for what I “owed” which unsurprisingly amounted to the majority of my covid check. I half expected to get a claim to suit in the mail from her since my boss is very similar to Lindsey in the way that she just likes to silence people but it was all empty threats because 1. I never stole anything which meant she doesn’t have proof 2. I never bought anything from her 3. I recorded every interraction I had with her including her denying my pay 4. What she sent me was a hand written “receipt” to scare me and 5. She would have had to file a criminal case against me for stealing for any of those claims to be valid via lawsuit or debt collections. I would have had a great case against her had she sued me. It’s been way over the 90 days period to file a criminal claim from initial incident so I think it’s safe to say I’m in the clear, but what I’m trying to get at is people like Lindsey exist and do things just to spite people when they know they’ve done fucked up but can’t admit it because of their fragile egos. I don’t know why people are like this. Legal stuff is scary and stressful and expensive so I hope whatever happens with Ri and Courtney ends up going well for them. So many well wishes and support for them.
Now I really want to be a fly on the wall for this case when it’s presented in court.
I still can't believe a cop told that lady who was being blackmailed and was a victim of fraud that she had to pay the blackmail to that con artist of a tattoo artist. That cop and the tattoo artist should both be sued. That cop was like, "I know this tattoo artist has multiple complaints for fraud and blackmail but you have to pay her whatever she wants, if she says you have to pay her a million dollars then you just got to do it or I'm going to arrest you."
Cops can be thick as mud and often don't know the law in certain areas. I would have walked and let the silly b pursue it in small claims.
Sending a letter to her may stop this from going further and is in no way a counter suit. It’s more or less a cease and desist. Also, if they did go to court and Ri wins, she can put it in her suit to have Lindsay pay her legal fees. I support Ri, but she’s not getting my money and I don’t think folks need to blindly send money to strangers on the internet. She’s still a stranger, even if you know about this one situation she’s involved in.
I agree, if Ri counter sues and wins which pays for her legal fees then what about the people that donated money for legal fees? Lindsay should be paying for Ris legal fees, not the general public.

I don’t know about the law in Canada but at least in here defamation cases are incredibly complicated and I see no case here. It’s not defamation when it’s your truthful experience. If Lindsay’s lawyer has a brain they will not go forward with the case beyond trying to bully them to silence.

She could have offered to refund any of the money people paid her for work that wasn't done. An apology would lessen some of the damage but defamation is a little tough to dispute seeing how she's been treating her clientele for years. What I thought too, I think she can’t try to do anything with Lindsay exactly because of it. She was smart by doing so. Not that Ri isn’t, but shitty people doing shitty stuff isn’t something new sadly, that’s all.
The funny thing is that Lindsay probably would have had an easier time moving on if she just didnt say or do anything. Now if it goes to court depending on the laws in Canada, anyone will be able see she has a defamation case, the details, etc.
(As far as I know court cases are public unless its ordered not to for some reason, so there's the potential. I'm not Canadian though, so I'm not entirely sure. But if it's the case, she could have just let it go or apologized, and she would have likely just faded into the internet. Instead at any moment it can come popping back up in the future with judicial/legal receipts whereas before it'd just be what's been posted so far)

Second, I was going to mention before seeing the whole video that America is SO litigious, that it's jarring to see someone mention so much about their case (cue second video from Ri clarifying lawyer has said, "Clear this with me before mentioning anything, please." Lol). Anything you say can get your whole case damaged & add more fuel against you in court. So for those who aren't aware, it's usually best to be mum on the topic (cue Courtney's cryptic video).

Defamation is super hard to win and usually only applies whenever something is untrue and the truth is twisted to skew the way people see the person in a way that is untrue.
This sounds like she is grasping at straws and going for the first thing she heard aka defamation…if anything the lady who scammed her clients could go after the guy whose course she learned these scammer tactics from. Not her clients whom she already did horribly wrong enough.

I'm sure that her lawyer is aware but there is a thing in some states called an anti-SLAPP Statute which protects people against civil lawsuits brought as a way of intimitating an entity. SLAPP stands for Strategic Litegation Against Public Participation, basically a case can be dismissed if it's found to violates a states anti-SLAPP Statute. For now though I think all parties would be smart to not post because anything they post online can be used as evidence in the case.
Clearly Lindsay is too young to remember the Streisand effect. If this makes it to court, we will all be laughing at the Lindsay effect :P
