- The CSIS Sumitro Chair for Southeast Asia Studies is pleased to host a Banyan Tree Leadership Forum featuring Antonio T. Carpio, Senior Associate Justice of the Supreme Court of the Philippines.
The lecture will discuss China’s nine-dash line claim as the root cause of the South China Sea disputes, and show how it encroaches on the maritime zones of other coastal states. It will argue that the recent creation by China of artificial islands in the Spratlys is part of a design by China to control the South China Sea for economic and military purposes. The lecture will explain how the nine-dash line claim, and the activities by China to enforce it, violate the United Nations Convention on the Law of the Sea (UNCLOS) and threaten peace, security, and stability in the region. The lecture will argue that the nine-dash line claim has no historical basis and that throughout Chinese history, the southernmost territory of China has been Hainan Island. The lecture will suggest a possible resolution of the dispute whereby China would return to the original intent of the 1947 nine-dash line, articulated by President Ma Ying-Jeou of Taiwan, as a claim to islands and their maritime zones that are recognized under international law.
Justice Carpio studied law at the University of the Philippines’ College of Law, and was admitted to the bar in 1975. He immediately went into private practice, establishing Carpio Villaraza and Cruz LLP. In 1992, Justice Carpio was appointed Chief Presidential Legal Counsel in the Office of the President of the Philippines, and on October 26, 2001, he was sworn in as a member of the Supreme Court of the Philippines. Justice Carpio has received the Presidential Medal of Merit, the Outstanding Achievement in Law Award from the Ateneo de Manila Alumni Association, and an honorary Doctorate of Laws from Ateneo de Davao University.
Former Justice Antonio Carpio gives has given a refreshing and expansive comprehensive historical factual explanation of the South China Sea. This must be used in the junior, seniors and college education for cultural information and interpretation, critical analyses, understanding and appreciation - with geographical videos. Justice Carpio must be our future ambassador for such a compelling basis in approaching the solution on this contentious "perceptions" of one continent of a nation as against small nations world over! Masisi natin si PRRD kung meron talaga tayo sapat na mga armas at hindi nya ginamit para labanan ang China kaso mo wala sa kalingkingan armas natin na alam natin matatalo lang at kawawa mga Pilipino.Yung ibang bansa sa Asya hindi makihimasok sa problema natin dahil may sarili din silang approach na kanila. Magaling lang sa salita si Carpio pero deep inside alam nya wala din magawa Pilipinas sa matagal na problema dyan.

No one person has the authority to hand over to china, a foreign country even an inch of the Philippine territory without full knowledge and the expressed authority from the nation because SOVEREIGNTY BELONGS TO AND RESIDES IN THE PEOPLE AND ALL GOVT AUTHORITY EMANATES FROM THE PEOPLE! We love his persistence but the issue is. The US and the UN has no political power to say to china move. So what would you do? Be a target of china while others are safely on the background? The scary tactic China can do is economic attack. Its all talk, show of force but no movement. Majority of the UN don't want to be on the bad side of China. If you can convince majority of the UN to protest. You might be able to let China think the risk of pursuing further land and sea grab. Its like they are not thinking ahead.

1. The question, "what would the United States (US) gov't needs to do?". I like the way Mr. Carpio answered the question relying on the context of the law. The question is tricky, why would you ask what needs to be done by the US when you're talking to the Philippines (PH) that has its own sovereignty. "PH has no power to direct US on what to do". It was been said that they'll stand neutral on the issue reason why it was brought to UNCLOS to direct every country to help the PH.
2. The question, "do we have any last options?". Unfortunately it "seems" none on Mr. Carpio's statement . Since other countries don't find ways to pressure and cripple China's economic on its incompliance of the international law. The UNCLOS is bullsh*t. Even if there's freedom of navigation it wouldn't hurt China at all. The guy who asked the question seems wanted to reopen the US military base in the PH. It's also what the American reporters/ US wanted to hear.
The consideration of reopening a US military base in the PH needs to be oversee and importantly would require the Executive and Solons position of the matter. To allow a foreign army unto your shore is like surrendering.
However, for me I'd wanted to reopen the US military base as an expansion of the Mutual Defense Treaty and with certain conditions. 1) No payment will be done by the PH to US. 2) All objectives will prioritize the PH. 3) Both parties will fund the development of the military base but all asset will be owned by the PH. 4) US Military aid will be deployed to safeguard our EXTERNAL ISLANDS AND SEAS ONLY. 5) All assets that will be gain from any exploration on the islands or our seas will be given to the PH. 6) US may invest on the exploration but under PH supervisions and approval.
US molded PH to be reliant to them in terms of Military. So, whether Filipinos like it or not they need US. They're busy helping Germany and Japan after the WWII instead of helping the PH where it was the most devastated after Warsaw, Poland. So, you can't blame why PH has no stronghold in terms of Militarization.

This happens 2015, no ruling yet, all of what he said is true, what is intriguing is what he did not say. He did not say that he is a member of the advisory panel of that administration that file the case. He did this primarily to get sympathy from everybody and that is ok. What is not ok is that most of the structures were built during that admin.,not a sigle one was built during this current admin.,further he did not say that the soil used in constructions came from the Phil.He admitted that we do not have the military capability to opposed and also we can not rely on the US unless we are attack..in the UNCLOS there is a provision in case of a dispute we may elect to a compulsory arbitration which we opted out during ratification and china likewise so it became voluntary, that is why china just ignore the ruling..we all knew force is the only thing that china respect. Currently he is faulting the President about this problem which he know absolutely started in the past admin. That is why his moves now is highly suspected to be politically motivated.
