  • SALIENT FEATURES REGARDING SECURITY OF TENURE
    D.O. 174 - s - 2017
    Rules Implementing Articles 106 - 109 of the Labor Code
    1. Security of Tenure
    Sec. 1. - Non-permissible forms of contracting and subcontracting arrangements undermine the Constitutional and statutory right to security of tenure of workers.
    2. Effect of Termination of Employment (sec 13)
    Termination prior to the expiration of the service agreement
    -Apply Art. 297 (Just Causes), 298 (Authorized Cause) and 299 (disease)
    Termination Because of Pre-Termination of Service Agreement
    -Right of employees of their unpaid wages, benefits shall be shoulder by the party at fault without prejudice to the solidary liability of the party in the service agreement
    Termination Because of the expiration of the Service Agreement
    -employee need to wait for 3 months. Within 3 months, if the contractor / subcontractor failed to provide new employment, the employees shall be entitled to separation pay as provided by law or by the Service Agreement whichever is higher without prejudice to bonuses and retirement benefits.
    -mere expiration of Service Agreement does not mean termination of employment of employees

      Kapag pilit sila pinapirma ng resignation, forced resignation po ito at ito po ay bawal.
      Bawal din po ang hindi mg bigay ng last pay. Pwede n po kau sumanguni sa Dole

    Sir may Tanong pa po ako. Mag 7 yrs po ako sa AGENCY ko at ganun din po sa company ko Ngayon pero sa 7 yrs Hindi po ako na regular at ngyon nga po tatanggalin na kami dhil may manpower reduction, mahina Kasi ang company. Ano po habol naman sa company.

      Yes po. Dapat po may process kapag tinanggal kau. Hindi po pwede agad-agad.
      Pero kung mailipat naman kau agad ng agency sa ibang assignment, better po un para hindi narin kau mg complain.
      Pero pwede po mg complain sa Dole kapag biglaan ang pag tanggal.

    Sir 7 years ako sa agency at na regular ako sa company hanggang ngayon mag 14 years na ako.ang tanong ko po kapag magresign po ako sa company maari ko ba maisali ang 7years para humaba ang length of service ko.

Paano po kung sabihin ng agency na ililipat nalang ng work tapos hindi na babayaran ng separation pay? At if hindi po tinangap ng employee yung bagong assignment ng agency?

      May po mg transfer ng work assignment si agency. Kapag na-transfer si employee, wala po separation pay.
      Ngayon, kapag hindi tinangap ni employee, pwede siya discipline ni agency or matangal ni agency based on insubordination.
      Pero may rules din tau sa pag lipat, dapat reasonable ung paglilipat lalo na in terms of location...

    Sir under agency po ako. Admitted po ako na may maling nagawa ako,bali habitual absencea at habitual tardiness,pero yung reason ko is due to my wife condition. Ngayun po ay tinanggal ako. Binigyan nman po ako ng due process ng agency but a certain high rank official nag insist na dapat di na kami magreport. Kasi nga raw nag bayad ang company sa agency para e provide naman ni agency ng good services. Pwede rinpo ba ako makakuha ng due process sa client or company. ?

      Ksi if hindi ka mabigyan talaga ng new work, u need to wait for three months pa before k maging entitled sa separation pay.

      Kung na absorb din ang 7 years mo ng company, wala na po separation pay sa agency pero kung start ka sa company from scratch in terms of years of service, dapat mabigyan ka ng separation pay ni agency. Kaya tignan mo muna kung anu status mo sa company, kung 7 years ka na ba or new employee ka. Ito ay kapag hindi ka binigyan ng chance n mg decide.
      Pero kung ikaw ay pinapili, agency ba o company, tpos company ang pinili mo, it is deemed resigned ka n sa agency. So wala po separation pay.

    Paano po pag may agency ka, tapos ayaw mo na marenew under agency. Pero gusto pa na magrenew ulit doon sa mismong company na pinapasukan pero hindi na under ng agency. Pwede po kaya yun na mag renew pero ang kalalabasan magiging direct hire na po hindi na under ng agency?

      Mg file ka ng complain sa HR laban sa supervisor mo. Hindi pwede ikaw lang ang may sanction, dapat pati ung supervisor dahil ng hamon at nanulak

      Depende ito sa magiging usapan. Kung kau ay maco-consider na resign sa old agency, wala po kau makukuha sa old agency kundi last pay, pro-rated 13th month at 5 days SIL kung more than a year n kau at hindi nyo pa nagagamit.
      Kung kau naman ay continuous lang ang service sa new agency, wala po makukuha kasi considered kau as employed pa at hindi resign.
      Pero kung kau ay na-terminate ng old agency due to lay-off or retrenchment, then possible n entitled na kau sa separation pay
      So depende po ito sa sitwasyon

      Since suspended ka, wala ka talaga sweldo. Now since extended ka, dapat entitled k n sa sarili mo kasi ang suspension at hindi dapat lalagpas ng 1 month. Now pag lumagapas ito, entitled ka n sa sweldo mo kahit suspended ka.
      Halimbawa, na suspend k ng buong month of October. Pag dating ng Nov, extended suspension mo. Starting Nov kahit no work ka, kailangan bayaraan n nila ang per day mo

      Kung kau po ay natangal dahil po ng bawas ng tao, ang una pong dapat gawin ni agency is ilipat kau sa ibang assignment. Within 3 months kung walang maibigay, entitled na kau sa separation pay.
      Pwede n po mg apply ng unemployment benefits sa SSS basta merun po kaung 36 monthly contribution at basta merun kaung 12 months n hulog bago ang tanggalan.
      Check nyo po muna kung may hulog po ang SSS po nyo sa SSS mismo at dun po pwde rin po kau mg ask or inquire

      Sa client, wala po kasi under po kau ng agency. Pero may process po ang pag tangal. Dapat mg comply dito ang client.
      Si agency dapat mabigyan kau agad ng new assignment. In 6 months, kapag walang nabigay si agency, entitled ka n sa separation pay under agency

      Make sure lang na expire na ung contract. May mga contract kasing auto-renewal. Tignan nyo mabuti kung naka-auto renewal.
      Secondly, tignan nyo kung sinu n ngpapasahod sa inyo, kung agency parin, under prin kau ng agency. Kung ung principal na, then pwedeng under n kau ng principal.

      Yes. If tinangal ka ng walang reason. Pwde managot si client. Pero bago ka mg complain sa Dole, ask mo muna si agency kung pwede ka mabiyan agad ng work, kapag hindi, pwde ka na mg file for Dole assistance.

      Dapat po kau mai-transfer ni agency sa new client within the period of 3 months. Kapag hindi po kau nai-transfer after 3 months, magiging entitled kau sa separation pay under agency.

      Kapag ng resign kau, cyempre hindi kau babayaran dun sa previous years nyo n separation pay unless nalang may contract or written agreement kau n kapag ng resign kau, may makukuga kau separation pay.
      Forced resign po ang pinapagawa sa inyo which is bawal po un. Pero tignan mo muna kung continuous ung years of service mo sa new agency. If yes, dapat stated un sa contract nyo sa new agency

    Sir under agency po ako, mag 7yrs na sa feb.25, 2024 sa company pinapasukan ko. nag meeting kami nun friday at ipinaalam sa amin na klangan daw ng company mg manpower reduction at matitira lang daw ay puro regular. Atty may karapatan ba kmi sa seperation pay? At sino po dapat mag bigay ng seperation pay ang company o agency ko? Thank you sir.

      Una po hindi pa po ako atty ha. Pero on the way naman n tau dun.
      2nd, kung 7 years ka n s agency Regular ka n s Agency mo. Ngyon kapag na lay off ka ng Agency mo, sila ang mg babayad sau ng separation pay. Pero kung matagal ka na sa Company at ang company ang may fault bakit may reduction, pwde ito habulin kapag hindi ng bigay si agency.

    Papaano naman sa case ko na walang kontrata na pinapapirma sakin si agency. 10 yrs na ko under agency and same with company.
    And balita ko wala daw period of contract si agency kay company.

      In this case, if this is true, pwede mo habulin si agency at si company. Pero better na si agency muna..
      Regarding naman s contract mo, ok lang naman kung wala. Ang importante sumisweldo ka sa kanila ibang employee nila (best evidence payslip and other factors). Kapag ganito, ang provision ng Labor Code ang masusunod.

      Kung mabigyan kau ng new assignment ng agency, wla po kau makukuha pero after 3 months at wala parin kaung assignment, entitled n kau sa separation pay under sa agency.
      Kung wla naman kaung work, pwde nman mg inform kau sa SSS

      No need naman mg pasa ng resignation lalo n kung ang agency naman ang mgtatangal sa inyo. Since sya mg tatangal, bakit 50% sep pay lang. Dpat 100%.

      @@ziaangels9909 Paid po dapat kau kahit under 10 ang number ng staff. Based sa Art. 82 ng labor code hindi naman exception ng coverage ang mga employer n under 10 ang staff. Unless may maipakita sila sau ng Dole rule na hindi bayad ang holiday pay nyo. Kung wala, based on Art. 82, covered dapat kau ng holiday pay (kung regular holiday ha ay monthly paid kau)
      Kung daily paid kau, hindi kau entitled sa Special Holiday kung hindi kau pumasok. So need mo malaman kung anu ang regular at anu ang special holidays

      Kapag ng bawas ng tao, ito po retrenchment , redundancy or other reasons. Kapag ganito, entitled po ang employee sa separation pay.
      Kung hindi pa terminated ang service agreement between company and agency, dapat bigyan k ng separation pay or ilipat k ng agency s ibang client.
      Kung hindi nila malipat at kung ayaw mo naman ng lilipatan, dapat mabigyan k nh separation pay. Pag hindi nila ito ginawa, pwde mo ito ilapit s dole for money claims.

      Kung mabibigyan kau ng work ng agency within 3 months, wala po kau makukuha. Pero kapag hindi kau nbigyan ng work ni agency after 3 months. Entitled n kau sa separation pay sa agency....

      Yes. Sakop kau nito. Ang pagkakaiba lang, kapag natanggal kau at hindi kau nabigyan ng new work ng agency, wait kau ng 6 months bago kau maging entitled sa separation pay under agency. (unlike ng mga hindi sekyu, 3 months lang pwede na.)
      So dapat si agency mabigyan kau ng new work agad. Pero kung may violation talaga ng labor code ang pagkakatangal sau, pwede ito ireklamo
