Mort, like I commented on your last video. Copart has done us like this 3 times. All 3 times we fought them and all 3 times the court found them liable and responsible for all fees and charges associated with the arrest and impound. The court ruled that Copart was supposed to have everything in order before selling a vehicle. So don't let this go. We stopped dealing with them and only buy from Manheim here in Statesville NC. I wish you the best man.
Carvana really exemplified this type of a problem as well and made it very public as it affected direct consumers. Like plenty of stories of women buy a car off of Carvana and get pulled over and charge with a stolen vehicle.

Thanks for the PSA so people know what to do to ensure this doesn't happen to them . Sucks to pay $1400 in fees and that doesn't include making sure it's not on the stolen vehicle list .
I have seven vehicles insured with Hagerty insurance for years and they have always been a great company for me ,I have to believe they will do the right thing. You have handled this whole situation and video in a very professional manner .

I've purchased theft recovery cars from RepairableVehicles in Harrisburg SD. Never occurred to me that the cars weren't cleared from police database. Thanks for the info!
I dealt with Copart when I ran a shop for Yellow Freight. They could mess up a two car funeral. They would sell units and "forget" to send us a check, they would have units on hand for long periods of time and "forget" they had it. Generally they were a nightmare to deal with.
My dad and I can't register with them while having a car lot due to them demanding documents of incorporation when the business is set up as sole proprietor in my state and even trying to explain this to the nutjobs they demand documents we dont got
We sold several cars through them when we cleaned up our lot. We ended up owing them money on several of them because they sold them for less than the auction fee.
Having also been falsely arrested and drug out of Calculus 2 in college I can wholeheartedly agree that it sticks with you and it sucks having to tell the story over and over again. Hopefully you can get your record expunged, lawyer will help with that for sure! Love your channel keep up the great work!
A lawyer should be able to get Mortske's criminal record expunged, meaning that ALL of Mortske's personal information, mugshots, fingerprints etc should be removed from ALL police agency databases. Copart/Haggerty should be financially responsible for the legal fees to accomplish this end! I suggest that Mortske or his legal counsel should contact the recent President elect with regard to this matter, I'm sure that he would have considerable empathy with Mortske's legal circumstances.
@@bobdirt1312 They just 'seal' the record, which means nothing but a request to the judge to unseal it should you ever come to their attention again. Once they get the information or put a person in the system it never goes away.
Im an OTR trucker, I NEVER travel highway 54, I’m in fact sure I’d never been through there. But this week I traveled from Albuquerque to the Kansas City area. I passed the abandoned station where you worked on your truck in Mondays video. Kingman KS I believe.
Having bought many many Copart and other auction cars as part of my full time gig (a bunch from OKC). Heres what I would suggest from now on be implemented into the auction system -- On theft recovery vehicles i think a separate form needs to come into play releasing the vehicles VIN from the NCIC system, almost like a lien release and be notarized and signed as part of the auction paper work given to the buyer. Im watching this situation very closely because I intentionally seek out theft recovered vehicles at auction as part of my business, they have been quite profitable for the time spent repairing them. The last thing I would ever want is one of my customers to find themselves in this type of situation, that would end my good reputation as well. I also wouldnt want myself in the same situation, I dont have a record and would be VERY unforgiving to any company that dropped the ball and put me there.
Mortske, I’m retired Law enforcement and the city agency that neglected to remove that truck from the stolen list is the culprit here. Get em! No excuse for something so simple as removing a recovered stolen from the system. Sorry you had to go through that buddy. As far as the Officer that arrested you, I understand how he may simply not have the time to do further investigation for you from a manpower view point. I can tell you under the circumstances at my agency I’m retired from they could have called the District Attorney’s office and asked for them to submit the case instead of arresting you. Now I’m in a different state so 🤷♂️
I'm also a Retired Officer and a Special Investigator for the County P.A. and the responsibility just doesn't end with the City/County Agency. Haggerty and Co-Part SHOULD have called them ensure that it was taken off and Co-Part shouldn't have listed nor sold the vehicle until they had conformed it was taking off the SVL.
Sounds to me like multiple suits need to be filed and some restitution and all court and lawyer fees to be paid for by co-part/ haggerty, and the local agency that was in charge of the investigation/ recovery of said vehicle.
Hope all is well no matter how long you talk. I’ll still watch your videos. You’re the type of person that makes everybody feel like they’re watching a part of the their own family. Good luck to you.

I was one of the guys who thought if you had just had paperwork you would have been fine. Man was I wrong! I'm so sorry that you went through that. I honestly hope things work out for you and that you are made right ( at least financially) after all is said and done.
Says a lot about the common sense the police officer have to arrest you as you hold a bill of sale from the auction. I’d sue them if I had the paperwork and they still falsely arrested me. You can’t blindly trust a database when common sense says the database is wrong.
Appreciate the video. You’re a stand up dude. We all love you man. We all feel connected to you for the small glimpse you give us into your life. We got your back. God is good! Glad we got 47! Looking forward to the giveaway on this truck.

wow. thanks for the upload sir! Sorry you got mixed up in this mess sir! Sounds to me like copart and whomever insurance companies they work with should be responsible for eliminating these kind of problems.
Feel your pain and frustration there Sir Morticus. I was arrested for possession of a stolen vehicle. It was my vehicle that i reported stolen a month earlier to my town police. Car was recovered in my town, insurance company called me to pick it up at a tow yard in my town, tow yard had my name on their list from the insurance company to pick it up, i had the title with me. two blocks from home, pulled over and arrested. Like you said, no amount of paperwork would have got you out of it. I had the title in my name, insurance card listing the car on my insurance, receipt from the tow yard. Still spent 6 hours in jail.
Maybe the cops choose not to use their discretion in situations like this because a "felony arrest" looks good on their records (Gold Star ⭐) and they don't really care that it's at the expense of yours??? He was smart too! He pretended to be your friend to try and avoid any direct complaint about himself! ("Oh, I'm so sorry! My hands are tied and I'm duty bound to arrest you and take you to jail for this serious felony!") 👮🏽♂🐷 Are cops automatons?? Do they have any discretion?? He could have looked at the abundantly clear evidence Mortske had on him, made sure he had insurance, understood the situation and let him get home to sort the issue out with the slack assed 'Copart' and 'Haughton Police Dept'!!! What a waste of tax payer's money, Mortske's time and money, Joe's time and money not to mention the unnecessary trauma and great embarassment caused to a law abiding citizen!
This information is actually helpful for anyone such as myself who is a car/ truck hobbyist. Over the course of the years I've ended up with some cars/ trucks without titles. Mostly parts vehicles. I'll be looking up everything from now on. Thanks for sharing this.
So sorry this has happened to you, my wife and I are huge fans and love watching you, keep your chin up, sending you lots of love and prayers from us all over here in England x

Feel your pain. I had an issue with my license back in 04'. Cost me 500-ish bills to get them back and shorty afterward got pulled over (in my pimped out 87 Monte Carlo Ls lowrider), deputy said my DL's came back suspended and i had a warrant. My mom had to take my pregnant girlfriend, her son, my niece and GF's cousin back home because i got arrested. Got released that night on a $500 bond, had to miss work the next day to go 40 miles out my way out get a copy of my driving record and deal with the sheriff dept over the warrant (which they said never was one). A month later went to court date stated on my paper work just to find i wasnt on the docket (found that out when the judge got done with the last case and i was still there). Judge ask if anyone had my driving record (which was a big no), handed him my copy which he looked at and immediately said dismissed, cause their wasnt ever a warrant and my license was good. I got all the bond exceot for jail fee which i should've been in the 1st place
As a reired Sergeant from a Sheriff's Office your right on all your information! NCIC and others it can be hard to clear warrants and other things. If a person comes in on a warrant and the Judge releases the individual on that warrant (s) I had to make sure it was cleared before they were released from custody. I'm glad your doing better and are finding out what went wrong.
Hello Hello From Canada!!! I felt literally sick when I saw the title of this episode and I'm glad to see you doing well. If that cop who pulled you over was an inexperienced rookie, he could have friggin shot you if he panicked about pulling over a stolen car. That could have been so very horrible for you if the situation all went south. It was a blessing that the officer you encountered was so professional and you were arrested in an area that your good friend could come to help. Anywhere along your way traveling home, one of the many other county's cops that you passed through, could have pulled you over and everything could have been a complete debacle. You should take all the parties who dropped the ball in this to court and kick their asses for letting this happen to you. I know it was traumatic for you but it wasn't just bad luck or chance that this happened and you got it on tape. The only way to make them ""Fix This"" and put some real safeguards in place so that this stops happening, is for you to hit them hard in court. Then when you get guidance from a lawyer about publicizing this, you are able to reach out to ask your viewers, how many other people suffered similar cases of this happening. Because your a popular youtuber, but "only after you talk to a lawyer", you can ask people who also had this happen, to message the links you've given us and their other favorite youtubers , to really show that enough is enough. You should also message as many of your fellow youtubers, like Cleetus Mcfarland and Derek Bieri @ VGG to warn them because this can happen to them in the future if the procedures don't get fixed. I hope that you and all those near or dear to you, stay safe, stay healthy and are as happy as you can possibly be in everything you do in the future. 🤘😁👍 P.S. That last line goes out to all your youtube friends and devoted fans who watch you as well.
I can tell you that I went through a similar situation. Bought a cool little S10 square body, 5speed V6 through Public Surplus. Had been gifted to a school. Had a title, which was provided to me. Went to DMV with the truck in Casa Grande Arizona. They informed me the truck was listed in Phoenix, from about 5 years before the current title was issued. Long story short, CGPD came out, inspected the vehicle...called PPD a few times, who finally admitted it was their fault because it was listed as recovered, but they never pulled it out of the system. Will probably never get rid of it now, just because of the story. All that to say this...I feel your pain!
I used to run the scale at a junkyard, and I used to buy vehicles from IAA and Copart quite a bit. I've had a couple come back funny, but it always gets cleared up quickly. There is usually a paperwork snafu somewhere, or it is a domestic situation where one partner got mad at the other and reported the car stolen. It's a pain in the butt, but I never got into any legal trouble over it. We would always run them through the system and immediately self report if there was any issue with the paperwork on them. You should move to Tennessee. With our title laws, possession is nine tenths of the law when it comes to classic cars.

@@christophers.4007 Nope, he is not wrong. My wife's car was stolen but we got it back later that same day. She was arrested dropping off the kids at school about a month later for possession of a stolen vehicle. It stays on your record and there is no way to get it off. She's a Dr. and when she got her license she had to report the arrest and provide documentation it was dismissed. It won't come up in a general background check, but it will come up in whatever background check they do for Dr's, lawyers, anything that requires a security clearance.
Copart: Where you pay Barrett-Jackson prices for junk. An auction is a place where you compete with others to see who will pay the most for something. I want to pay the least for something. When I was a kid, I thought "If I could just have access to dealer & salvage auctions, I could make a fortune!". Then I became friends with a guy who had a dealer's license and he took me to some auctions. I immediately discovered that I could do far better buying cars from the classifieds....
Thank you for your videos, and I'm sorry you had to go through that. During the arrest your true character showed. You were a gentleman throughout the entire terrible circumstance, and were very respectful to the officer and everyone involved. I wish I could have the same composure as you in that same situation. You are a great role model!
Great video brother i emailed everyone on your list and told them they need to fix this problem for you and where it wouldn't happen to know one else and prayers for the family that hand the house burnt down love you Brother keep them coming 👍
We love ya Mr. Mortske. To be completely honest, I thought this whole situation was a joke until the video on the main channel rollled out. Sheesh. Hope that never happens again lol
It was explained to me. By an Officer. The police only have facts to go by. They weren't there when you bought the truck. And I guess Lawton Police were the lacking party in clearing a automobile that they send to Copart. Glad you exposed Copart as I too have looked for some deals there. Crap Companies never change.
The fact that he showed the officer emails confirming that he bought the truck at auction was enough that an investigation should have been conducted to verify his side of the story and released pending further investigation. The truck should have towed, there's no getting around that. They know who he is and have all of his information. Heck his life is out on TH-cam. If the investigation revealed that Mortske in fact stole the truck, an at large warrant for his arrest could have been issued afterwards. You don't arrest someone when you have a pretty good idea that they're innocent, especially for a clerical mistake because you have discretion as an officer to investigate first and arrest later. If investigation shows probable cause that he committed the crime, arrest him later. Now he's stuck with an arrest record for absolutely nothing he did wrong.
As a 19 year veteran police officer/detective in a major city I would not have arrested you and or seized the vehicle. Based on the totality of circumstances I could have determined you hadn't committed a crime and the vehicle slipped through cracks with NCIC. It happens.
Whoever told you that they don't run the VIN when your register a vehicle is lying to you. It has to be checked on NCIC. Their system will not let them assign a new title to someone if it comes back stolen.
They check it in New York; I worked with a guy years ago who bought a car and when he went to register it they told him it was stolen. They made him turn it in to the NYPD and the police questioned him.
Glad you have found a good friend and an extension of family in Puddin et al in Oklahoma. Finding a good church is a great thing, and I'm glad for that also. Keep doing what you do, and I wish you well.
You're a good man, helping those people. It's cool seeing the other side of Ol Mortske. Also, if I win that beautiful machine, I'm naming it "Stolen Thunder." Glad you're home safe and sound.
Thank you for sharing Mortske. I saw the video on the other channel hoping it wasn’t true, but you did get in back of a police car. I can tell you are shaken by the whole experience still a week later. Hopefully you can find justice with Copart and or the insurance company.
Mortske I just fired off an email to hagerty they need to make you whole. I’m so tired of people not doing their job oh it slipped through the cracks. Again so sorry for your troubles. Thanks John from Arizona
Dang Mortske, thanks for sharing, hoping it helps others too. Way to lay it all out there. Props for keeping your cool. In the moment and while going over it/reliving it.
Hey Mortske, I've worked for Minnehaha s.o. for a while now and seen guys in your situation a time or 2. Miserable situation. u are correct, there is no way of getting around what happened other than the initiating agency doing their job. Appreciate the level approach u have to this situation. Being booked brings out the worse in most people and u handled it like a gentleman. Very much appreciate your content! Keep up the great work!
Mr Mortski, you should never have been arrested by that policeman in the first place. Whatever happened to common sense? It was clear you were innocent by your openness, manner and actions because if you had been guilty you would have had to be one amazing actor. My thoughts from the UK.
Mort, I am a recently retired Major from a Sheriff’s Office. You can get this removed from your record. I have personally dealt with incidents like this before. You committed no crime, no crime occurred so this can be removed. It is the responsibility of the arresting agency. I would start with the Records Dept. Having the vehicle removed is the responsibility of the owner, Haggerty. If they didn’t report this to the entering agency it’s on them. If they did it’s on the original entering LE agency. If you showed proof of the sale on your phone, we as LE are bound to look into that info prior to formal arrest so not to arrest an innocent person. That’s also why agency’s have detectives.
Once an arrest is expunged, it’s generally removed from your public record, which means most employers, landlords, and others won’t be able to see it. However, an expunged arrest may still be visible to certain government agencies or law enforcement under specific circumstances. For example, expungement will not remove the record for high-level security checks, especially those related to federal agencies.
The arrest will never come off your record. The only way... is to have a judge seal it. Make haggerty and copart pay for that. One day of your life and distress equals a good amount of pocket change. If you don't see movement in 30 days hire a lawyer. And go for big bucks. Props to chin and the circle of friends that was there for you.
Thank You , your video was done in true Mortske style, You are a gentleman and handle everything in a Professional manner with class and a calm demeanor . Some individuals might take a different approach , get hot headed and use language that is not befitting the situation , but that only makes the picture distorted and unfit to publish . You have stated the facts as they happened , straightforward , to the point with honesty and integrity . Once again ,Thank You ,I send this to you with a hope for much better days ahead . I love your presentations and wish you well , Stuart in Canada ..
The only way for sure to find out if a vehicle is stolen is to have a police department/sheriff check the vin. That insurance site you mentioned only has vehicles that have been paid off by the insurance company. So many vehicles that are stolen don't have full coverage or no insurance and they won't be on the list. It's one of my pet peeves is not allowing the public to check if a vehicle is stolen.
A NMVTIS check will show stolen and will also tell you if the title the seller is presenting to you is valid. NMVTIS shows the title number and date issued. Those should match if you have the current title.
@@markrandall1456 "NMVTIS is a program mandated by the DOJ to collect information from Departments of Motor Vehicles nationwide." DMV cannot tell you if a vehicle is stolen or not as I know from personal experience and as Mortske stated so if that's where NMVTIS gets their info from then they won't know either.
I had one of my trucks stolen in 1999. I reported it stolen. It was never recovered. I had only liability insurance so wasn't covered. I just signed up to one of NMVTIS approved sites and paid an introductory fee of $2.95 and ran the VIN. It didn't state that it was stolen. So, there's proof it doesn't work. Useless.
@@clunkersandclassicsyou pay for & get the NMVTIS online. You are correct. The BMV, DMV, DOR M, etc won’t tell you. But yes, NMVTIS will tell you if it’s stolen.
@@markrandall1456 The public can only access NMVTIS through one of their approved sites, which I just did. No mention of stolen or not. I just spent half on hour on their chat. Copart would be most liable civilly. They have in the past sold vehicles "stolen recovered" and caused other people grief. They have the obligation to NOT sell stolen property!!! Hagerty also should NOT have released the vehicle to be sold prior to having it removed from N.C.I.C. (National Crime Information Center). I hope you make a lot of lemonade out of this story. I dealt with Copart when I ran a shop for Yellow Freight. They could mess up a two car funeral. They would sell units and "forget" to send us a check, they would have units on hand for long periods of time and "forget" they had it. Generally they were a nightmare to deal with.
That’s unfortunate
My dad and I can't register with them while having a car lot due to them demanding documents of incorporation when the business is set up as sole proprietor in my state and even trying to explain this to the nutjobs they demand documents we dont got
Sounds like stealing cars from them would be profitable. They don't even know what they have or where it is.
Damn calculus!
Glad to hear you had a great experience at Jacob's church. ❤
That fellowship is greatly needed.
Absolutely
MONTREAL CANADA!! Just finished watching your video we’ve sent all three emails! Good luck and keep us posted!
Awesome thank you!
Im an OTR trucker, I NEVER travel highway 54, I’m in fact sure I’d never been through there. But this week I traveled from Albuquerque to the Kansas City area. I passed the abandoned station where you worked on your truck in Mondays video. Kingman KS I believe.
Thanks for sharing
I just wrote in the comments about this very subject of towns to avoid, but your comment was better.
I'm from Kingman. That used to be a convenience store called Sav-A-Trip.
I fully agree
@@moremortskerepair4354 NCIC Release Verification form. It needs to be a thing Copart!!! Im sure all transporters would agree as well.
I would sue their pants off co part should have checked to make sure it wasn't stolen.
@@moley4514 Haggerty also. Ultimately Co-Part is responsible for selling it but Haggerty is still responsible too.
Seriously Mortske, I would be freaked out and pissed for a while. God bless you. You are handling this like a gentleman.
You are dead on the law. I mean who hasn't watched COPS? Everyone on there is a lawyer till they are not.

@PortlandFleetService 💯
Appreciate the video. You’re a stand up dude. We all love you man. We all feel connected to you for the small glimpse you give us into your life. We got your back. God is good! Glad we got 47! Looking forward to the giveaway on this truck.

Thank you
Sucks that happened to you and I hope you get justice, thanks for sharing this and hope you never have to deal with this again
wow. thanks for the upload sir!
Sucks
I’m here to help
Once again, I'm sorry you went through such a traumatic event. I hope it doesn't plague you too much. Be well Mortske. Your fans stand with you.

Welcome aboard!
Thanks for the info
Sent a note to all three emails, Mortske. Hope it helps! Good luck getting your business settled!! F’ed up!
Awesome thank you!
🤘😁👍
Mortske you are the man, keep smiling.

That’s the bs part of this. It shouldn’t even show up in a case like this.
@@christophers.4007still shows and if not disclosed he’ll get asked about it. I know people with past arrests from 20 years ago and have to disclose.

We love ya Mr. Mortske. To be completely honest, I thought this whole situation was a joke until the video on the main channel rollled out. Sheesh. Hope that never happens again lol
Me yoo
Wow unbelievable! Thanks for sharing
Our pleasure
It is a wrenching experience emotionally, hang in there and we appreciate your sharing of the frustration.
Thank you, I will
As a 19 year veteran police officer/detective in a major city I would not have arrested you and or seized the vehicle. Based on the totality of circumstances I could have determined you hadn't committed a crime and the vehicle slipped through cracks with NCIC. It happens.
This is by far your best video! Dan at DD Speed Shop is proud!
Wow, thanks!
@moremortskerepair4354 I'm just messing with you, but I bet Dan did get a chuckle out of your misfortune.
Whoever told you that they don't run the VIN when your register a vehicle is lying to you. It has to be checked on NCIC. Their system will not let them assign a new title to someone if it comes back stolen.
No. It definitely does not in ND.
They check it in New York; I worked with a guy years ago who bought a car and when he went to register it they told him it was stolen. They made him turn it in to the NYPD and the police questioned him.
@@philohara8314 I confirmed and they do not check it with NCIC in ND

Hey Mortske, I've worked for Minnehaha s.o. for a while now and seen guys in your situation a time or 2. Miserable situation. u are correct, there is no way of getting around what happened other than the initiating agency doing their job. Appreciate the level approach u have to this situation. Being booked brings out the worse in most people and u handled it like a gentleman. Very much appreciate your content! Keep up the great work!
Thank you
Mr Mortski, you should never have been arrested by that policeman in the first place.
Their last message is: I apologize for any inconvenience. However, stolen vehicle is not yet part of the service we provide. I hope you understand.
Can I help you with anything else today?

I am a soldier in Korea currently and I watch TH-cam frequently to stay connected with home.
I recently came across a Mortske Repair video where he was arrested due to someone’s negligence. His record was spotless until this happened and now he has a vehicle theft on it because he bought one of your stolen vehicle recovery items from copart. This is an in justice and needs to be made right by the responsible party, which is you. Make him whole again without prejudice. I would be a big fan of anyone who does the right thing because it is so rare these days.

Thank you Mortske!! I will never do business with these companies if they dont try and make it right!! Also I'll be sure to spread the word! They did you dirty!!!
I really enjoy watching your content, keep it up.
