  • Alamin ang mga pwedeng ma-claim ng isang employee na separated na sa kanyang employer. Ang ibig sabihin ng separated sa video na ito ay ang mga resigned, terminated at yung mga employee na biglaang pumanaw (anu ang maaaring makuha ng pamilya ng employee).

      bawal po ang forced resign. Kung termination naman, dapat may due process po dun. Kung gasgas lang ito, sobrang laki naman 165k. Gasgas lang naman.

      Una, magpakita ka ng evidence n kulang ang benefits mo sa HR nyo. Na - pri - print naman ito online or kuha ka sa branches ng sss, pag-ibig, philhealth. Ipa settle mo muna sa kanila. Ngyon kapag hindi nila na-settle, pumunta ka n sa sss, pag-ibig at philhealth at mg file ka n ng complain

      Hindi ka pwede tangalin dahil sa buntis ka ...
      Pero kung on leave lang pwede.
      Pero pag tinangal ka, illegal dismissal po ito.

      Kung kayo po ay nag - apply, na-hire, binibigyan ng sweldo, at merun mga rules and regulations na dapat nyo pong sundin, at kung kayo ay limang taon n, regular employees na kau. Lalo na na walang contract kaung pinirmahan sa kanila.

    Kami po ay kinuha namin ung pinasukan namin na 1 1/2 day pay.
    Sa kadahilanang pinaalis kami dahilan lang po sa mag utang everday for buying food.tapos nagalit ung katiwala at pinaalis kami kasi sa trabaho .
    Ngayon po tinanong ng security ung katiwala.ang sagot nung katiwala kami lang po daw ang umalis .
    Tapos nung pag alis namin pina band kami sa village at hindi kami papasukin dahil po ay may ninakaw kami .pero bago po kami umalis check ung bag .
    Siniraan kami ng katiwala ng boss nmin .

      Ang makukuha lang po is last pay, pro-rated 13th month pay at 5 days n SIL kung hindi mo pa ito nagagamit.

      Hindi po ito pina-file. Automatic po itong binigay ni Company kapag n meet ung mga circumstances ayon sa Labor Code n may right n si employee sa separation pay gaya ng lay-off, closure ng company, etc.

      Dapat po May 13th month po kau.
      Alamin nyo po muna sa agency Kung bakit kau ntangal. Kung mapunta kau s floating status, waiting p po kau ng 6 months bago kau mabigyan ng separation pay Kung hindi kau mabigyan ng new post ni agency.

    Hello po Sir nag resign po ako sa trabaho last Nov. 30, 2023 , sabi daw ng agency ko wala daw ako makukuha na 13th month pay at Final Pay dahil may existing or outstanding balances daw ako sa SSS ikakaltas daw po nila lahat un dun. Ngayon naki usap ako na ibigay nila dahil kamamatay lng ng mother ko at need ko ng financial ngayon

    Nag file ako ng resignation ko july 4 without rendering kasi pwedi pa yung immidiate resign
    then naaaproved po ata kinabukasan july 5 or 6
    suddenly yung flash express nag baba ng memo ng july 5 na kailangan kapag nag resign ka is kailangan mag render na 7 days .ngayun hindi na daw po maibibigay yung commission and subsidy ko dahil saklaw daw ako dun sa memo na inimplement nila.

      Good pm sir. Medyo nalito po kase ako sa ginawa saken Ng company. 4 years na po KO sa company na terminate with just cause because of AWOL po. Then ang tanong KO po is pwede po ba KO maka kuha Ng Coe pwede naman daw. Mga ilang araw po nung kuhaan na Ng 13th month nagtanong po ulet Hindi daw pwede ako makakuha Ng Coe na ilalagay dun with just cause.     Attorney reguar po ako sa trabaho 2 years mahigit na akong regular, tataning ko lang po sana kapag nag immediate resignation po ba ako may makukuha po ba akong coe, dito kasi sa company na pinapasukan ko hndi sila magbigay kelangan ko pa daw mag 30 days rendering.

      Dapat within 1 month po nabigay n po. Ask them kung anu pa kulang po para magawan mo ng paraan or ask mo anu ung ng papatagal ng release ng last pay.
      Kapag wala sila masagot or unreasonable ung answer nila, pwede na po kau pumunta sa Dole for money claims.

      Kung more than 5 years n kau sa agency, entitled po kau sa retirement. Pag file lang po kau ng retirement. Basta between 60 to 65 years old. Pero pg 65 years old n po, automatic po yan n entitled n kau sa retirement. (basta may 5 years or more kau sa agency)

    Hello po atty.tinanggal po kami ng katiwala dahil lqng po sa always kami bale 2 times a week .nagalit ang kqtiwqla kaya pinaalis na kami .at sabi wag na pasok.

      Ayon sa batas, entitled ka na sa retirement pag tungtong mo ng 60 years old. So pg ng retire ka ng 60 yrs old, may retirement pay ka na.
      Kapag 58 yrs old, hindi pa entitled sa retirement pay UNLESS nalang may policy ang Company na nagbibigay ng retirement kahit 58 yrs palang. Kaya better n mg ask ka sa Company kung allow ka nila mg retire ng 58 at mabigyan ka n ng retirement pay. Kung hindi ka nila allow, mg wait ka pa ng 60 yrs old

      Pero ganito gawin mo, mgpa clearance ka agad. Ayusin mo agad para wala reason ung company mg hold ng 13th month.

Peter 12 years sya dun...dahil po commission basis sila wala po sila benefits na kahit ano, pero meron pong kinakaltas na 500/month para sa cash bond nila.. nagresign na po sya, nagclearance na rin, ilang mos. Na hindi pa rin nya nakukuha cash bond nya...

      Anu po reason kung bakit hindi pa binibigay ung cash bond? As per Dole rule, bawal po ang cash bond.
      Gawa po kau ng official letter sa kanila at hingin nyo ung cash bond. Kapag wala parin ngyari, punta n po kau sa Dole

      Depende ito kung papaano ka nila tinangal. Kung basta ka nalang tinangal, mali po un at un po ay illegal dismissal. Kailangan po dumaan sa process ang lahat.

      Pero kung ang company naman ang mg tatanggal sau, at hindi voluntary sa part mo, mabibigyan ka ng company ng separation pay

      Una, tignan mo yung Code of Conduct nyo, tignan mo kung ung violation n nagawa mo ay akma dun sa decision nila sau n tanggalin ka. Pag ito ay hindi akma sa Code of Conduct, write them a letter or talk to HR na mali ang naging decision nila.
      Ngyon kung tama naman ang naging decision nila, tignan mo kung may due process - kung may Notice to Explain, hearing at Notice of Termination. Kapag walang Notice to Explain at Notice of termination, illegal po ang pag tanggal sa inyo.
      Ngunit kung lahat ng ito ay na comply ng company, wala na tau magagawa dito. Pero kung hindi ito na comply, pwede mo itong ilapit sa NLRC para mg file ng case.

      Kailangan ka muna ma check ng company kung talagang hindi ka n fit to work... If hindi na talaga, you may ask for separation pay. Then tignan mo lang din ung magiging decision ng company. Pero kung declare ka nila as fit to work, then, need mo bumalik sa kanila

      Check nyo po muna kung tama ang process ng pg terminate. Dapat po ito may due process at in accordance sa rules ng Dole sa pag remove ng employee n ng positive sa drug test. Pwede kau pumunta sa Dole at manghingi ng advice.

      As a standard rule under the labor code, hindi po entitled ang manager sa holiday pay (double pay) kapag pumasok sya ng holiday. Pg di nman cya pumasok ng holiday, paid lang cya nung araw na un.
      Kung wala pong contract, ang provisions ng Labor Code ang masusunod at nasasaad sa Labor Code n hindi entitled ang managers sa holiday pay (double pay) kapag siya ay pumasok ng holiday.
      Pero kung bibigyan sya ng Company, wala naman itong problem pero hindi ito advisable.

      Kung sadya nyo po na nasira ung monitor or kung dahil sa kapabayan po nyo e nasira sya, magiging accountable po kau dun at ibabawas un sa last pay po.

      Then kung na-terminate ka at not valid ang termination, pwede ka humabol by seeking assistance sa DOLE or NLRC.

      Merun taung 3 years prescriptive period for money claims. Since 2019 pa ito, ng lapse n ung 3 years UNLESS may mga proof of action ka n ginawa para makuha mo ito - like letters etc.
      Sa concern ng termination, kung wala silang dahilan, hindi po ito tama. Lalo n kung naka 1 yr n kau UNLESS nalang project based kau for 1 yr.       Kapag house help po or personal sitter, hindi po entitled sa 13th month unless nalang na by practice is binibigyan ka na nito. Kapag hindi ito practice, di po kau entitled

      entitled kau sa 13th month. Kahit ba sabihin nila na AWOL kau.
      Punta kau ng NLRC at mg ask ng assistance. Mg file kau ng illegal dismissal plus money claims. Dapat within 30 days makuha nyo n ung mga claims nyo sa kanila.
      Ung sa illegal dismissal, check nyo kung tama ba na ma-AWOL kau

    Sir ask ko lang po sa inyo..... Nagka violation po ako sa aming Agency as security guard.... Tapos pinagawa ako ng voluntary resignation ng Operation Manager namin.... Tapos sinabihan ako na ma hold yung sahod ko 2 cut off na po 15 days at 13 days na sasahorin... Tapos hold daw sahod ko ano po Maganda na gagawin sir salamat po pa advice naman.... Tapos wla pa hulog mga benefits namin kaltas Lang kada sahod 1 year and 3 months na ako sa Agency sir ngayon di na ako nag duduty

      Una, ask mo sa agency kung anu pwede mong gawin para ma - release ang sahod. Usually, kailangan mo mgpa clearance. After ng clearance, within 1 month dapat mabigay sau ang sahod mo. Kapag hindi, pwde ka n lumapit sa dole.
      Pangalawa, bawal po na pwersahin kau mg voluntary resignation.. Constructive dismissal po ito. Pwde po ito ireklamo sa Dole or NLRC
      Pangatlo, pa verify mo sa SSS, Philhealth at Pag Ibig kung wala ka talaga hulog. If yes at sinabi nila n wala talaga,, ask mo ung agency kung bakit. Kapag wala sila nasagot sau, pwde ka mg file ng complaint sa SSS, Philhealth or Pag Ibig. Or pwde ka mg file ng criminal action sa kanila kung ng kakaltas sila sau tapos wla naman hulog

    Sir 3years po ako sa company na pinagtrabahuhan ko binabaan po nila ako ng preventive suspension ng feb 14 to march 14 tapos nung march 12 po pinatawag ako sa office sabay sabing terminate daw po ako ask ko lang po may makukuha pa po ba ako.

      Yes pwede mo pa ito ma claim kaso ma claim mo lang is ung huling 3 years. Pero try mo baka mabigay sau pati ung ibang years. So mg file ka ng complain for salary claims.

      Yes. 13th month pay na pro-rated computed mula Jan (kung december ang cut-off) up to March. Then, entitled ka din sa last pay mo. If more than a year kana, entitled ka sa 5 days n Service Incentive Leave kung hindi mo pa ito nagamit

      Kung ang suspension is preventive suspension, since hindi pa ito penalty, pwede nga cya ma-terminate. Pero kung penalty n ung suspension then bigla cyang tinangal, e mali po un.
      Ngyon, kung termination cya. Entitled parin sya sa 13th month pay. So, pwede nya itong habulin.

      Kung end of contract, makukuha mo ang last pay, pro-rated n 13th month pay at SIL n 5 days kung hindi mo pa nagamit. Tska depende ito sa mga provisions ng contract mo sa company

      Since ng resign ka, last pay, 13th month at service incentive leave (SIL) Kung hindi mo pa na gagamitin ang makukuha mo. Kung May other incentives ka, good un (ask mo ung company).
      As regards naman sa injury, kung nakuha mo ito ng dahil sa work, pwde k makakuha sa SSS. Kung work -related injury.

      Depende ito sa nakalagay sa contract mo. Ang Government kasi, iba ang bonus scheme nila. Tignan mo sa contract mo or rules nila kung entitled ka sa bonus

      Pumunta ka sa SSS paka mg file ng complaint regarding sa SSS mo. Pag-Ibig naman kapag sa Pag-Ibig at Philhealth pag Philhealth.
      Need ito hulugan ng agency kasi maaaring makulong ang may ari nito kung hindi sila mg hulog lalo na kung kinakaltasan ka nila

      After 1 yr of service dapat may SIL n. Pwede mo ito demand s employer mo. Pg hindi sila nakinig, ask k assistance s dole.
      Kung mg resign ka, remember n ang makukuha mo lang is ung last pay at 13th month.
      Regatding s visor mo, pwede mo cya report aa HR nyo or sa may ari ng company.
