  • The CSIS China Power Project is pleased to host a public discussion with Ambassador Cui Tiankai, Ambassador of the People’s Republic of China to the United States. Coming hours after a tribunal at the Permanent Court of Arbitration will issue its verdict on Chinese claims in the South China Sea, Ambassador Cui will discuss China’s perspective on the award and the future of the South China Sea disputes.
    Ambassador Cui was appointed as ambassador to the United States in 2013. A career diplomat, he served previously as vice foreign minister from 2009 to 2013 and before that as ambassador to Japan from 2007 to 2009. He is a graduate of Johns Hopkins University.

    You can’t possibly say that those Islands and Reef belongs to you since distance wise China is way far away from those Islands and you can’t enforce a rule that you own the whole China Sea. Each Country has its own international boundary. The reality is China has become powerful militarily and economically that it’s now flexing its muscle to occupy the whole China Sea. Territorial disputes started only when China started occupying Islands that don’t belong to them.

    Lets be clear here, the line of questioning by all the audience is weak. Not one of them asked this guy any tough questions, like about the arbitration court finding the island building and militarization of such illegal. No one asked the ambassador about the destabilizing affect on the region of such illegal Chinese action. The QC Bonnie was a joke, and quite clearly out of league on this. She didn't impart any fear into this ambassador what so ever. She had no control, that guy owned her. No one pointed out that China had indeed consented by default to a process of arbitration by being a signee of the UN international law of the sea. The whole reason why China did not agree to the arbitration process is because they know what they are doing is wrong, they knew no international court could possibly rule in their favor, hence the no public acknowledgement of the ruling. Again such question should have been asked. China is the bad guy here, they know it, and they know they are trying to pull the wool over the eyes of the rest of the world, while at the same time trying to legitimize their actions in the eyes of their own people that they rule.

    China don't want to obey the arbitration ruling and international law (UNCLOS) because of China's gov't greediness. UNCLOS was approved and signed by almost all nations to include the Phils. and greedy China purposely to avoid misunderstanding between nations. Imagine, what will happen if a nation has no laws and rules to follow. Mr. Ambassador, even in China you have also laws and rules to follow, and if one of your citizen broke the law, you punished him. It is necessary for China to obey international law (UNCLOS) to get the respect of international community and have peace and stability in WPS and SCS.

    that claim line is crazy, it's a total take over of international waters. I am not American, or pro American in any way but that claim is crazy, it's as if I started parking my car in the middle of the street in front of my house and claimed it as part of my front yard. I do know countries have to do this kind of stuff all the time regardless of whether it's fair or not.

      China had a long history sailing the seas, Chinese stated that they were the first people to discover those islands, they weren't completely wrong.

      The Argentinian Navy video of the sinking was great! Quick note: China has over 3000 long distance fishing vessels that can stay at sea for months. These ships are illegally fishing and plundering resources in African waters. Small nations don't have the money for good naval vessels and the Chinese take full advantage.

    As per unclos, south china sea is an international water that no country can claim of ownership. It is actually owned by global community and every country has interest at stake on it. As an international water, it must not be under any country's control and impose restriction and must be free for any country' navigational used.

    The arbitration is exclusively between Philippines and China, yet Cui Tianksi avoided mentioning the Philippines in his entire remark but rather concentrated on the United States which had no participation in the arbitration. Surely Cui did not cover the fact that Philippines did not sue for sovereignty or territorial dispute. The Philippines sued for the validity of the 9 dash line breaching the Philippines' 200 mile EEZ and the environmental damage that China caused on the marine life. China further aggravated the Filipino fishermen's economic difficulty by blocking them from their traditional fishing areas within the EEZ. China is abusive and does not want peace. Cui represents what China really is. Talking one thing but doing the opposite.

    The UN Charter & rules of law have no implementing mechanism that encourages China not to abide by the Laws & Sea Codes adopted by every UN member States. NATO including US allies from South East Asia have decided to coordinate military efforts to force China to comply with the rule of law.

      I am not sure which international court gives fair judgement for China. In UN has power. II do not believe in any territory dispute , it is not matter of legal or ilegal. If you can be more benefit from international law, you follow. But If it does hurt you, you ignore it. Many countries do.     NO COUNTRY accepts the "Nine dash line" in the South China Sea ILLEGALLY claimed by China as its own territorial waters. As far as China is concerned, "might is right" and use of economic and military pressure is necessary in dealing with justice and its relations with other countries. And even if it is a signatory to the UNCLOS, it does not follow its provisions/regulations by ignoring the EEZ of its neighboring countries. It imposes its own rules as a superpower, regardless of whether they are inimical to other countries' legal rights and national interests. China has become a big pariah country in the world.

    You have been mentioning often International Law but which do you think is in authority of International Law, is it China or the United Nations particularly UNCLOS, yet you defy and violates the provisions of the UN Convention on the Law of the Sea by encroaching on the Territorial and EEZ of other Nations, this is non-negotiable.

It's written in Putonghua, the standard method of rendering Chinese into Roman letters, and in that system the letter C is pronounced pretty much TS. The guy's name is Tsui, and in many Chinese regions this comes out close to Tswei or Tsway. But hard K is pretty much the only way of getting it completely wrong.

    The Permanent Court of Arbitration (PCA) is not UN agency and it is definitely not a judicial branch of the UN. court. According to Wiki, it is merely an organiser of arbitral tribunals to resolve conflicts between member states, international organizations, or private parties. Its ruling is neither legal binding nor representative of UN mandate. Don't know why mass media is paying so much attention to such rulings... unless they are politically motivated.

      My understanding is although all those islands and rifts are far away from China, but traditionally considered as Chinese. I supposed it was so until around 1970's. And as fishing grounds, until then they were open to all the surrounding nations' fishermen and there was peace and order in the region.. Off and on there were cases of others' marines personnel that disrupted the fishing works of the Chinese. There was a big case a few years ago where the Philippines marine police shot and killed Taiwanese fishermen.
      Basically, I gathered that the Chinese maintained they are the title holder based on historical chronologies, but willing to share development and of course profit. Remember, those days in the 60-70's, China was not better than any one of her neighbors, safely said. I presumed the idea was targeting Japan at that time.
      I believe this option is still standing, since this was the initial intention and if China were able to officially preserved her sovereignty, I think the China would more than happy to agree.

    What the hell the so-called “nine-dash line”. There is no legal basis in international law and the law of the sea. All maritime boundaries are drawn from the land or “land dominates the sea”. China will never be able to justify this imaginary line based on international law. It can only arguing as “historic right” which in UNCLOS historic right only applicable to the bay. Not in the middle of the sea. So that’s why the Ambassador did not touch upon the substantive matters of the issue, he and his government only explaining something procedural time and again.

    UNCLOS 298(4) gives any State Party the right to take to arbitration any matter even against a State Party which has made a declaration against that type of dispute. So China had no legal leg to stand on there. "Spirit of goodwill" could be held against China too. We see how China 'negotiates' its disputes. It must be embarrassing to be an ambassador for a nation which is behaving in such a way.
