Step 1: Getting clearances from your home country (NORI-NO OBLIGATION TO RETURN TO INDIA)
*Application pre-approval/get forwarded from Indian Embassy in USA
*Send application for NORI in India by Self to MHRD DELHI, STATE Office, Passport Office.
*Get no objection Letter from all three.. a copy goes to Indian Embassy directly
Step 2: Online Application and Mailing in the petition for waiver to Department of State (DoS)
Step 3: Getting your home country embassy in the United States to directly send in a No Objection Letter to the DoS citing your petition number.
Step 4: Waiting! Waiting and waiting
Step 5: Getting a Favorable Recommendation on the waiver from DoS
Step 6: Getting Waiver approval notice from USCIS
NOTE: The Health Minister JP Nadda has decided to tackle the issue by not issuing the NORI (No Obligation to Return to India) certificate to doctors under any circumstances, except those over 65 years of age. A NORI certificate is required by a person who has gone to USA on J-1 visa. This is to just balance the doctors crisis in India I hope.

So I applied for extension and I got my new DS2019 few days back now my New DS2019 is valid until 2025 may. But my visa stamp in passport is about expire. Though I belong from west Bengal but I originally got my passport from Lucknow when I was doing my masters from IIT Kanpur. Originally I appeared for passport interview in Kanpur city and in my passport its written it is issued from Lucknow. I am slightly confused where should I send the document which is required for passport office verification. Also Lucknow has both passport seva kendra and regional passport office. From their site, I dont see any information of when they will return my original passport. Any idea on this? In case I need to travel, I dont want to give away my original passport for long. And one more question: I have my visa stomping until 2024 May ( this is my old University visa for some reason I changed my University and they given me 1 years DS-2019 that is September 2022 to September 2023). If go India for visit do I need to go for stamping .
No, there is no need go stamping. You can visit and come back before September. It's better to come back 1 month before expiration.

Yes you can go… you need waiver when returning back to America before spending 2 years in Pakistan

yes you can apply for H1b from J2 directly.. If you had J1 before J2, you may required waiver otherwise no... You are dependent of your husband so when changing your status you need to submit your husband doc.. but prefer to transfer to j2 to h1b.. don't go on H4- beoz you cannot work

You should be fine.. it should not apply if have used entered the country… of if you spend 2 year in home country, j1 waiver is not needed

Thanks for your video. I'm on J1 in the USA, I got J1 for 5 years from my university. I'm in the USA for 8+ months and luckily I got all 3 NORI stage 2 documents from India in less than 1 month of my application. So I completed NORI stage 2. What will be the best time to apply for stage 3 of NORI? I will be traveling to India in December vacation. I have not traveled to India after entering the USA. Is it ok to travel outside of the USA, mainly in India after applying for stage 3 NORI? Does travel to India impact NORI's outcome? Please guide.
Good that you have 5 year stamp. NORI 3rd is necessary when changing from J1 to H1b/Green card. You can do whenever you want but we should apply 9-12 month before you change the visa.

Short term J1 should not effect… you can check on visa 212e apply or not..

Means past and new J1 VISA category might be different so you may get new VISA.. but I am not very expert in this.. best way to apply a new VISA and lets see what US embassy says. best wishes

I am currently in the USA with a J-1 visa. I got a job in the USA. I have two doubts.
1) As it can take almost 1-year to get the waiver, can I work with any other type of visa for the company until I get the waiver because my current J-1 visa will expire on March 31, 2023?
2) For the waiver, I have to get one clearance from State Home Department. I am a bit confused about what is home state. My Adhar card, voter id, and ration card are all from West Bengal. But the address and birthplace on my passport are Ranchi, Jharkhand. So, can you please suggest to me what my home state is? I checked that for the J-1 waiver, my parents have to say that I am not ‘abandoning’ them. My parents live in West Bengal.

First of all its very confusing to understand your situation. You should write clearly
1-its very short period to get waiver.. you can extend your current postdoc job or get another postdoc and transfer current visa. you cannot work for another company.. you need either O1 Visa
2-watch waiver video again.... waiver and NORI is two things.. NORI application from MHRD delhi, state sachiwalya and passport office where you got your passport

Hi Santosh, thanks for the video. One question: I've all 3 clearances. All my documents (that were supposed to go from my end to the Department of State) have been received. But when I'm checking my DS3035 status on the website, I do not see if the No-objection Statement has been received. On the other hand, I have already received my copy of the No-objection Statement from the embassy - Do I need to just wait or is there is any action to be taken from my side? Thanks!
If you have followed the right procedure, you should soon get update. sometime indian embassy delays. can call and check with them if they updated directly to US dept of state.

@@---kt5xz Yeah.. right.. US have more jobs/better pay than Canada.. But hard to get green card/long time visa compared to Canada..If you are hard working,, you will find out sponsorships easily

J2 Can change if they donot have any J1 before, but sometime it require waiver of their spouse j1.. better to talk to international office to get clear message

For F1 visa 212E rule of J1 is not applicable I hope. If we go on J1 visa for research internship for 7 months then come back and complete final semester of engg ( 6 months) and apply for F1….will their be problem in the same with 212E rule

Hi Santosh, please I need a help. I am stucked at a little confusing step, I read manytimes but still confuses me.
So I have all the three No-objection letters, I have also filled up the J-1 VISA WAIVER RECOMMENDATION APPLICATION (which is DS-3035) and have generated the pdf with the barcode. This is where my confusion is, do I now send all the documents directly to the Indian Embassy or do I have to post a mail to the US Dept of state.? According to the following link, I have to post mail to the Dept. and also pay a fee of $120. But from what I understand from your explaination, I should post all my documents to the Embassy now and they will submit it for me, I that correct? But what about the fee of $120? Would really appreciate your help. Unfortunately, link provided on the Embassy page on this step doesnt work!!

I did long time back.. you should send documents at both places, US dept of state and indian embassy.. one barcode goes to embassy with 3 NORI letters. talk to someone did recently in your dept.
