    The EEOC, OLC, DIR, DOL is there to help the employer. Watering down your complaint, Pushing you to settle for a couple $$$$, keeping you case hostage on the shelf for decades so your case will never make it. None of them will take any action to penalize or prevent the employers wrong doing at all.

    My personal observation that happen in Puerto Rico frequently is that the employer do not terminate your job, but do your life miserable and very difficult until you finally decide to leave. I think there may exist any appropriate remedy in law for such described situation in the Federal Court.

    I have lost total faith in the American judicial system. I was discriminated against by the City of Los Angeles. I first filed a grievance through my union, but the city ignored my grievance. I then filed my grievance with the EEOC, and they referred it to the DFEH, the DFEH gave me a "Right to Sue Letter". I then attained a civil attorney that litigated my case for 3 years, then quit 5 days before my trial.

    This is very good information. Due to corona virus,they only do telephone interview according to the website.
    I have to wait till an open date,which seems like its going to be a long while before I can get a date to talk to someone. I hope is not discourage people.

    I'm currently dealing with a wrongful termination case as well as a discriminating case. Pro-se. It's with the State of Idaho and their attorney is the Deputy Attorney General. Can these cases be combined for settlement? And how much $$ is usually settled with? I know it depends on the situation, just a ball park figure.

    Question to anyone that’s able & willing to take a moment to answer - what options are available for large groups (30 average) on a 27.000 force - that were wrongfully terminated without any previous disciplinary actions - a group with specifics similarities- Age- Salary- etc- can a group file a charge as a class Action charge with the EEOC ?

    I got fired because I told my employer I was going to sue them..
    They fired me the next day..
    I know this to be retaliation but could be hard to prove out right..
    I need to speak with someone about my case because I already have a racial discrimination charge against a major trucking firm in which the eeoc already filed a charge against that company..
    But yesterday I realized that I was retaliated against by a whole different major trucking firm when I told them I was going to sue..
    So my question is can I have 2 cases going on at the same time with the eeoc?
    The racial discrimination charge is in its investigative stages now..
    The eeoc rep told me that they definitely discriminated against me racially..
    But yesterday I realized that the other trucking firm also violated equal employment rights against a protected status which is blk or African American..
    My question is can I have 2 cases with the eeoc at the same time?
    All these things happened back to back to back to me, so both of my cases basically happened within a month from each other..
    If possible can I have your honest opinion about the retaliation case due to being fired for telling my employer I was going to sue..

    I was recently terminated from my job . The reason being that you are getting complaints of disrespect. I asked if my clinical manager could give me details of what i did or said to correct the behavior. The second time again but this time mentioning things that never took place and deliberate lies . Example: You made a comment about a client making noise with his mouth. This never took place. I never received any verbal or written warnings of any behavior on my part. I work with children with Autism. This was not something that took place over a long period of time it was only 2 separate occasions but i was terminated based on these false allegations. I felt helpless and almost as if it had nothing to do with my performance but my color or race. Just because i feel this way does not mean i have a case. I filed a claim for hostile work environment due to the deliberate lies to get me out of the door . A simple we don't think this is the best fit is better than putting some one through all the mental and emotional stress. Should i brush it off or pursue this ? Lying and gaslighting seems to be a practice in this field of ABA therepy.

      Ug, so sorry that you have to deal with this. If they made up these lies b/c of race-based discrimination, that would definitely be a claim. Sounds like you may have already filed at the EEOC, which is the next step. I'd recommend consulting with an attorney at this point.     Being rude does not constitute that the EEO should violate your right. EEOC is paid by your tax dollar, they have a duty to do their job right.

    If the employee hire a lawyer does the lawyer take care of EEOC and all procedure of the case in order not to miss any appointment.

      If you hire a lawyer he or she will generally take care of the EEOC charge for you. But a lawyer is not required to file a charge

      What if you had a phone interview w/EEOC and you don’t agree with what they wrote from your charges over the phone ( language barrier). How do you edit what they wrote/mis-heard incorrectly ?? Would an attorney help you draft the charge any better ? In FL. My friend needs help to correctly outline the many charges.

      @@BlueOriginAire Your friend has the right to change the language and can let the EEOC intake person know about the mistakes or write them himself and send them to the EEOC. Yes, a lawyer can help you do this. Try www.nela.org or www.avvo.com to find a lawyer in Florida. Good luck!

    can you please explain how the attorney work in employment cases. Do they charge you as you go until they clean your saving out or they work on percentage. Do attorney work actually with the the employee or with employer and your attorney.

      I have a series about how attorneys fees work in employment cases on my podcast I Got Fired. You can check it out on any of the major apps that allow you to download Podcasts. Briefly, employment lawyers can work in a variety of ways in terms of fees. For some cases, it is pay as you go, or an hourly basis. Sometimes employment lawyers will work on a contingency fee basis, that is, you don’t pay attorneys fees unless there is a settlement or victory of court. It is never an attorney’s objective to clean out your retirement account. In fact, if you are paying an hourly rate, one of the frequent conversations you should be having with your attorney is whether or not you’re going to get more out of the case than you put into it.

    Some of this makes this sound like the outcome is based on subjective things like whether you were polite to the clerks, but the law should be the law, and it should be applied justly. Y'all are basically giving a voice to corruption and saying if you scratch my back, I'll scratch yours. Isn't that just a concrete demonstration that our justice systems aren't all that they claim they are? Where are the super men that will fly in and clobber these cronies?

    Does Discrimination and retaliation at work claim Involved to file EEOC?

      All claims are involved with the EEOC if you choose to go that route. EEOC is like an extension of the investigation. Depending on your case and whether or not your claims are against a federal or private sector you have to exhaust the administrative process(EEOC) before going to district court.

      Yes, most discrimination/retaliation claims need to be filed with the EEOC or a similar state agency, for instance, the DC Office of Human Rights if you are in the District of Columbia

      Yes, if it was based upon discrimination. The EEOC website lists the different types of discrimination.

    question? i was fired during a probationary period (literally the last 30days of it), the reason they gave my manager was that our store(a smoke shop) smelled like weed and bad customer service. i called the owner and they said it was because i had been bringing my dog to the store that they’ve told me not to bring before and that my coworker would service all the customers when they came in instead of me. they did tell me not to bring him but then my manager said i could bring him but keep him in the back part and secure him in with boards from the displays. my coworker admitted that he would take the customers because i worked from open til close everyday and they would come in the second half so they would give me a break, it wasn’t like i told them to help them instead of me. all of this was why i got fired which i wouldn’t have done if it wasn’t for my manager saying i could. is this grounds for wrongful termination?

    Filing within 45 days, not 180 or 300 or whatever days if against a Federal agency

      With a federal agency, you generally have 45 days to file a charge with your EEO rep
