The petitioners, inter alia, challenged the provisions of
Sub-Rule (2) of Rule 11.1 of the Punjab Civil Services Rules, Volume II
(Annexure P-2), and seek restoration of the commuted portion of pension
after a period of 15 years instead of 11.5 years.
Counsel for the petitioners also contends that recovery of the
commuted portion of pension appears to be in excess of what is actually
legally due to the respondents, which finds mention in Para 4 of the Writ
Petition.
Notice of motion.
Ms. Deepali Puri, Addl. A.G., Punjab, accepts notice on behalf
of respondents-State and seeks time to file reply to the Writ Petition.
At her request, adjourned to 21.08.2023.

Court ka faisla to sabhi pe equally implement hona chahiye. Govt rules mei partiality nhi ho sakti.very good initiative. Sir 18 months ke DA ke arrear ka writ bhi court mei pending hai uska status bhi update kijiye pl.csn we central govt employees hope for refund of same by govt.
Very nice news l think all respected Associations/Union may be initiated action against this matter and give the justice to retirees The affected retirement persons be joined the concerns unions/ Associations to file the case in court to get the benefits.
Why next date of hearing after four months. The honorable justice is requested to dispose off the case on next date of hearing in favour of poor pensioners.

Ye commutation act to sabhi par ek jaisa lagu hoga chahe koi initiate kare ya na kare it's a dutyof govt to regulate same rule for each employees / retirees .
Really this is a open loot which must have been stopped but regret to say no one is interested to stop this .

i retired on 31st may 2007 on 1st june 2022 they must restore commuted portion but un fortunately it will continue till November 2024 Rationale of undue recovery is not sufficiently explained .Probably banks want to make govt servants scape goats for their NPA. . But it is also true that pensioners are living on pension given by Govts. God save Indian pensioners!
Exactly very important case till now all ESM are being loss big financial benefits and should be considerable what expenditure we may also ready to pay our share....

Pensioners के हक में पंजाब और हरियाणा हाई कोर्ट, Chandigarh ने बहुत ही अच्छा फैसला लिया है और commutation की अगली recovery पर रोक लगाई है l Sir मैं भी पंजाब सरकार का 31-03-2012 का retired हूँ l इस सम्बंध में मैं भी petioner बनना चाहता हूं l कृप्या मुझे बताएँ मुझे क्या करना पड़ेगा l बनने वाले नए petioners की लिस्ट में मेरा नाम भी शामिल कर लिया जाए l धन्यवाद l

There are pensioners whose recovery was done till 17 years like me. We was superanuated in March 2007 and my recovery for commutation was done till December 24. Please be advised if I can file a case for refund of my money recovered from me for such a long period.

This judgement may be implemented for all pensioners. Recovery of commute value is double than the 40% of commute value.
Extra money in the name of interest should be returned to the concerned pensioners with interest for the extra period.

This is a very good initiation.
Since 10 years the principal amount and 5 years interest deduction is not correct.
Since the rate of interest is very less now. As asked 11.5 years is correct.
The commutation amount will be paid a maximum of 40% of the basic pension.
But as per formula , we won't get a 10 year amount, but deduction Will be 180 months
total double amount we have to pay.
One way is cheating.
If the pensioner died in between , the remaining amount deduction Will not be there in the family pension.
This is the only benefit
