    All I have to say is this - If I mistook an acorn for a gunshot and dumped an entire magazine into a vehicle THAT WAS OCCIPIED, I would be in prison for sure. Doesn't matter my history, my military service, etc. No cop or State Attorney would feel bad for me and let me go. It's total BS

    No charges where filed because they felt SORRY for him... he panicked because he wasn't in tune with his world. The sad part is that a regular citizen doesn't get that courtesy ... the system doesn't fell "sorry" for us... had that been me I would have been caged and humiliated.

      Honestly, yes. And the other reason is that it's the nature of his job: it's all on camera. If this was all on camera for a civilian, there's a chance it would work out this way as well, although I expect it would go to trial.
      The way he responded does make it look like he believed he was shot... I haven't seen many people dispute that. But yes, if this happened to anyone but a cop and it wasn't recorded, they're absolutely screwed.

      In this world, all you need is 1 minute or less of not paying attention to everything around you, like sounds, smells, motion... to trigger ptsd episodes. Ptsd doesn't affect just ex soldiers it affects everyone- from being a janitor to a king,, every profession if done long enough it can mess your mind up. Stay safe out there my friends.

    An acorn hitting the roof of a car does not sound anything like a gun being shot. This was grossly negligent. And then the fantasy that he had been hit?? This cop was out of his depth. Some type of charge should have been brought against him.

      @@mnm8818 Well... no. I mean, there's always that question, is it subjectively reasonable (and then by extension, would a reasonable person find this reasonable, ie., "objectively" reasonable). We cover quite easily that it's not objectively reasonable, here, because it was a friggin acorn.
      But for murder you have to have that awareness and intent. If it's subjectively reasonable, definitionally it cannot be murder. If someone points their fingers are you and for some reason you truly believe that it's a gun, it's subjectively perfectly reasonable for you to shoot them -- good luck convincing a jury you thought their fingers were a gun, though. They're just not gonna believe you.
      This guy's actions, strangely enough, *_DO_* pretty convincingly show that he thought he was shot at. I cannot imagine wtf was going on in his head to make him think that...
      I guess if it went to trial you'd just point to his state of mind, that it was subjectively reasonable (even if REALLY bad policing) to think the deadly threat is in the cop car and shoot at it... but you just say it was temporary insanity that made him like that, or something. (Because I think you'd have a rough time convincing a jury that a reasonable cop is gonna hear an acorn hit a car roof and have that belief that he'd been shot...)
      But I dunno. Whatever it is isn't murder. It's something F'ing nuts though, if you'll pardon the pun.

    Why are we talking about spare magazines and staying in the fight? There was no fight. He wasn't shot. He wasn't even shot at. Nobody was shooting!!! Saying she did a good job is insane!!

      100% wrong. It's almost as if they completely ignore his negligent actions because he's wearing a uniform. Which is a horrible viewpoint to operate from. They should be held to a higher standard BECAUSE they wear a uniform not treated with kid gloves. John has talked on his channel about would I, could I, should I and completelky ignores these same elements he charges civilians wiith the responsibility of maintaining. This is about the biggest failure of law enforcement ettiquette we've seen on video in a long time and they treat like he made a boo boo. Not he nearly killed someone because he heard a louder than usual noise. That's IT. On top of that he explicitly claimed to be shot with zero evidence or identification of any wounds solely so his partner could also return fire, once again at NO THREAT.

      ​@@AkinaSpeedStarsAE86 I can sort of understand their assessment of her actions, because why would you ever assume your partner would be screaming "I'm hit!" and shooting and rolling on the ground if not for an actual threat. If you have to take the time to second-guess that, you will be reacting too late.
      The only defence for Hernandez is PTSD, however it seems he never claimed that. That disability shouldn't justify his actions, but it could explain his state of mind. I agree he should have at least been indicted on some sort of charge, but the bigger issue is the vetting of former active-duty soldiers for police work. This is equivalent to making a "Charlie in the Trees!" Vietnam vet a traffic officer: it is completely inappropriate and a danger to the officer and everyone around them.
      To be clear, there are plenty of vets doing great police work. But there does need to be more scrutiny on their mental/emotional state before rubber stamping a new hire.
      The frisk is heavily overemphasized in this analysis. If this is his state of mind, even the most thorough of searches wouldn't have prevented what is plainly a mental break.

    I’m really surprised by ASP’s take on this one. I can respect a person’s military history. That being said, if a person is so terrified, they would mistake an acorn falling on the roof of the vehicle; they should not be a police officer or carry a firearm. Had this been an average citizen, they would be in jail right now, no question. This is exactly the two-tier justice system that has created a divide between citizens and the police. ASP, in every other circumstance, is very critical about the backstop; however, in this one, for some reason, they don’t seem to mind that Hernandez’s backstop is other apartments where innocent people may be and the sergeant’s backstop is a trailer park. You can also see from both cops’ body cam footage that there is also a real cross-fire issue developing.
    As I said before, had it been any normal citizen, they would be in jail charged with at least attempted murder, unlawful use of a firearm, and assault with a deadly weapon. The regular citizen would probably be convicted of at least one felony and would not be able to have guns. Hernandez, however, because he is a part of that other tier of the justice system, gets to quietly retire with no charges. He will probably show up in another department in six months to a year.

      @@kennethcurtis1856Average citizens are held to a higher standard than police. Unless it's a blatant violation of rights, a cop can be excused for breaking the law by claiming they were unaware. Saying you're unaware of the law as a citizen is not a defense that is accepted in court.

      Yeah only thing I can think of is he was having a PTSD episode. I don't think he should be punished too harshly, but he should never have an occupation that let's him carry a firearm again and he shouldn't be able to carry a firearm day to day anymore. He got super lucky that neither hit the guy. Female officer should be fired for not knowing what she's doing.

      ​@@Zoroaster4 Not a smart take here... "just because [they're] a criminal" wasn't why the officer started shooting (although it does play a role... if you're not naturally more distrusting of a known criminal than you are of the Pope, you're probably an idiot).
      The officer wasn't playing "judge jury and executioner" he was responding to a perceived threat. It makes zero sense to imply he just wanted to kill this kid because he thought the kid deserved it.
      If you can't criticize honestly, don't criticize at all.

My point was that just because the person is a criminal doesn't mean the officer should receive any more or less punishment than if the Pope were the suspect. I don't care if the guy is a criminal or not, it is so unreasonable to mistake an acorn for gunfire and falsely claim you where hit that he should receive some punishment for doing so. By shooting at someone just because they're a criminal when you have no reasonable reason to believe they are a threat that is acting as judge, jury, and executioner.

    An overactive murder imagination is not a reason to mag dump. Playing pretend that you're in combat is not a reason to mag dump.

    He had to imagine a shot was fired, fine...but whats with the rolling around as if he feels actual pain? Whats the paralysis once he's (half) in cover fumbling the mags?
    This is how i imagine a ptsd induced panic attack to look like.

      I won't speak to everyone's experience with trauma, it does manifest in different ways. But I have a hard time believing this guy seriously thought he was hit. I could believe him maybe hitting the dirt getting into cover and hyper ventilating for a few minutes while he processes a flood of emotions. I've seen that before. But continuing a lie, panicking and shooting at phantom threats is.........well it doesn't seem right. Not as in he's not right in the head, but more in a "I don't believe that is PTSD" kind of a way.

      @@fullysemi-automaticmemes3888 PTSD often manifests itself as a panic attack, and panic attacks often involve hyper ventilation. Panic attacks can also trigger adrenaline dumps in the body. The debate going around right now is whether he had a panic attack which led to his behavior, or if he was just looking for an excuse to start shooting at the guy. I do find it hard to believe the acorn was enough to cause a panic attack on it's own.

    this is funny as hell. Especially when he starts shouting shots fired shots fired and stops for a few second in silence and then decides to start unloading into the cruiser. it gets even funnier when he says I'm hit then starts rolling on the ground and agony, LMAO.     I love this channel but pointing out the cop is a good dude and the guy in the car has a history of suppressed firearms is quite the stretch for justifying the response. The LEO's reaction was beyond ridiculous. Thankfully this guy is no longer a sheriff. Trying to justify it might even be crazier. Blue really sticking together on this one.

    Guys this is absolute incompetence. The point you guys make about the criminal possibly having a gun is laughable, he’s frisked and wearing skin tight jeans. Hes not fitting a suppressed 9 mil in a body cavity or in skin flaps like an obese person could. Whether he’s a special forces combat veteran or not he should know the sound of a suppressed weapon and the sound of broken glass. Bullets don’t pass through glass or a car door without making serious noise or observing a window breaking as bullets pass threw it. The officer absolutely should have been charged and now he’s made a scum bag criminal extremely wealthy as the department will absolutely be sued by him.

    If law enforcement fire on civilians unlawfully, are we allowed to fire back? The justice system gives officers the power to murder. The fact that this officer is called incompetent at MINIMUM is concerning. They searched this man before placing him in the car. HOW could you even think he’s pulling a pistol out and shooting at officers from inside the damn car. What wouldve happened if the guy actually got shot and died? Would that have been whats needed to make the case for the cop being wrong? Waiting until its too late?

People see a cop doing something and get mad, so they want to blame the people who don't get mad too. Emotional fitness is literally what ASP is showing. I'm sure they're frustrated, but acting like "well he's a cop so he's bad" isn't a lesson, and if they were going to say that, they'd just not show the video and show something else that gives a better lesson.
      Look i'm not saying ASP is great. Personally I stopped watching him when he took on the "crazy man beard" and stopped looking professional. Yet getting angry at someone for not being angry when you are, and saying "they're hypocrates and I can prove it" sure, prove it. Then we can all agree, and go on our day.       Dude, no one is making excuses for the cop, but him knowing that the suspect owned a silenced pistol and had recently sent threatening photos of it to the victim, I can see how Hernandez subjectively believed he heard a silenced pistol shot. No it doesn't make it objectively reasonable, but it explains how he made the mistake that ended his career.

      You did watch the whole vid, right? The pat down wasn’t up to any standard. In a completely different example, which has very different circumstances, I would like to remind you of the women who was fully arrested and in cuffs in the back of a patrol car being 1) freeing herself from handcuffs, 2) obtained a police officer’s AR-15 rifle from that locked patrol car while still in custody, and shot the rifle out car striking a civilian and an officer. That HAS happened. Obviously, the officer in this vid is totally in the wrong…. but this dude was seeking a suppressed weapon in a thorough pat down to fully arrest him. Wasn’t likely to be there, but he had to check. Then, that noise and all his bad decisions…. But it truly isn’t as outlandish as you’d expect

You talk al lthe time about citizen carriers knowing your backstop, knowing where every bullet is going, shooting only when it is justified, etc. Yet in your analysis of this video you did not hold these two cops to those same standards. And you overemphasized the cop being a "good guy" where that should not be part of the analysis nor is it typically. What we are reacting to is a poorer quality of analysis than we have come to expect from you and we are disappointed. That is a fair and reasonable reaction, not mob mentality.

    I researched deeper. The officer did not have direct combat experience, he was a commissioned officer who worked in ops not the frontline. I’m sure he had the training via West Point, Infantry and Special Forces. Officer Hernandez panicked. Objective evidence leading to a lethal outcome?

    What seems very suspicious to me is why he was even walking to that side of the vehicle? It almost looks like he was contemplating something and walked to the far side of the vehicle so he could not be seen. If you look closely at the tape, he's almost past the back passenger door and at a point when he should be reaching for the door handle, he's standing out of reach. I think what he was trying to do was figure out a way to execute this guy and make it look justifiable. Don't tell me that an experienced soldier with two tours in Afghanistan and an experienced officer doesn't know the difference between the sound of an acorn hitting a roof and a suppressed weapon. Even if he had mistaken an acorn for gunfire, he was still claiming that he had been shot. Even if it had hit the vest, at that distance, he would have felt a significant amount of pain. On camera, he goes to the ground, yells, "I'm hit, I'm hit!!" and later stated that he felt weird but was ok. He even laid on the ground pretending to be wincing in pain. Why? Because at this point, he was confident he had killed the man in the backseat. He was putting on a show for the body cam. So no, I don't think he's a good guy at all, he just tried to kill a man and get away with it.

      There are a very far and wide different types of PTSD. PTSD doesnt always mean you freak out and think gunshots. PTSD can be depression, heightened awareness (which can be a positive thing for cops).

    Let’s put a few things into perspective: 1. The suspect, according to the news I read was released and not charged.
    2. Suspect was searched handcuffed and in a police car. 3. Law enforcement is the 22nd most dangerous profession in the US. 4. Being a nice guy isn’t relevant to what happened here.

      When I first saw this, it was hilarious to me. It could've easily been a horrific, tragic event but fortunately (miraculously) nobody was harmed.
      My conclusions after rewatching another time were that was either intentional, incompetence or a PTSD episode.
      I'm leaning on PTSD. The way he reacted to the bang of the acorn, the combat roll, etc.
      I think he rolled over a rock and the sharp pain made him think he was hit as well.
      It was just such an overreaction (to put it mildly) that one can only conclude that he was either very on edge, having a PTSD episode or both.
      I've seen things like it before ...minus the gunfire.
      I had an older friend who was an Iraq war veteran. He was actually in combat and suffered from injuries due to it. He saw and experienced some terrible things.
      During a cookout one summer, someone down the road lit off fireworks. Upon the first firecracker going off, he immediately got down and yelled "GET DOWN, GET DOWN" and started crawling towards a picnic bench.
      He stopped soon after, after his wife ran over to him and held him. She was literally lying there with him, trying to soothe him as the rest of us told him it was ok.
      It took a few minutes to snap him out of it.
      Before the firecrackers went off, he was normal, joking around, nothing was off about him.
      That's kind of what I'm seeing here in the video - except this man had a firearm...and we see what that led to.
      I don't know if it was an episode for sure, but either way this man should not have been on the force or been allowed access to firearms. He's clearly mentally unfit.
      And thankfully, nobody was hurt and the only victim of this debacle were the pants of the man handcuffed in the backseat, which I'm sure were full of sh*t when it was all said and done.

    I have to strongly disagree with the ASP findings here. There is so much that could have gone wrong launching 30 rounds with no defined target. Didn't the officer already search and handcuff this dude first? The Tasmanian Devil/Speaking in tongues thing he does after executing the Magnum PI role and emptying an entire magazine is strange. Stealing a car is not supposed to be a death sentence by acorn!

      Not defending this guy, but there have been plenty of instances where a guy was searched and put in a cop car but then killed the cop with a hidden gun. It happened in my hometown right as the officer was about to pull into the jail. It also happened recently where a guy got his gun all the way into the interview room where he was being booked and killed the cop and escaped I think.

      They weren't negligent. They were intentionally fired. At a perceived lethal threat.
      Criminal intent is often an element in most criminal charges.
      If you act in self-defense, even if your perception of a lethal threat is unreasonable, that still precludes criminal intent.
      The only crime they could potentially be charged with is unlawful discharge of a firearm.

    I sure hope you both also do a video on the other coward cops in Texas at the church where they recently had an active shooter murdering people and the cops literally were hiding and running away and never engaged the threat at all. The threat was finally stopped by an off-duty officer from I think they said some kind of code enforcement division in Texas and a hero citizen. But the uniformed officers literally were hiding in hallways and trying to get up the stairs to the second floor so they can get away from the shooter. It's actually an unbelievable video to watch I don't understand how these cops are not being fired and also charged for dereliction of duty.
