    Why do white people keep on aspiring to own lands anywhere in the world? Who do they think they are? Do they feel they're citizen of every country that they like? Do they believe in countries and national boundaries? Are they spreading a stateless world or anarcho-communism agenda? Or are they simply imperialists?

    I will never understand the need that some foreigners feel to buy land in Thailand. Maybe a better plan would be to learn to speak and write Thai language. Thai people are proud and don't want farangs colonizing their country through shell companies and sham marriages. Every time I hear a story about a farang who builds a house for a Thai woman and she kicks him out, I smile and say, 'He deserved it.'

    The law is quite clear. It is NOT legal to form a company for the purpose of owning land. Secondly a lease is only legal for 30 year max regardless of a contract saying it can be extended.

    the financial requirements are so high for a country where the cost of living is around 1500 usd a month. What are they trying to combat by stopping a digital nomad who "only" makes 70k a year.

      Yes. I usually order from Lazada. Beware copies, avoid Chinese vendors. I usually check the "Local" filter to ensure I get a vendor in Thailand

      Technically, "Yes". Be sure to get a good lawyer involved to make sure this is all set up correctly with no surprises.

      Establish a registered company to own and operate the farm. It may be illegal for you to work the farm yourself as agriculture is a prohibited job for foreigners. Talk to a lawyer

    An agent will also take your money - the funny thing is an agent is always looking to move the property, they don't really care what it sells for because they get a nice commission check. It's a volume game in the end.

      It's the agents job to sell the property, but keep in mind the offer comes from the buyer and the acceptance comes from the seller. Agents don't dictate price, that's totally between the buyer and seller.

      @@geraldenright9845 You just proved my point. I am interested though, how does a foreigner get a work permit and the proper Visa to sell property in Thailand? Given there is no such license to sell property, as in other regulated countries, it would seem that anyone can claim to be a real estate agent, even a Thai. The foreigners working without the proper credentials would be my serious concern which would be very hard to understand how a Thai real estate agency would hire them given the minimum salary requirements and visa/thai work permit requirements. I have yet to meet any foreigner that has these things selling real estate, they are all working illegally typically.

      ​@@geraldenright9845 Working as an MD, Managing Director, your engaged here on TH-cam using a corporate company registered in Thailand advertising real-estate process which is in violation of your work permit but fortunately not enforced at this time unless reported. You can manage the business, you can't take Thai jobs, education or advertising activities direct without a Thai national representing the majority of the information - you would only be a support for translation purposes, management oversight. The exception is if you are acting as a legitimate instructor which your Visa and Work Permit don't support - you're not classified as a professor or teacher, but rather a Managing Director. Big difference. Advertising is a marketing job not a core business management job. You are not alone. I’m just stating the facts in the spirit of the law. Given that the company you're working for or partially own, it appears you represent RE/MAX, a global real-estate franchise company, it must be a Thai 51% majority company, Thai owned company, as the US/Thai Amenity Agreement prohibits real estate businesses given the land restrictions. Again, you're violating your work permit because you are acting in a direct marketing capacity. If you want to educate people, I do honor this. You need to do it freelance without advertising the Thai company you work for to avoid a conflict. Now that this is public on TH-cam, the clock is ticking...

    What if my sons are Thai national and I am not and I would like to form a company with 51% on my sons and the rest on my name, then I wish to sell the company or a property acquired via the company, is that requiring the sons consent? Or is it up to the company formation contracts with my sons and how the board isarraged? And if so any laws about the company board?

      I'm unsure if a minor can be a director of a company. What I have discussed with our attorney is a case whereby the minors are the owners of a property. As their guardian you can liquidate their assets however you must petition the court for permission and demonstrate that said liquidation is in their benefit. Once they reach the age of majority, they can sell the assets without your consent. I've seen schemes where the Thai owners enter a loan agreement whereby the accrued interest will out-value the asset potential gains. Talk to a smart lawyer, I'm sure they will offer more sound advice than I can.

    What about building a house that can be moved from property to property. Maybe a kind of container home. If a lease won't renew, that's fine, just move the home to another piece of land.

      yes, if you own the structure and it's moveable, then you could move it. This should be fairly easily done. Technically you can own the structure (permanent or temporary) independent to the land. Technically you must be granted a right of way to your house. Technically in the case that your house is permanent, they cannot sell your house when they sell the land so it would become an impasse for the courts to resolve. But legal cases can take years to resolve in Thailand and I want to help people avoid finding themselves in that situation, to begin with. :)

I would like to raise a question about what if the landlord sells the property to someone else, would that affect the lessee's right in the lease? (given that the lease is less than 30 years and properly registered). My point is, would the selling of the property by the landlord invalidate the lease or Thai law would protect the lessee's right in the property? Another question is what would happen if the landlord gone bankrupt and the property is sold by a court order to repay the landlord's debt? Would the lessee's right protected by Thai law as well? Or do the lessee needs certain special clause drafted in the lease to protect his or her rights? Thanks a lot.

    Thailand talks so much about inviting people to live in the country and increasing the amount people spend which helps the local economy develop. Last month they came with an ill thought of idea of trying to get high net worth to invest in Thailand which was rescinded. My wife and I (wife is not a Thai) were planning to retire in Thailand and we looked at various options for owning property and each one came with their own caveats. We have dogs so an apartment / condo is ruled out. Renting short or long term is possible but because we have 10 dogs we are not shown decent places. These rescue dogs were being moved from Brunei to Thailand and have been with us for a few years. Staying in a rented house in our twilight years is not exactly what we were looking for. Anyway we don't have the millions of dollars Thailand wants. Thailand's loss is someone's else's gain since we have got enough to buy a 400-600K US$ house cash down and have enough coming to us from our other real estate investments in other global locations. I am sure there are many like us who love to be in Thailand but like to plant some roots too!

    Its just a headache, dont do it. Worst of all is when u put your land under a bar monkey's name. Condo seems the best option. Honestly, just stay away from buying land in South East Asia. just rent it is as cheap as peanuts and you still live very well. STAY AWAY FROM BUYING LAND - GET THAT IN YOUR HEAD!!!!

      I own land with my wife and in companies. The trick is not to be naive thinking you know it all and that it's in any way shape or form like your home country. Laws are very different and NOT fair by western standards. Don't trust just anyone, including girl friends, know-it-all expats, shady lawyers or agents. Gullible investors in land will be chewed up and spat out. Just Google all the bitter stories of enamored foreign men losing it all. That's why I do these videos, to try to help those who are willing to listen.

      @@sebastianniqvist3144 Renting is good for short term stay because while renting is cheap now it can always change. The landlord could just raise the price out of nowhere. I think if you stay long term in Thailand getting a citizenship should be on the table.

    I think it also depends how beneficial you're to the Thai economy. If you setup your company correctly and also buy a buisness , Hiring Thai employees + paying frequent tax authorities turn a blind eye since Thai people are benefiting from your ownership / presence in their country. While you're operating like a company should. If you're filing blank tax returns every month that's a red flag for possible disaster . As it shows you made the company just to bypass the ownership laws .

    What if you wanted to lease for 30 years a house being built in a neighborhood from a developer, but you plan on selling in 10 years to make a profit. Do you hold it in such a way that you can sell it for a profit after 10 years if the buyer is Thai citizen who wants to cancel the lease and buy it freehold?
