If the dealer was that unscrupulous to sell a car without 5th gear, why would he offer a warranty on the vehicle knowing that it would immediately come back for repair? The buyer was willing to take the risk to save money and was probably willing to fix the car himself until he found out the cost. Personally I don't know why the customer did not immediately drive back to the dealer (in 4th gear) to return the vehicle, I would have (but then, "I" would have a warranty).

Re: the Yaris, one moral of the story is always give a car a full test drive including trying every gear! The quy got quite a chunk of money off a cheap car which should have rung some alarm bells but hard to believe the dealer didn't know about the gear box.
I think you are very right on this one James, if he knew what he was doing he should repair the car himself, and he could get a cheap gearbox and it will probably cost him £400 all in replacement box and fitting.

What you said about selling as spares and trailered away is correct I believe, so technically / legally the dealer is liable, but as you also said, morally and in fairness the buyer should pay up for repairs, quoted price of a grand is ridiculous it can be done for less,
I can see both sides. As a customer we always want the best price and will push to get a discount. But, you can't ask a trader to support the vehicle if you've removed their margin. Nothing is ever for free, every action has a reaction. He's got a great discount on a popular car. Don't understand why the trader moved so much, unless they perhaps did know that something was wrong. Can get parts and someone to fit them for a lot cheaper than quoted. He should ask the dealer to get the gearbox fixed within the trade and pay that. The dealer has given the guy a really good deal. The buyer is asking for far too much.
If all car dealers were as honest as you are ,what a lot of happy people there would be .I am sure a some of your buyers don’t listen to what you tell them,and what do they expect. If they want everything perfect they want to buy anew one . They would still have problems even with anew one .Some garages have the intention of ripping you off for just clear profit.

The BMW auto should not have self destructed within 3 months - full refund less mileage allowance The other one was issued with a new MOT with defective tyres -full refund or part ex returned + plus refund. It does not matter if a car is sold to a member of the public for only £500,a dealer is still liable under CRA 15 and dealer’s rarely win in the Small Claims Court-it is a peril for being a car dealer.
Exactly , BUT that's why it makes selling £500 cars completely impossible! The law is madness that a 100k new car falls under the same law as a £500 20 year old one. This is why these venerable customers with limited budget will be left buying with zero protection from driveways with no comeback. Australia and America have laws that distinguish on age and limit liabilities. A simply change to say 30 days on cars over 10 years 100k would allow people a decent level of protection and allow professionals who will still wish to maintain decent reputations and avoid courts to service customers within this budget.

My understanding of the CRA and short term right to reject is not that a customer can return a car for ANY reason. If, for example, an electric window motor failed after 2 weeks, taking into account the age, mileage and price paid, it would be seen as reasonable that the dealer could fix this. In other words, a car with a fault is not necessarily a faulty car. A distance sale does allow 14 days to return the car for ANY reason (in fact a reason doesn't even have to be given by the customer).
I think in this case the buyer will have to accept the loss, he did have a chance to drive before he bought it, and then he asked for the cheapest price which involved the loss of warranty aspart of the lowest price which he accepted.

Very interesting about the legality of trying to sell as a trade deal when your not in the trade. Eg a garage cannot, we were looking for a car for wife’s granddaughter and there was a cheap Peugeot sold as trade, lad was saying they had done various bits but there was a large damaged section on the windscreen near the top of a semi panoramic screen ( goes a lot further back) these are £1100 as I checked on a price. Not interested as not taking risk of anything else. She did buy an insignia explained needed to be reliable she has a 2 year old, first day it stopped while driving and restarted. I drive it and there was an unevenness in the running plus the gear lever was moving as though if it was being driven by a gear there were teeth missing. Took it back full refund boyfriend put a code reader into the port came up with lots of faults. I couldn’t believe the dealer was not check for codes on every car sold
If an invoice is marked "Trade Sale" and the buyer does point out that he isn't a trader would it be reasonable for the dealer to claim it actually was a trade sale? Was the BMW gearbox actually faulty and was the repair worth £2k (eg rather than replace the box) - one of those where it's best to get an independent check before coughing up money?
it was probably just a slipped gear linkage clip & the trans garage were trying to rip him off. Why would the dealer try to sell a car that 5th gear doesnt work? its pretty likely any one test driving the car would find that fault. Also its unclear why the dealer was so desperate to sell the car that he kept reducing the price.
Unless someone is a proper trader and if he's trade you tell him the full sp, warts and all, anyone else no matter what they say have protection of law, dealer sounds crazy to put a car on his forecourt with no fifth gear, that's never going to end well.
I don't understand why he didn't just seek to buy one privately for cheaper if he was just going to get rid of the warranty?! Must of been a mega cheapskate/keen to take a gamble to sacrifice the warranty for 200 odd quid.
The dealer's price softness was a big warning that he just wanted the car off his book. The guy was too keen to think that he was getting a bargain. There is no free lunch of course. Accepting a car on trade terms when one is not a dealer and then deciding that one is not a dealer after all, is effectively an attempted fraud on the part of the buyer. The best remedy for the dealer is a full refund and just unwind the bad deal. If you are not a car mechanic or a mad collector of old garbage, then never ever throw £2 grand away on worn out crap. If 5th gear has gone already, then what is next?
The dealer let the guy drive it under the impression he was going to have the warranty, so that covers the dealer. The dealer did him a massive favour by letting him have it at that price and moved the goal posts to get it to that price, and then the buyer signed a legal document as well. So the buyer has to cough up.
The law is the law and will always go in the side of the consumer. The lowest price doesnt mean that he should be excluded from consumer rights act 2015 Check out cra section 2 there is a grey list of 20 terms.
I'm aware of all these things bud, its my business. I think the lower price absolutely should! I think the law should be changed to mirror Australia and America where on older vehicles the customer can choose to buy as is or with warranty. The consumer rights act is simply totally unrealistic when it comes to ten year old 100k plus mile cars. As they give no clear restrictions on what is fair wear n tear on cars this age dealers don't want to sell them and then leave those venerable consumers with limited budgets to the mercy of driveway sales that car zero cover!

In my view the customer brought this on himself, buying a car for such a low price without a warranty is asking for trouble, buyers quite often only see the story from their side. I think the car dealer was more than fair--The old maxim of Buyer Beware applies here--
Buying a car at the lowest possible price without any warranty is taking a massive risk. You have to be very careful to fully road test the car and be certain that all gears work as they should and that there are no other issues that will be expensive to repair. I agree that if he has a used gearbox fitted at a garage that is not going to overcharge he will still have a fully working car for a good price. The selling dealer was as fair as you can expect, we all get our fingers burnt at some point with cars, even dealers sometimes have to take a hit.
Dealer is right, you shouldn’t be buying as trade if you don’t know what your doing. My sister in law did the same on a Vectra only for the alternated to go a week later. At a very minimum the buyer should have tested all the gears on the test drive.
Yes they guy took a risk and did not pay off. If I sell like this is spares or repair and the handover form would scare off the most experienced car buyer as they sign 4 times over to agree and future repair is up to them!
I'd say tough shit you signed the form giving them exemption. No one forced you to do it to get that deal should of just bought a car more in your affordability range. Trader reduced his price AND increased his exposure. Go figure!
If an invoice is marked "Trade Sale" and the buyer does point out that he isn't a trader would it be reasonable for the dealer to claim it actually was a trade sale? Was the BMW gearbox actually faulty and was the repair worth £2k (eg rather than replace the box) - one of those where it's best to get an independent check before coughing up money?

Customer needs to accept he gambled and lost, but surely he can get a replacement box cheaper.

it was probably just a slipped gear linkage clip & the trans garage were trying to rip him off. Why would the dealer try to sell a car that 5th gear doesnt work? its pretty likely any one test driving the car would find that fault. Also its unclear why the dealer was so desperate to sell the car that he kept reducing the price.
Unless someone is a proper trader and if he's trade you tell him the full sp, warts and all, anyone else no matter what they say have protection of law, dealer sounds crazy to put a car on his forecourt with no fifth gear, that's never going to end well.
I don't understand why he didn't just seek to buy one privately for cheaper if he was just going to get rid of the warranty?! Must of been a mega cheapskate/keen to take a gamble to sacrifice the warranty for 200 odd quid.
Moral or not a judge wouldn't be sympathetic to the buyer. You must do everything to find a compromise and the dealer did

The dealer's price softness was a big warning that he just wanted the car off his book. The guy was too keen to think that he was getting a bargain. There is no free lunch of course. Accepting a car on trade terms when one is not a dealer and then deciding that one is not a dealer after all, is effectively an attempted fraud on the part of the buyer. The best remedy for the dealer is a full refund and just unwind the bad deal. If you are not a car mechanic or a mad collector of old garbage, then never ever throw £2 grand away on worn out crap. If 5th gear has gone already, then what is next?
The dealer let the guy drive it under the impression he was going to have the warranty, so that covers the dealer. The dealer did him a massive favour by letting him have it at that price and moved the goal posts to get it to that price, and then the buyer signed a legal document as well. So the buyer has to cough up.
the second scenario here ... wiper welded on, the headlight glued in ... did he mention what car and how much he paid?
The law is the law and will always go in the side of the consumer. The lowest price doesnt mean that he should be excluded from consumer rights act 2015
Check out cra section 2 there is a grey list of 20 terms.
I'm aware of all these things bud, its my business. I think the lower price absolutely should! I think the law should be changed to mirror Australia and America where on older vehicles the customer can choose to buy as is or with warranty. The consumer rights act is simply totally unrealistic when it comes to ten year old 100k plus mile cars. As they give no clear restrictions on what is fair wear n tear on cars this age dealers don't want to sell them and then leave those venerable consumers with limited budgets to the mercy of driveway sales that car zero cover!

Getting car at big discount just get second hand box which not gonna cost £1000 . Even put new clutch still not cost £1000.
By the way i bought a volvo s40 that was a non runner and only 5 years old for 4,500 quid and lucky for me it only had a seized slave cylinder on the clutch.
Buyers problem now. Bought with no warranty. Dealers been fair to me.
Buyer beware
In my view the customer brought this on himself, buying a car for such a low price without a warranty is asking for trouble, buyers quite often only see the story from their side. I think the car dealer was more than fair--The old maxim of Buyer Beware applies here--
Buying a car at the lowest possible price without any warranty is taking a massive risk.
You have to be very careful to fully road test the car and be certain that all gears work
as they should and that there are no other issues that will be expensive to repair.
I agree that if he has a used gearbox fitted at a garage that is not going to overcharge
he will still have a fully working car for a good price.
The selling dealer was as fair as you can expect, we all get our fingers burnt at some point
with cars, even dealers sometimes have to take a hit.
The bloke should have test drove it properly. no comeback there for the dealer. I would buy a recon box.
Dealer is right, you shouldn’t be buying as trade if you don’t know what your doing. My sister in law did the same on a Vectra only for the alternated to go a week later. At a very minimum the buyer should have tested all the gears on the test drive.
Yes they guy took a risk and did not pay off. If I sell like this is spares or repair and the handover form would scare off the most experienced car buyer as they sign 4 times over to agree and future repair is up to them!
I'd say tough shit you signed the form giving them exemption. No one forced you to do it to get that deal should of just bought a car more in your affordability range. You pay higher price from a dealer for the protection you void that at your own choice. Tough luck take it on the chin lesson learnt. It's like buying something from the reduced section and then trying to return it because it isn't fresh.
