      Leave it to the feds!
      It sounds difficult but after a bit of training on it it is quite simple and has a great job of catching and tracking positive tested drivers, and keeping our roads just a bit safer!

    I just took over Driver Qual- files for my new company. Small carrier, less than 20 drivers. The prior custodians did do the D & A background checks. Should I submit those after the fact? Thank you

    What about a drug or alcohol violation Pre-Clearing House was created. Or failed pre-employment drug test is that still a concern to be reported to employer or the Clearing 🏠 House....?

      Great question! If the test was prior to 1-6-2020 (Start of FMCSA Clearinghouse) the test will not be reported to the Clearinghouse and will not be tracked by the clearinghouse. The only tests that are tracked and reported are positive DOT Alcohol or DOT Drug tests that happened on or after 1-6-2020.

    Does this only apply for testing AFTER getting a CDL? Or will it be able to see refusals from a factory job?

      The FMCSA Clearing house only applies if it is a DOT regulated test. So a refusal from anything non-DOT will not appear on the clearing house.

      Thank for the question, the FMCSA mandated the Owner Operator must have a Third Party Service Provider to manage the D&A Testing Program and Clearinghouse obligations.

      How do owner-operators meet their Clearinghouse obligations?
      An owner-operator (an employer who employs himself or herself as a CDL driver, typically a single-driver operation) is subject to the requirements pertaining to employers as well as those pertaining to drivers. Under the Clearinghouse final rule, an employer who employs himself or herself as a CDL driver must designate a consortium/third-party administrator (C/TPA) to comply with the employer’s Clearinghouse reporting requirements (§ 382.705(b)(6)).

      It's a nightmare. They will random you for breath analysis as well as drug tests.
      They are doubling up on these drug tests.
      Most accidents come from lack of sleep not drugs.

    Can a pre employment drug screen refusal be reported after 4 months?

      It's reported on your record in less than 24hrs.
      I refused an observation for a pre-employment & they put it on my clearinghouse.
      It's going to cost me around 6k in the next 5yrs. I never failed 1 test in 20yrs.
      This is the biggest scam since I have been driving.

      It is supposed to be reported within three days. But if someone messed up and failed to report it. They would probably report it late. I would also imagine they are in deep trouble for failing to report.

      Travis, seeing all your comments, I understand you are upset about your situation. I'm sorry to hear you are going through this. If only you wouldn't have refused... If you've been driving for over 20 years, you should have known better. You cannot refuse without facing the consequences. This is not a new rule, the only thing that's new is how they track the drivers who violate the Drug & Alcohol Prohibitions. Everyone knows a refusal is the same as a positive test. Why on earth did you refuse? If its a messed up Pre-Employment test you might be able to challenge the refusal... Have you reached out to us for help?

    Does this play a factor if you had a DWI in your personal vehicle? Would that be something that would pop up on this?

      No, a DWI will affect your CDL but not the FMCSA Clearinghouse. The only tests that are in the FMCSA Clearinghouse are the Pre-employment, Random, Post Accident, Reasonable Suspicion, Return to duty, and Followup tests that are positive. Additionally, refusals to any of these tests are also reported.

      @@d.o.t.university1422 I am getting a lawyer for the pre employment…I had stopped smoking 6 month prior to to getting my cdl and the first company I went for orientation did pre employment test but did never mention of failed it would affect ur clearinghouse and I wasn’t even signed up for clearinghouse at the time

    So a driver can just let the 24hrs expire, be removed from the clearinghouse and then just get added back on?

    Registration is difficult. I've been working on it now 3 months. Even the phone operators don't know what's going on.
    So far I've only lost 2 jobs because I can't register.
    Another government gridlock.

      Registration for the FMCSA Clearinghouse? Yes if the account is locked out it can be a difficult process. But there is a process for getting it up and running. I did a video on that a while back.

      But it doesn't work that way.
      You have to start all over again.
      What a serious stupid way to do business.

      It appears some trucking companies are not cooperating with FMCSA.

      As an owner operator you can as long as you have a 3rd party administrator for to C/TPA.

    My job already does random drug testing. Can the clearing house reach out to me or my job to have me take a random piss test?

      No the Clearinghouse doesn't do test request. It is a positive test data base.

      If the failed test is entered in the FMCSA Clearinghouse, yes that will know.

      It's racketeering... Big money grab... Completely illegal to suspend ones CDL for a failed pre employment drug test...
