      The plea agreement was for a lesser charge. If he goes to trial, it will be on the original charge, CSC 3rd. So he’s risking more jail time, not sure how much.

      He gave him the max allowed by law for the act he pleaded guilty to as part of a plea deal..sometimes plea deals are made so the victim doesn't have to reluve it in court

      I am not victim blaming, especially since we don’t know all the details of both sexual assaults. But, it is outside of normal statistical variations for one person to be a victim of two sexual assaults by the age of 15. I thinks it’s fair to ask whether the victim was engaging in particular behaviors that opened herself up to being more at risk of being assaulted. I think this is also what @dredarrough6385 was getting at.

      Re-victimisation is not limited to sexual offences or just women
      Unfortunately, though, child sexual abuse survivors were much more likely than those in the control group to be re-victimised in what are considered medium and high harm personal injury crimes.
      For instance, they were five times more likely to have been victims of sexual assault later in life, twice as likely to be victims of physical assault, four times as likely to be threatened with violence and twice as likely to be stalked.
      We also found the increased risk of re-victimisation was not just experienced by women. For example, male survivors of child sex abuse were seven times more likely to be the victims of a further sexual assault than the men in the control group
      Maybe read before judging or just be kind.

      I get why there are plea deals but in cases like this the prosecutor should put the work in and get the conviction at trial and put them behind bars for the rest of their life

      In most cases like this, the prosecutor will seek the permission of the family to make the deal. This is often done to spare the victim from having to testify.

      We have a judge where I live that has done it more than once and I love it. I live in a small community and the lawyers seem to have these deals worked out all the time. I love when she tells them no way she is approving it. I vote to retain her Everytime.

      Yes, his lawyer seems to be out of touch with what harm his client caused. Even with great therapy she'll live with the effects for her entire life. Hopefully she can find a healthy outlet. I feel so badly for her. Sex offenders are just that and will always be predatory. Nothing fixes them! Brave child to speak up!

He even says, “I’m not trying to diminish the act”. That’s no different than a defense attorney that is trying to get a murderer a life plea, instead of the death penalty.

    He isn't that slow. He provided her with things she couldn't obtain on her own because of her age. He was setting her up. He alluded to having a gun so she would go along with the rape. He understood he had to take her to a secluded area to carry out the rape. I'd say he understood exactly what he was doing.

    I feel so sorry for her. I was sexually abused from the age of 3 until I left home for college. All of my childhood I lived in fear. I will never forget the painful rapes. I will never forget the shame, embarrassment, and guilt I felt.
    Fortunately, my faith in God was strong and He enabled me to carry on. He made me strong and gave me the Will to live. I became a professional singer /songwriter and musician. I have traveled the world.
    I forgave them a long time ago, but my mind cannot forget. When I was a little girl I dreamed of growing up and having a family with children of my own, but as much as I have healed, I am so unlucky in love. I just can’t seem to find love . I hope love will find me one day.

    The judge felt his hands were tied and I don’t blame him. The defendant literally confessed to the crime to the police even before the plea! Plus the ridiculously short sentence offered by the prosecutor would have him out before the victim was a full adult and able to cope.

    This is so triggering for me , but also so glad there is some form of justice for this young lady . So extremely brave she is. It took me until I was a parent myself to be able to seek help and speak the words out loud. I relate to her self harming. God bless you. Young lady with prayers always from CANADA.     I've watched several programs about what happens to sex offenders in prison. They have to be in a special sections of the prison because they would be murdered by someone in general population. Many gangs in prison will make a new inductee kill a sex offender to become a gang member. If our justice system fails us, unfortunately, prison justice becomes our only hope for real justice.

      I'm sorry, I missed the part where it said the mother walked her over to his car and let her get in... /s she's 15 not four stop blaming the mother for the criminals actions. If you listen to it he carefully groomed her until he was able to isolate her. I guarantee you he didn't do it in front of anybody that would stop him like her mom. He tricked her into being isolated by offering her things like vape pens, she's not going to be telling her mom about her 20-year-old friend that gives her weed / nicotine. 🙄

    This is my hometown Judge; he is also the Circuit court Judge for the next county over. He's strict but fair, I watch his Court on a weekly basis and he has had some wild cases over the years for being such a small town.

    This judge is insane. I can assure you I was molested, not raped but molested and I required therapy for years. I had nightmares, I had poor relationships with others, I had control issues and was overdependent. It is insane for the law not to presume maximum psychological harm from a rape let alone a childhood rape.

For some reason the last few sessiosn when I was about 70 truly did the trick. I think it was when I stopped focus on the molester and realized that my true hurt and disappointment was from my mother not protecting me even when I told her what was going on. Once I realized that I really was able to let the trauma at the physical stuff go. She is dead now and that really helps even though it sounds cold. I hope you find peace.

      It’s 23 months (min) up to 10 years (max). With time served, he would meet the min requirements, and thus be immediately eligible for parol. Chances are he wouldn’t be granted parol until probably 5 years.

    23 months to 10 years with almost a year time served?! So he can get out in a year. WTF is wrong with our system?! The man raped a child threatening that child with a gun! Wtf?! I know a guy who just sold a lot of weed and got 17 years! So what they are saying is they care more about weed than they do children. And then they wonder why the inmates kill these guys.     I really want him to take it to trial for what he put her through. I mean let's face it he has already admitted it .
    She was very brave to stand there a couple of feet from him . My heart broke for her and her mom.
    I wish her well I really hope she can move passed this with the right therapy. She is stronger than she thinks she is. She stood in front of the judge and made a statement she's a survivor.

Evertime they start to heal there’s another hearing. That’s why they plead some people out. Also sentences aren’t long enough for sex crimes against kids or adults. I’m sorry you went through it.

    There's another problem here. Mom said that was the second time. Chances are she again will go hang out with a predator. I know people will call my comment "victim blaming", but that's not what I'm doing. His age is probably the only reason they got a conviction. The point is, continue prosecuting predators, but also learn how to avoid being in bad situations

    Very brave of the victim to face her assailant! I hope this helps her on the long and arduous journey of healing…. As far as the defendant. If it was up to me they’d get the death penalty, or better yet, taken out back after court and put down. But I would settle for a life sentence, considering the damage these animals impose on their victims lasts a lifetime.

    Judge Gauthier doesn't mess around which is why I like him. He's fair but also isn't afraid of holding people accountable like too many judges in our country.

    Deserved more. Being slow isn't an excuse rape, especially a family that opened their home to him and his brother and this is partly why people don't want open their families up to older kids in foster care because it opens their family up to whatever that kids biological parents have wrong with them or whatever they may have done to the child and that puts your family in danger

    He’s a predator and thought he wouldn’t get caught. He used fear to intimidate, control and assault her. She had never had sex and was terrified. He left her w physical and emotional injuries. He probably should get the DP but America is soft on criminals. If he offends again he will kill the victim. America you must decide if you want more victims or not. Life or DP is the only choice if you want a safe and free society. You need to make the hard choices for a safe society. I’m not white, this has nothing to do with race. if you look at the stats it is clear white folks aren’t attacking black folks.

    I hate what happened to this poor girl, but this was an eye opening video, much appreciated! Also feel bad for the mom. It's gotta be hard taking care of a daughter that's been thru something like this twice! Yikes. Seemed at her wits end. What a sick monster. Hope this cockroach gets a long time. Progroms can only do so much smh.

      100% I agree with you. Their testimony broke my heart. I have a daughter who is the same age as the victim was and I couldn’t imagine how heartbreaking it would be if my daughter was in so much psychological distress. I commend the mother for having the strength not to lunge at the scumbag who hurt her daughter because I don’t think I would exercise the same restraint. They should bury him under the prison. That girl is going to have a lot of issues going forward and her future relationships with men will always be affected because of what she endured.

      If there had been a father involved, my money would be on this never having happened. She would not have been allowed to hang with an unemployed much older guy of questionable intelligence. The mother had to have about this guy. Despite her good intentions, she is part of the problem.
