      Yeah I just learned about a case where a 23 year old mother murdered her 2 year old child and dumped her body down a sewage pipe. She got TWENTY YEARS.

    It sounds like Kirstin didn't have effective lawyers at trial. The appeals lawyers did a good job. In 2019, Kristin filed a federal lawsuit against the Las Vagas police and detectives who handled her case.

      Good, I hope she has/will bury them. Police sometimes get terrible tunnel vision, and cannot appreciate the absolute devastation they can render on the lives of innocent people when doing so. There's no excuse for it, and they are just as guilty of causing harm to the innocent when they do so as any criminal. The consequences for such actions should be devastating, to remind other police they must at all times be guided by evidence alone, not by their own subjective judgments.

    The fact it took 16 years is repulsive.There should be overwhelming evidence before incarcerating someone, obviously there isn’t sometimes.. The system is broken.

      There is rarely overwhelming evidence. Few cases are based on hard information. Circumstantial evidence is the norm.

Ted Bundy, Jeffrey Dahmer, Wayne Williams, Gary Ridgeway (the Green River Killer), Joseph DeAngelo (the Golden State Killer), Lonnie Franklin Jr (the Grim Sleeper), Ivan Milat, mass shooters like Martin Bryant or Nikolas Cruz, not to mention more recent cases such as, Jodi Arias, Letecia Stauch, Stephanie Lazarus and countless others.

    A friend made the mistake of talking to the police because "he had nothing to hide". Yeah, the lawyer's fees bankrupted him. The lawyer told him it would have been a lot cheaper to not talk to the police.

      I was on trial for murder once because I shot a bunch of people at a shopping mall (not my fault, I thought the safety was on) and the prosecutor was talking to me during discovery and he noticed my Spice World tattoo near my snatch area (I was a huge Spice Girl fan when I was a child and my mom allowed me to get a tattoo) and the prosecutor was telling me he was real into Dune. Like, I did not get what he was talking about. Later I discovered that Dune is a science fiction series about which family controls some spice planet and he thought my Spice Girl tattoo was something about Dune. I just went with it and got a reduced sentence.

    "When a person adds substances to their life, they subtract the presumption of innocence." This statement is so haunting to me, as a person in long-term recovery from substance use. I have been clean for several years - because I attend a methadone clinic I am regularly monitored and have a lengthy and consistent record of clean drug tests - however, I know that the fact that I was once an IV heroin user will be a dark cloud hanging over my head for the rest of my life. Forget about the fact that I have a degree from NYU and have worked for some of the largest newspapers in the world - if I were to ever find myself in a situation like this one, in which I coincidentally happened to cross paths with an individual who ultimately ended up dead through no fault or involvement of my own, I would certainly end up as Suspect #1 due to my "incorrigible history of hard drug use." It's a bitter pill to swallow knowing that law enforcement (and a sizeable percentage of the general population) will _always_ perceive me as just another junkie no matter what I accomplish in my life.

      I always say that it is shocking how horrible our education system is yet the same government expects randomly selected jurors to be effective in deciding the outcome of a trial. A lot of jurors can’t read or write their way out of a paper bag let alone properly apply critical thinking skills. The only thing more tragic is how eager police and DAs are to convict ANYONE versus the actual perpetrator.

    Kirstin Blaise Lobato is a Nevada woman who was exonerated for the July 2001 murder and mutilation of Duran Bailey, a homeless man from St. Louis who was living in Las Vegas at the time of his death. At her first trial in May 2002, she was convicted of first-degree murder and sentenced from 40 to 100 years in prison. In a 2006 retrial, she was convicted of the lesser charges of voluntary manslaughter and sentenced to 13 to 45 years. Lobato's case gained significant notoriety due to the publication of new evidence, which some believe points to her innocence of the crime.

    The fact that there was extensive fingerprint, DNA and shoeprint evidence at the crime scene - none of which belonged to Kristin - should have
    easily resulted in no charges being filed against her. It is inconceivable that she could end up in trial with all this exculpatory physical evidence.

Because the woman who said the dead man r@ped her in a similar manner a couple weeks prior was also a drug user maybe she was an informant or would do favors to cops or like she said her friends might have done it but it was never investigated

Where drug addicted, troubled criminals lifestyles, get them caught up in hairy situations. Guilty, or not, you see a lot more less empathy. You see a lot more comments in the judgemental vein. "That's bad. But maybe if you weren't a druggie out on the streets, you wouldn't have gotten caught up in this mess" A far more stern sense of admonishment, generally. Just find it interesting, how the sense of connection with the human condition, seems to vary depending on who we're looking at.

    I tell me grandkids never talk to the police. Ask for a lawyer if under arrest. The shady deal the DA worked out with the liar prisoner is what got this young woman this lengthy sentence.

    😊😊Hi Dr. Grande, excellent analysis. You are right regarding substance users. My Therapist threatened me with jail if I didn't do Detox. Said he had friends on the Long Beach, CA police force. So I did Detox ( twice).

    Thank you for having compassion for this woman. I've known a few like her. My highschool best friend ended up on meth. I watched her go through withdrawals when i was 16. She could be mean. She once #icked me in the head with her foot because i told her "friend" to stop giving her meth. She had a lot of problems. But her mom took her own life and so she was left with her cruel grandmother. Blossom was so beautiful and was very sweet when she wasnt using. She took her own life at 32 years of age just like her mom did. It breaks my heart that people are so mean to these people. They are human beings.

    Maybe if a random stranger grabbed you and attacked you and tried to rape you, it would make more sense to you.
    Consider panic, fear, adrénaline, traumatic stress, etc. That fucks with your memory. It doesnt always make a person hyoer aware to detail when your just trying to avoid being killed or sexually violated.

It took so long for her to be set free, but in hindsight, it may have helped her- she was still young enough to change her mind and leave her hometown after a year or so after moving back there, and who knows what might have happened with her. It's still sad though, and I hope she leads a happy life.

    I have self defense insurance because I carry a firearm for protection and the number 1 thing that is told if have to defend yourself is only tell the police when you call, that you have been a victim of a crime and need assistance, give location and advise if need fire, ambulance etc... and hang up. That's all you have to say. Other than that call your attorney.

    I'm VERY Liberal on most social/class issues, but when it comes to self-defense, the Right will get little argument from me. If you are attacked, ANY way you defend yourself is ENTIRELY your prerogative. You owe neither the perpetrator, nor the law, ANYTHING.

      @@jamese9283nobody owes anyone an equal fight. How does the victim know if the attacker with gouge their eyes out if the attacker gets the victim on the ground? Should the victim play a wait and see game? You attack someone, you’re done. The law is definitely wrong on these issues.
      Having said that try your best to neutralize the threat without killing.

      She didn't stab him. Their argument was bc she stabbed someone else she was capable of killing him. Yet they had DNA, prints and shoe prints that did not match her. Plus she had an alibi. So twisted.

    I was on trial for murder once because I shot a bunch of people at a shopping mall (not my fault, I thought the safety was on) and the prosecutor was talking to me during discovery and he noticed my Spice World tattoo near my snatch area (I was a huge Spice Girl fan when I was a child and my mom allowed me to get a tattoo) and the prosecutor was telling me he was real into Dune. Like, I did not get what he was talking about. Later I discovered that Dune is a science fiction series about which family controls some spice planet and he thought my Spice Girl tattoo was something about Dune. I just went with it and got a reduced sentence.

    I made that mistake once. Cops made me spend 45days in jail for a crime I could prove I wasn’t even in the same state as the crime at the time , with video evidence and phone records

    Hi Dr. grande. Very impressive and admirable analysis in this case - which could affect the life of an unjustoy convicted person. This seems to be following in a recent stream of your videos which hint at subjects and issues if more personal interest to you, as well as of wider interest than simply the titillating "crime" issues.
    I encourage you to continue on this focus, assuming you agree that your recent videos are in more alignment with your passion and interests than previous posts.
    My attention in your recent shift was when you noted some case and mentioned "conservative" and "liberal" political behavior, with a clear personal bias revealed toward traditional conservative politics. I didn't want to hastily post a comment, so I can't immediately recall the exact video, but it has been about one week since that post.
    I sensed a more focused, personal presentation of interest than with your lust of prior, wider ranging vide subjects. Kee up your fine work. I suggest reviewing book/material in distinguishing between creative ideas that are more suited for specific media. A book with title like, _,Is your idea a Song, a film, or book?_ Screenplays are about the most condensed, specifically defined models, and therefore, seem t me, to be a great creative discipline to consider and attempt.

    I want cards made - wallet sized cards that are right beside the ID card or Driver's License and I want it to be given to any police officer that one might encounter and this Card will say that this individual is not allowed by their attorney to talk to the police and for the officer to back off & leave the person alone. This society is in DESPERATE need of these kinds of Cards!

    I'm aware of another case where police investigating a criminal allegation interviewed a suspect regarding one piece of evidence and the suspect answered the questions put by police believing they were talking about an entirely different (but similar) piece of evidence. The police had no actual knowledge regarding the evidence to which the suspect had been referring in answering their questions, and the suspect had only vague knowledge of the evidence they were referring to when questioning him. Incongruities in the suspect's answers arising from the fact that he was speaking about an entirely different piece of evidence were ignored by the police - who believed he was referring to the piece of evidence to which their enquiries were directed. It became obvious to the suspect during the trial that there were two different pieces of evidence (the evidence was two different files on a computer hard drive) and that the interview process had been undermined because of the confusion regarding which piece of evidence was the subject of the interview. A contributing factor was that he was self represented during the trial. The judge realized there was a problem, but he was still convicted by the jury. On appeal, his conviction was overturned. The judgment is a fascinating read regarding how the police screwed up.
