This isn't a misuse of civil courts. It is a textbook example of the kinds of disputes civil courts are meant to address. The big problem I see is that the four-plus year injunction is punitive, and should open the court officers up to criminal and civil punishment for violations of rights under color of law.

Unfortunately it’s not a simple matter. I’m also being sued for my legal private target range on my property. There is no noise ordinance here, my range has been determined safe by several law enforcement including the state’s attorney’s office, I am being sued as a nuisance violation. Fighting it in court has already cost me over $100k. Shooting here only occurred 2-3 times per year and usually less than a couple hours per session. There are no laws being violated and until this case is over any kind of counter lawsuit isn’t even possible. It’s ridiculous that people can’t just enjoy their own land. I would understand if I used the range often but once every few months doesn’t meet nuisance in my book.
My brother went through a situation like this. The couple that bought land a half mile away didn't like the sound of gun fire, they were told tough shit. So my brother bought 4 of those propane bird scare cannons and let them go for a couple weeks. He never heard anything else from them.

Sometimes its not the CA people that are the problem.

His coworker replied, "Why don't you go down there and tell him that?" No one came to me with any complaints.

The farmland nearby was sold to a housing developer. The lawsuits began as the first house was built. The suits kept getting thrown out of court. The judge would ask the developer if he was aware of the club range prior to building houses. Yes he was, case dismissed. Then they found a new judge. The club was shut down.

Do you remember when motoX rider Danny Brocker was jailed for 56 days for riding his dirt bike, practicing, on his home property back in 2021? Another rider back in like 2017 had a neighbor perform a citizen arrest on his wife and young daughter who rode their 4 wheeler down to their mailbox at end of a 3/4 mile driveway then were charged by the state for having a riding track on his 50 ACRE property in country. Went to Supreme Court and he lost. Supreme Court decided if any neighbor can hear you doing whatever it is you do in your own land and someone can hear the noise and doesn't like it you can't do it. More examples of the US Constitution and Bill of Rights being ignored.
The other case of the wife and kid being citizen arrested by the Karen neighbor may have been more like 2010. I'm horrible about dates. Nothing against the law nothing against any ordinances shooting on my land but my ex Chicago neighbors constantly called the police whenever I shoot. Unfortunately the county sheriff does respond to these calls because they have nothing better to do. Depending on the individual deputy who responds the consequences have varied from the deputy literally asking me about my firearms and us talking about guns for an hour to one of the real dirtbag deputies straight up threatening to come back and shoot me if I continued shooting that day. What this gentleman is going through is the next iteration of law fair, a bunch of uppity city folks who think the country should be absolutely the way they envision it using the courts to bypass the legislature
It sounds to me as though this is "Vexatious litigation" a legal action which is brought solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. I hope that when this gets into court the Judge has the sense to dismiss it "With prejudice" so the Plaintiff cannot refile the same motion again at a later date, and awards Josh 'costs and damages' to cover his legal fees etc.

@UnregisteredSkeptic That law applies to living within a municipality. You can't discharge a firearm. If you're on private land outside of a town, it doesn't apply. If you build a range properly with a earthen backstop and follow proper firearm safety rules, you can have a range.

I have a neighbor literally next door who complains to the sheriff every time we shoot. Deputies have been out multiple times to evaluate where we shoot (I know most of them personally) and have said there’s nothing unsafe about our shooting practices. She comes out and turns her car alarm on every time we’re out there but there’s no noise ordinance so there’s nothing either of us can do.

In 1989 living in Colorado in the country on 50 acres of land and we’re having a group shoot day with friends using automatic weapons had a city dweller liberal move into the area who believed they had the right to decide whether I could shoot my guns on MY property. So they knew it was guns but they decided to call the sheriff and say I was using fireworks which is illegal ….deputies arrive at our get together and verified we where shooting machine guns…..which is legal, so they wanted to shoot a uzi machine gun which made them smile, they returned to the liberal house and advised them this was not fireworks and cautioned them about making false complaints. Some people are just mad at the world and anybody that does not believe the way they do is a criminal.
I do as well. The funny part is that the local sherrif's department uses my range as well. We've had SOME complaints, but the sherrif handles it by telling the complainant that is was them
I am a member of a gun club in farm country. The guys running it are pretty smart. They made arrangements with the local police to use the range for training. The police have regularly scheduled times that the range is closed for their training. We have a powerful ally. It can be argued that our range is an important community asset.
I think this is the issue the courts has to settle. Sounds like the intent of the law is to prevent commercial range where profit comes from people pay to shot at the range.

We own roughly 85 acres about 90 minutes from where we live. It's surrounded by acreage owned by relatives and we shoot there all the time. No one is complaining. Now, would I consider shooting on the five acres where we live? I have thought about creating a range but I haven't done so, so I can't say how neighbors would respond. I suspect our two immediate neighbors wouldn't say a word but you never know how people are going to react.

Sorry to hear about your situation. Hope you get a favorable outcome. I was a member of a hunting club in New Hampshire in the 1980s. The club existed over 75 years at that location. The farmland nearby was sold to a housing developer. The lawsuits began as the first house was built. The suits kept getting thrown out of court. The judge would ask the developer if he was aware of the club range prior to building houses. Yes he was, case dismissed. Then they found a new judge. The club was shut down.
It's crazy how all these houses have illegal marijuana growing on the property sheriff.

Unfortunately, I think we are all fighting a losing battle. This is happening nationwide. People from the big cities retire and sell their homes at huge profits and move to rural communities. Then they start getting into local politics and highering expensive high-powered attorneys to change local laws and regulations, thus destroying our way of life, and they wonder why the locals hate them so much. They believe that all they are doing is trying to improve everyone's quality of life, but what they are actually doing doing is exerting their power of wealth over others.
It’s wild that the initial judge said it was ok and all it took was for them to find a different judge that ruled against it. You can have 99 yes and all it takes is 1 no and it’s lights out… it’s fucking wild.

Do you remember when motoX rider Danny Brocker was jailed for 56 days for riding his dirt bike, practicing, on his home property back in 2021? Another rider back in like 2017 had a neighbor perform a citizen arrest on his wife and young daughter who rode their 4 wheeler down to their mailbox at end of a 3/4 mile driveway then were charged by the state for having a riding track on his 50 ACRE property in country. Went to Supreme Court and he lost. Supreme Court decided if any neighbor can hear you doing whatever it is you do in your own land and someone can hear the noise and doesn't like it you can't do it.

I have run into a similar issue in rural Wisconsin. Nothing against the law nothing against any ordinances shooting on my land but my ex Chicago neighbors constantly called the police whenever I shoot. Unfortunately the county sheriff does respond to these calls because they have nothing better to do. Depending on the individual deputy who responds the consequences have varied from the deputy literally asking me about my firearms and us talking about guns for an hour to one of the real dirtbag deputies straight up threatening to come back and shoot me if I continued shooting that day.
What this gentleman is going through is the next iteration of law fair, a bunch of uppity city folks who think the country should be absolutely the way they envision it using the courts to bypass the legislature

It sounds to me as though this is "Vexatious litigation" a legal action which is brought solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. I hope that when this gets into court the Judge has the sense to dismiss it "With prejudice" so the Plaintiff cannot refile the same motion again at a later date, and awards Josh 'costs and damages' to cover his legal fees etc.
Shooting on your own property and taking a video of it would be covered by the 1st amendment and the 2nd amendment

@UnregisteredSkeptic That law applies to living within a municipality. You can't discharge a firearm. If you're on private land outside of a town, it doesn't apply. If you build a range properly with a earthen backstop and follow proper firearm safety rules, you can have a range.

I have a neighbor literally next door who complains to the sheriff every time we shoot. Deputies have been out multiple times to evaluate where we shoot (I know most of them personally) and have said there’s nothing unsafe about our shooting practices. She comes out and turns her car alarm on every time we’re out there but there’s no noise ordinance so there’s nothing either of us can do.

In 1989 living in Colorado in the country on 50 acres of land and we’re having a group shoot day with friends using automatic weapons had a city dweller liberal move into the area who believed they had the right to decide whether I could shoot my guns on MY property. So they knew it was guns but they decided to call the sheriff and say I was using fireworks which is illegal ….deputies arrive at our get together and verified we where shooting machine guns…..which is legal, so they wanted to shoot a uzi machine gun which made them smile, they returned to the liberal house and advised them this was not fireworks and cautioned them about making false complaints. Some people are just mad at the world and anybody that does not believe the way they do is a criminal.
I do as well. The funny part is that the local sherrif's department uses my range as well. We've had SOME complaints, but the sherrif handles it by telling the complainant that is was them
I am a member of a gun club in farm country. The guys running it are pretty smart. They made arrangements with the local police to use the range for training. The police have regularly scheduled times that the range is closed for their training. We have a powerful ally. It can be argued that our range is an important community asset.

I work in a rural Tennessee community. The number of calls we get for complaints of gunfire and ATVs out in the county is depressing.

We own roughly 85 acres about 90 minutes from where we live. It's surrounded by acreage owned by relatives and we shoot there all the time. No one is complaining. Now, would I consider shooting on the five acres where we live? I have thought about creating a range but I haven't done so, so I can't say how neighbors would respond. I suspect our two immediate neighbors wouldn't say a word but you never know how people are going to react.

I’ve dealt with this. Parents property that my great grandad bought 80+ years ago. Yuppie moved in and started complaining immediately. Harassed, false accusations, baited us into confrontations, tried to bribe us with a hog hunt to stop, called sheriffs repeatedly. Then threatened to sue, which he never did but mostly because I moved 5 hours away and quit shooting. I still make sure to do a mag dump when I’m back that way 😂.
Sucks, my family use to own about 120 acres in south Mississippi. We used it to hunt and shoot for over 50 years. Suddenly the closest city incorporated a huge swatch of land including ours. Suddenly we had 100plus actor acres that we could no longer hunt or shoot on it.

We have a noise ordinance from 7am to 10pm in winter & 7am to 11pm in summer. Starting to make noise at 10am to 5pm omg what does she do when someone is mowing their lawn? I recently had someone fly a drone over my property & after pointing the rifle at it, it dared not come back. He should buy a drone & fly it to her property line maybe she can sue him for that too since she has the money to bring a suit so ridiculous against him.
