      Doorbell cam costs less than a gun typically and will come in handy way more often. The gun also won't tell you when a package arrived or if your kids sneaks out at night.

      except for when they use it to see if anyone's home then when you say I'm not home right now. Their homies break in the back and steal all your shit. so as long as you keep that in mind they can help you be safe but also can be used against you though social engineering.

    I am a former police officer. The Constitution gives the highest level of protection to those within their home and this Airman was within his home. It's not illegal to have a firearm within your home or even to have a firearm in your hand within the home. The Airman did not point the firearm at the Deputy or act aggressively in any way. The deputy had the ability to move out of the doorway and draw his firearm just in case things went bad. Had the Airmen come out of his home into the hallway i.e., advance on the deputy there would be no question as to the justification of the shooting. Shooting a person who is not threatening you and who is within their home to me is wrong on many levels.

      Yeah I agree. It is highly dangerous if someone has a gun in their hand so like you said important to draw and move but the citizen has the right. Now if he then made a quick movement that looked like raising the gun, then fair game but it you really need good training to make those split second decisions. Which you would expect from a properly trained officer

      I agree. The deputy maybe shot too quick but you should know as a former Officer. It takes .75 of a second to go from lower to shooting stance .. so I think both the airman and the deputy had faults. This wasn’t a homeowner that took an 8 hour firearms training this is a highly trained military personnel. He shouldn’t have open the door if he had doubt it was the police. Call 911 and verify it’s the police at your door. The officer should have waiting for a second officer especially in a DV call. Also maybe waited a few seconds before firing. It’s just a bad situation for all involved.

      Ability, opportunity, intent. The airman had the ability and opportunity. I doubt a jury would find the simple presence of a gun in the decedent's hands proves criminal intent to justify the officer's actions.

      Never be on a jury. Too stupid. Calling in a domestic dispute call when she'd previously heard screaming and heard someone slap someone is completely justified and noble. Could have been a lethal threat to the partner, this one is tragic, but at the same time, completely utterly stupid for a home owner to answer a door to someone yelling Sheriff's Dept and put a gun in your hand...Air Force guy is a complete moron, and quite possibly an abuser of women if he's the one that was heard slapping someone. Next time you want to share a thought, try thinking first.

Their job is to gather evidence against you by pretending to be your friends and let you work it out in court. There’s a reason it’s called a legal system and not a justice system. The only thing that matters is what you can prove in court and the truth is a side note on both sides of the court room.

      It's also that Police Department's policy to be accompanied by another officer on a domestic violence call. Another officer was on his way but superman rushed over so he could get paid leave. This is one of the same Acorn Cops from the incident a few months back, notice the cop was not in view of the peep hole when he banged on the door and said "it's the police." Also why didn't they go to the apartment where the actual incident took place. If he feared for his life he or the manger could have called.

      He probably thought he raised his gun. The officer clearly acted in a knee jerk way and his brain probably told him the gun was raising, or it told him he must have been raising the gun, as he was trying to replay what happened in his mind. He definitely didn't process the information in front of him quickly. That's a problem.

    If you have to grab a gun because of who is outside the door, don't open the door and barricade up.
    If you're not sure whether it's ACTUALLY the police knocking, call 911 and figure it out.

    What kind of weird dystopia do you live in to think that this might be justified? Citizens are allowed to be armed, especially in their own home. The victim never raised the weapon or threatened the deputy, the deputy just saw a weapon and started shooting.
    We have rights, this isn't a police state, and they don't have any right to execute you in your home for being armed.

    I’ve been in this situation before. I went to a marijuana club. This guy went in. He was trying to get this girl’s number. I walked in. I was the responding officer. I asked the man to leave the establishment. The guy got mad and started running his mouth because I was kicking him out. The guy went to his car and grabbed his gun but never pointed it at me. I pulled my service weapon, aimed it at him, but never shot, because the guy never pointed the gun at me. I told him to drop the gun or get shot. The guy complied and I arrested him for carrying a concealed weapon, and brandishing a weapon in public. I can’t shoot unless someone points a gun at me. I can’t justify shooting someone unless I am shooting someone in self defense. I don’t think the kid had the intent to shoot. The gun was pointed at the ground. The kid opened the door with a gun in his hand which isn’t the best thing to do.
    But I think there were bad choices made on either side. Why did the officer go to a potential domestic violence call for service, without a cover unit? That made no sense. Could a phone call have been made to the unit from the apartment tenant roster? Too many questions. I think the family will get a settlement from this matter. But money won’t bring back a loved one.

      I think your situation was a little more sketchy than this one but this officer should have reacted similarly. If officers are allowed to gun down citizens for simply holding a firearm then how can anyone practice their 2A right without fear of being killed for it.

      The problem is that you're wagering your life on being able to draw from your holster and shoot him faster than he can simply raise his hand and shoot you. Oh...and he's firearm trained too.

      Look, this is a shitty situation, but I'm with the ASP peeps on this one, in that both of them could have done better, and both could have done worse....but do I think this is criminal? Not based on the info so far....and not that I would be in law enforcement these days for any amount of money, but until other info sheds new light, I'm with the OCSD deputy on this one.

    Deputy Eddie Duran was "terminated" following an investigation by internal affairs, the Okaloosa County Sheriff's Office reported in a news release.
    The investigation determined that Duran's "use of “unaliving” force" in the shooting of Senior Airman Roger Fortson "was not objectively reasonable and therefore violated agency policy," the sheriff's office said.
    We can hope that the deputy will be prosecuted.

      ​@@ActiveSelfProtection The officer hadn't "clearly identified himself". He had been playing around by knocking, then hiding and not saying anything for 30 long seconds. The victim could only perceive the deputy as some potential home intruder. Even when the deputy finally identifies himself not only it's too late to make it look less suspicious, but he keeps hiding from view, so it's only logical for the victim to think this was an actual home intruder pretending to be the police (which is actually a thing that happens quite often).

This is a demonstration of the intent that was missing when a USAF airman was murdered, in his own country.... Once that person starts yelling threats, waving around a gun or knife, or displaying signs of aggression, it’s more likely they intend to harm you. The USAF airman was not waving or pointing his weapon. This means that there was no intent to use his weapon to harm that derilect deputy. The deputy executed the airman, before he could determine intent and that is going to be a mistake that will cost his county's sheriff's department and him. The airman was not pointing his weapon. The airman's intent to harm the deputy was not present. Intent is not a mind state. Intent means did the person have the intent to harm the victim, with a weapon or with their physical body. Was the gun in a position to be used, as intended.... no

    The supreme court has ruled that the mere presence of a firearm does not give them the right to shoot people. That should be especially true in a man's own home. Exercising the Right to bear arms is not a death penalty offense. I've seen other cases like this where the cops were charged and convicted. Unfortunately though, most of them aren't, even if the shooting was not legal/justified.

What a genius. He probably was the one creating the sense of danger in the victim by acting that way. By the way, just because he gets a call of a domestic argument doesn't mean it's domestic violence. When he was checking with the caller she wasn't specific at all and it didn't seem to be something serious. Then the officer is next to the door and there seems to be nothing going on, and yet he proceeds to act super suspicious about it. He overreacted from the beginning and was too paranoid about how to approach the situation.

That's how they're trained, and it gets people's attention. Nothing suspicious about it. You think the cop was just hoping to create an opportunity to ambush and kill someone? Also, the people he spoke with in advance were telling him his girlfriend or wife was saying he's getting worse and they felt it was very serious, more so than their previous arguments. They heightened the officer's concern. They weren't nonchalant about it at all.

    "This is a wobbler." Sorry, John, I disagree. I fully agree that the officer's conduct was spot on until the actual opening of the door. At that point, with the gun pointed down, arm straight at the side, no aggression evident on the victim's face - the officer WITHOUT ANY COMMANDS, and WITHOUT ANY VISUAL CUES from the victim, drew and fired at the mere presence of the gun. I can visualize this officer drawing and shooting someone who turns around and lets him see a gun in the small of the back. I'd be willing to bet that this officer would fail a Hogan's Alley exercise if it had an armed civilian at one or more stages.
    While your advice to not answer the door armed if it's the police is commendable and certainly valid on its face, that doesn't absolve the officer of the crime of manslaughter.

      It takes a skilled shooter under 1 second to draw and take a shot with a concealed weapon. on the other hand It only takes a fraction of a second to point and shoot with a gun in already your hand, specially at close range.       @BullseyeHTX - Yes, I'm judging the officer. There was zero reason to shoot. The officer shot because of "what if," "maybe," etc. Reacting to "what if" is based upon a fear level that a duty officer cannot have and remain a duty officer. Plus, one commenter has stated that the policy for his own department specifically mandates two officers on a DV call and that one was on the way. Why was he violating department policy? Don't know, but it shows the officer in the wrong already, and the errors continued after he listened for a while and determined relative quiet in the apartment - i.e. no immediate extenuating circumstances. Added to this that the Supreme Court has already ruled that the mere presence of a gun DOESN'T justify lethal force. The officer was in the wrong. While I don't jump to an accusation of murder, I do point out that manslaughter is defined as "the killing of a person in the heat of the moment." This certainly qualifies as manslaughter.

And I believe as a human leo/citizen whether your being paid for it or not; your main prerogative is keeping your life. Very unfortunate that the young man came to the door with a gun in his hand while an officer was investigating a domestic violence call - but i do not believe the officer should lose his life trying to protect his/another. This is an unfortunate mistake that COULD HAVE been avoided by BOTH parties - but 2 wrongs don’t make a right.

He didnt break any laws, and hadn’t committed domestic violence, as he was home alone. The idea that a cop can gun you down just for having a firearm in hand or nearby in your own home without breaking any laws is fucked up on many levels.

    An unknown person knocks on your door, then steps out of sight of the peephole, then bangs louder, and steps to the side again. The one place you are allowed to have a gun in every state in the country is your home. This cop acted unreasonably. He was told there was yelling and screaming coming from the apartment. There was no yelling and screaming. Additionally, the 'witness' clearly stated she wasn't sure what door the yelling and screaming were coming from. Even the Sheriff said: "The objective facts do not support the use of deadly force as an appropriate response to Mr. Fortson's actions. Mr. Fortson did not commit any crime."

    You know what, I actually have personal experience with a similar situation involving law enforcement. I was target shooting and zeroing my firearm, I was not at a range I was on public land outside of city limits. Someone called the cops on me and reported me as “a black man shooting in public”. Maybe 10 or so minutes after the call was placed an officer showed up which I had no idea about. I heard “do not reach for your firearm” and nothing else because I had hearing protection on. For some reason without even looking up (the officer was standing on top of and to the right of the hill I was where my targets were) I instinctively reached for my gun. I honestly have no idea why it’s just what I did. He shouted again “DO NOT REACH FOR YOUR FIREARM” and that’s when I looked up to see a Kern County sheriff’s deputy standing there with his rifle. He never once pointed his rifle at me, he obviously didn’t shoot me otherwise I likely wouldn’t be typing out this message. He instructed me to put my hands in the air and I did. He told me to leave my firearm where it was and come up the hill which I did. He told me to place my arms behind my back so he could pat me down which I did. After that we went down the hill, he cleared my gun, and asked for ID so he could run the serial number. While we waited for dispatch to run the serial number we had a conversation about recent laws and events in the 2A community. Everything came back to me and checked out fine. He told me that atleast two or three times a week people came out to shoot at the exact spot I was at and that that spot was too close to a road. He told me to put my gun in the trunk and my ammunition in the back seat and after that he told me of another spot maybe 2 miles further out of city limits where it was legal to shoot and where I wouldn’t be bothered and told me I was free to go home and change my draws as I looked quite nervous. We both laughed he thanked me for my compliance and I thanked him for his respect and we both left. All that to say this Okaloosa deputy should 100% be in prison for shooting this young soldier. If the mere presence of a firearm is enough to earn a summary execution, you should not be a police officer. I wasn’t executed even after reaching for my firearm after explicitly being told not to by the officer. That officer never even raised his rifle during our entire interaction and at the end of the day we both went home with no new holes in our bodies. That’s how this interaction should’ve gone too. Shameful, really.

    9:40 “ never answer the door with a gun in your hand” you have every right to answer the door with a firearm in your hand. This is the type of forfeiture of rights under the guise of compliance that is bringing us to the world. We are today there is no way you could twist this into ad justified shooting I’m actually quite taking a back by your analysis of this. The oldest belongs to law-enforcement, the “professionals” they need either better training or better enforcement of the training they receive. It’s absolutely despicable.

      I dont think applying common sense is a forfeiture of rights. They never once said you dont have that right, actually they said the opposite. I think you have to think about what your doing and is it safe/ smart. Nothing the airman did warranted a death sentence nothing. I agree the analysis was weak because if you really watch the video, the gun was about as low as it can get and the man stepped back held his left hand up, very submissive. However the flip side is he answered the door swung it open and brandished a gun. I agree the shoot wasn't justified I'm just saying the airman didn't make wise decisions and his actions should be criticized. I've actually opened the door with a gun in my hand and I had the common sense to know it isn't smart to just have it so they could see it.. I cracked the door and had the gun hidden. I think this would have been a better option giving the airman time to say hey I have a gun I'm gonna lay it down.

    Honestly, I think the truth is the type of person necessary for us to have ethical policing is basically someone who values the law more than their own life. You need police officers who would rather risk taking a bullet because they aren't certain than killing someone innocent out of fear. Those types of people definitely exist, but unless we massively shift the expectations of the career (and pay them a lot more money), I don't think we will ever see a caliber of policing that the American public will accept.
    I get that this probably sounds like a completely unreasonable condition to a lot of people, but I honestly think it's the only thing that's realistic in a country that is as unique as America in terms of its liberties. A free country needs police who care more about the law than their lives.

      My father was one of those. He was a combat Marine in Vietnam and then a cop for decades. He once put his firearm on the roof of his car before going into a domestic/hostage armed suspect situation and brought the guy out alive. He thought it was his duty to protect life. RIP Pop

    Law Enforcement are supposed to ANNOUNCE they are law enforcement. Meaning they knock on the door firmly STAY IN FRONT of the peep hole so the occupants can see them. This officer stated he was Law Enforcement but hid from the peepholes because of FEAR. The occupant came to the door thinking "If this person is not Law Enforcement I am prepared with my firearm and if this person is Lae Enforcement, as long as I keep the muzzle down everything will be okay. I am not breaking any laws". The shooting was not justified because the victim was not committing a crime. The officer should be charged with murder since he did not follow his training. THIS WAS NOT JUSTIFIED!

      This would have been my reasoning for having a weapon in my hand.
      Then, knocked twice more, announcing who he was.
      According to 2A and the castle doctrine in Fl the SrA was allowed by law to protect himself and had no duty to retreat.
      He was not brandishing his weapon because there was no intimidation.
      As soon as the door opened, the officer saw the weapon as a threat and responded, even though the SrA's only movement was hus left hand coming up. The weapon was in his right hand pointing towards the floor. It never moved!
      I think with the clarity of the video and the details that we currently know to be true, this was not a justified shoot.

    I'm not an American, nor do I live in the states. But I've seen plenty of videos of citizens being blasted by the cops because they open the door with a firearm or knife. And I've also seen plenty of cops being shot in the face as soon as the door swings open, and sometimes even before that.
    So in that regard, I've always thought to myself, "NEVER open a door to a police officer while armed". I don't care how much rights you have or how "free" you are. That's bad stuff waiting to happen. It's sad the kid got killed over nothing, but I can't blame the officer in this particular instance. A tragedy for all, may he rest in peace.

    Like i mean seriously need a door cam or door peep hole, but i mean if you open a door with a gun in hand to a cop, i dont know what the hell else would happen cept you get shot or at least gun pointed at you with a 95% chance of being shot. Theres the right to keep and bare arms, then theres the right to be a dumbass, and having a gun in hand when you first encounter someone in a surprise situation thats instantly going to cause someone to panic regardless of if your in the right or not. Saying he was right and allowed to have a gun in his hand in his home is fine, but he still got shot cause of it. All that would change either way is if the cop gets fired or sued later cause of it.

      It was. 1.The police identified he was a police, 2. If the dude was scared enough to need a gun he shouldn't have opened the door in the first place. 3. Holding your finger on the trigger brandishing a firearm, is a threat. 4. If you're a police responding to a call & there is an imminent danger of a possible threat, you don't wait around to get shot before doing something, or try to sit there & talk reason to someone brandishing that has the ability to have a quicker draw on you.

    I love this channel, but there are parts of this assessment that lack critical thinking. The first issue I noticed is that the female manager that the officer was speaking with doesn't appear to be the person who witnessed (heard) the incident. She says, "she was saying that it happens frequently..." which suggests this information was told to her by someone else.
    Additionally, when the officer asked her which door it was, she initially replied "I don't know" which was conveniently left out of the captioning. She then follows that up with "I'm not sure". Then she proceeds to talk about a different incident (which may or may not have been at the same apartment as the current incident) and directs the officer to an apartment where she thinks she heard an argument on another occasion, again after stating she didn't know and wasn't sure which apartment it was. She says, "I heard a slap... but I wasn't sure where it came from". This woman is part of the reason this happened.
    The second issue is that we are being led by the provided captioning. I could not hear the word "police" at the time it appeared on the screen. However, at 3:36 I can hear someone say "who is it? " with no immediate reply from the deputy. That someone was saying "who is it" was also conveniently left out of the captioning. The brain can fool us into believing that we hear "police" because that's what we're reading. It's clear these words were placed there by the police department to make the viewer believe the Airman was aware there was an officer knocking at the door.
    Regardless, none of this changes the fact that he never pointed his weapon at the deputy.

      I've been saying in this comments sections for a week the same things that you'r pointing out, especially the captioning of "police". That part is total BS fabricated by the Sheriff's Office (let's not forget it's their video and unfortunately they're allowed to edit it before releasing it to the public). They only wanted to make this look as if the victim new it was the police the whole time, when that's clearly not the case. How convenient that they understand the "police" bit but the rest is "inaudible". I, personally, couldnt understand a single word in that part, but what you say makes a lot of sense, since the deputy hadn't identified himself yet. That deputy is the one that cause a situation that led to a wrongful death. By the way, he was fired on Friday after his department completed their internal investigation. Let's hope he gets criminal charges.

    The Sheriff's Office fired deputy Eddie Duran on Friday after finishing an internal investigation that determined the deputy's use of dedly force on Roger Fortson wasn't reasonable. Let's hope he's now criminally charged for this.

    14:56 not a hard problem at all, at no point was a crime committed by the homeowner, at no point did the officer have probable cause to even go to that door because all the information he has is second hand by someone who thinks they heard yelling.
    It’s an immediate no go from the start, he should be in prison for murder.

    Regardless of the wisdom or [lack thereof] of bearing arms when opening the door to the cops, the question in big red letters on this presentation is:
    "Was This Shooting Justified?" and the answer is a resounding "NO".
    Go to 4:07 and watch closely and at about 4:09 you'll see the guy has his pistol pointed down at the floor, and then the cop shoots him anyway.

      @jeepguitargod I don't know, I think with the tactical position the cop had to take...the Airman was thinking if it's not a cop and a home invasion, I'm ready....and if it is a cop, the cop will be trained well enough to see the gun is by his waist and he can just tell him to drop the gun [before he shoots four rounds into him and he's bleeding out].

Once the door opened, cop had to make a split second decision...decision was wrong...if he hadn't shot 1st, the kid would've dropped the gun. Unfair hindsight, but we know now.

    John and MIke are playing it safe here. They don't want to call it. This cop had no reason to kill this man. He did not raise his weapon. He had his left up as to say it's ok, I don't mean you any harm. The cop over reacted and murdered him. It's clear to see. There is nothing ambiguous. Instead of calling it they resort to victim blaming. They assert if you answer the door with a gun in your own home you should expect to get dead. I do agree that he should not have opened the door. Period. But that doesn't mean he should be murdered.

The guy in the home did not point the gun at this police officer. He had every right to have a gun in his home. Tragic situation
