    Very good analysis. Instead of all such confusions, they should work on CTC centric taxation. All payments to the employee be treated as pay irrespective of any name. The concept of basic must be done with as almost all companies are appointing employees by offering CTC. All payments must be included in the CTC and accordingly work out the contributions. Even the government jobs must be at par with private companies.

    We are 2 employees in a Private limited co. and we both get more than Rs 21000 salary amount, regarding this we have some questions to ask:-
    1. is ESI and PF applicable?
    2. what percentage of basic salary we should take if we only have HRA in allowances?
    3. What is CTC calculation in this case?
    4. what percentage of HRA we should take?
    It is a humble request to members of "Labour Law Advisor" and viewers of the channel, please answer my questions ASAP!

    HRA % which is to be fixed as part of salary has not been defined in income tax or PF. Yes HRA exemption for income tax is explained which is least of the following i)40% or 50% basic, 2) Rent - 10% basic 3) Actual HRA. If special allowances are added to HRA then PF will not be calculated extra. PF department has to give proper explanation which are those components that are part of Basic wages than creating confusion. Or calculate PF on Gross and reduce the rates from 12% to 10%

    As EPF is social security scheme of India, 12% contribution is must by employee to have certain minimum nest egg keeping in mind the inflation and other things.

    Milna chahiye. Join hote wakt ye koi nahi sochta lekin retirement aate aate ye sab calculations yaad karte he. Shuru se hi define kar do ki
    last salary ka 50 percent = pension

    If there is no compulsation of PF above 15000 salary, then why the companies aren't willing to increase the salary slab so that there won't be any compulsion for paying PF?

    As I understand, PF deductions will be same as earlier, nothing has changed. Basic can be 40% or 50%, will not cut pf from all allowance ONLY ON BASIC @12%, like old time.... do i understand right?

    The trend is there in corporates that both the contributions ( employee+employer) are deducted or part of the ctc of employee.....is that not illegal?

    My company denied to cut PF from our salary as basic pay above 16000. Is that any rule in which company can't pay or cut PF ? Employee having less than 16k basic pay having PF account .and company gives other half of PF. But above 16k basic pay neither have PF not have NPS. Is there any provision or rule company can deny PF and NPS. Doesn't take responsibility for pension. It's MNC Ltd company

    Pahale saving karo then expenses dear advisor....you talking from employer side..basic should be apx 40% of gross salary and then pf contributions should be 15% from each side I.e30% is better ..

    Thanks for such a valuable video. My suggestion is that given the increase in the cost of living, PF % should be 8%, which will result in increase in take home of the employees. In fact whether an employee wants to have PF deduction or not should be left to the employee himself. Its his hard earned money and he is king of it. There should not be any compulsion so far as PF is concerned. After his take home is increased; its all up to him where he wants to invest his money. Secondly Indian laws are more ambiguous than any other countries. The government deliberately does this so that there some grey area where it can try its luck and its so called BABU's have chance to earn extra buck. A BEST LAW IS ONE WHICH HAS LEAST OF PROVISOS AND MORE OF STRAIGHT FORWARD IN NATURE.

      Sir in my company basic is kept fixed at 10000 and all variable is combined and added in HRA. So HRA comes to more than 100 percent. Only two components in salary Basic+DA and HRA is this correct

    Sir recently I raised a transfer claim and got the following response:
    :This is with reference to your Grievance registered vide Registration Number .
    Following final decision has been arrived at: As per provisions of EPF Scheme, a member who joins on or after September (new member) drawing salary more than Rs.15000/- cannot be enrolled to EPS membership. As per our records, the joining date is after 01.09.2014 and there is an enrolment for EPS membership which should not be, hence the claim has been rejected Please clarify the following 1. Please inform if there any prior service / employement before 1.09.2014 by attaching the annexure K for the same 2. If not Please contact your employer for submission of request letter along with the revised 3A for adjusting/correcting the contributions.
    Could you please advise on what to do next, I had already submitted the letter from the company?

    Hello,
    I have two questions here
    1. Whose basic is greater than 15k...so is there deduction will continue as per the previous rules..I mean 12% of basic?
    2. If anyone's basic is less than 15k now (e.g deduction will happen on gross salary not on basic) & If that person get increment after 1year, then if his basic his incremented to 15k so again the 12% of basic this rule is applicable for that person or that time also 12% of gross will be deducted for EPF?

    This kind of Harassment or Confused Judgment is effected maximum to those who "manipulate" the salary structure for paying PF and ESI..
    and employeee will not effect Because Educated Emplyee can Raise the Voice and Labour Ministry. And Emplyee ( I would say less Educated who comes in the Bracket < 15000 (Basic).. employers will only do the needful direct or indirectly 😀😀😀 Because they have to pay the other part also ...
    Genuine Employers and Employee Will Not Effect With Judgment Because it is Very Confused

    Don’t know what happened to Supreme Court from last few years they passing stupid judgement which is impacting nation instead of parties who are fighting. This new bundle law has impacted 2.5k in my inhand salary.

      HRA not count in EPF brother...they only count fixed verible

    Sir my question is - if a member has not withdrawal his pf of last company and now joins another company on wages more than 15000₹, his pf will be deducted but now assume if that employee has withdrawal epf fund form 19 but has not withdrawal form no 10c eps, and join wages more than 15000₹ still his contribution will be deducted or not? Please tell me about this…?

    Sir, my last employer is not putting date of exit in uan portal, not transferring my pf amount from previous pf accounts to current pf account niether he paid my last month's remuneration. I left the company on 26th July this year over the issue of not providing any offer letter or appointment letter when I joined which he kept lingering for three months. Please suggest what legal action can I take against him on this issue??

    Sir Rapido bhi एक Taxi company है, जो Ola-Uber ki tarha hi ek Taxi company hai. जो सिर्फ Bike (Private Number भी) Attach krti hai. Rapido की देखा - देख Ola Compsny भी Private Number Bike aur Scooty attach कर रही है। अब मेरा सवाल आपसे यह है कि यदि Police वाले, Private Number Bike ko Taxi(Comercial Use) में use करने पर चलान काटते हैं या Bike जब्त करते हैं तो इसमें हमारे क्या अधिकार हैं।
    क्योंकि हम तो अपने बच्चें पाल रहे हैं।
    अगर उन्हें चलान ही करना हैं तो इन Companies का ही करें। जो Private Number गाड़ी को Attach कर रही हैं और खूब पैसा कमा रही हैं।

    Basic is RS.28k Special allowances RS.12k. I have to pay PF on 12k

      No you basic is more than 15K, you employer will not deduct your pf on allowances..

    Sir, kindly help me on an issue, I just joined a company as an accountant, But I can't find out how to round off the EPF amount, one of our employee's Basic + DA is 3729, so his contribution should be 447.48, and as per rule ( ROUND OFF TO NEAREST DECIMAL,) I rounded it off by .48 paise, that means 447(BCOZ 447 IS CLOSE THAN 448 FROM 447.48) but 447 is 11.98% of 3729, So am I right ? or I should Roundup the amount to 448? please help me with this Issue, please sir, Otherwise I have to lose my job.
