    I have seen this video for 20 times or more. It helped me a lot specifically what to write as no objection statement . The video clearly described what is the actual process for J1 waiver.I have only seen this video and applied for my J1 waiver.       @@JitendraPant7 , your video has become a gold standard for j1 waiver to Indians .
      I think people should start the stage 1 and 2 the moment they step into the US . They can decide on when to proceed to stage 3 later . Doing everything in the last minute can create a lot of anxiety that can be avoided .

A question could use your guidance on the Home Department informed me they have "dispatched" NORI clearance to address on the forms submitted to them, presumably the Indian Consulate but I have not received a copy of this clearance. Will the Indian Consulate mail me a copy or do I need to check with the Indian Consulate to get a copy or the home department clearance ? In order to be able to submit copies of all 3 clearance letters(I have copies of other 2) Thanks

      Both you and CGI will receive your own individual copies from Secretariat of your state in India. If its dispatched it will be coming to you within a month. Note they send it via regular mail from Indian postal service so takes more time than usual!! I don’t think CGI will have additional information but it won’t hurt to ask!

    I just had a question with regards to the self attested envelopes. What is the 'From' address to be put there? Is it the one in MO or in DC?

      Leave the from address blank but put "To" address i.e you address: you need two self-attested envelope one for MO and One for DC with the two packets that are generated after filling DS-3035. The concerned authority will complete the "from" before mailing you.

    hi Jitendra is there any way to communicate with CGI. They have provided many phone numbers but they don't pick any of them. Neither they respond via email. Besides this I also wanna know how much time do they take to process stage 3 application to Washington DC. Please let me know. Thanks

      1. You have to keep writing email and call multiple times unfortunately. I know it’s annoying.

    Hi Jitendra! Incredibly helpful video. I just had a quick question about question 2 in the affidavit (stage1). My DS2019 says I need a waiver based on my skill sets. I was not sponsored or financed by any Gov. So would it be ok to write "NA" for all fields in question2? Just to clarify I copied question2: "The exchange programme was sponsored by the Government of India / State Government of ___________NA_________in India / Agency of the Government of ________NA________ and financed by the Government of / Agencies of the Government of __NA___ / other."     Hi Jitendra, Thanks for your helpful video, and that's pretty informative. I appreciate your efforts in making this video. I have a couple of questions on Affidavit form (stage 1)
    1. Am I supposed to enter "not applicable" in the blanks in Affidavit? for example: I haven't taken any scholarships from Govt. of India, so shall I enter "not applicable" over there? But It's specified in affidavit that none of the blanks should be left empty or "Not applicable". So I'm a little confused of what to enter in the blanks that correspond my J1 aspects.
    2. In affidavit, do I need to complete questions 7, 8 and 9? because there is no space to enter data over there.
    Any advice on these two questions will be highly helpful. thanks!

      @@JitendraPant7 Hi Jitendra, thanks for your prompt response. here are the questions of 7,8 and 9 -> 7. I have not taken loan from any person or agency; 8. My presence is not required in India for any civil or criminal proceedings; 9. I'm unmarried/married and have not deserted my spouse and children in India. I had another question regarding question 7, do I need to specify about any home loans that I have taken?

      Ideal answers:
      Answer to 7- Yes
      Answer to 8- Yes
      Answer to 9-Yes
      Since the Q7, is particularly regarding J1, mentioning home loans etc is not required, plus it can badly hurt your chances to get a waiver.

    Update with respect to the application: Stage 3
    Application filed with the DOS: 01 Sep, 2021
    Application update on DOS website: 20 October, 2021
    NOS update (Indian Consulate): 21 October, 2021 (I got the letter on 14 Sep, 2021, but DOS updated it late)
    Favorable Recommendation - DOS: 18 Feb, 2022
    USCIS receipt - 28 Feb, 2022
    USCIS Approval - 15 March 2022
    Received Letter on 22 March, 2022
    It took quite a long time due to understaff in covid time. DOS processing time was mentioned as 12 to 16 weeks once they receive all letters. Mine took close to 16 weeks. Hope it will be faster in the near future.

      DOS processing time as of now is 12 -16 weeks; if anyone exceeds the processing time limit. You can contact the local congressmen to expedite the process. However, by contacting them within the processing time, DOS will deny the expedite request and reply to you stating that your case will be processed as the order is received. Before covid, the overall processing time was close to 2 months after filing. Now we are experiencing a long wait time.

    Brother, great video. I have a doubt if your could clarify. What if the both J1 visa page on the passport and the DS2019 indicates that the 212(e)-2 year Home residency rule DOES NOT apply? From Somewhere I got this " If the J-1 worked or studied in a field that appears on the "skills list." This is a list of fields of specialized knowledge and skills that are needed in the J-1's country of last permanent residence for its development. Canada, Australia and Germany are examples of countries that are not on the list. China, India and South Korea are examples of countries that have many skills on the list". I studied and worked in Canada (although an Indian Citizen) while applying for the second postdoc in USA. That explains why it mentioned that I am NOT subjected to 212(e)-2 year Home residency rule. However, any thoughts? As a layman, may I assume as both the J1 visa and DS2019 indicate (which is I am NOT subjected to 212(e)-2 year Home residency rule). Looking forward to your reply. Thanks again.

      If you are in the US; you just have to provide the three NORIs from stage II to the consulate. But do go there with your ID and Passport. They might ask to see it but will only keep the NORIs with them not your passport. You can fill up the miscellaneous form on spot there. All the best!       Ideally yes!!
      Status will be seen online + shall receive a document via physical post.
      but the responses are not always synced.
      Best to also write emails regularly on a daily basis to USCIS to know the status.

      Hi Pritpal,
      After filling DS-3035 online (see the link in the video and description box below the video) you will get a third party barcode, case number and will also receive a checklist for generating two packages:
      Package 1. Mail to St Louis waiver division - via mail with one self-address envelope
      Package 2. Submit physically (or via mail) to your CGI along with all other docs (along with third-party barcode). This has another self-addressed envelope so that USCIS can correspond with you after they receive your case.

    Hi Jitendra, I currently have all three NORIs and am ready to go to stage 3.
    I also have a 2 week trip planned soon outside the US. I would like to kick off the stage 3 processing ASAP by going to the consulate and sending the packet to Missouri before leaving for the trip.
    Do you think this will have any negative effects? (I am working on F1 STEM OPT and don't have any other visa application in process)

    This is very helpful video. I just followed steps as mentioned in this video.
    Thank you very much for this informative video.
    I want to add one more additional information. I applied for J1 waiver when I was in Georgia. I completed my stage 1 and 2 process in 2018 from Atlanta Consulate General.
    In my NORI form received from passport office, Cochin India stated the letter to 'CGI, Atlanta'.
    Now I shifted to Michigan and I am under Chicago consulate. Since the letters mentioned CGI Atlanta, I send the stage 3 documents to CGI Atlanta last week and I received all the documents back today and asked me to submit the forms to Chicago CGI because I am not under their (Atlanta CGI) jurisdiction (rejected).
    Now I have to do the stage 3 application to Chicago.
    So guys, when you apply for stage 3, just apply to CGI near to your place. not to your previous work place.
    I hope it will help most of you guys, since we are moving around USA during this J1 visa status.

      @@DrFox-cm4jo yes. The letter from other departments to the CGI Atlanta. That’s the reason why I submitted it first to Atlanta. But only thing is to submit J1waiver to your nearest/under jurisdiction CGI. Therefore there was not a single issue at CGI. is okay.

      You don't need to get them attested since you are physically present in India. Notarization is for those who are in a different country than their home country.

As you mentioned here, that some states in India have discontinued the RPO clarification. How can I know that which are those states? Also, did you send your documents directly to RPO office or at a particular division at the RPO office? Thank you!

      I don’t have the list but your CGI in the US should have this information for your Indian state.
      It goes to RPO which issued you Passport.

    At 7:30 you have mentioned to write the case no, name and country on the documents. Is it necessary? As, in the DS3035, they haven't mentioned anything as such.

      As far as I remember its needed. I clearly recall it was written in the package that also contains 3rd party barcode. It can be hand-written.

    Hi Jitendra, Hope your in good health!! Just wanted to give you an update with respect to the application:
    Application filed with the DOS: 6th Jan, 2021
    Application update on DOS website: 25 Feb, 2021
    NOS update: 8th Mar, 2021
    FR: 1st July, 2021
    USCIS: pending
    As you can see, it took more than 16 weeks to receive the FR, once the NOS was updated. However, I have seen cases that were issued FR within 2 weeks-2 months. So, I contacted the local congressman earlier this week to request the DOS for an update and the reason for the delay in processing of the application (typical times are between 12-16 weeks now, my case exceeded 16 weeks). All my measures to ask for the update from the DOS via the email did not lead to any response and hence had to involve the congressman office. I would suggest people to contact the local congressman after the 12th week itself.
    In any case, I will update my timeline with respect to the next steps with USCIS as well. Hopefully, this would be faster than the DOS.

After the FR from the DOS on 1st July, the case was updated on the USCIS website on the 21st July and the status was shown as approved on the 23rd July. Waiting for the hard copies now.     Hello Jitendra, thank you for sharing the information to your video about J1 wavier.I want to know one more thing if a person had applied wavier already but haven’t got it yet. In that situation is that person is legible to apply for extension or not?
    Secondly, If a person is on J1 extension, Is that person is allow to visit his home country during that period and come back to USA?

    As JP told me to share my experience, just adding a bit. The SF consolate clearly told me no need to include passport in the package, rather notarized photocopies are needed. Also no need to send the affidavit or biodata for stage III.

      Yes you need to need to mail the original passport. For DS, a notarized colored copy (front and back) should suffice. Please check with your CGI. Also use FEDx express overnight service both to send and receive for safety purpose. U can get the label online.

      There is no pass/fail in stage 1- with the receipt and 4 copies you have completed it!
      Regarding education I meant, if you are planning yo study on F1, you don’t need a waiver- neither do u need a waiver if you get O1 visa later but you will still need stamps from US consulate!!

    I'm in the third stage of waiver process. I sent the documents to Missouri and to NY embassy. New York consulate issued me a waiver certificate and grant of waiver certificate. I have not heard from Washington DC yet.
    I have a question: Should I send anything to Waiver division at Washington D.C.? From your video I understand that they will send me the certificate directly. IS that right?

      Hi Amy, that’s correct.
      The Ny consulate must have send your waiver certificate copy to DC and you will be getting follow up docs from DC soon. I would highly advice sending emails and calling regularly to push them.

      I don’t have the weblink. I guess the new procedure now is to still apply the regular way. And when ur application reaches RPO, they issue a certificate saying, “RPO” is not required. The only thing that changed for u or the applicant at this point of time is not the procedure as such but the time (will easily save u 2 months). This is true for Delhi, I don’t know about other states. I will update the video as I learn more.

      @@JitendraPant7 thanks a lot for your reply. The applicant in this case is my wife. Curently, she has a O3 visa and now she has been offered a post doc. The university would help her to change the status to a J1 visa. However, in future once she wants to change from J1 to H1B or O1 or O3. The two year rule might pose a problem for us. As a result, we were already looking into the process of applying for a waiver. Since, her passport contains New Delhi as her permanent address, it already means that we would save some time in the entire process with respect to thr RPO clearance. Just one more thing, is there any validity associated to these no objection certificates issued by the MHRD/Secretariat/RPO? We are thinking of applying for these in few a months and hopefully obtaining them successfully. We then plan to use them when the appropriate time comes and apply online at USCIS.

      Himank Anand Hi! No there is no validity issue. You can collect these docs from stage 2 and then apply for stage 3 at your convenient time. I did so after a year of stage 2 approval and had no problem. All the best!

      1. Changing address doesn’t create much problem as long as the CGI still stays the same. However if you must change the address there are additional steps if your CGI changes based on the new state of residence. I know a friend who did it without much work. Within the state there is no issue. In summary, while not changing address is best case scenario, a change of address is not the end of the day.
      2. Yes the highest degree should suffice

    Hello Mr. Jitendra, thank you so much for such an amazing video. This is question is just to get some hope and wisdom from you. Before seeing your video, a couple of days ago I approached an immigration law firm for this NORI process and they said it’s a long 10-11 months process even though I mentioned the website says it’s a few weeks process (the attorney even had a sarcasm response with a snicker smile) and just for this NORI process they are ready to charge 2800 and plus the US processing fee that are just a couple of 100’s. Whilst I felt a lil hopeless because being a teacher and I only have only one more year on my visa span, it’s not that easy for me to decide. I definitely need your advice on whether they are saying it to take money or is it really a 10-11 months process now? I hope yo hear from you soon. Pranam 🙏🏽!!! - Prema

      Unfortunately, it can take 10-11
      monthly easily because covid rated understaffing has only made it worse.
      However, this video and comments have everything you need so no need to pay the attorney fees. The most time consuming step is India clearance but attorney can’t help you with that anyway. If you must use an attorney let me know, I can get you in touch with a law firm and ask them to give you discount to save you some $$!

    My J1 waiver is at its third stage. On September 3rd I see their received status while in June21st I sent applications. Now my current j1 is ending in 30Nov.
    So can you please tell me, what are the ways I can expedite at least try to do, the process? It seems like after received date, they are taking 4-5 months which I don’t have in hand. So I am really concerned.
    Also is there any possibility that my h1b petition can be filed based on the j1 waiver application received status( if not then which status of j1 waiver, can h1b be filed) so that I can at least legally stay in USA?

      1. Your CGI in US
      2. The RPO that issued your passport/or rpo that falls under ur current residence

    I have a question that i am in the states on a J1 exchange visitor visa which is valid until december and i am currently in my last semester of undergrad and now i want to apply for masters degree and change my status to F1.I am also subjected to 212(e) . Should i also need a j1 to adjust my status to F1 because some website it requires and USCIS webiste does not mention F1 in waiver category what should i do please reply

    Hi Jitender, Thanks for the informative video. I am in the fourth year of J1 visa. I want to apply for J1 waiver but my visa is expired. It got expired in Dec 2018. I have DS-2019 valid until Dec 2021. Unfortunately do you pandemic I am unable to travel to India and get visa renewed. Do you think I can start J1 waiver with expired visa and valid DS-2019 or I cannot apply at all? Please let me know what you think.

    hello Jitendra, one question your certificate was issued in September 2017 from India, but CGI Atlanta document was issued on June 29, 2018, does it take this much time to go for this process in US after we submit everything to SF office?

      In general yes. I got mine in 3.5 month. Know a friend who got in less than 3 months. Be safe and keep 4 months time in hand, sometimes consulate can cause some hiccups.

One quick question myself and my daughter are on J2 dependent Visa , so we also have to take a waiver or it’s just the Primary J 1 has to take ? Kindly share your opinion and thoughts . Best regards

      @Sanjeev- Just the primary Applicant. Once your wife gets the waiver, you and your daughter will get the waiver by default.

    Thanks for your great explanation. I have a 2 year residency rule and I am currently in my F1 visa ( 3 semester of my Masters). When do think the correct time to start the process. I don't have a job
    company to sponsor my H1B (not yet at least). Any leads is much appreciated.

      If you are on F1 or OPT, you can apply for J1 waiver asap. Don’t delay a day as its a very slow process (may take about an year or more). Ideally you have it before adjustment of status of a new visa (H1B, Card etc).
      Thankfully you may have extra time if you work on opt (3 yrs).

    Hi Jitendra , An update - These days MHRD is not issuing the NORI certificate within 10 days. It is over a month and I am still waiting. I found the same situation with some recent applicants. If there are more people like me, please comment below.

      @@JitendraPant7 it is time to simplify this process altogether . Having a single electronic submission for stage 2 with a common standard procedure for all (regardless of their state of origin or the country where they are living) . May be some scientists should come forward and talk to the government to amend the existing procedure. In the past once people get the waiver done , they just move on with their life . Now people are coming forward atleast . Such complex procedures are only hurting our country in the long term .

    Hi Jitendra, Thanks for the super helpful video. I am currently waiting for the waiver to come. DOS received NOC on July 12, but nothing from them yet. I had one question on next steps post getting J1 waiver? Can one still travel to India and get J1 stamped to use for getting back in US, if the current J1 is valid till next year?

      Unless you have got the waiver you can travel and get J1 stamps! However in your case since you got the notice from the DoS, there is a risk and depending on how the immigration officer at the Airport navigates the situation your entry can be denied even if you get the visa stamp! Also traveling is risky at the moment, I would advice switching to another visa (if possible) and travel after November once the travel restrictions and NIE requirements are dismissed!

      You can send a cover letter (its not mandatory). In my case I did send a cover letter to list all the docs that I was sending.

      U don’t need that. But you need third party barcode which has statement of waiver. So have that along with NORIs

    Hi Jitendra, Thanks for sharing complete details. I am also applying for the waiver procedure and have received three NoCs from home country. I am filling up DS-3035 and I am unable to generate the summary packet. I tried several times with different browsers and computers too, it showing application error. Display packet link is not working. Do you have any idea how to go about it? I tried approaching DoS but was not helpful.

      1. Did u try “enabling cookies” ?

      Online thing does not work. But u will receive letters from every step as ur case will move forward including when DoD received your request from Indian Consulate by DoS and j1 waiver division in St Louis. Ultimately you will receive i-767c and i767. It takes 3-4 months overall. But its pretty streamlines so nothing to worry about.
