@@shivaninain8662 please mention question itself so that I can respond without having to open the paper again.. for this I did - exclusive licensee can institute infringement proceedings as he/she is similar rights, the original patentee can join as plaintiff (the one who puts a case), but he doesn't, then it is added as defendent (the other party ). Irrespective of this the patentee is not liable for any cost out of court proceedings. Answer is C

Post grant opposition is always an option because of the timelines (within 12 months) - the question didn't give us any option around groundless threats, hence, no point thinking about that.

Sir Q36 about "No infringement suit shall be commenced...." is very ambiguous to read, there can be clearly two ways of reading it as there is no comma given in the question paper.
I felt the same, not sure about others - before that patent is granted no one can initiate the infringement suit - that's how patent rights work, but once the patent is granted, the rights get accrue from publication date - hence any infringement occurring after publication can be sued (ofcourse if they stop after grant of the patent - all good)

@@mannykrish1 See its a qualification exam - so 150 is also an agent and 250 is also an agent, what truly matters is how good you are with knowledge aspects - because you need to navigate clients with appropriate pathways....I hate to talk about scores..but guess, you will not be happy if I don't address your question...In order to avoid reliance on interviewer's personal biases (interpretation), I would like to have at least 125-130 marks with paper 1 and paper 2..now paper 2 scoring is a bit subjective..so it's always better to score heavy on p1..like 75 plus..
Sir your videos are always very helpful but I am confused with question of ISA for Indian applicants. Just as you mentioned all the options were correct so what do you think, will they provide grace marks for that question?
Sir i scored 52 marks only, i am also able to pass paper 2 but i passed paper 1 on boundary so i need atleas 40-42 marks in interview and I think it is very difficult target. So sir please guide related with viva.
