    Thank you Abhay ji for clarifying the concept of priority date:In summary: 1) When the subject matter is disclosed compltetly to the public that date should be considered as priority date irrespective of application (Provisional/complete application) made.Section 11.4, Section 137 2) In case of divisional application, priority date would be the earliest or the original application date. 3) In case of cancellation of provisional application, the latest application date should be considered as priority date. 4) In case of post dating, everything will get shifted maximum by 06 months (or requested month) with respect to the earlier priority date I e date of filing the complete specification.

      Just so that I am clear on what is scenario - re article means research article right? Since its a publication, the only problem you can face is that of plagiarism, if you have given appropriate citation/credit to the original authors (patents) - you should be okay. People don’t go to courts for publications 😅

    Sir, What would be the scenario in the following case? What if Mr Chandra refuse to give out his share? Mr. Chandra was doing his Master’s thesis at Ramanujam University of Science and Technology. He along with his guide Prof. Chanakya made an invention. Having no IPR policy in place, a patent application was filed (and granted) with Mr. Chandra as applicant, and Mr. Chandra and Prof. Chanakya as inventor. Later on, the University took your help as Patent Agent in forming their IPR policy and realized that the patents generated in the University campus, even in past, should be on their name as Applicant. What is the prescribed procedure and documents required for bringing the name of University as an applicant in Mr. Chandra’s granted patent. Mention the corresponding section(s), rule(s), form(s).

Here's a step-by-step approach: 1. _Review the agreement_: Check if there's a prior agreement between Mr. Chandra and the university regarding intellectual property rights. 2. _Section 68 of the Patents Act, 1970_: This section deals with the assignability and transmissibility of patents. The university can request Mr. Chandra to assign the patent to them. 3. _Form 16_: This form is used for the registration of an assignment of a patent. 4. _Rule 85_: This rule outlines the procedure for registration of assignments and transmissions. 5. _Section 64 of the Patents Act, 1970_: If Mr. Chandra refuses, the university can seek cancellation of his patent on the grounds that he's not the rightful owner. 6. _Legal action_: If all else fails, the university may need to take legal action against Mr. Chandra to assert their rights

      @@AbhayPorwal Sir, Thanks for so detailed response. But it is mentioned that previously there was no policy in place. That means there was no existing policy where employees must assign patents to employers. Also, there is no agreement between the employee and the employer.

      Agreement and policies are different . We need to check if there was an agreement or not, if nothing, a request to assign the invention citing reasons such as usage of university resources and any other means.

      @@AshutoshKumar-zj5nd could be from commercial angle where a licencee may provide support documents about licence agreement along with duration - if the patent is surrendered than there is no value of the licence agreement, anybody can use the invention so licencee losses out on market

      All objections come at the same time when the first examination report is issued - you have to respond to each objection one by one providing your arguments on why such objection should be withdrawn

      Hello there, Yes, you have enough time to prepare for the exam - you have full 4 months - sufficient time to go through the act, go through the lifecycle of the patent and related various use cases that may arrive. Regarding Job, please understand one thing, patent agent is not a key to open doors for job opportunities - in IP industry there are many positions (analytics - and related) which don't require you to be an agent. When you read the act - you become aware of many scenarios and solutions for those - this helps you to become a better IP professional.
