- सुप्रीम कोर्ट ने आदेश दिया है कि अत्यधिक कठिनाइयों की स्थिति में सरकारी कर्मचारियों को किये गए गलत भुगतान कि रिकवरी नहीं की जा सकती है। DoPT has issued instruction vide O.M. dated 6/2/2014, 2/3/2016, 19/9/2022 and 3/10/2022 on the basis of Supreme Court Orders. In this video, all the situations in which recovery of wrong or excess payments impermissible in law is discussed in details. Hope this video will be helpful for all those employees against whom this recovery of excess payment has been ordered.

यह सभी निर्देश सुप्रीम कोर्ट से समय समय पर दिये गये हैं फिर भी मैदानी कर्मचारियों को ऐसे कोई भी आदेश बरिष्ठ अधिकरियों द्वारा नहीं बताये और ना ही अवगत कराया जबकि छोटे कर्मचारियों को मौखिक आदेश भी अधिकारियों दिये गये हैं और सभी मैदानी कर्मचारियों को मानना पड़ता है और पालन भी किया है बाद में उन्हीं अधिकारियों द्वारा छोटे कर्मचारियों से जबरदस्ती वसूली लिए गए हैं ऐसे में न्यायालय कर्मचारियों की वसूल की गई राशि या रुपये बापिस करवा सकेंगे यह हमारी गुजारिश है निवेदन है हम👈😑👉 पर सभी आदेश रखें हैं जो कि निवेदन करने पर भी अधिकारियों द्वारा जबरदस्त तरीके से राशि वसूली गयी है कृपा करके गरीब कर्मचारियों और कुछ सेवानिवृत्त हो चुके हैं ऐसे में क्या सुप्रीम कोर्ट हम👈😑👉 सभी की मदद करके राशि बापिस कराने की कृपा करें जय हिंद बंदेमातरम भारत माता की जय हो जय हो

Many of the retired/ very aged pensioners are now disappointed that all the private hospitals are refusing to entertain CGHS card holders due the fact that the Ministry of Health, Govt of India are yet to clear the bills presented by them, on account of treatment given to pensioners. Where should we, the CGHS card holder pensioners go for medical treatment now

Two matters are : failure to ensure compliance with the existing law and making false claims by government servants. Both involve non-compoundable offences.
The court should have required pre-audit to answer Art 266(3) and Art 39(b) requirements. The stand of the court encourages corruption,nepotism and favouritism.

However, sometimes, employees may loss in non payment of pay fixation and other benefits. Employers may not work properly and may be delayed the cases till employees file suit in court for delayed grivances which again deprive them for indefinite period of time and also have to bear financial loss in Cort cases. When erroneous pay fixation done due to misrepresentation recovery after retirement may be done.

This mainly happens after retirement when service sheet of the govt.employee is submitted to concerned treasury office for verification. At that time treasury office make query that excess payments has been made and same should be recovered from the employee. So necessary instructions may please be issued to all T.Os by the Govt.quoting above citation of the Hon.Supreme court.

सर यह बताने का कष्ट करें कि प्रमोशन मिलने के कितने दिनो के अंदर प्रमोशन स्वीकार कर लिया जाना चाहिए क्योंकि एक जगह आदेश में जॉइनिंग टाइम नहीं दिया गया था और six months तक किसी ने जब प्रमोशन स्वीकार नहीं की तो उसे प्रमोशन दे दी गयी और पोस्ट vacant रही तो क्या वो debar नहीं हो गया था।

सर यदि किसी जूनियर कर्मचारी का ग्रेड पे या लेवल सीनियर कर्मचारी से ज्यादा है तो क्या वह उसे स्टेप अप कर सकता है जबकि जूनियर कर्मचारियों को कोई एक्स्ट्रा बेनिफिट या एक्स्ट्रा फैसिलिटी नहीं मिली है जूनियर कर्मचारी जॉइनिंग में भी जूनियर है और प्रमोशन में भी जूनियर है
स्पीकिंग ऑर्डर क्या होता है? जारी करने की प्रक्रिया क्या है? किन परिस्थितियों में जारी किया जाता है?
विभागीय जांच प्रक्रिया के दौरान या उपरांत ऐसा आदेश जारी करने के निर्देश प्राप्त होते हैं.
इस संबंध में निवेदन है कि कृपया उचित मार्गदर्शन करें सर.....
This indicates the inefficiency of concerned staff. What ever the case may be, the fixation done by concerned employee must be held responsible for the lapse. He must be charged with ' spend of public money by inefficiencent means', the employee must pay the excess money paid to him. Recovery of excess money paid is known to him and failed to bring to the notice that he is being paid over and above his entitlements. The DOPT also must bring in such a system that all employees are aware the process of their entitlements. Are these employees not approaching courts if he is paid one rupee less? There may be cases that staff dealing with fixation of pay on promotion, CPC arrears etc.,. Involved in corrupt practices such cases are identified and dismissed from the services. Atleast, such things will never happen.
That's why instructions has been issued to pay fixation authorities.

ऐसे में अगर उससे ऑप्शन फार्म गलत हो जाए ( वर्ष 2016,,मे) ओर उसका जूनियर उससे
एक स्टेप आगे की बेसिक pay उठा रहा हो तो ऐसे में क्या,,सीनियर कर्मचारी जिसे अपने same service,, same कैडर जूनियर से बेसिक pay एक साल पीछे की मिल रही है तो ऐसे मे stepping up
का प्रार्थना पत्र दिया जा सकता है ?
