    Fun fact. You could have sued for the cost of the tree, some trees can hit the 7 figure mark depending on species and age. A 70 year old white oak runs 700k

      @Brody Albert the ammount of wood from such an old tree would have to be traceable through other neighbours if not through online market (like craigslist) records if he sold it off that way.

      @@SonsOfLorgar no its reference to a case where q neighbor illegally had a tree cut down on a persons property. He had to pay 700k and because of this he had to sell his house to make the payment

      I feel like he could have done both, but you can sue for 700k all you want , doesn’t mean that 1) he has it at all, or 2) you would get the payment anytime soon. The OPs property value probably had a decent increase. One of the few things in this world that will always hold/increase value is land! Remember that!

      @@SonsOfLorgar If the wood was sold online, you have no possibility to trace anything. As if illegal or questionable deals are recorded somehow, lol. You have any idea how many stolen goods are sold on eBay alone? They're simply sold as "private" stuff.

      @@agoddamnferret I completely agree. My situation wasn't like the one in this story. It was just a tree that meant a lot to myself and the kids of the neighborhood. It is where we built our tree house and loved the tree. As we got old we took down the treehouse but left the first 3 steps on it as a reminder. Eventually, my parents needed money and had to sell part of our land with the tree on it. They sold to a developer and I was worried about the tree till my Mom reassured me they couldn't touch it because it was protected by the city. She made sure to inform the city just in case they may have overlooked the records before selling. The tree still stands today and the person who has their bigfoot home next to it treats it well.

    Shame Story # 1 couldn't have some r/treelaw revenge. One thing I've learned over the years is to never, _ever_ cut down someone else's tree.

      From a legal standpoint, any part of the tree that overhangs onto your property you can cut away. My neighbors found out the hard way when they tried to sue me. I was having my driveway enlarged and that had a large tree near the property line. The tree ended up dying because of all the roots that had to be cut and removed for driveway. They lost.

    They could have gotten Witnesses and security footage of the whole thing going down and that if there is anybody that seen a tree being cut down. Which if it's this old and then the store come neighborhood then there would be freaking Witnesses. And tree law the dad would've known.

      Yes, if someone saw the company truck and had a name, they could have gone to the company with the threat to sue for trespassing and cutting down their tree. The company, to avoid lawsuit and bad publicity, might have then given them the info that Lumpy hired them to cut the tree. Then they could have sued Lumpy for the cost of a good mature maple tree. And then still gone through with the revenge.

    We have a strict "do not rent to friends or family" policy on our rental units. I wouldn't even make an exception for my own parents. It's saved our butts many times. I encourage others to do the same.

      @@colbytucker2178 Yep. Child abusers dont last long in general population. I got a friend who used to be a prison guard. They never told inmates about incoming inmates. But they never had to. They found out on their own from outside sources and the news travels fast. My friend said they brought in a guy that got way to light of a sentence due to not being able to get charged with abusing his daughter due to the defense attorney making it seem like it didnt happen (how he got away with it either way is no ones guess)
      anyway it didnt matter much because the inmates made sure that kid got justice in their own way. he didnt last one day. The guards heard a cut off scream and found his bunk mates trying to hang him with their bed sheets after beating him to death. it was one of those multi people jail rooms so there were quite a few people in the room. It took a while for the guards to get to him and by the time they did he was already gone.

    I remember 2 maple trees on the west side of the farm house i grew up in. They were planted there the year I was born. I loved climbing the north tree in particular as a kid because if the hill and the way the branches grew on it. The lower branches in the south tree were to high for any kid to reach.

    Yup, unfortunately my mom had one of those "tenants from hell" stories. She owned a condo that was 2 hours driving distance from where she lived (she initially bought because it was close to work, then had to change jobs and move to a closer apartment to her work), and her renters turned out to be noisy party people. When the neighbors complained she had to evict them after just a few months, and of course, they trashed the place as much as they could before their move-out deadline. The insurance company she had underpaid severely and blocked her at every turn for further recovery until eventually she had no choice but to sell the condo at a significant loss because of all the damage the tenants had caused. So what was supposed to have been an investment and steady income stream for her eventual retirement instead turned into a money pit that destroyed that option and caused her instead to live her final years barely making ends meet.

    I am an automotive technician, and the car was being sold for $1,000 right? Well check this out they said that 1) The check engine light was on, which can be fixed by simply plugging in a code reader into the port and clearing the code. 2)An A/C recharge kit comes to $26-$56USD...AND 3)A FUEL PUMP "THINGY" (SOLENOID $48 /ACTUAL PUMP WITH CORE $80-$130USD).
    SO RIGHT AWAY, THE OP IS GETTING THE SHAFT.

    The neighbor knew full well what he was doing, he just figured he could get away with it. His smugness proves it. It was a bit petty to make sure all the trees shed on his side. I’m surprised you didn’t get in trouble for stealing his chop shop.
    In most areas in the US, if a neighbor’s tree hangs into your yard you can cut the branches back to the property line. Why didn’t you try to sue the neighbor for destruction of the tree? If the property is that old, he could have been in huge trouble for destroying historic property.

      I’m from Scotland, we have Pictish carved stones from 300-843CE so 1,200-1,500 years old, we have Ogham inscribed stones from 0-400CE~ so 1,600-2,00 years old, we have Neolithic Stone circles from 2,500BCE~ so 4,500 years old, and we have cup marked stones from 7,000BCE~ so 9,000 years old, so anything that’s 200 years old architecturally speaking around here is really young lol

      @@ZombieSazza Caucasians came to North America cir. 1500 C.E. so about 500 years ago. 200 is an old house, here. By and large, the average age of a home in the U.S. of A. is less than 60 years old, so, yeah. My home's records i. The county seat go back to 1823 and the earliest record is a sale from the L&N Rail Road Company to its first private holder. So it is somewhere around to just over 200 years old, and is the oldest structure in my immediate area. The next oldest is one of our local churches built in 1832. Also, please remember that our population across the countryside was few and far between for a long time after the beginning of our nation. The majority of our populace was centered on major cities and towns. So, the homes of older ages would be closer to towns, or spread out around further distances across vast areas. The United States is a quite large country, after all, and we are still a young country by world standards. Our native peoples did not build houses and buildings, for the most part. There were only a few tribes in the west that built mud-brick structures into the hillsides. The rest were still using TeePee style tents and grass huts. So no "older" structures existed here. A few castles have been taken down from the older countries and reassembled over here, but only a few. We have one here in Kentucky, there is one in Canada that I know of, and I have heard of three others, but I don't recall where they are located. There are some buildings in the oldest of towns and cities that date back to the late 1400s and early 1500s, but very few compared with how much our population has grown and how much our building standards have improved over that time with the invent of electricity, indoor plumbing, and technology. Unfortunately, building materials have also gotten cheaper as well as less expensive, resulting in structures that don't last as long as the old timber framed and stone structures of centuries past, so demolition and rebuilding are more common then remodeling as the standards have changed as well.
      So, yes, other countries may have buildings that are much older than we do, but they also have a much longer history than we do as well. We can't have those older buildings, when no one was here to build them. Our Native culture lived off the land, they did not own the land. Ownership, to my understanding, was not even a concept to them before they met the Europeans and Spaniards. They were one with nature. Minimalism, and taking only what was needed to survive from the land, was their way of life.

      At least half of the farm houses in my home area is over 500 years old. Most churches are between 500 and 1000 years old. Middle Europe. I am always laughing when in horror movies they talk about "ancient houses that were built over a cave where a demon was said to be living" and that ancient house is 180 years and thus younger than all houses in my current neighborhood. :-D

    The last story reminds me of when I helped someone I just met because they are in a supposedly bad situation. They said they'd keep their stuff in my mom's garage for a couple weeks and would pay her for it, 6 months and no payment later my mom finally made them get their stuff. Now they're dragging me through the mud because they didn't hold their end of the deal. The promise to pay my mom was their idea, not my mom's. And it's the only reason she decided to help someone she didn't even know. Not to mention they'd sit in front of her house smoking pot in their bus they're renovating to move into. She lives right across the street from an elementary school.

      my other decided to help her ex-husbands daughter and paid out of her pocket to move her, her husband, and all 3 kids in with her from 2 states away. They were given simple rules on moving in- no drugs, kids have to attend school, the labeled boxes in the fridge were off limits (me and my BIL both kept sandwich stuff for work lunches in them. when your meat and cheese is $10-15/lb you get possessive of it), and they needed to try and keep the noise down unless everyone was awake (because two of us had variable schedules).
      They... fucked up a ton of ways "It just looked so good I had to try some" after eating half a pound of capicola and horseradish cheese. "Oh I didn't know you were awake" after sitting in the laundry room directly below my bed and blasting action movies, they dug through my mom's stuff in storage- and damaged some of my aunts paintings (the prints thankfully not the originals that can't be replaced), would randomly take 'family days' and pull the kids out of school- until finally we had to report it because our state would have slammed every adult in the house with fines for contributing to delinquency of a minor, barged into my room in the middle of the day (and got surprised to find a gun pointed at them because I was in the middle of putting on my duty belt for work), and my personal favorite: They would randomly take long "walks" where they would come back reeking of meth barely covered by what smelled like a bathtub's worth of body spray and just assumed that my BIL who used to work with the DEA wouldn't recognize the smell. They were highly offended after we evicted them that nobody helped them move stuff out and my and BIL just sat in the front yard smoking and drinking coffee like we did every morning and tried to call the cops saying we were harassing them, which I mean fair point, two big guys in uniform discussing work over coffee like they do every day is certainly harassment. We asked the officers that answered their call if it would be to much to take the time to clean out guns, he just laughed and said to play nice.

    Unpopular opinion: 1st story, no lumpy should not have cut down the entire tree, he's an a-hole for that. But part of the blame should go to the owners. Their tree was over growing in his yard and he informed them and asked them to trim it, they should've taken the responsibility of finding a landscaper and having it trimmed. Why should he have had to do the legwork for something that's their responsibility. Especially if they had issues with him in the past. Passing on the task of finding a landscaper and getting a quote was the catalyst.

    The tree story doesn't seen legit for several reasons:
    If Lumpy didn't cut it down who did? If he hired a company they would most certainly check the legality of it.
    If Lumpy was running a chop shop there would have been some auto parts with traceable VIN numbers.
    If this happened in a small town it would have been the story of the century. It is beyond belief that the author wouldn't know the final outcome.

    There are a couple of things about the first story about the tree. "Lumpy" could easily have solved his problem by hiring a landscaper or arborist OF HIS OWN CHOOSING and paying them to trim the offending tree limbs right at the fence line. What "Lumpy" did was wrong, but the RIGHT THING FOR THE AUTHOR'S FATHER TO DO was to sue "Lumpy" for the value of the tree. In this case BOTH men were in the wrong for what they did.
    The truth is that "Lumpy" can legally take action over the revenge of his neighbor. No one can assume legal ownership of their neighbor's property just because it is lying on the other side of the property line, especially if that neighbor has no knowledge of where the property line was. If there were tools or other things associated with "Lumpy's" shade tree mechanic business, they should have been placed on "Lumpy's" side of the actual property line. For the Author's dad to seize and sell those things or to sell automotive parts that were not legally his as scrap metal was theft by conversion. Doing that was no different than breaking into "Lumpy's garage and stealing those items. "Lumpy" can find a good attorney/barrister to take the case because his defense about not knowing about not knowing where the property line is a defense, especially if the deed to the property he bought shows an error.
    The other things that "Lumpy" can do is (1) sue the previous owner of the home and that person's real estate agent for not disclosing the property line issue, (2) sue the local municipality for a return of all property taxes paid on the strip of ground that turned out not to be his, and (3) file a claim with his own Title Insurance Company for the cost of rebuilding the home so that it is accurately oriented on the property. The Title Insurance Company failed in its duty to provide "Lumpy" with an actual clean title to the property and must pay the damages.
    Finally, if the Author's dad planted new trees deliberately in such a way that they would be a nuisance to "Lumpy", "Lumpy" can (1) "cut all the way down to Hell and all the way up to Heaven at his own property line such that the limbs or roots do not creep or hang over his property to cause damage, and he can also erect a fence high enough to BLOCK the leaves from drifting over. He can also hire a gardener to collect the leaves and deposit them over the fence back onto his neighbor's property. All of these actions are perfectly legal. There have been court rulings authorizing people to throw their neighbor's offending trash back over the fence.
    But this story was about a couple of absolute numbskulls who BOTH did things the wrong way. BOTH of them were in the wrong, completely. The Author's dad may yet be sitting in the defendent's seat in court.
    HONEST MEN know that revenge does not taste sweet. There is a Chinese saying: "When considering revenge, first dig TWO graves." Make no mistake; revenge ALWAYS COSTS those who seek it. I like what the Bible says:
    " Do everything possible on your part to live in peace with everybody. Never take revenge, my friends, but instead let God's anger do it. For the scripture says, “I will take revenge, I will pay back, says the Lord.” Romans 12:18-19

    Regarding the story about the Craigslist car, it had little to nothing to do with the car. He interpreted her not selling the car to him as a loss of power and harassing her gave him a sense of control. This kind of thing can escalate into far more than threatening texts. Sadly, depending on where you live, there may be little to nothing you can do legally. In this case, OP was blessed to have someone take the time to investigate and had the added bonus that the harasser could be prosecuted for other crimes, but these sociopaths will take full advantage of this legal loophole; please contact your representative to push them to get laws on the books to protect victims of harassment of all types. This can happen to anyone, regardless of gender and/or economic status.

    I used to sell a lot of things on Craig's list, cars, trucks, tools, machines etc.
    I was really surprised at how many times people would ask me to drop my price, because "I won't make much money reselling it if I buy it at your price". Seriously, why should I drop price so you can make more money?
    I have to worry about my own family, not your profit margin, who the hell even thinks that way?

    As for the first story, this is very much depending on the country you are in. Like in Germany I know everything that grows from the neighbor to your property the neighbor has to cut if you want it to be cut. If he doesn't after asking him to do it you can do it yourself (not sure if you can make him pay for it though. I think that might even be the case).
    You for sure are not allowed to cut a whole tree down (as it's on his property), but can very much radically cut everything off just onto the property line, no matter how destructive and shitty it looks afterwards. What grows onto your property from your neighbor is technically still his, but it's on your property and thus you can have it removed.

    4:50: Gee, for somebody who's father it seems was a 'crown judge', you know very little of common law! As to trees which grow over property lines, it is perfectly legal to cut any and all branches which stray across your property lines, in as far as doing so does not damage the rest of the tree.

    I walked out one day and saw a large Burr oak tree that had been cut down. It was 100% within my boundaries including the branches. A neighbor’s son was a cop who was killed in the line of duty and the neighbors and I wanted to plant a tree in the son’s honor in his name and he wanted a Burr oak which I had gotten at wholesale price at a local nursery and gotten a larger tree than usual and had it planted. Five years later they moved from the multistory house to a one story house as they were retired and moving to their home town. The people who bought the house soon expanded the driveway, cutting down the tree of honor. When I saw that, I contacted the previous owner and said that I was going to plant the same tree as I had known the son. Most of the original owners had moved, and I did it on my own. Fast forward 10 years and the tree was 10-12” in diameter so it was immediately apparent that it was missing from my front yard. I was furious and didn’t know who had done it when two neighbors decided to cut down my ‘dead’ tree, not the first time people had trespassed on my property and once cut down all my shrubs, flowers and saplings to a 18” height. I then told them that nobody had permission to do anything on my property unless I authorized it and was present. Now the other residents say that I am ‘picky’ about my yard. The dead tree? It was deciduous and had lost it’s leaves as usual every fall.

    Story 2, the car: I have had the exact same thing happen. Had something up for sale, guy sends payment. On this site there's no guarantee that the seller will see the payment right away and generally it is understood that it may take a day or two for a response& item shipment. My reputation is 11/10, I go above and beyond for those I sell to.
    Within an hour the guy is messaging me angrily for the item, within 3 hours of not hearing from me he is SPAMMING my entire page with horrible messages on other items & threats in the DMs. He even crossed platforms & spammed my Twitter with identical awful messages. I didn't see his request until 23 hours after his purchase. I was with my family for godsakes.
    He had gone totally nuts. Looking at the 17-23 messages &time stamps in awe, I don't think the guy slept all night.
    Luckily since my reputation with everyone else who has been on my page for years, they knew that this guy did not know me and what he was saying was not true, They knew that this person was flying off the handle and was making a fool of themselves. That was the only good part.
    Since the guy had sent so many messages I tried to talk to him first and figure out if he was new to the platform &try to get him to talk about why he was so angry. At that time I wasn't sure if I was still going to sell him the item or not cuz let's be honest everyone needs the money.
    I tried giving him a chance to redeem himself but he truly was an awful person with nothing but haye to say to me as a woman. And when I wouldn't sell him the item due to his red flag firing behavior, it got even worse. So I made sure to report him on the site, block him 100%. This was too much. Since he had paid for the item, as far as I know he would have had to contest it with the platform to try to get the money back, or it is absorbed by the site, because either way I did not have or even want the ability to keep the payment.
    So in the end, everything he was screaming about not getting the item he paid for was completely on himself. I'm glad he showed his colors but damn. The rage and anger some men have towards women, you'd have to see it/experience it to believe it.

    First story is iffy. The neighbor already cut down a tree in OPs property and got away it it, then they replanted another tree that would shed all over the neighbor's property and they expect he will just take it without doing it again? Dunno. Claiming the property line makes sense, but everything else is too dumb to be true.
