My youngest son was accused of assault by a girl at his work place after he would not go out with her. Local police investigated and said no evidence to support her claim so she went to Sherriff who did not investigate but arrested my son. All but one of the store managers ( some one had to run store ) showed up at court to be character witness for him. At court after son's lawyer talked to her lawyer charges were dropped on condition he took anger management class. Instructor said he did not need class and we needed more people like him. She later got arrested for murder and is now a guest of the state.

False accusations are evil and disgusting but the system fails because to every false accusations there are hundreds actual assaults that goes with a slap on the wrist especially in big cities without mentioning the many many assaults which go unreported. The problem is that SA is a pretty hard to prove crime at times, and with lack of evidence, a rapist could very well fight back against their victim and try to frame them to be making a false report. I 100% agree that making a false report is completely unjustified, and that people who do so should face justice too, but the fact of the matter is that SA and falsified reports of SA can be hard to prove.

@@AarushK007 You are thinking of it as a case of only two outcomes, when there are three possible outcomes.
If there is an accusation, then either the accused is guilty, or not. Which is two outcomes. And if you think like that, then the accuser is guilty if the accused is not guilty.
But there are three outcomes. Either the accusation is proven correct, and the accused is punished. Or the accuser is proven to have made it all up, and the accuser is punished. OR, neither can be proven and neither is punished.
As it currently is, we only got the accused being punished if proven guilty. What we need is that the accuser should be punished if proven guilty.
Yes, a rapist could fight back agaisnt their victim and try to frame them for a false report. But then again, a false report is a "victim" trying to frame an innocent, which you seem to disregard.

While I don't disagree in principle, that will never happen.
Let's look at the possible consequences for this girl (legally):
*I presume this is the U.S., though I may be wrong, but I'll operate under that assumption.
      • OP could sue her.
That will accomplish nothing. It'll just cost OP money. The girl is a minor child in the eyes of the state, she's in foster care and has no assets, so OP would not be awarded any money in a lawsuit, and even if he was, collecting would be damn near impossible. He would be responsible for his attorney fees and court costs and never see a penny from her. He'd just be throwing away more of his own money.
      • OP could file for a restraining order.
Under the circumstances, he'd likely get one, at least for 2 years. But the girl lives in a different city and her only link to OP is via his brother and his brother's girlfriend, and he's cut both of them off. OP won't realistically have any foreseeable contact with her anyway, so it's unnecessary, and at worst would only give her an opportunity to spread more lies and make more accusations (though that would be stupid of her). There's nothing to gain pursuing this. He's moving anyway at the end of his lease, just change his phone number and lock down social media (which he likely already has) and he's a ghost to 99% of people who might go looking for him. He won't have further contact with her.
      • Bring Criminal Charges.
OP can press charges, but "pressing" charges, just means you're asking for charges to be brought against her. Like "pressing" your boss for a raise, the answer may still be "no". Only the prosecutor in that jurisdiction can make that decision. OP has no say in this. And it sounds like the police dropped the ball on this one, and dredging up their mistakes in court in the same jurisdiction is going to create tension between the local police and the DA's office. That shouldn't matter, but it does. If she's being charged in another county, the DA would prefer it be handled there, by someone else who doesn't need to maintain a relationship with the local PD.
      • Criminal Charges Cont.
The only thing she could be charged with is making a falsified report to law enforcement and harassment. And again, she's a minor child in the eyes of the state, just another troubled foster care kid with a junkie mother and a father in the system. This will be a gentle slap on the wrist. Her record will be sealed anyway, and her attorney will likely advise her to plead no-contest in exchange for court-mandated therapy instead of an ankle monitor or juvenile detention. Perjury is off the table, she didn't swear under oath, nor would the state recognize her as competent to understand her rights in that regard, so if this goes to court, even with all the evidence, it's a coin-toss that the prosecution would even win, and they have bigger fish to fry, so they'll toss her an easy plea deal to put it behind them.
The sad truth is that there often isn't justice for victims. Sometimes you're just fucked. It's often best to just get up, dust yourself off and move on. It's not fair, but that's life. If the circumstances were a little bit different, OP might be in a more actionable position, in which case he should go for it. But you have to objectively measure what there is to be gained, and in this case, there's not much.
But you can usually trust in Karma. The girl comes from deadbeat parents, has a possible (yet unconfirmed) history of abuse, likely inherited addictive tendencies, run-ins with the law in multiple jurisdictions, is a documented liar whose future claims will be largely disregarded, and when she turns 18, her foster parents will stop getting support checks from the state, rendering her homeless, and her sister/sister's boyfriend are furious with her, so that bridge is burned. Mark my words, this girl will be hustling from the slimy side of a truck-stop glory hole before she turns 20. Her downward trajectory is already well-established, and she has no family for support. The universe has a way of catching up to these people one way or another. She will destroy herself, all society needs to do is step back and let her.

Lbr it's mostly down to the patriarchy, not the people making false allegations. Name one other crime where people react the same way. "Oh you got bit by a shark? Did you really or are you making false allegations? Cause 1% of people who say they got bit by a shark turn out to have willingly put their arm in the shark's mouth and asked it to chomp and then play victim" can you imagine? No. It's not the people making false allegations. Not that there's nothing wrong with false allegations but be honest it's not the false allegations it's the fact that men have all the power and do the majority of SA and want to keep that power and distance themselves from that wildly disproportionate percentile of crimes they commit so they switch the narrative to instead be about the 2% of men who are victims of false allegations rather than the 98% of women who are actually victimised. Statistically one in four women has been assaulted in her life and sa is underreported due to the treatment victims receive based on that overhyped statistic, meanwhile of all reported rapes, only 4.6 out of 1000 lead to incarceration and 2/12 of those will be falsely accused so if you ask me, I think the bigger issue is with the fact that 99.56% of assaults don't lead to incarcerations and not that something like 0.01% of sa allegations lead to false convictions.

@@sweeety969 The 2% number is complete bunk. The only source for it is Susan Brownmiller's "Against Our Will". A book, published in *1976* that got that number from a single sentence quoted from a judge's speech on the topic. Upon further inquiry the clerk that had helped prepare that speech could not remember how he ever got that number in the first place.
So not only is it almost 50 years old, there is not even any verifiable data behind it.
For anyone interested, look up: "The truth behind legal dominance feminism's 'Two percent false r**e claim' figure" by Edward Greer
A meta study done by the Cambridge University Law Journal in 2006 (simply called "False Allegations of R**e") looked at around 20 or so studies on the topic, with false allegations being defined as someone lying on purpose.
The results of those studies range all the way from 1.5% up to 90%. With both extremes being equally credible. As in, they had horrible sample sizes. Most of the studies however ranged somewhere between 10% and 20% (including the ones with better sample sizes).
Now it needs repeating: these are only the ones were it is known that somebody lied on purpose.
No one knows how high the real number is. And there are barely any studies done on the topic, as most papers simply default to quoting the bunk 2% number without any further scrutiny.
So, considering the veracity of your 2% number, your other numbers are probably equally great.
Also, the main thing keeping women from reporting is feminists constantly lying to them that they will never ever be believed and constantly dragged through the mud by horrible horrible police *men* and they should instead simply go on twitter and tell it to millions of strangers and anyone that dares question it, is simply a r**e apologist.

I feel really bad for OP, at least he has his sister as a good member in his family. Also why is OP's brother still with her? Did she cut her sister off after what she did? And yes, for the ones who didn't understan it wans't OP's SIL that made the false acusations, it was her sister. (Some comments didn't realize that) Anywas, if his brother is really sorry then he should pay OP's lawyer fees, make a public apologie and make the liar and criminal also do one and of his girlfriend still in contact with the liar/criminal he should break up, if not he is showing that he rather have a relationship with someone that is still in contact with someone who almost ruined his brother's life for a stupid truth or dare game. If he really wants to apologize then he needs to stand up for OP after he helped OP's life to almost be ruined, so that means do everything on his power to make it up for OP and break up with his girlfriend if necessary, as she's the sister of the people who almost ruined OP's life forever.
